Abstract

This study aims to explore the concept of curriculum in developing children's intelligence from the perspective of Sayyid Muhammad Qutb. The study is based on a literature review of Qutb's book "Manhajut Tarbiyah al-Islamiyyah" and other relevant sources. The research found that Qutb's concept of curriculum emphasizes the holistic development of children, including intellectual, emotional, physical, and spiritual intelligence. Qutb believed that all four types of intelligence should be nurtured and developed simultaneously to achieve balanced growth and development in a child. The study also highlights the importance of Islamic values and principles in shaping the curriculum and education system, as they play a crucial role in developing children's character and morality. The research concludes that the implementation of Qutb's concept of curriculum in education can significantly contribute to the development of children's intelligence and character, in line with the principles and values of Islam

Abstract

This study aims to investigate the practice of jujuran—a traditional monetary gift in Banjar marriage customs—from the perspective of Islamic jurisprudence and legal anthropology. Through a juridical-normative and legal-ethnographic approach, the research reveals that jujuran functions not as commodification of women, but as a culturally embedded expression of honor, responsibility, and economic solidarity. Drawing on principles such as maṣlaḥah (public interest), ‘urf (custom), and the objectives of Islamic law (maqāṣid al-sharī‘ah), the study reinterprets jujuran as a legitimate and dynamic legal norm that contributes to wealth redistribution, gender equity, and the preservation of marital dignity. The findings highlight that Banjar women actively participate in jujuran negotiations, challenging patriarchal interpretations and revealing women’s agency within customary frameworks. This research advances the discourse on contextual Islamic legal theory (fiqh al-‘urf) by demonstrating how local traditions, when aligned with Islamic ethical values, can serve as instruments for inclusive and justice-oriented marital practices. It contributes to global Islamic legal scholarship by offering a model for harmonizing cultural heritage with contemporary legal reform. Future research should explore comparative studies across Muslim ethnic groups and examine the evolving role of technology and digital mediation in customary marriage practices.

Abstract

This study aims to investigate the role of biology education in fostering the character of students and communities in Islamic Boarding Schools in Banjarbaru City. The main focus of the research is on increasing environmental and health awareness through biology learning methods. The research methods used involved surveys, interviews, and observations of students and communities involved in the biology education program at the boarding school. The results showed that character building through biology education has a positive impact on environmental and health awareness. Students and the community became more aware of the importance of protecting the environment and had better knowledge of good health practices. In addition, this study also identified factors that support or hinder the implementation of biology education as a means of character building in a boarding school environment. The findings provide an important contribution to the development of character education in the boarding school environment, particularly through the implementation of biology education as a means to increase environmental and health awareness. The implications of this study can be used as a foundation for the improvement and development of character building programs in boarding schools and also as an inspiration for other educational institutions that want to integrate character values through special subjects such as biology.

Abstract

Kecocokan (kafa'ah) memegang peranan penting dalam menunjang kehidupan perkawinan yang sesuai dengan tujuan agama Islam. Dalam penelitian ini, penulis bertujuan untuk mengungkap kafa'ah dari sudut pandang Syekh Muhammad Arsyad al-Banjari dalam bukunya “an-Nikah”. Kategorisasi kafa'ah oleh Syekh Arsyad berbeda dengan empat mazhab besar. Kajian ini didasarkan pada analisis tekstual dan fokus mengkaji kitab “Kitab an-Nikah” karya Syekh Muhammad Arsyad al-Banjari. Merupakan penelitian kualitatif yang dilakukan dalam bentuk tinjauan pustaka, yang melibatkan penelaahan berbagai sumber literatur seperti kitab-kitab, nash-nash fikih, dan sumber-sumber lain yang relevan yang berkaitan dengan topik yang diteliti. Dalam pandangan Syekh Arsyad, ada pembedaan dengan mazhab Syafi'i yang dianutnya. Perspektif ini didasarkan pada pemahaman urf (tradisi) yang berlaku saat itu. Dalam konteks ini, Syekh Arsyad berpendapat bahwa laki-laki yang kurang ilmu agama dapat dianggap sejajar dengan perempuan yang berilmu agama baik jika ia unggul dalam mencari nafkah atau rezeki. Kemahiran yang dimaksud oleh Syekh Muhammad Arsyad al-Banjari adalah kesanggupan mencari nafkah atau rezeki. Kata Kunci : Kafa'ah, Syekh Muhammad Arsyad Al-Banjari, Kitab an-Nikah.

