Abstract

This study examines the application of Islamic law principles in Article 173 of the Compilation of Islamic Law (KHI) regarding inheritance barriers (mawāni‘ al-irts) in the context of Islamic inheritance law in Indonesia. The purpose of this study is to analyze the Sharia basis, social relevance, and legal rationality of the expansion of inheritance barriers in Article 173 of the KHI through the ijtihad tathbîqî approach within the framework of tahqîq al-manâṭ. This study uses a literature review method with a normative juridical approach, accompanied by an analysis of shar‘i texts and contemporary social realities. The results of the study show that the expansion of mawāni‘ al-irts—which includes attempted murder, severe abuse, and slander against the heir—has shar‘i legitimacy through the stages of istinbâth min al-nushûsh, idrâk al-wâqi’, and tanzîl al-ahkâm, and is in line with maqāṣid al-syarī‘ah, particularly the protection of life and honor. In addition, this provision serves as a preventive measure through the application of the principle of sadd al-dzarî‘ah. Thus, Article 173 of the KHI represents a contextual and adaptive renewal of Islamic inheritance law to the needs of contemporary Indonesian society

Abstract

This study explores the intersection between Islamic law and human rights in the context of national law in Indonesia. The main focus of this study is to analyze how the concept of Maqashid al-Syari'ah functions as a theological basis for protecting basic human rights. Using normative legal research methods with a conceptual and philosophical approach, this study examines classical Islamic literature and Indonesian positive legal instruments. The results show significant harmony between the five universal principles of Islam (al-kulliyāt al-khams) and Articles 28A-J of the 1945 Constitution, covering the protection of life, religion, reason, lineage, and property. The practical implementation can be seen in the role of zakat in economic justice and the contribution of the Religious Courts in protecting the rights of women and children. However, challenges in the form of interpretative tensions regarding minority rights are still found in the field. This paper concludes that wise harmonization between Islamic law and national law is crucial to strengthening pluralism and inclusive human rights protection in Indonesia. Abstract

This journal examines the customary practices of the Banjar community in conducting "sighat akad" (contractual declaration) during transactions, which involve not only using the phrase "sell" or stating the price of the item as "I sell this shirt for fifty thousand,"but also adding the phrase "sell as is". The purpose of this research is to understand the perspective of the Shafi'i school of thought regarding the legal status of the contract of sale using the phrase "sell as is" in the Banjar community's practices. The research methodology employed in this study is field research with descriptive analysis, where data is collected through interviews and literary sources regarding the contractual agreements of buying and selling, which are then compared with the theories from the Shafi'i perspective. Based on the findings of this research, it can be concluded that according to the Shafi'i school of thought, the contract of sale using the phrase "sell as is" is permissible due to the mutual agreement between the seller and the buyer. This perspective aligns with the main objectives of a contract, which include the presence of mutual agreement, clarity of the object and terms, rightful ownership, and immediate payment and delivery.

Abstract

Polemik pembagian harta yang digunakan secara bersama dalam rumah tangga, terutama pada kepemilikan rumah melalui skema Kredit Pemilikan Rumah (KPR), menjadi fenomena yang kerap memunculkan perselisihan di Kecamatan Gambut. Minimnya pemahaman masyarakat terhadap dasar-dasar fikih dan pertimbangan keadilan dalam penyelesaian konflik membuat pandangan ulama lokal serta praktisi hukum keluarga Islam sering dijadikan rujukan. Fokus kajian ini diarahkan pada cara para tokoh tersebut memaknai dan memberikan solusi atas persoalan pembagian aset yang masih menimbulkan sengketa setelah terjadinya perpisahan. Metode yang digunakan berupa penelitian empiris melalui wawancara mendalam dengan tokoh agama dan praktisi KUA. Hasil temuan menunjukkan kecenderungan penggunaan pendekatan kemaslahatan dan keadilan kontribusi, sejalan dengan konsep maslahah mursalah dan kaidah al-ghurm bil-ghunm yang diterapkan dalam bentuk anjuran penjualan aset, penggantian nilai angsuran KPR secara proporsional, serta penyelesaian damai sebelum menempuh jalur litigasi. Temuan tersebut merefleksikan pola penalaran fikih kontekstual yang adaptif terhadap dinamika sosial-ekonomi masyarakat Gambut.

Abstract

Marriage in Indonesia requires both religious validity and state registration, creating legal challenges for Dayak Meratus customary marriages that lack formal recognition. These issues intensify when couples convert to Islam, necessitating legal alignment with Islamic and state systems. This study uses a normativeempirical juridical approach, examining regulations and Religious Court decisions. It finds that although itsbat nikah provides a legal pathway, administrative barriers, particularly within SIMKAH, limit effective registration. This results in tensions between customary, Islamic and state law, affecting legal protection. The study emphasizes the need for inclusive legal pluralism, institutional coordination, and administrative reform to ensure legal certainty and protect indigenous civil rights.

