Abstract

Abstract

The Go Digital Grow Financial program, implemented through the Community Service Program (KKN) in Sukaraja Village, Rajapolah District, aims to enhance the capacity of Micro, Small, and Medium Enterprises (MSMEs) in facing the digital era. MSMEs in this village still encounter several limitations, such as low digital literacy, limited market reach, and weak financial management. The program was carried out in several stages, including observation, training, digital marketing practices, and assistance in simple financial recording based on SAK EMKM. The results showed significant improvements in the ability of MSME actors to utilize e-commerce, create product catalogs, and manage online promotions. In addition, participants began to understand the importance of daily cash recording, separating personal and business finances, and maintaining discipline in cash flow management. This program has proven effective in boosting entrepreneurs’ confidence to expand their markets and establish more transparent financial management. However, challenges remain, particularly technological infrastructure limitations and the need for continuous mentoring.

Abstract

This study aims to analyse the comparison of regulations, procedures, and legal protection in the implementation of non-execution auctions in Indonesia and the Philippines through a legal-normative approach. This study uses a normative legal research method with a statute approach and a comparative approach. In Indonesia, non-execution auctions are a state administrative mechanism under the authority of the State Property and Auction Service Office (KPKNL) as regulated in Minister of Finance Regulation No. 122 of 2023, which emphasises formal legal certainty and procedural legality as a means of legal and transparent transfer of rights. Meanwhile, in the Philippines, the extrajudicial foreclosure mechanism regulated in Act No. 3135 jo. Act No. 4118 gives creditors direct authority to execute collateral without a court order, while still guaranteeing the substantive rights of debtors through the principle of equitable redemption and the redemption period. The comparison shows that the Indonesian system is oriented towards administrative efficiency and formal legal certainty, while the Philippines emphasises corrective justice and the protection of civil rights. This difference in orientation illustrates two complementary legal approaches legal certainty according to Gustav Radbruch and corrective justice according to Aristotle which, if integrated, could give rise to an ideal non-execution auction model: economically efficient, substantively fair, and legally accountable. This research is expected to provide a conceptual contribution to the development of a more adaptive and equitable non-execution auction legal system in Indonesia and the Southeast Asian region.

Abstract

Abstract

This study investigates the impact of land mafia practices on land conflicts and disputes in Indonesia and evaluates the potential of electronic land administration policies to enhance legal certainty. Land remains one of the nation’s most strategic resources, yet its governance has been undermined by systemic irregularities and organized criminal practices. Land mafia activities ranging from document forgery and duplicate certificates to collusion with state officials have generated prolonged disputes, eroded public trust in the legal system, and hindered investment in the property and infrastructure sectors. The research employs a normative legal method, focusing on statutory analysis and doctrinal review to identify principles, norms, and legal frameworks relevant to the problem. Primary legal sources include national agrarian legislation and Ministerial Regulation ATR/BPN No. 3 of 2023, while secondary and tertiary sources encompass scholarly literature, journal articles, and legal reference materials. This conceptual approach allows for a systematic evaluation of both the challenges posed by land mafia practices and the opportunities offered by digital transformation in land governance. The findings indicate that land mafia practices cause significant legal uncertainty, particularly through falsified and duplicate certificates, which create conflicting ownership claims and protracted litigation. Such conditions not only harm individual landholders but also weaken the national economy by discouraging investment. In response, the government’s introduction of electronic land certificates provides a promising reform, offering enhanced transparency, security, and efficiency in land administration. Nevertheless, challenges remain, including resistance from vested interests, cybersecurity risks, and unequal access to digital platforms. The study concludes that combating land mafia practices requires a comprehensive approach that integrates technological innovation with institutional strengthening, professional accountability, and community participation. The contribution of this research lies in highlighting the normative and policy dimensions of land governance reform, while also identifying critical areas for further interdisciplinary and empirical investigation. By addressing these issues, the study advances the discourse on sustainable, transparent, and equitable land governance in Indonesia.
