Abstract

This study discusses placing the mushaf on the stomach of a dead person who has not been washed, what is the legal status of doing so and whether people who die are punished for having hadats because obligatory bathing is obligatory. The author discusses this problem because according to the author, placing the mushaf on the stomach of a corpse that has not been washed is an interesting thing to study. What's interesting lies in the legal status if you do this. This study uses a qualitative method, with reference to field data and literature as the material used as the object of research. The author finds that what is the ruling on the person who did it putting the mushaf on the stomach of the deceased who has not been washed, because the person who dies is required to take a mandatory bath as in the hadith narrated by Imam Bukhari and Imam Muslim about the Prophet Muhammad who ordered to bathe his daughter with a certain number. If it is related to other laws, such as the law on touching the Qur'an when in a state of great hadats (a situation where a person is required to take a mandatory bath) then the law is haraam.

Abstract

This research examines the scope of the methodological thought of various fiqh schools and their influence on the formation of Islamic law in Indonesia. The objective is to analyze the epistemological characteristics of each school and their practical relevance to the development of national law. This study employs a normative (doctrinal) research method with conceptual and statutory approaches, utilizing qualitative analysis of primary and secondary data. The results reveal that each school has distinct istinbath mechanisms, such as istihsan in Hanafi, maslahah mursalah in Maliki, istidlal in Shafi’i, and strict textual commitment in Hanbali and Zhahiri. These methodologies significantly shaped the Compilation of Islamic Law (KHI), which functions as a cross-school synthesis (manhaj muqaran) through takhayyur and talfiq. While the Shafi’i school remains dominant due to historical factors, the KHI integrates diverse views to address modern social needs. In conclusion, the methodological diversity of fiqh schools provides an authoritative yet flexible foundation, allowing Islamic law in Indonesia to operate as a responsive "living law" while remaining rooted in Sharia principles

Abstract

This article examines the plurality of Islamic schools of law (madhāhib) and the methodology of legal reasoning (istinbāṭ al-ḥukm) from a normative–conceptual perspective within the Indonesian context. This article argues that madhhab plurality is a historical and epistemological reality that emerges from differences in juristic reasoning, socio-cultural conditions, and methodological approaches among classical Muslim scholars. Using a library-based and normative analytical approach, this study explores how various methods of istinbāṭ, such as qiyās, istihsān, and maṣlaḥah mursalah, contribute to the richness and adaptability of Islamic law in Indonesia. The findings indicate that plurality does not fragment Islamic law, but instead strengthens its normative framework by enabling legal interpretation to respond dynamically to social change. The paradigm of maqāṣid al-syarī‘ah functions as an integrative bridge between textual interpretation and contextual application, ensuring that Islamic law remains just, beneficial, and compatible with the national legal system. Therefore, madhhab plurality plays a strategic role in shaping a contextual, humanistic, and maslahat-oriented methodology of Islamic legal thought in Indonesia.

Abstract

AbstrakPenelitian ini bertujuan untuk mengetahui reaksi masyarakat terhadap informasi pandemi Covid yang disampaikan oleh media massa. Penyampaian berbagai berita atau hal yang sejenisnya secara berkali-kali membuat masyarakat mudah faham, dan memiliki dampak ketidakpercayaan jika tidak sesuai dengan faktanya. Penelitian ini mencoba untuk mengungkap dan menemukan bahwa media massa secara simultan dapat meningkatkan kepercayaan tentang covid-19 atau sebaliknya. Penelitian ini berbeda dengan yang lainnya, dikarenakan bahwa media yang secara simultan malah membuat ketidakpercayaan secara penuh terhadap pemberitaan yang disampaikan. Metode yang digunakan dalam penelitian ini adalah deskriptif kuantitatif secara pusposive sampling terhadap para mahasiswa yang sekarang lagi belajar secara daring dan selalu dekat dengan berita di media sosial. Responden dalam penelitian ini adalah 300 mahasiswa yang terdiri dari tujuh kampus di Provinsi Kalimantan Selatan, Indonesia. Berdasarkan hasil temuan, penelitian ini menyimpulkan bahwa informasi yang disampaikan berulang kali tentang Covid akhirnya membuat masyarakat kurang peduli terhadap Covid. Hal ini dibuktikan dengan munculnya fakta terbalik dari berita dari berbagai media massa.Kata kunci: Persepsi, media, fakta, simultan, masyarakat AbstractThis study aims to determine the public's reaction to the Covid pandemic information conveyed by the mass media. Repeatedly conveying various news or similar things makes it easy for the public to understand, and has an impact of distrust if it is not by the facts. This study tries to uncover and find that mass media can simultaneously increase beliefs about Covid-19 or vice versa. This study is different from the others because the media simultaneously make complete distrust of the news delivered. The method used in this research is descriptive quantitative by purposive sampling of students who are currently studying online and are always close to the news on social media. Respondents in this study were 300 students from seven campuses in South Kalimantan Province, Indonesia. Based on the findings, this study concluded that the information that was repeatedly conveyed about Covid ultimately made the public less concerned about Covid. This is evidenced by the emergence of upside-down facts from the news from various mass media.Keywords: Perception, media, facts, simultaneous, society

Abstract

Buying and selling is something that is never separated from the needs of everyone, especially buying and selling food as a means of human survival. All You Can Eat restaurant is a restaurant or place to eat that offers food to customers/consumers with a pay-as-you-go concept can eat as much as they want within a certain time limit, meaning that each visitor to the restaurant is given the freedom to choose what type of food and how much food they want with nominal payment and time determined by the restaurant. Every food they take will not be the same portion between one another and the money that has been set. This is what causes problems related to the existence of elements of gharar or jahalah (obscurity) in such a system. A qualitative approach was used in this study by reviewing several literature reviews originating from various references as reference material in this study. Shaykh Prof. Dr. Sa'ad As-Syatsri revealed that the act was permissible and there was no problem with it because the harm that was caused was only a little and it was forgiven. It's the same as when someone wants to go to a public toilet, he will pay the fee, even though he may use a lot of water or a little.