Abstract

Abstract: This paper discusses about the problematic of the polygamy rules between text and context of the suitability of polygamy requirements stipulated in the Compilation of Islamic Law and some positive Indonesian law with the requirements and permissibility of polygamy in the book of Islamic Jurisprudence of Wahbah Zuhaili. According to Wahbah Zuhaili, the polygamy requirements are only two namely justice for their wives or children and a husband must be able to provide for the maintenance. Meanwhile, according to the Compilation of Islamic Law, several clauses explain the requirements that must be fulfilled by the husband when he wants to do polygamy. They are to maintain the welfare of the soul, wealth (livelihood), and environment. Zuhaili’s mashlahah approach is more directed to the practice of polygamy that must really achieve the goodness of the Islamic law clearly and confidently, not just lust. While the mashlahah approach in the Compilation of Islamic Law leads more to the adjustment of the ability of the soul, the provision of decent living, there is no tendency among the bride’s family, and not creating mudharat in the household and social life. The issue of the requirements as mentioned in the Islamic jurisprudence and the Compilation of Islamic Law has similarity as to avoid as much harm as possible. Abstrak: Tulisan ini membahas problematika aturan poligami antara teks dan konteks yaitu kesesuaian persyaratan poligami yang diatur dalam Kompilasi Hukum Islam serta beberapa hukum positif Indonesia dengan persyaratan dan dibolehkannya poligami dalam kitab Fiqih Islam karangan Wahbah Zuhaili. Menurut Wahbah Zuhaili, persyaratan poligami hanya ada dua yaitu keadilan bagi para istri atau anak-anak mereka, dan seorang suami harus mampu memberi nafkah untuk memelihara kemaslahatannya. Sedangkan menurut Kompilasi Hukum Islam ada beberapa pasal yang menjelaskan persyaratan yang harus dilakukan oleh suami ketika ingin berpoligami, yaitu demi menjaga kemaslahatan jiwa, harta (nafkah), dan lingkungan. Pendekatan mashlahah Zuhaili lebih mengarah pada praktik poligami yang harus benar-benar mencapai kebaikan dari syariat Islam secara jelas dan yakin, bukan sekedar nafsu belaka. Sementara pendekatan mashlahah dalam KHI lebih mengarah pada penyesuaian kemampuan jiwa, pemberian nafkah yang layak, tidak ada tendensi antar keluarga mempelai, dan tidak menjadikan mudharat dalam rumah tangga dan lingkungan sosial masyarakat sekitarnya. Prasyarat poligami dari perspektif mashlahah antara kitab Fiqih Islam dan KHI memiliki kesamaan dalam masalah pemenuhan syarat berpoligami dan menghindari kemudharatan semaksimal mungkin.

Abstract

This study aims to find the concept of match making or coercion in marriage against women. Women are more sensitive to match making issues and express disagreement with practices that violate women’s rights and endanger their future. However, previous researchers also considered match making coercion, sowe tried to research what if it was adapted to the concept of kafa'ah according to Shariah. The method used in this researchis a literature review by looking at the book an-nikah by Shaykh Muhammad Arsyad Al-Banjari, written in the 17th century AD. Through a hermeneuticalapproach, the researcher explores the marriage problems that her parents thought to becornering women in marriage problems. We try to uncover marriage problems that are sometimes considered to push women into marriage problems by their parents. This research proves that the concept of kafa'ah in al-Banjari theory can eliminate the perception of match making with a coercive system, because in the kafa'ah what is prioritized is a person's faith relationship which is ultimatelyable to maintain the honor of his wife and family. Not only in terms of material, but more inclined to approach immaterial needs. The Immaterial approach is evidenced by the harmonious relationship between the two families of the bride and groom.

