Abstract

Penelitian ini bertujuan untuk menggambarkan konsepsi perlindungan hukum Islam terhadap kehamilan, menggali esensi perlindungan hukum Islam terhadap kehamilan dan menganalisis bentuk-bentuk perlindungan hukum Islam terhadap kehamilan tersebut. Metode  penelitian yang digunakan adalah pendekatan normatif, pendekatan sosiologis dan pendekatan filosofis. Hasil penelitian dalam kajian ini ada tiga. Pertama, perlindungan terhadap kehamilan belum sesuai dengan makna hukum keluarga Islam. Kedua, perlindungan terhadap kehamilan belum berlandaskan pada penjagaan jiwa. Ketiga, penerapan terhadap prinsip-prinsip perlindugan hukum Islam terhadap kehamilan belum sesuai dengan konsepsi hukum keluarga Islam. Kesimpulan penelitian ini antara lain adalah konsepsi perlindungan hukum Islam berlandaskan pada makna menjaga atau memelihara, dengan demikian perlindungan terhadap kehamilan menekankan pada aspek penjagaan dan pemeliharaan kehamilan tersebut. Esensi perlindungan hukum Islam terhadap kehamilan adalah menekankan pada aspek penjagaan jiwa seorang wanita dengan memelihara kemaslahatan diri wanita ketika ia hamil. Prinsip-prinsip perlindungan hukum Islam terhadap kehamilan antara lain adalah prinsip perlindungan terhadap Jiwa/Hifzu al-Nafsi, prinsip perencanaan kehamilan dan prinsip perlindungan terhadap kehormatan.

Abstract

Penelitian ini merupakan field research kualitatif deskriptif yang merupakan penelitian lapangan (field research) maka metode Pendekatan yang digunakan adalah Pendekatan Teologi Normatif dan Pendekatan Yuridis Empiris. Sumber data yaitu data primer yakni data empiris yang bersumber atau yang didapatkan secara langsung dari Sayyid atau Syarifah. Data sekunder yaitu data pendukung yang telah tersedia dimana penelitian hanya perlu mencari tempat untuk mendapatkannya. Data Tersier Sumber data tersier ini dimaksudkan sebagai bahan penunjang sumber dan primer dan sekunder. Tekhnik pengumpulan data melalui Observasi, Interview (wawancara), dan dokumentasi.Selanjutnya data pada penelitian ini menggunakan Riset Lapangan dengan melalui wawancara serta observasi, sedangkan teknik pengelolahan dan analisis data dilakukan melalui tiga tahapan yaitu: reduksi data, penyajian data dan penarikan kesimpulan.Hasil penelitian menunjukkan bahwa (1) Konsep Kafaah dalam perkawinan keturunan Sayyid di Sulawesi Selatan masih mempertahankan konsep Kafaah nasab. (2) Kriteria Kafaah yang ada dalam masyarakat Sayyid ada tiga, yang pertama agama yaitu seorang Syarifah tidak sekufu dan tidak dibenarkan menikah dengan seseorang yang berbeda agama, yang kedua nasab seorang syarifah tidak sekufu dengan laki-laki yang non sayyid, dan yang ketiga Aliran seorang syarifah ahlussunnah wal jamaah tidak sekufu dengan laki-laki yang yang bukan ahlussunnah wal jamaah . (3) Hukum Islam dalam permasalahan kafaah terdapat perbedaan pendapat dikalangan ulama mazhab./ Namun semua tetap mendasarkan pada faktor agama yang diharuskan pada kesepadanan dalam perkawinan selain faktor yang lain (nasab, kemerdekaan, pekerjaan, kekayaan).Implikasi Penelitian Konsep (1) kafaah hendaknya dipahami dan dikembalikan pada tujuan awalnya yakni untuk mencapai keluarga yang sakinah mawaddah dan rahmah. (2) Dalam sistem perkawinan, persoalan nasab hendaknya tidak menjadi penghalang bagi dua insan yang hendak mengarungi bahtera rumah tangga, asalkan calon mempelainya adalah seorang muslim yang memiliki akhlakul  karimah. (3)Perlunya merelevansikan hukum yang berkaitan dengan konsep kafaah dalam fiqih munakahat dengan kafaah yang berlaku dalam suatu komunitas masyarakat serta perkembangan zaman. Kata Kunci : Tinjauan Hukum Islam, Kafaah, Praktik Perkawinan Sayyid

