Abstract

This study aims to align the principles of fiqh of disasters with Indonesia’s disaster management policies, particularly Law No. 24 of 2007. It seeks to explore how Islamic legal objectives can enrich and complement Indonesia's disaster governance framework. Using a maqāṣid based analytical approach, the research identifies and categorizes key elements within the maqāṣid framework, including concepts, objectives, values, societal groups, universal laws, divine commands, and textual evidences. These components are then systematically examined to evaluate their relevance and alignment with national disaster management strategies. The findings reveal a significant divergence in the interpretation of disaster and disaster management stakeholders between the two paradigms. Indonesian law defines disaster in technical-administrative terms, while fiqh emphasizes theological dimensions, such as divine awareness and submission to God’s will. Furthermore, the integration of religion as a vital element in disaster management remains insufficiently addressed in current policy frameworks. This study offers a novel integration of maqāṣid al-sharīʿah into the context of disaster management, proposing a theological-ethical dimension often overlooked in secular policy discourse. It bridges religious jurisprudence with contemporary disaster governance. The research suggests that involving religious leaders, institutions, and the Ministry of Religious Affairs in all disaster stages of prevention, response, and recovery can strengthen community resilience by fostering spiritual preparedness, psychological support, and culturally grounded disaster literacy.

Abstract

This article examines the products of Islamic legal thought, which have a broad impact on Muslim communities and can serve as a strong foundation for legal principles. The aim of this study is to explore the existence, issues, and application of Islamic legal instruments within the legal system. The research employs a qualitative method, utilizing bibliometric and textual approaches, along with descriptive analysis.The findings reveal that Islamic law has developed in Indonesia through the products of four schools of legal thought: fiqh (Islamic jurisprudence), fatwas by religious scholars, court decisions (ijtihad), statutory regulations, and sociological legal theories. The challenges in legislating Islamic legal thought in Indonesia include low legal awareness, discrimination, the pluralistic legal system, internal debates among Muslims, lack of education, and political dynamics. Addressing these challenges requires an integrative approach involving all elements of society to foster better understanding and support for the implementation of Islamic law within the national framework.

Abstract

Philosophy law Islam or tasyr'i is runway philosophical Which underlying all over building law Islam, Which regulates human relations with God and fellow human beings in everyday life. Through the study of Islamic legal philosophy, we can understand the goals, basis, and principles underlying the application of law in the lives of Muslims. This study aims to examine the essence of Islamic legal philosophy by identifying its sources of law, the values contained, as well as objective Which want to achieved. Method study This is studies literature with approach descriptive-analytical to understand the concepts of Islamic legal philosophy. This analysis describes the concept of tasyr'i as a way to maintain human welfare and prevent damage. The results of this study indicate that tasyr'i is not only formal legal but also functions as a moral, social, and spiritual guide to achieve justice and human welfare.

Abstract

Philosophy can be interpreted as love or a tendency towards wisdom. The philosophy of Islamic law is a philosophical study of the nature of Islamic law, the source of the origin of Islamic law and the principles of its application as well as the function and benefits of Islamic law for the lives of the people who implement it. The urgency of the philosophy of Islamic law is to make philosophy an approach in exploring the nature, sources and objectives of Islamic law. Positioning the philosophy of Islamic law as one of the important fields of study in understanding the sources of Islamic law which come from revelation and the results of ijtihad of scholars. The philosophy of Islamic law has an important role in the development of Ijtihad.

Abstract

The principles of convenience, divinity, benefit, and balance between physical and spiritual are the main keys to the value of Islamic law itself.

Abstract

In the history of Islamic law, one of the main principles often used to determine the law is the benefit. This term refers to the benefits or general good desired by Islamic law (sharia) for humans. The Istislahi Theory or better known as Maslahah Mursalah, is one of the methods used in determining Islamic law which always prioritizes maslahah or goodness. Although among scholars they try to adjust sharia law to the conditions of the times and certain places for the purpose of broad benefit.

