Abstract

Abstract: This study examines the criminal liability of children in conflict with the law in the context of drug abuse crimes. The main focus of this study is to identify the legal aspects that regulate the liability of children, as well as the challenges faced in enforcing the law against child offenders. The methods used consist of normative legal analysis and interviews with legal practitioners, psychologists, and social workers. specific provisions in the Child Criminal Justice System Law, implementation in the field is often hampered by social stigma, lack of rehabilitation facilities, and public misunderstanding of children's rights. This study recommends the need for policy reform and increased public awareness of child protection, as well as a rehabilitative approach.Keyword: Criminal Liability, Children, Drug Abuse.

Abstract

The rapid development of information technology has opened up opportunities for new threats to national security, one of which is information system hacking. Cyberattacks not only cause economic losses and disrupt public services but also pose a serious threat to Indonesia's digital sovereignty. In this context, state intelligence plays a strategic role as the vanguard in detecting, analyzing, and countering various threats to the country's strategic information systems. However, strengthening the state intelligence function in countering hacking crimes still faces various obstacles, ranging from immature regulations, weak inter-agency coordination, to limited technology and human resources. This study aims to assess the effectiveness of strengthening state intelligence in countering information system hacking and to formulate the urgency of updating national legal policy to support the formation of a strong, integrated, and professional cyber intelligence system. Using normative legal research methods supported by conceptual and case-based approaches, this study concludes that strengthening state intelligence requires regulatory updates, institutional integration, and investment in technology and human resources to safeguard national sovereignty in the digital era.

Abstract

The criminal act of falsifying administrative documents related to civil registration is a form of crime that has serious implications for the order of state administration, public trust, and the validity of civil registration data. This study aims to analyse the motives and driving factors of perpetrators in falsifying administrative documents related to civil registration through the application of strain criminology theory. The research method used is normative legal research with a criminological approach, supported by a literature study of relevant laws, regulations, doctrines, literature, and court decisions. The results show that the falsification of administrative documents is influenced by the gap between the cultural goals of society—such as obtaining employment, education, and social status—and the limitations of available legal means. Social pressure, economic conditions, and negative experiences such as frustration and bureaucratic obstacles encourage individuals to commit illegal acts as a form of adaptation. In addition, other contributing factors include weak social control, opportunities created by an ineffective administrative system, and the influence of a permissive social environment on forgery practices. The conclusion of this study confirms that the crime of falsifying administrative documents is not solely an individual problem, but also a structural and systemic one. Therefore, prevention efforts must be comprehensive, not only through strict law enforcement, but also by improving the administrative system, strengthening bureaucratic oversight, and reducing the socio-economic pressures faced by the community.

Abstract

This study discusses the implementation of the effectiveness of legal oversight of regional personnel management in the era of regional autonomy. Regional autonomy grants broad authority to regional governments to regulate and manage public interests, including in the management of state civil servants (ASN). However, this authority often gives rise to problems, such as nepotism, politically motivated job transfers, and weak accountability in personnel management. Legal oversight is an important instrument to ensure that all personnel policies and practices are implemented in accordance with the principles of legality, professionalism, and accountability. The research method used is normative legal research with a statutory, conceptual, and case approach, as well as qualitative analysis of regulations and personnel oversight practices. The results of the study indicate that the effectiveness of legal oversight is greatly influenced by the consistency of regulatory implementation, the strength of supervisory institutions such as the State Civil Service Commission (KASN) and the State Civil Service Agency (BKN), and the legal culture of regional apparatus. Strict enforcement of sanctions against violations also plays an important role in maintaining the integrity of the merit system. The conclusion of this study confirms that effective legal oversight can prevent abuse of authority, strengthen the professionalism of civil servants (ASN), and support the achievement of regional autonomy goals, namely improving the quality of public services and public welfare. Therefore, strengthening regulations, supervisory institutions, and internalizing the values ​​of good governance are necessary to realize transparent, accountable, and integrity-based regional personnel management.

Abstract

This study aims to analyze the legal impact of drug use on the health of inmates at the Tanjung Kusta Women's Detention Center and to examine the handling efforts based on applicable laws and regulations. Drug abuse in detention centers not only violates the law but also has serious impacts on the physical, mental, and social health of inmates, as well as hindering the goals of social development and reintegration. The research method used is empirical legal with a statutory approach, a conceptual approach, and a sociological approach. Primary data were obtained through interviews with prison officers, medical personnel, and inmates, while secondary data were obtained from laws and regulations, legal literature, and official reports. The research results show that legal regulations regarding the prohibition of narcotics use in detention centers are regulated in Law Number 35 of 2009 concerning Narcotics, Law Number 12 of 1995 concerning Corrections (as amended by Law Number 22 of 2022), and Regulation of the Minister of Law and Human Rights Number 6 of 2013 concerning Correctional Institutions/Detention Centers. The resulting impacts include organ damage, the risk of infectious diseases, mental disorders, decreased quality of guidance, and increased recidivism. Handling efforts are carried out through repressive, preventive, and rehabilitative measures, but their implementation is still hampered by limited supervision, facilities, and coordination between institutions. This study concludes that normatively, the existing legal framework is adequate, but its implementation in the field is not optimal. Strengthening the monitoring system, improving rehabilitation facilities, and synergy between relevant agencies are needed to ensure the protection of the health rights of drug-using inmates at the Tanjung Kusta Women's Detention Center.

