Ibn Qayyim invites and calls on Muslims to ijtihad and leave taklid, Ibn Qayyim al-Jauziyah is a scholar who is very persistent in fighting blind taklid and calling for freedom of thought, but still clinging to the main points of Islamic teachings and the creed of the Salaf. In Ibn Qayyim's view, ijtihad must develop in accordance with the development of situations and conditions in various places and times. Therefore he put forward a rule: Fi taghayyir al-fatawa wa ikhtilafiha bi hasbi taghayyir al-azminah wa al-amkinah wa al-ahwal wa al-niyat wa al-'awa'id. According to him, an important factor in formulating legal provisions or legal stipulations must be related to five things, namely al-azminah (the situation of the times), al-amkinah (the situation of the place), al-ahwal (the circumstances), al-niyat (the cause of desires), and al-awa'id (customs). All of this affects the development of law, so that Islamic law can truly be lived as a law that is rahmatan lil 'alamin, able to answer the challenges of changing social dynamics of society. Thus Islamic law remains suitable for all times and places.

In Islam, marriage between a Muslim man and a non-Muslim woman is absolutely prohibited. If in a marriage there is a divorce because the wife is out of her religious belief (apostasy), then there is a dispute over the authority of whether the wife can carry out maintenance in the form of care for her child or not. The majority of mazhab scholars allow infidel wives to perform hadhanah on the grounds that mothers have more love for their children. However, Wahbah Az-Zuhaili in his book Fiqhul Islami wa adillatuhu, argues that the right to hadhanah is not stipulated for an apostate wife. Based on the explanation above, the main problem raised in this thesis is how the concept of hadhanah according to Wahbah Az-Zuhaili, what are the source and methodology of his thinking about hadhanah rights because the wife is an apostate and how is it relevant to Islamic law in Indonesia.

The purpose of this research is to reveal the history of the emergence of Ahmadiyya and its entry into Indonesia, the facts of violence against the Ahmadiyya Congregation in Indonesia and the government's role in protecting the Ahmadiyya Congregation, as well as social justice for the Ahmadiyya Congregation in Indonesia in the perspective of Islam and Pancasila. This qualitative research is a library research that collects data through literature such as journals and books. The results show that Ahmadiyya is a faith-based organization initiated and propagated by Mirza Ghulām Ahmad. There are two sects within this organization; Lahore and Qadian. The Lahore Ahmadiyah sect was spread to Indonesia through Mirza Wali Ahmad and Maulana Ahmad in 1924. Meanwhile, the Ahmadiyah Qadian sect was spread by Rahmat Ali in 1925. The Lahore sect stated that Ahmadiyah was born in 1888 while the Qadian sect stated that Ahmadiyah was born the next year. The existence of the Ahmadiyya Congregation in Indonesia is marked by a series of episodes in the form of neglected facts of social justice. Various acts of attacks, violence, persecution, and so on are portraits of the life of the Ahmadiyya Muslim Community in Indonesia as legal citizens before the law. It is understandable that the government's role in protecting the Ahmadiyya Congregation has not been maximized due to various acts of violence against the Ahmadiyya Congregation in Indonesia. Based on the fifth precept of Pancasila and from an Islamic perspective, in this case the preservation of life, lineage, property and reason, social justice has not been realized for the Ahmadiyya Congregation in Indonesia with violent attacks in the form of indiscriminate acts. vigilantes against the Ahmadiyya Congregation are still found.

Shari'ah and Hakikah are two sciences in Islam that are seen as conflicting sciences. The science of Shari'ah which is oriented to the deeds of human birth and the science of hakikah oriented to the inner deeds of man. Both tend to be viewed differently in their practice. However, if understood and explored, the two sciences have a very close relationship and cannot be separated from practice. Man consisting of both lahiriyah and batiniyah elements desperately need both knowledge to achieve the goal of human creation, namely worship and worship God. The science of Shari'ah as a form of embodiment of human slavery through concrete behavior, while the science of nature as the embodiment of human slavery through abstract and only known emotional and inner activities of the individual who does it. Through the fusion of shari'ah and hakikah, the application of Islamic law can be enforced in a mannered manner with law enforcement through a method of gentle approach or upholding ihsan. The enforcement of Islamic law with ihsan has been enforced since the time of the Prophet Muhammad (peace be upon him), enforcement in a polite manner is expected to uphold the sharia law of Islam to all human beings around the world without any violence and compulsion.

The purpose of this study is to find out how reason and revelation go hand in hand in the formation of Islamic law. The method used is a literature study with a qualitative approach. The results of the study show that reason and revelation are both the basis for giving birth to Islamic law. This study also analyzes that there is no contradiction between reason and revelation in principle. In fact, the position between reason and revelation can be parallel, but theologically it is revelation that is the source of inspiration for reason so that revelation (as a subject) has a higher position. On the other hand, reason cannot be a source of revelation, because reason is a creation while revelation is the word of God. The conclusion of this research is that today's Islamic law must be able to maximize its scientific reasoning (reasoning) in order to find hidden meanings in the texts of the Qur'an and hadith in answering the problems of life in the world without neglecting the benefits of the hereafter.

