Abstract

Halal certification and labeling is a form of renewal that occurs in the food and public consumption sector. Halal certification and labeling on food in circulation, especially instant food, is something that actually did not exist in the past, but now its existence is something that is considered important. This paper is a conceptual research related to the study of halal certification and labeling on food in the perspective of Islamic law through the study of ayat ahkam. The results of the study show that halal certification and labeling on food can actually be viewed by returning to the basic rule in terms of food, namely "the law of origin of everything is permissible, until there is a reason that prohibits it". The verses that explain that food commands to eat halal food is good, so halal certification and labeling on food is so important today as an effort to fulfill the commandment by raising a belief and certainty in the halal of a food and a form of caution that will avoid eating food that is haram.

Abstract

The aim to be achieved in this writing is to find out whether in practice the legal protection of immovable property belonging to minors is in accordance with the statutory regulations or is it still far from being appropriate. The ideal arrangement for guardianship of children in conflict with the law is as regulated in Article 33 of the Child Protection Law, by reconstructing and dividing the two phrases of guardianship, namely guardianship in the civil aspect which must be carried out through a court determination process, and the criminal aspect which is directly determined. an institution or body that is given the task and authority to carry out guardianship of children in conflict with the law without having to go through a court decision. So learn from the perspective of Islamic law towards guardians who manage immovable assets belonging to minor children. The research method used in this research is a qualitative research method, therefore the source of research data is obtained from observations, interviews and documentation that will be carried out at the Surakarta Religious Court as well as from various literature and other references related to the subject of discussion. The results of this research can be concluded that at every stage of the examination, whether in the inquiry, investigation, prosecution, or examination stage in court (Article 23 of the SPPA Law), Children in Conflict with the Law have the right to receive assistance from parents/Guardians and trusted people ( Article 3 letter j of the SPPA Law). And also guardianship cases at the Surakarta Religious Court from 2021 to 2023 will see more guardianship cases in 2021, around 52% compared to only 2% in 2023.

Abstract

This research examines waqf's potential to revitalize economies during crisis-induced recessions. It presents an analysis of economists' theories on recession causes, addressing factors such as the separation between financial and real sectors and the influence of price speculation. The historical context of 20th and 21st-century economic recessions is explored, highlighting the consistent repercussions of reduced economic growth and activity. Additionally, the study delves into waqf's development across countries, revealing significant asset values yet limited productivity. We found various models of waqf development that offer avenues for progress, with potential economic benefits including increased economic activities, enhanced economic growth, price stability, improved production, reduced unemployment, and wealth disparity reduction. Despite this potential, we found that waqf's global impact remains limited due to inadequate administration, weak management, and a lack of government support. The research underscores the importance of effective waqf management and supportive policies to unlock its full potential and contribute to global economic stability.

Abstract

The mutual cooperation between the customer and the capital owner, namely Baitul Maal Wat Tamwil or BMT, is a partnership allowed by Allah SWT as long as there is no oppression towards either party in the partnership. "Musyarakah" itself is a form of cooperative agreement between two or more parties for a business endeavor in which each party contributes, and profits are shared equally while risks are collectively borne according to the agreements made by the parties involved. In this research, it can be analyzed that the Musyarakah practiced at BMT Fadhilah Santosa involves a management system where customers have full control, and BMT only provides motivation and input to advance the customer's business. Regarding profit-sharing calculations, BMT only determines the percentage of profit distribution, while the customers collectively decide the rest. The method used in this research is qualitative descriptive research with an inductive and categorical mindset. Based on the results of the research conducted, it can be analyzed that the Musyarakah financing at BMT Fadhilah Santosa is not fully in line with the fatwa issued by DSN-MUI. This is evident in the issues related to capital and loss-sharing.

Abstract

This journal delves into the implementation of Salam transactions in accordance with Fatwa DSN MUI No 05/DSN-MUI/IV/2000, focusing on a profound understanding of the definition of Salam transactions, clear identification of goods and prices, and the aspects of transparency and clarity in agreements. Upfront payment is deemed crucial to avoiding speculative elements and ensuring contract fulfillment according to the principles of Salam transactions. Moreover, transactions must align with the principles of Islamic Sharia, including the avoidance of usury and uncertainty (gharar), necessitating thorough documentation. The journal recommends consultation with Sharia legal experts or scholars to ensure authenticity in compliance with the latest developments in fatwas or scholars' interpretations. Additionally, the paper reviews the implementation of Salam contracts on the Sharia-compliant marketplace, Pasar Al Huda, within the framework of Sharia Economic Law. Various parties, such as buyers, sellers, the delivered goods, and the contracting process (sighat), play vital roles in ensuring the smoothness and authenticity of transactions in the marketplace. Buyers bear the responsibility of understanding the legal aspects and transaction conditions, while sellers must comprehend the law, avoid breaching commitments, and ensure timely delivery as agreed upon. Key elements in executing Salam contracts include clarity in goods, prices, delivery times, and the expression of mutual consent (ijab qabul).