Abstract

The possibility of social change in the Orang Banjar ideology is illustrated in this study. The people of Banjar demonstrate that farming is to be taught for the next generation, not just for the economies alone Bahuma or right farming. This research is field research with a descriptive-analytical approach. This research found that the philosophics of the traditions of Banjar should thrive wherever they are, with the approach of longitude (honesty, trust and fathanah), superficial (persistent and resilient), tugul (diligent and continuity), paibadah (near to God), batarget (sight and a clear mission). This paper is based on al-Qur'an surah Al-Fath verse 29 and al-A'raaf verse 56 and supports Ashabiyah Ibn Khaldun's theory, which emphasizes that three stages tend to change people's thinking, namely the stage of creation, the stage of enjoyment, and the stage of individuality. Likewise, Arnold Toynbee's theory, which suggests that changes that happen in society, whether they are improvement or failure, can be explained by social concepts that are always interrelated, namely challenges and responses. Abstract

ABSTRAK Penelitian ini ingin mereview tentang penggunaan dan fungsi obligasi serta surat berharga berjangka dalam tinjauan hukum ekonomi Syariah. Peneliti melihat ada celah yang datang dari praktik ini dalam penggunaan Akad yang dapat digunakan dalam penerbitan obligasi syariah meliputi mudharabah, musyarakah, salam, istisna, dan ijarah. Metode yang digunakan dalam penelitian ini kajian pustaka terhadap review artikel tentang obligasi dan surat berharga berjangka. Penelitian ini membuktikan bahwa Pendapatan (hasil) yang diperoleh pemegang obligasi syariah sesuai akad yang digunakan. Pemindahan kepemilikan obligasi syariah juga mengikuti akad-akad yang digunakan. Perbedaan obligasi syariah dan obligasi konvensional adalah penggunaan konsep imbalan dan bagi hasil sebagai pengganti bunga. Kata kunci: Obligsi,syariah, surat berharga, hukum, ekonomi ABSTRACT This study wants to review the use and function of bonds in a review of Islamic economic law. we see that there is a gap that comes from this practice in the use of Akad that can be used in the issuance of Islamic bonds including mudharabah, musharakah, salam, istisna, and ijarah. The method used in this study is a literature review of review articles on bonds and futures securities. This study proves that the income (yield) obtained by Islamic bondholders is by the contract used. The transfer of ownership of Islamic bonds also follows the contracts used. The difference between Islamic bonds and conventional bonds is the use of the concept of reward and profit sharing instead of interest. Keywords: bonds, sharia, securities, law, economy