Abstract

Typhoid fever is a significant health issue caused by the Salmonella Typhi bacteria, leading to symptoms such as fever, abdominal pain, diarrhea, muscle pain, and serious complications if not treated promptly. A common challenge faced by society is limited access to medical professionals, especially in remote areas, and delays in recognizing symptoms. To address this problem, this study designs and implements a web-based expert system using the Certainty Factor (CF) method, which helps diagnose typhoid fever quickly and accurately. The Certainty Factor method is used to calculate the certainty level of the symptoms experienced by the patient, providing a diagnosis result in the form of early-stage typhoid, mild typhoid, or severe typhoid. The system was developed using PHP programming language and MySQL database, and tested at RSUD Djoelham Binjai City. The research data was obtained from patients at RSUD Djoelham Binjai with a case study on patient number 22. The processing of symptoms through Certainty Factor calculation showed that the patient is most likely to have severe typhoid with a certainty value of 0.9443 or 94.43%. This result proves that the Certainty Factor method can be used to assist in providing an accurate early diagnosis of typhoid fever with a high degree of accuracy.

Abstract

The diversity of types of tourism that provide a variety of tourist interests makes industry players continue to innovate creatively and sustainably. Opportunities in utilizing the potential of the surrounding nature and local wisdom of the community are industrial strategies in adding value economically, socially, and environmentally. The application of the concept of educational tourism in the sago factory can be a choice of activities for students, students and other visitors to get a different tourist experience. The purpose of this study is to identify the potential for educational tourism in sago factories, describe the readiness of human resources, and provide an overview of the preparation of educational tour packages.This research method uses a qualitative approach with purposive sampling in sample selection, and through observation, interviews, and literature studies in extracting data. The results of the study show that the sago factory at PT. BAA in Bangka Regency has the potential to provide education to tourists, including having a process of making sago as an educational tourist attraction, the use of sago grounds as animal feed and organic fertilizer, diversification of sago products such as sago noodles, sago crackers and sago cakes, in addition there are non-agro opportunities that are integrated into technological development and environmental conservation.

Abstract

Tebing Tinggi City Regional Regulation Number 1 of 2024 serves as the basis for collecting Regional Taxes and Regional Levies, including in the entertainment sector. However, the implementation of night market entertainment at Sri Mersing Field showed a significant leakage of Regional Original Revenue (PAD). An investigation by the Anti-Corruption Community Communication (KOMAKI) revealed potential regional losses reaching more than IDR 439 million from the activities that took place from April 22 to June 5, 2025. This loss came from various levies such as food, beverages, parking, entertainment, advertising, and cleaning that were not paid legally, even though they were included as tax objects according to Article 23 and Article 27 of Regional Regulation No. 1 of 2024 concerning Regional Taxes and Regional Levies. Strong suspicions point to systematic tax evasion by legal entity night market organizers (corporations). This violation is not only administrative in nature, but has the potential to become a criminal offense based on Article 102 of Regional Regulation No. 1 of 2024 in conjunction with Article 181 of Law No. 1 of 2022, and can even be qualified as a criminal act of corruption by corporations according to Law No. 31 of 1999 in conjunction with Law No. 20 of 2001. Therefore, the importance of law enforcement for economic crimes that reaches structural aspects, including apparatus accountability and public oversight, is key to preventing systemic neglect in regional governance. This article aims to evaluate the form of violation of the Law on Misappropriation of Regional Original Revenue Funds. Normative legal research with field data shows an element of intent in tax evasion. Therefore, firm legal steps are needed to prevent repeated losses and strengthen the regional government oversight system. This approach is in line with the ideal of Law (Dassolen) to bridge intentionality with empirical reality (Dassein).

Abstract

Customary Criminal Law (Hukum Pidana Adat) is an unwritten legal system that has long existed within indigenous communities and focuses on restoring social balance. Its existence has historically occupied a position of legal ambiguity, as it was not formally recognized in the old Penal Code (Wetboek van Strafrecht), which led to normative conflicts and legal uncertainty in practice. However, the enactment of Law Number 1 of 2023 concerning the Penal Code (KUHP) marks a significant milestone by recognizing the concept of living law (law that lives within society) as part of positive criminal law. This study aims to analyze the position and role of Customary Criminal Law following the implementation of the new Penal Code, focusing on two main aspects. First, it examines the position of Customary Criminal Law based on its norms and its implementation within the context of legal pluralism in Indonesia. Second, it explores the implications of the development of Customary Criminal Law within the national criminal law system, particularly in relation to the new Penal Code and the reforms of the Criminal Procedure Code (KUHAP). Using a normative juridical research method with legislative, conceptual, and case approaches, this study reviews various literature, court decisions, and dispute resolution practices in indigenous communities, including cases in Nias and Wamena. The results show that the recognition of living law in Articles 2 and 100 of Law Number 1 of 2023 provides formal legitimacy for Customary Criminal Law, transforming its status from mere social practice to a binding legal source.However, its implementation faces challenges, such as standardizing the process for proving the existence of customary law, ensuring the compatibility of customary sanctions with human rights principles, and harmonizing them with criminal procedural law. Therefore, clear technical regulations and synergy between law enforcement officials and customary institutions are required to establish an effective hybrid model, where restorative justice through customary law can be integrated with the state criminal justice system

Abstract

This study analyzes the effectiveness and challenges of the Public Prosecutor (JPU) as the sole executor in carrying out the penalty of paying substitute money (UP) in corruption cases. Replacement money, which is regulated in Article 18 of the Corruption Law, is an additional criminal sanction that is essential to recover state financial losses (asset recovery). This normative-empirical legal research identifies that normatively the prosecutor has the strong authority to confiscate and auction the assets of the convict if the UP is not paid within one month. However, in practice, the prosecutor faces significant obstacles, mainly due to: 1) The act of transferring the convict's assets triggers a lawsuit against a third party (derden verzet), which delays the execution process; and 2) Technical limitations in asset tracing to track assets disguised through money laundering schemes. It was concluded that it is necessary to strengthen synergy between institutions and the optimal use of TPPU legal instruments to ensure the success of asset recovery and achieve restorative criminal law goals.
