Abstract

This study examines the regulation of the minimum marriage age in the Compilation of Islamic Law as a form of progressive ijtihad based on maqaṣid al-shari‘ah. This research emphasizes how the marriage age requirement reflects the integration of maslahah fardiyyah (individual welfare) and maslahah ‘a’iliyyah (family welfare), both of which are legal principles aimed at protecting children and strengthening family institutions. Adopting normative legal methods with a statutory, conceptual, and philosophical approach, this research combines classical and contemporary Islamic legal thought and relevant laws and regulations in Indonesia. The theory of maṣlaḥah, developed by scholars such as al-Ghazali, al-Juwayni, al-Shaṭibi, and Ramadan al-Būṭi, forms the main theoretical foundation, particularly through the lens of ḍawabiṭ al-maṣlaḥah (parameters of public interest). These theories emphasize the preservation of life (ḥifẓ al-nafs), intellect (ḥifẓ al-‘aql), and lineage (ḥifẓ al-nasl) as central objectives of Islamic law. The findings show that the marriage age provision in the Compilation of Islamic Law is not merely an administrative policy but a legal strategy aligned with maqaṣid-based reasoning to prevent child marriage and its associated harms. This approach reflects a contextual reading of Islamic law that is responsive to socio-cultural changes, while remaining faithful to its foundational values. The study concludes that reinforcing a maṣlaḥah-based framework is essential to harmonize Islamic legal principles with national law and to ensure the well-being of individuals and families in contemporary society.

Abstract

This study examines the role of the usul al-fiqh maxim al-hukmu yaduru maa illatihi wujudan wa adaman (a legal ruling revolves with its effective cause in both its existence and nonexistence) as a foundation for the flexibility of Islamic law in responding to contemporary social dynamics. Employing a qualitative library research method, the study analyzes the application of this maxim in both classical cases (such as the prohibition of khamr and the obligation of zakat) and contemporary contexts (including the suspension of Friday prayers and the formulation of Sharia-based policies during the COVID-19 pandemic). The findings indicate that this maxim effectively sustains the relevance of Islamic law by ensuring its conformity with the Maqasid al-Shariah, particularly in safeguarding life (hifz al-nafs) and promoting the public interest (al-maslahah al-ammah). These findings underscore the urgency of applying rational Sharia legal maxims as a foundational basis for the development of positive law oriented toward Islamic values.

Abstract

Kaidah fikih “idza iyjma’at ibdatanio min jinsin wahid, tadakhala af’aluhuma wa iktufiya anhuma bif’lin wahid in kana maqsaduhuna wahidan” merupaka suatu peinsip penting dalam memahami flesibilitas dalam hukum ibadah Islam. Kaidah ini menyatakan bahwa jika dua ibadah yang sejenis digabung dalam satu amal apabila keduanya mempunyai bentuk dan juga tujuan yang sama. Penelitian ini bertujuan untuk mengkaji kaidah tersebut secara mendalam melaui pendekatan kualitatif dengan metode deskriptif analitis melalui studi pustaka. Hasil analisis memperlihatkan bahwa kaidah ini hanya dapat berlaku pada ibadah yang benar-benar sejenis dalam bentuk dan juga maqsad. Studi kasus pada penggabungan salat qabliyah dan tahiyyat al-masjid membuktikan dalam penerapan kaidah ini dapat memberikan kemudahan yang dibenarkan dalam syariat. Akan tetapi, penerapannya juga harus memenuhi syarat fikih yang sangat ketat supaya tidak menyimpang dari prinsip tauqiyah ibadah. Oleh karena itu, kiadah ini dapat menjadi bukti bahwa Islam ialah agama yang flesibel tetapi berbasis pada nash dan juga kaidah.