Abstract

ABSTRACT This research examines the habits of pets owned by neighbors who often disturb and dirty neighbors' houses and also sometimes eat food belonging to neighbors without the knowledge or permission of the homeowners. The purpose of this research is to find out what is the law if keeping neighbors' pets often pollutes the neighbors' houses and sometimes eats the neighbor's food without the knowledge or permission of the home owner. What causes this problem to occur frequently in several residential areas. Even though everyone agrees that it is a disgraceful act to disturb other people's comfort and take what is not rightfully theirs, this research has differences from the legal approach to maintaining it. The research method used in this study is a field research method that often occurs at the researcher's house and around the researcher's house, namely the Pamukan Utara District of Kotabaru and is analyzed descriptively qualitatively, namely the discussion obtained by collecting data from interviews and sources of Islamic literature such as the Qur'an, hadith, and the opinion of the scholars regarding the problem of disturbing neighbors and eating something that does not belong to them. From the results of this study it can be concluded that keeping pets that pollute the neighbor's house and eating at the neighbor's house without the knowledge or without the permission of the owner of the house is illegal because it is a sin. This problem often arises in the community, and it is important for the community to know about the law in order to create harmony, Keywords : Raising Pets, Disturbing, Neighbor's House ABSTRAK Penelitian ini mengkaji mengenai kebiasaan binatang piaraan punya tetangga sekitar yang sering mengganggu dan mengotori rumah-rumah tetangga dan juga terkadang memakan makanan punya tetangga tanpa sepengetahuan atau tanpa seizin pemilik rumah. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana hukumnya jika memelihara binatang-binatang piaraan tetangga yang sering mengotori rumah-rumah tetangga dan terkadang memakan makanan punya tetangga tanpa sepengetahuan atau tanpa seizin pemilik rumah. Apa yang menyebabkan permasalahan ini sering terjadi di beberapa daerah pemukiman warga. Meskipun semua sepakat mengganggu kenyamanan orang lain dan mengambil yang bukan haknya adalah merupakan perbuatan tercela, tapi penelitian ini memiliki perbedaan dari pendekatan hukum memeliharanya. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian lapangan yang sering terjadi di rumah peneliti dan sekitaran rumah peneliti yaitu daerah Kecamatan Pamukan Utara Kotabaru dan dianalisis secara deskriptif kualitatif, yaitu pembahasan yang diperoleh dengan mengumpulkan data dari wawancara dan sumber kepustakaan Islam seperti Al-Qur’an, hadits, dan pendapat para ulama yang berkenaan dengan permasalahan mengganggu tetangga dan memakan sesuatu yang bukan hak miliknya. Dari hasil penelitian ini dapat disimpulkan bahwa memelihara binatang piaraan yang mengotori rumah tetangga dan makan dirumah tetangga tanpa sepengetahuan atau tanpa seizin pemilik rumah hukumnya adalah haram karena itu perbuatan dosa. Permasalahan ini sering muncul di lingkungan masyarakat, dan masyarakat penting mengetahui terkait bagaimana hukumnya agar terciptanya kerukunan, kenyamanan, dan ketenangan dalam bertetangga. Abstract

ABSTRACT Piduduk is a custom from our ancestors that is still practiced by the Banjar community at every walimah. Piduduk is not an offering in general, but as a guard to avoid the disturbance of spirits. Piduduk contains rice, coconut fruit, brown sugar, chicken eggs and also money. Piduduk is generally placed in the lower corner of the aisle, in the bride's room, or in other special places. Some people consider that piduduk is part of shirk because it asks for protection from other than God. And there is also an assumption that some people put piduduk because they follow customs, not believing in it as a guardian. The research method used in this research is field research method and analyzed descriptively qualitative, namely the discussion obtained by collecting data from interviews and literature sources about shirk. From the results of this study it can be concluded that the piduduk tradition according to the review of Islamic law is `urf, namely custom or habit, which is to preserve Banjar cultural customs, but the negative side of this tradition is feared to shift religious beliefs. Keywords: Piduduk, Banjar cultural customs, custom or habit ABSTRAK Piduduk adalah adat istiadat dari nenek moyang terdahulu yang masih dilakukan oleh masyarakat Banjar pada setiap pelaksanaan walimah. Piduduk bukan sesajen pada umumnya, melainkan sebagai penjagaan agar terhindar dari gangguan makhluk halus. Piduduk berisi beras, buah kelapa, gula merah, telur ayam dan juga uang. Piduduk pada umumnya diletakkan di sudut bawah pelaminan, di kamar pengantin, atau di tempat khusus lainnya. Sebagian orang menganggap bahwa piduduk bagian dari syirik karena meminta penjagaan kepada selain Allah. Dan ada juga anggapan sebagian orang meletakkan piduduk karena mengikuti adat istiadat saja bukan mempercayai sebagai penjagaan. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian lapangan dan dianalisis secara deskriptif kualitatif yaitu pembahasan yang diperoleh dengan mengumpulkan data dari wawancara dan sumber-sumber kepustakaan tentang kesyirikan. Dari hasil penelitian ini dapat disimpulkan bahwa tradisi piduduk menurut tinjauan hukum islam merupakan `urf yaitu adat atau kebiasaan, yang mana untuk melestarikan adat kebudayaan Banjar, namun sisi negatif dari tradisi ini adalah ditakutkan menggeser keyakinan dalam beragama.