Abstract

Inheritance disputes in Banjar customary society extend beyond material distribution and are closely connected to kinship relations, moral obligations, and communal harmony. When such disputes are resolved exclusively through state law, particularly the Compilation of Islamic Law (KHI), the outcomes often fail to accommodate the social and cultural realities of indigenous Muslim communities. Formal litigation, with its adversarial structure and procedural rigidity, may intensify conflict rather than restore family relationships. This study adopts a normative legal research design using conceptual, doctrinal, and comparative approaches to examine Banjar customary inheritance mechanisms, namely bacu’ur (genealogical tracing), basuluh (moral and religious consultation), and bapatut (consensus-based deliberation). These mechanisms are analyzed through the perspectives of restorative justice and fiqh al-aqalliyyat as frameworks of contextual Islamic legal reasoning. The analysis relies on primary legal sources, including the 1945 Constitution, the KHI, and legislation on alternative dispute resolution, as well as secondary literature from legal anthropology and restorative justice studies, without employing empirical methods. The findings indicate that the Banjar karakatan system embodies restorative justice principles such as dialogue, collective responsibility, and relational repair. From the perspective of fiqh al-aqalliyyat, these practices constitute legitimate forms of Islamic legal reasoning that prioritize maslahah, islah, and social cohesion within plural legal settings. This study argues that Banjar customary inheritance resolution offers a normatively grounded model for integrating Islamic law, customary practices, and restorative justice within Indonesia’s alternative dispute resolution framework, contributing to broader debates on legal pluralism and the contextual application of Islamic law.

Abstract

This paper aims to prove that Biological Children can provide Civil Relations with their fathers if they have an apparent legal force. This study differs from other researchers in the comparative aspect of normative Law and Islamic Law. This difference lies in the Constitutional Court decision results, which states that children produced outside of marriage have a civil relationship with the mother and family of their mother, father, and family of their biological father, which can be proven by DNA testing between them. Meanwhile, according to Islamic Law, children outside of marriage (Zina) only have a civil relationship or blood relationship with the mother and the mother's family. The method used in this research is a literature review with a normative approach to the Constitutional Court decision and the Scholar's opinion on children outside of marriage (Siri). This research found that children can biologically provide civil relations with their parents if done in marriage and proven by clear legalities such as witnesses and marriage documents. The presence of a decision of the Constitutional Court is a legal assurance or defense of the human rights of a citizen, whether they have the correct data and facts to their civil relations.

Abstract

This research aims to analyze the function of collective Ijtihad operated by Muslim intellectuals in Indonesia as the driving force for the renewal (tajdid) of Islamic legal thought. Starting from a gap in previous research that tended to focus on legal outcomes (product) rather than the thought process and method (process) of Ijtihad, this study employs an analytical framework that combines Jasser Auda's Contemporary Maqasid al-Shari'ah (as the philosophical framework) and Fazlur Rahman's Double Movement Method (as the methodological framework). The transformation of Ijtihad in Indonesia from individual to collective, represented by major institutions such as the Indonesian Ulema Council (MUI), Nahdlatul Ulama (NU), and Muhammadiyah, demonstrates a diversity of methodologies within a dialectical space between text, school of law tradition, and modern demands. The case study of In Vitro Fertilization (IVF) proves the collective Ijtihad's ability to reach a consensus. The analysis indicates that the cautious stance of these institutions allowing IVF only between a legally married husband and wife without involving a third party is an expression of critical and responsive Muslim intellectuality. Through the lens of the double movement, the mujtahids succeeded in drawing the universal moral goal from the texts prohibiting the confusion of lineage, namely the protection of honor and the clarity of the family line, to be applied to the problem of modern reproductive technology. Philosophically (Maqasid), this process balances the benefit for infertile couples (the right to have offspring) with the obligation to safeguard the universal objectives of Shari'ah, particularly the preservation of progeny (hifz al-nasl) and human dignity. The implications of this Ijtihad finding are reinforced in Indonesia's Positive Law (Law No. 36 of 2009 concerning Health).

Abstract

Pesantren, traditional Islamic boarding schools in Indonesia, play a crucial role in fostering religious moderation and promoting tolerance and peace in multicultural contexts. This study explores the teaching of Khilafiyah Fiqh, or jurisprudential disagreement, in Pesantren in South Kalimantan and its impact on cultivating an inclusive and peaceful environment. The concept of khilafiyah, derived from the Islamic legal tradition, reflects the diversity of interpretations of Islamic law and is respected as a sign of dynamism and flexibility. Pesantren teach khilafiyah through various methods, including the recitation of classic Islamic texts, discussion, and debate, which encourage critical thinking and openness to different opinions. The implementation of khilafiyah fiqh in Pesantren involves teaching differences of opinion in various aspects of Islamic practice, such as prayer, zakat, and fasting. Kyai and Pesantren scholars emphasize the importance of respecting different views and avoiding fanaticism. Understanding khilafiyah has a positive impact on supporting religious moderation, as it encourages santri (students) to be inclusive and open to diversity, both within the Muslim community and in interfaith relations. Case studies in South Kalimantan demonstrate the successful application of khilafiyah fiqh in promoting tolerance and peace. However, challenges exist, including internal differences among teachers and santri, resistance to changes in traditional teaching methods, and external resistance from the community and other Islamic organizations. To overcome these challenges, Pesantren employ various approaches, including interfaith and cross-cultural dialogue, which strengthen the understanding of khilafiyah and its role in fostering a harmonious society.