Abstract

The death of the Prophet Muhammad (peace be upon him) essentially marked the end of revelation and the finalization of divine guidance for Muslims, as accumulated in the Qur'an and the Hadith. However, the complexity of social dynamics and contemporary developments demonstrate the need for adaptation and relevance of Islamic law to the contemporary context. In this context, the role of Qawā‘id al-Aḥkām (legal principles) is a fundamental element in efforts to understand and interpret Islamic law comprehensively. The focus of this study is to elaborate on Islamic legal principles and their implementation in order to provide innovative, sharia-guided solutions to new challenges, as well as to strengthen the philosophical foundation of contemporary ijtihad. The research method used is library research in normative legal studies with data sources from various books and research articles

Abstract

Artikel ini mengkaji falsafah hukum Islam dengan menitikberatkan pada konsep Asrār al-Ahkām dan relevansinya dalam kerangka maqāṣid al-syarī‘ah pada konteks kehidupan modern. Kajian ini bertujuan untuk menunjukkan bahwa hukum Islam tidak semata-mata berfungsi sebagai seperangkat aturan normatif, tetapi juga mengandung tujuan, hikmah, dan nilai kemaslahatan yang mendalam. Melalui pendekatan kualitatif-deskriptif berbasis kajian pustaka, artikel ini menganalisis bagaimana setiap ketentuan syariat memiliki rasionalitas moral dan sosial yang berorientasi pada perlindungan kepentingan dasar manusia. Konsep Asrār al-Ahkām dipahami sebagai upaya menyingkap dimensi filosofis di balik hukum-hukum syariat, seperti shalat yang membentuk kedisiplinan spiritual, zakat yang memperkuat solidaritas sosial, serta larangan riba yang bertujuan mencegah ketimpangan dan ketidakadilan ekonomi. Temuan kajian menunjukkan bahwa integrasi Asrār al-Ahkām dengan teori maqāṣid al-syarī‘ah yang mencakup perlindungan agama, jiwa, akal, keturunan, dan harta menjadikan hukum Islam bersifat dinamis dan kontekstual. Dalam menghadapi tantangan modern seperti isu hak asasi manusia, kesetaraan sosial, kesehatan publik, dan kelestarian lingkungan, pendekatan ini menegaskan fleksibilitas hukum Islam serta orientasinya pada kemaslahatan umat secara universal.

Abstract

This study discusses the practice of eyebrow and lip embroidery micropigmentation from the perspective of Islamic Jurisprudence on the principle of hajiz (water barrier) in thaharah and the concept of taghyir khalqillah (change of Allah's Creation). The phenomenon of the increasing use of semi-permanent beauty procedures among Muslim women has raised legal debates because it is often equated with the practice of permanent tattoos which are prohibited in the hadith. This study aims to discuss the legal status of eyebrow and lip embroidery by considering the normative fiqh aspects and dermatological scientific explanations regarding the micropigmentation technique. The research method used is qualitative research with a juridical-normative approach through a literature study of classical and contemporary fiqh literature, fatwas of religious institutions, and related medical studies. The results of the study show that micropigmentation differs substantially from permanent tattoos because the pigment is implanted superficially and is semi-permanent, so it does not always meet the criteria for hajiz which invalidates wudu. From the aspect of taghyir khalqillah, this practice cannot be considered absolutely haram, but depends on the purpose, level of change and the impact it causes. This study concludes that the law on eyebrow and lip embroidery is ijtihadi and contextual, depending on the purpose, level of change and impact caused and requires caution by considering sharia principles and developments in modern beauty technology. Abstract

This field research provides an overview and factual and explains the various relationships of all the data obtained. This research was conducted in Majene and precisely in the working area of the Majene Religious Court. The study is based on an application for marriage dispensation. Instruments used are researchers, observation, interview, and documentation data. The judge's consideration in granting or rejecting the application for marriage dispensation at the Majene Religious Court is the completeness of the administration at the time of applying for marriage dispensation following Perma No. 5 of 2019, and there is no pro; there on marriage as in Article 8 of Law No. 1 of 1974 concerning Marriage, while still taking into account the aspects of benefit and mudharatan arising from the granting of the application for marriage dispensation.