Abstract

The purpose of this study is to find philosophical facts about the harm of abandonment of rights of wives and children after divorce by focusing research on the reality of neglect of rights of ex-wives and children in the city of Makassar, including the causes of neglect of ex-wife and child rights and forms of handling neglect of these rights. The methods used in this study are normative and sociological approaches. The analysis used in managing this research data is by using analysis of Islamic legal philosophy. In addition to these three methods, this study also interviewed divorce perpetrators directly. The results of research in this study found that neglect of the rights of wives and children after divorce has caused harm to wives and children which has implications for economic harm, psychological harm to ex-wives and children. This study concluded that the neglect of the rights of ex-wives and children in the city of Makassar was caused by the lack of employment opportunities and lack of expertise of ex-husbands as well as the lack of responsibility of the husband's manta towards the mantas of wives and children

Abstract

This article discusses the role of Islamic legal views on the free sex of minors. The main problem is that the most influential factor in changing adolescent behavior in free sex is the entry of western culture to developing countries like Indonesia, one of which is in the Bara-Barayya Makassar village. The authors formulate the following sub-problems: 1. What are the factors Causes of free sex underage children? 2. How are efforts to control free sex among minors? 3. Islamic legal theory regarding the free sex of minors.The type of research used is field research (Field Research) which is descriptive qualitative. Primary data sources are through interviews. This research contains secondary data sources of analysis through books, statutory regulations, and related theses. The approach used is juridical. and Syar'i. Furthermore, the data collection methods used are observation, interview, and documentation. Then, data processing techniques and data analysis were carried out through three stages, namely: data editing, data coding, and data analysis.The results of this study indicate that: 1) Free sex in the city of Makassar, especially underage children in the Bara-Barayya village, still really needs to do a social, religious, and direct touch from the family because the family is the place for the child's first socialization. 2) The social environment in-community and school are places of direct contact for children in socializing themselves, therefore it is necessary to strengthen understanding of religion and the foundation of self-strengthening before going directly to the community. 3) The habit of watching pornographic films and dating can lead to child-free sexual behavior.The implication of the research is that the Makassar City government or all related agencies and agencies and the surrounding community need to carry out several approach programs for minors, in this case, the sex of minors, including the need to synergize existing programs in government and in the community.

Abstract

Maja Labo Dahu's philosophy represents the Bima community's local values that have been internalized into Islamic law. This research aims to find answers to the issues examined, namely the existence of Islamic law in the Sultanate of Bima. The primary focus lies in the analysis of the implementation of Islamic law during the Sultanate of Bima and the internalization of the philosophy of Maja Labo Dahu within the Sultanate of Bima. The method used in this research is a descriptive qualitative method, which explores written documents and information from Bima community figures who know the implementation of Islamic law in the Sultanate of Bima as a result of the internalization between the philosophy of Maja Labo Dahu and the fiqh tashrī' in Islam. The data used in this research were obtained through observation, cross-checking interviews, and literature study. The findings of this research reveal that Islamic law has existed in the Sultanate of Bima since Islam was accepted as the official religion, based on the legitimacy of the theory of shahada, which explains the application of Islamic law coinciding with the Bima community's embrace of Islam. However, formally and juridically, Islamic law was declared applicable throughout the Sultanate of Bima after the establishment of three legal institutions, namely Sara Tua, Sara Sara, and Sara hukum, which were responsible for coordinating the implementation of laws such as flogging, stoning, retribution, and discretionary punishment. The philosophy of Maja Labo Dahu has been internalized into the Islamic law of the Kingdom of Bima, causing the Bima community to feel fear and shame in committing legal violations. Abstract

The diversity of human life necessitates order to achieve social harmony. This study examines the significance of divine law (syari’ah ilahiyyah) as superior to tasyri’ wad’i (man-made law), focusing on the consistency of Islamic law and its relationship to the fiqh maxim “Laa Yunkaru Taghayyur al-Ahkam bi Taghayyur al-Azman” (legal rulings may change with changing times). Using a literature-based method, the analysis incorporates classical and contemporary scholarly perspectives alongside practical applications of the maxim. The findings reveal that rulings derived directly from textual evidence (nass) are immutable, whereas those based on custom (urf), public interest (maslahah), or independent reasoning (ijtihad) may adapt to changing contexts. The maxim is narrowly applied to rulings influenced by customs, leaving core scriptural rulings unchanged. Examples include theft punishments adjusted for customary definitions of safekeeping, evolving zakat policies, and contemporary regulations such as traffic laws. These findings affirm that Islamic law combines permanence in foundational principles with flexibility in contextual applications, ensuring its relevance across times and places. The study concludes that understanding the boundaries of this fiqh maxim is crucial for maintaining the balance between the timelessness of Islamic law and its adaptability to modern challenges, preserving both its authenticity and practical utility.--Keberagaman kehidupan manusia memerlukan keteraturan untuk mencapai harmoni sosial. Studi ini mengkaji pentingnya hukum ilahi (syari’ah ilahiyyah) yang dianggap lebih unggul dibandingkan dengan tasyri’ wad’i (hukum buatan manusia), dengan fokus pada konsistensi hukum Islam dan hubungannya dengan kaidah fiqih “Laa Yunkaru Taghayyur al-Ahkam bi Taghayyur al-Azman” (hukum dapat berubah sesuai dengan perubahan zaman). Dengan pendekatan berbasis literatur, analisis ini mencakup perspektif ulama klasik dan kontemporer serta aplikasi praktis dari kaidah tersebut. Temuan menunjukkan bahwa hukum yang bersumber langsung dari nash bersifat tetap, sementara hukum yang didasarkan pada adat (urf), kemaslahatan (maslahah), atau ijtihad dapat disesuaikan dengan konteks yang berubah. Kaidah ini diterapkan secara terbatas pada hukum yang dipengaruhi oleh adat kebiasaan, sementara hukum nash tetap tidak berubah. Contoh penerapan mencakup hukuman pencurian yang disesuaikan dengan definisi adat penyimpanan barang, kebijakan zakat yang berkembang, dan peraturan kontemporer seperti lalu lintas. Temuan ini menegaskan bahwa hukum Islam menggabungkan keabadian prinsip-prinsip dasar dengan fleksibilitas dalam aplikasi kontekstual, sehingga memastikan relevansinya di berbagai waktu dan tempat. Studi ini menyimpulkan bahwa pemahaman batasan penerapan kaidah fiqih ini sangat penting untuk menjaga keseimbangan antara keabadian hukum Islam dan kemampuannya beradaptasi dengan tantangan modern, sekaligus mempertahankan keaslian dan kegunaannya secara praktis.

