Abstract

Studi ini membahas peran pemimpin Indonesia dalam membangun ketahanan negara, fokus pada keterlibatan strategis Presiden dalam memotivasi dan mengkoordinasikan upaya pertahanan nasional, terutama di perguruan tinggi. Presiden memiliki peran penting dalam meningkatkan kesadaran bela negara di kalangan mahasiswa dan masyarakat, memastikan perguruan tinggi berkontribusi dalam pengembangan teknologi yang mendukung industri pertahanan. Pertahanan nasional bertujuan melindungi warga dan wilayah sambil meningkatkan kesejahteraan umum, menekankan patriotisme melalui cinta tanah air dan keyakinan pada Pancasila serta UUD 1945. Koordinasi Presiden dalam upaya pertahanan nasional, termasuk di perguruan tinggi, sangat penting untuk menanamkan kesadaran pertahanan yang kuat terhadap berbagai ancaman, termasuk ideologi radikal. Prioritas pada program pendidikan dan sosialisasi bela negara esensial untuk menjaga kedaulatan dan keamanan Indonesia.

Abstract

Ketentuan Pasal 14 Ayat 1 Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah telah mereduksi pesan moral dan mengakibatkan inkonsistensi kaidah hukum secara vertikal terhadap Pasal 33 ayat 3, Pasal 18, dan Pasal 18A Undang-Undang Dasar 1945 juga menganulir kewenangan Pemda Tingkat II di bidang pertambangan berdasarkan Undang-Undang Nomor 4 Tahun 2009 tentang Minerba meningkatkan konsekuensi kerusakan lingkungan dan berdampak pada terpinggirkannya perlindungan hukum bagi rakyat kecil yang karena keterbatasan melakukan usaha pertambangan tanpa izin yang diancam sanksi pidana sesuai Pasal 158. Artikel ini didasarkan metode penelitian hukum empiris sosiologis untuk mendapatkan data primer melalui observasi dan wawancara di 6 desa berbeda kecamatan yang ditetapkan secara purposive. Penegakan hukum pertambangan tanpa izin di Kabupaten Kuningan lebih bersifat persuasif kompromis, belum berdampak secara signifikan terhadap fungsi lingkungan karena berkurangnya tekanan penduduk. Perlu dilakukan pemberdayaan hukum kepada mereka agar dapat menggeser mata pencahariannya ke sektor pariwisata & kuliner.

Abstract

The implementation of the people's representation in the administration of the state is a free and honest general election. In Indonesia elections are held every 5 years. Considering that the State of Indonesia adheres to the notion of constitutional democracy. Historically, the Election Law must be formulated and enacted no later than 2023. Issues related to the postponement of the 2024 Election have received much opposition from the public. Bearing in mind that Indonesia is a democratic country and seeing the large number of Indonesian people who reject the idea of postponing the election, the government should consider it to continue with the election. If there is a postponement of the election, then the term of office of the President and Vice President will be extended and that is clearly unconstitutional. Not to mention the term of office of members of the MPR, DPR and DPD and even the DPRD will further add to state and governmental chaos and there could be the possibility of spreading to positions in the structural hierarchy downwards.

Abstract

Industrial relations in Indonesia are based on the principles of Pancasila Industrial Relations, which is a form of relationship between actors in the production process of goods and services, namely workers, employers, and the government. In this study, the researcher focuses on whether the provisions regarding force majeure in Indonesian labor law are in accordance with the principles of fair and sustainable labor protection, by analyzing the extent to which labor law in Indonesia supports worker protection in force majeure situations, and whether existing legal provisions are still relevant to the principle of social justice for workers. In relation to layoffs caused by force majeure reasons, workers have the right to seek legal remedies to obtain protection. According to Law No. 13 of 2003, termination of employment in force majeure situations can be carried out, but must still comply with existing provisions, such as the provision of severance pay and other rights in accordance with applicable provisions. Legal remedies in labor disputes are a crucial aspect in ensuring justice and protection for workers in Indonesia. In the context of industrial relations, disputes between workers and employers often involve issues of basic worker rights, such as wages, working conditions, termination of employment (PHK), or unpaid benefits. Without a clear legal mechanism, workers may not be able to obtain equal justice with employers who have greater access to legal resources. Therefore, legal remedies are an important channel to ensure that workers' rights are maximally protected.

Abstract

Kasus kebangkrutan PT Sritex pada tahun 2024 menyebabkan pemutusan hubungan kerja (PHK) massal terhadap ribuan pekerja, yang memberikan dampak sosial dan ekonomi yang besar. Penelitian ini bertujuan untuk menganalisis perlindungan hukum yang diberikan kepada pekerja yang terdampak PHK massal serta mengevaluasi efektivitas kebijakan Jaminan Kehilangan Pekerjaan (JKP) dalam memenuhi hak-hak pekerja. Penelitian ini menggunakan pendekatan yuridis normatif dengan studi kasus pada PT Sritex, serta menganalisis perundang-undangan yang relevan terkait ketenagakerjaan dan kebijakan JKP. Hasil penelitian menunjukkan bahwa meskipun peraturan yang ada memberikan dasar hukum untuk perlindungan pekerja, implementasinya masih menghadapi kendala dalam memastikan hak-hak pekerja, seperti pesangon, jaminan sosial, dan program JKP. Kebijakan JKP yang baru saja diterapkan memerlukan pengawasan lebih lanjut dari pemerintah untuk memastikan bahwa hak pekerja yang kehilangan pekerjaan dipenuhi dengan baik. Implikasi dari penelitian ini adalah pentingnya penguatan sistem perlindungan hukum ketenagakerjaan dan penegakan yang lebih optimal terhadap kebijakan JKP, guna mengatasi permasalahan PHK massal dan krisis sosial ekonomi yang dapat muncul. Penelitian ini diharapkan dapat memberikan kontribusi dalam merumuskan kebijakan yang lebih efektif dalam melindungi hak-hak pekerja di masa depan.