Abstract

Inheritance disputes in Banjar communities continue to increase as families confront controversies over unwritten norms, generational change, and rising land value, creating a growing need for culturally grounded solutions. These disputes reflect a broader trend in Indonesia where communities prefer non-court settlement when judicial rulings risk disrupting social cohesion. Within this plural legal landscape, families must navigate overlapping expectations from customary norms, Islamic law, and state regulations. This study addressed a key gap by examining how restorative justice principles operate within Banjar inheritance practices. Using a qualitative normative method, the research analyzed primary legal materials, documented customary procedures, court decisions, and academic literature. The findings showed that adat badamai integrated restorative values through open dialogue, inclusive deliberation, and relational repair among heirs. The study concluded that adat badamai provides an effective culturally rooted model of restorative justice and recommends stronger legal recognition and enhanced mediator training.

Abstract

The increasing religious polarization in Indonesia has triggered urgent debates about how moderate Islamic identity can be maintained in a diverse society. Within this context, the concept of wasatiyyah (moderation) has become a central theological and policy framework, yet most existing scholarship treats it as a static doctrinal category rather than a dynamically constructed discourse. This study addresses this gap by examining how Qur'anic interpretation actively shapes the formation of wasatiyyah discourse in contemporary Indonesia. The research aims to analyze the interpretive mechanisms through which Qur'anic verses related to moderation are mobilized by Indonesian scholars and religious institutions to construct inclusive religious narratives aligned with national policy agendas. Employing a qualitative methodology that integrates textual analysis of key Qur'anic verses (including ummatan wasatan, anti-ghuluw, and justice-related passages) with discourse analysis of interpretive frameworks from major Indonesian religious institutions, this study reveals three principal findings: first, wasatiyyah emerges as a polysemic concept negotiated through diverse interpretive strategies emphasizing balance, justice, tolerance, and social harmony; second, contemporary Indonesian tafsir increasingly adopts maqasid-oriented and contextual approaches that transform wasatiyyah from theological principle into policy-relevant discourse; and third, institutional actors such as Nahdlatul Ulama, Muhammadiyah, and the Ministry of Religious Affairs play decisive roles in mediating interpretive authority. The study concludes that understanding wasatiyyah as a discursive construct rather than fixed doctrine offers more productive pathways for strengthening religious moderation initiatives, and recommends greater attention to interpretive pluralism and contextual hermeneutics in moderation policy frameworks.

Abstract

The marriage in Indonesia is usually done with customary rules, one of which is the Banjar tribe who still has a strong culture in the process of marriage ceremony. In practice in Indonesia, in addition to following religious regulations, tradition also becomes important, as practiced by the people of Banjar when conducting marriages filled with various customs both before, shortly or after marriages are conducted. The application of the procession, the benchmark is honesty itself, where if the total honesty requested is not met by men, then the girl's family prefers to cancel it. In this condition, the local people's customary approach is the benchmark in the traditional Banjar marriage system

Abstract

This study examines the legal status and protection of children born out of wedlock within the Indonesian legal system, highlighting the tension between religious norms and human rights principles. The primary objective is to analyze the legal dimensions of lineage (nasab), inheritance rights, and civil recognition of such children based on Islamic law, national legislation, and Constitutional Court jurisprudence. Employing a normative legal method and qualitative analysis of statutory regulations, religious doctrines, and court decisions, the study finds that Islamic law recognizes only maternal lineage for out-of-wedlock children, excluding them from paternal inheritance. However, Constitutional Court Decision No. 46/PUU-VIII/2010 affirms civil recognition through biological evidence, though its implementation faces administrative and societal resistance. The findings imply the urgent need for inclusive legal reform, harmonization between Islamic and national law, and strengthened child protection mechanisms in practice.

Abstract

Abstract: Partnership is a cooperative relationship between several parties in achieving a certain work relationship. The partnership between the school and the family and community in building an educational ecosystem is in line with the Ministry of Education and Culture's vision of "the formation of education and cultural   human   beings   with   character   based   on   mutual cooperation". This partnership also aims to establish cooperation and alignment of educational programs in PAUD units, families, and communities  as  a  center  of  education  in  building  a  quality education   ecosystem.   Therefore,   it   is   necessary   to   have   a relationship or involvement from all parties to achieve the development of quality education for early childhood. Abstrak: Kemitraan merupakan hubungan kerjasama antara beberapa pihak dalam mencapai suatu hubungan kerja tertentu.Kemitraan  antara  sekolah  dengan  keluarga  dan masyarakat dalam membangun ekosistem pendidikan sejalan dengan visi Kementrian Pendidikan dan Kebudayaan yaitu “ terbentuknya insan serta ekosistem pendidikan dan kebudayaan yang berkarakter dengan berlandaskan gotong royong”. Kemitraan ini juga bertujuan untuk menjalin kerjasama dan keselarasan program pendidikan di satuan PAUD, keluarga, danmasyarakat sebagai tri sentra pendidikan dalam membangun ekosistem pendidikan yang bermutu. Maka dari itu perlu adanya hubungan atau keterlibatan dari semua pihak untuk mencapai pengembangan pendidikan bagi anak usia dini yang lebih berkualitas.