Abstract

This article aims to uncover the phenomenon of ikhtilaf among the Islamic community of Makassar city which is devoted to the study of comparison between Nahdlatul Ulama and Wahdah Islamiyah). This type of field research uses a normative approach. The source of this research data is the primary data source namely the leadership of Nahdlatul Ulama and Wahdah Islamiyah Makassar city and secondary data source namely Qur'an, hadith, fiqh, books, journals, and literature related to the discussion of this article. The results of this study suggest that Nahdlatul Ulama and Wahdah Islamiyah Makassar city in applying the law using the legal resources agreed by jumhur Ulama, namely: Qur'an, As-Sunnah, ijma, and qiyas. Nahdlatul Ulama and Wahdah Islamiyah also use legal sources that are not agreed by jumhur Ulama such as istishan, mashlahah al-mursalah, and others but prefer the source of the law that has been agreed by jumhur Ulama. Nahdlatul Ulama and Wahdah Islamiyah Makassar city differ in terms of commemorating the maulid of the Prophet Muhammad. In this case, Nahdlatul Ulama commemorates the anniversary of maulid while Wahdah Islamiyah does not commemorate it. Nahdlatul Ulama and Wahdah Islamiyah Makassar city considers that the phenomenon of ikhtilaf will not be solved, but what can be solved is our way of addressing the ikhtilaf, and the attitude is mutual tolerance, mutual respect, mutual respect, and mutual support. The implication of this article is expected to be expected to the Islamic community when looking at the phenomenon of ikhtilaf, especially in terms of furu', should not be to concern each other. When the phenomenon of ikhtilaf happens the best thing to do is tolerate each other, respect each other, respect each other, and support each other

Abstract

This article examines the role of key Islamic jurisprudential principles as constraints in the application of Islamic law, particularly in situations involving emergencies or conflicting obligations. It focuses on two foundational rules: al-rukhaṣ lā tunāṭ bi al-maʿāṣī (legal relief does not apply to immorality) and al-wājib lā yutraq illā li-wājib (an obligation may not be abandoned except for the sake of another obligation). Through a library-based research method, the study analyzes the meanings, sources, and practical relevance of these principles by discussing contemporary scenarios such as invoking rukhṣah during sinful travel, postponing prayer due to urgent medical duties, and balancing academic commitments with the obligation of Friday prayer. The findings highlight the significance of employing the principles of caution (iḥtiyāṭ) and prioritization (tartīb al-awlawiyyāt) in legal istinbāṭ (derivation). These limiting principles serve to protect the integrity of Sharia from the misuse of emergency concessions while promoting justice, public benefit (maṣlaḥah), and alignment between scriptural texts and real-life contexts. The integration of these rules is essential for formulating contextual Islamic legal responses that remain faithful to ethical and evidentiary foundations of Sharia.

Abstract

This thesis examines the implications of Islamic law on underage marriage caused by doti among the people of Tanah Towa Village, Kajang District, Bulukumba Regency. It addresses three main questions: (1) the consequences of child marriage due to doti, (2) community perceptions of such practices, and (3) the implications of Islamic law on underage marriage resulting from doti. This study employs field research with theological-normative and juridical approaches. Data sources include primary, secondary, and tertiary data, collected through observation, interviews, documentation, and literature review. Data analysis is conducted through data reduction, presentation, and conclusion drawing. The findings show that, first, the practice of underage marriage due to doti is generally similar to marriage practices in the Kajang community. Second, community perceptions vary: while many consider it a common cultural practice, others view it as inappropriate because it violates human rights, particularly children’s right to education. Third, from the perspective of Islamic law, although such marriages may be considered legally valid, they violate regulations on minimum marriage age and contradict fundamental principles of marriage in Islam, especially those related to consent, welfare, and protection. This study implies that underage marriage driven by doti limits children’s opportunities and personal development. Therefore, parents and society should allow children greater autonomy in determining their future and be more aware of the negative consequences of forced or premature marriage.