Abstract

Personal data protection is an effort to protect individual privacy rights, which includes the need to protect a person's privacy as well as the protection of their personal data. The type of research in this study is normative juridical, which focuses on the review of positive legal norms.To find out about the protection of personal data regulated in Indonesian Legislation and to find out the obstacles to personal data protection in law and their solutions. In Indonesia, Personal Data Protection has been regulated in Law Number 27 of 2022 concerning Personal Data Protection, Law Number 11 of 2008 concerning Electronic Information and Transactions, and the Regulation of the Minister of Communication and Information of the Republic of Indonesia Number 20 of 2016 concerning Protection of Personal Data on Electronic Systems, and has obstacles in the application of this Law such as the overlap of the old law with the new one, and preventing a legal expert from adopting which Law.In the current technological era, the significance of addressing security factors in the processing of personal data using various technologies has become increasingly critical. While electronic systems have enhanced data security, it is undeniable that the risk of data theft by irresponsible parties still exists. Therefore, regulations or laws are necessary to provide protection for personal data.

Abstract

Artikel ini bertujuan untuk mengetahui pertimbangan hakim dalam penyelesaian perselisihan pemutusan hubungan kerja dengan alasan efisiensi sebagaimana telah diatur dalam Pasal 43 PP Nomor 35 Tahun 2021. Pasal 43 ayat (1) PP Nomor 35 Tahun 2021 yang mengatur PHK dengan alasan efisiensi karena pengusaha mengalami kerugian harus membuktikan dengan hasil audit baik itu internal maupun eksternal. Tetapi kemudian pada Putusan Mahkamah Agung Nomor 1345 K/Pdt.Sus-PHI/2022, Mahkamah Agung memperbaiki amar judex factie yang secara tidak langsung mengakui bukti berupa laporan keuangan masuk dalam kualifikasi Pasal 43 ayat (1) PP 35/2021 dimana frasa ‘antara lain’ seharusnya bertentangan dengan asas kepastian hukum dan lebih jauh lagi Mahkamah Agung memperkuat ketidakadilan tersebut.

Abstract

Thinking in legal philosophy about the balance between individual freedom and national security in the context of human rights is an important debate in a democratic society. This study formulates the main problem with a focus on legal philosophy thinking on the concept of balance between individual freedom and national security and the policies that can be adopted by the government to maintain the balance. The article presents a review of the various perspectives and theories that underpin different approaches to this issue. While some views emphasize the importance of protecting individual rights as the foundation of democracy, others underline the need for strong measures to safeguard national security. The article also analyzes the various policies that can be pursued by the government to maintain such a balance, seeking common ground between the protection of human rights and the measures necessary to protect state security. It highlights the importance of legal philosophy thinking in guiding fair and balanced policymaking in the context of human rights

Abstract

The concept of responsibility plays a central role in legal philosophy, shaping views on justice in society and legal systems. Since antiquity, philosophers such as Plato and Aristotle have raised fundamental questions regarding individual responsibility in the context of law. They considered whether individuals have a moral obligation to abide by laws and social norms. The literature study method will be the main approach in this research to examine in detail the development of the concept of responsibility in the context of legal philosophy and explore how this concept has been applied in legal practice over time. To determine the differences and similarities in the context of the concepts of individual responsibility and societal responsibility in legal philosophy. This article demonstrates the importance of the concept of responsibility in designing a just and sustainable legal system in a complex and globally connected society

Abstract

Inequality in tax payments is a complex issue that has a significant impact on income distribution and social justice in Indonesia. In the context of this case study qualitative research, secondary data from official sources such as the Directorate General of Taxes, the Central Statistics Agency, and government reports are used to analyze the impact of unequal tax payments. This study shows that unequal tax payments can trigger increasing social and political inequality in society. The impact extends to the development and public services sectors, with a lack of funding available to support welfare programs and necessary infrastructure. Apart from that, unequal tax payments also contribute to greater income inequality in society. However, the Indonesian government has responded to this issue with various policies, including the Economic Equalization Policy (KPE), healthy fiscal policies through the Budget, and the Tax Amnesty program. Taxes are considered a tool for income redistribution, with progressive taxation on individuals with higher incomes. Awareness of the importance of paying taxes fairly and tax policies that support a more equal distribution of income are important steps towards a more just and sustainable society in Indonesia. Collaboration between government, the private sector and society is needed to overcome this problem and achieve better social welfare and maintain social and political stability.