Abstract

Makalah ini membahas kaidah fikih al-khurūj min al-khilāf mustaḥabb yang berarti "keluar dari perselisihan adalah sesuatu yang disukai". Kaidah ini merupakan prinsip penting dalam fiqih Islam yang bertujuan untuk menjaga kehati-hatian dan menghindari perbuatan yang berpotensi salah menurut sebagian pendapat ulama. Dalam konteks khilafiyah, kaidah ini menganjurkan umat Islam untuk memilih pendapat yang dapat mencakup semua pandangan agar ibadah dan amalnya terhindar dari kekurangan atau ketidaksahan. Pembahasan dalam makalah ini mencakup pengertian bahasa dan istilah kaidah, sumber-sumber syar’i dari Al-Qur’an, hadis Nabi SAW, serta contoh-contoh aplikatif dalam berbagai bidang fiqih seperti wudhu, shalat berjamaah, dan shalat Jumat yang bertepatan dengan hari raya. Melalui pendekatan normatif dan deskriptif, makalah ini menekankan pentingnya sikap bijak dan toleran dalam menghadapi perbedaan pendapat serta pentingnya mengedepankan prinsip kehati-hatian sebagai bentuk perlindungan terhadap keabsahan ibadah. Dengan demikian, kaidah ini tidak hanya bersifat teoritis, tetapi juga memiliki nilai praktis tinggi dalam kehidupan sehari-hari umat Islam

Abstract

Penelitian ini mambahas tentang tradisi masyarakat bugis dalam nilai-nilai makkalu dapureng wekka pitu yang diintegrasikan dengan fiqh munakahat tentang kesiapan menikah. Analisis falsafah tasyri’ digunakan untuk menggali nilai-nilai yang terkadung dalam hukum perkawinan. Penelitian ini adalah penelitian kualitatif dengan pendekatan normatif empiris untuk memecahkan masalah tentang makkalu dapureng wekka pitu yang menjadi tradisi dari masyarakat bugis. Teknik pengumpulan data yang dilakukan yaitu observasi, wawancara. Hasil penelitian menunjukkan bahwa nilai-nilai dalam makkalu dapureng wekka pitu  sejalan dengan konsep fiqh munakahat dalam konsep tanggung jawab seorang suami kepada istri. Hal inilah yang perlu dikuatkan bagi setiap laki-laki yang akan menikah agar tidak mudah dalam mengambil keputusan pernikahan tanpa ada persiapan dalam kesanggupan pemenuhan tanggung jawab kepada perempuan.

Abstract

The fiqh principle of "ad-Dhararu yuzalu" (poverty must be removed), is one of the five main principles in ushul fikih that plays a central role in shaping welfare-oriented Islamic legal policies. This principle asserts that all forms of harm, hardship, and danger—both to the individual and to society—must be avoided or eliminated. Through the approach of syariah-evidence from the Qur’an and hadith, as well as an analysis of various derivative rules, this paper explains the forms of mudharat and the mechanisms of syariah in responding to them. Application examples from various fields such as ubudiyah, muamalah, and crime are presented to demonstrate the flexibility of this principle in daily life. This principle is also fundamental in granting rukhsah (legal relief) in emergency conditions, on the principle that an emergency cannot be overcome by another equal or greater emergency. Thus, the principle of “ad-Dhararu yuzalu” serves as an important guideline in responding to contemporary issues, while demonstrating the solutive and adaptive character of Islamic law to social dynamics.

Abstract

This study aims to examine the permissibility of charitable giving (ṣadaqah) in the context of political contests using the al-Umūr bimaqāṣidihā legal maxim approach. The phenomenon of political charity is often equated with money politics, sparking debate among scholars, government authorities, and the public. The discussion explores the concept of ṣadaqah in Islam and the role of intention (niyyah) as the foundation of legal rulings, based on al-Umūr bimaqāṣidihā and its derivative principles. This research employs a qualitative normative method through library research of classical and contemporary Islamic legal sources. The findings indicate that ṣadaqah during political contests is not inherently prohibited, but its legality depends heavily on the giver's intention. If the act is done sincerely for the sake of Allah’s pleasure, it is considered permissible. However, if it is meant to influence voters or gain political support, it is deemed unlawful. In conclusion, government regulations should not impose an absolute ban on political charity, but rather implement strict oversight to ensure that it aligns with sincerity and the principles of fair and honest elections