This study aims to determine the sociological considerations of Islamic law against the rejection of pornography in Indonesia. The method and type of research used is descriptive-qualitative research. The results of this study indicate that showing pornography on social media that is easily accessed and watched continuously by someone will have an impact on the rise of adultery, rape, and even murder, as well as various other negative effects. According to Islamic law, pornography is expressly prohibited and is an unlawful act. This can be seen in the Al-Qur'an surah al-Nur/24: 30-31, namely the command to guard the genitals or honor. Likewise in the Al-Qur'an surah al-Isra'/17: 32 regarding the prohibition of approaching adultery and the punishment for adultery in the Al-Qur'an surah al-Nur/24: 2. In Islam, pornography is equated with adultery or serious adultery . Pornographic crimes are not regulated directly by law. Therefore, law is adopted from classical law by adopting law based on existing texts and laws.

This study aims to analyze the sociological considerations of enforcement and application of Islamic law in Indonesia. This research is a library research that is qualitative in nature. The results of the study show that the sociology of Islamic law is a reciprocal relationship between Islamic law (Syarī'ah, Fiqh, al-Ḥukm, Qānūn, etc.) and patterns of societal behavior in which Sociology is one approach in understanding it. In essence, Islamic law in Indonesia is legal norms originating from Islamic law that grew and developed in people's lives throughout the history of Indonesia. Theories of thought regarding the application of Islamic law in Indonesia are formalistic-legalistic thought theory, structuralistic thought theory, culturalistic thinking theory and substanialistic-applicative thinking theory. It turns out that the enforcement and application of Islamic law has many obstacles so that Islamic law seems very slow, especially in the field of jinayat (Islamic crime).

Penelitian ini bertujuan menganalisis tentang konsep hukum Islam dalam mewujudkan stabilitas dan perubahan dalam masyarakat, serta bertujuan untuk melihat sumber hukum Islam yaitu al-Qur’an dan Sunnah yang merupakan peraturan dan tatanan yang datang dari Allah untuk mengatur berbagai aspek kehidupan manusia, namun keduanya memiliki daya jangkau yang terbatas. Penelitian ini menggunakan deskriptif kualitatif. Data dikumpul melalui wawancara, observasi, dan dokumentasi. Penelitian ini menggunakan Teknik Analisa data yang terdiri dari tahap pengumpulan data, reduksi data, sajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa perubahan sosial dan permasalahan sosial akan selalu tumbuh dan berkembang dan menuntut kepastian hukum. Permasalahan hukum diberbagai aspeknya dimasa lampau tidak pernah terhayalkan timbul, namun di masa kontemporer timbul dan berkembang dengan cepat. Sementara tidak semua permasalahan kehidupan manusia sebagai individu atau sosial masyarakat yang perlu ditetapkan hukumnya terekam oleh al-Qur’an dan sunnah Rasulullah Saw. Namun Islam memiliki nilai yang universal dan absolut sepanjang zaman, karena Islam bukanlah dogma yang kaku dalam menghadapi zaman dan perubahannya. Islam selalu memunculkan dirinya dalam bentuk yang luwes, ketika menghadapi masyarakat yang dijumpainya dengan beraneka ragam budaya, adat dan tradisi.

Penelitian ini bertujuan menganalisis tentang faktor sosial budaya dalam penetapan hukum privat dalam Islam. Serta bertujuan melihat lebih dalam pelaksanaan hukum privat dalam pendekatan hukum Islam dengan dalil yang bersifat umum dan dalil yang bersifat khusus. Penelitian ini menggunakan deskriptif kualitatif. Data dikumpul melalui wawancara, observasi, dan dokumentasi. Penelitian ini menggunakan Teknik Analisa data yag terdiri dari tahap pengumpulan data, reduksi data, sajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa faktor yang dapat mempengaruhi penetapan hukum privat dalam Islam berdasarkan kajian Yuridis-Empiris Sebagian produk hukum privat dalam Islam telah mengalami perubahan dan diakomudir dalam peraturan perundang-undangan yang berlaku di Indonesia, namun sebagian belum mendapat respon yang positif. Oleh karena itu diperlukan pengaruh faktor sosial budaya sebagai pendukung untuk mempengaruhi dan menetapkan pemberlakuan hukum privat dalam Islam secara massif dan terstuktur dalam sistem hukum tatanegara di Indonesia.

Penelitian ini bertujuan untuk mendeskripsikan efisiensi dan stabilitas PT Bank Syariah Indonesia, Tbk. (BSI) setelah penggabungan dari tiga bank syariah milik pemerintah Indonesia. Pendiskripsian melalui metode uji beda dengan t-Test Paired Two Sample for Means pada efisiensi dan stabilitas sembilan periode sebelum merger dan sembilan periode setelah merger. Pengukuran efisiensi berdasarkan pada pendekatan data envelopment analysis (DEA), sementara pengukuran stabilitas berdasarkan pada Z-score. Hasil pengujian menunjukkan bahwa efisiensi dan stabilitas BSI setelah merger semakin baik secara signifikan dibandingkan efisiensi dan stabilitas tiga bank syariah (PT BRISyariah, Tbk., PT Bank Syariah Mandiri, dan PT Bank BNI Syariah). Penelitian ini merekomendasikan peningkatan efisiensi dan stabilitas BSI melalui peningkatan konsentrasi pasar berbasis teknologi dan menghindari diversifikasi pendapatan yang menjadi salah satu penyebab instabilitas bank setelah merger.