Abstract

This study aims to find out the practice of early marriage, express the community’s views on early marriage and make an analysis based on Islamic law about the practice of early marriage in the Darul Istiqamah Lappa'e Islamic Boarding School, Sinjai. This research is a field study using a descriptive qualitative approach. The results of the study show that early marriage at the Darul Istiqamah Lappa’e Islamic Boarding School is based on parental approval and encouragement. In addition, the community views early marriage in Islamic boarding schools as a positive thing because it aims to foster young people to achieve piety and avoid promiscuity that is contrary to Islamic teachings. According to Islamic law, early marriage at the Darul Istiqamah Islamic Boarding School does not violate religious law because it is considered a solution to prevent greater dangers, such as adultery or pregnancy out of wedlock, by referring to the rules of Dar’u al-Mafasid. In addition, early marriage is carried out with the consent of the students themselves without coercion, with various considerations of benefits, namely efforts to achieve greater goodness and benefits.

Abstract

Marriages conducted in Pinrang Regency often do not pay attention to the rules of marriage that have been established, especially the issue of age. Such problems are difficult to avoid, especially in ordinary people, thus reducing the negative impact of early marriage. The role of the National Family Planning Agency through the Office of Population Control, Family Planning, Women's Empowerment, and Child Protection of Pinrang Regency is required. The objectives of this study are as follows: to identify the negative impacts caused by early marriage in Pinrang Regency, to analyze or determine the potential for underage marriage in Pinrang Regency, and to describe the role of the Pinrang Regency government in reducing underage marriage. This study is qualitative research. The approach used is socio-juridical. The research is descriptive qualitative. There are two types of data used, namely primary data and secondary data. The technique of data processing used observation, interviews, documentation, triangulation, and data validity tests using credibility, transferability, dependability, and confirmability. Furthermore, the data analysis technique used the data reduction technique (data reduction), display (data presentation), and conclusion drawing/verification (concluding). Based on the results of this study, it shows that: first, underage marriage has a negative impact, especially concerning health issues. Second, It was found that approximately 90% of underage marriages in Pinrang Regency were conducted by women, with requests for dispensation of marriage being submitted more by people who live in urban areas compared to rural areas. The negative impact presented in early marriage is more dominant than the positive impact. Based on the Maqasyid shari'ah theory, the practice and potential of early marriage in Pinrang City is contrary to Hifdzunnafs for both women and children based on the data that has been described.

Abstract

The application of hudud in Islamic criminal law requires the highest level of legal certainty due to its direct relation to the protection of life, dignity, and individual freedom. The concept of shubha functions as a crucial safeguard to prevent judicial error in punishments that are fixed and irreversible. This study aims to analyze the concept, legal foundations, and contemporary implications of the maxim al-hudud tasqut bi al-shubuhat. Using a qualitative descriptive literature study, the research reveals four key findings: shubha operates as a barrier to enforcing hudud when doubt exists in the act, intention, or evidence; classical and modern scholars consistently affirm that even minimal doubt nullifies hudud to preserve justice; the judicial practice of the Prophet’s Companions demonstrates exceptional caution toward ambiguous cases; and the standard of proof for hudud must reach absolute certainty. The study concludes that shubha serves as a fundamental principle for ensuring substantive justice. Its main contribution lies in strengthening the relevance of this maxim within modern Islamic criminal law discourse.
