Abstract

The need for adequate housing is a mandate of the Constitution. This is what encourages the growth of the house development industry and ready-to-live buildings in Indonesia. However, in its implementation, the community is often faced with the problem of developer companies being declared bankrupt, causing legal uncertainty for consumers. This is what makes researchers interested in examining these legal issues. This research uses normative juridical research with a statutory approach through secondary data searches. The result of this research is that when the developer enters PKPU and is even declared bankrupt, it is the consumers who suffer great losses. Because, if the developer is declared bankrupt and the Deed of Sale and Purchase (AJB) has not yet belonged to the consumer, the consumer's assets will also be confiscated and auctioned, and the consumer does not necessarily get a share of the proceeds from the auction because it is not certain that the results are sufficient to pay off his share. In this case, it can be seen that in bankruptcy cases, consumers are the most vulnerable. In the absence of AJB in addition to being the last creditor, the consumer is not the owner of the land and the land will be auctioned and divided by the separatist creditor. There needs to be an effort from the government to form a specific regulation governing further provisions and the position of creditors in bankruptcy, PPJB, reservation agreements, Pre-Project Selling obligations of developers, as well as sanctions if it is found that the development company has defaulted or broken promises. Because the Bankruptcy Law and GCPL have different solutions from each other, it is necessary to have clearer arrangements between bankruptcy and consumer protection to create legal certainty.

Abstract

Indonesia has laws and regulations that regulate people's behavior. Therefore, the government must communicate effectively with the community, so that they can obey it. In order for the implementation of legislation to be more effective, the government issues circulars addressed to the public. This circular contains technical information or messages that need to be carried out by the public. This article discusses the effectiveness of government legal communication to the public through circulars. This research approach is quantitative by conducting surveys and normative observations of secondary data in the form of circulars, expert views from various references, and regulations related to circulars. The results showed that the government's legal communication to the public through circulars was mostly effective. This is because circulars made by government officials are more of a regulatory nature (as a regulation), and a small part are stipulating (as a stipulation). This circular is a one-sided message from government officials to other officials or the general public as communicants. The nature of regulating circular letters can be in the form of orders or recommendations that are mandatory or which can be carried out by the communicant. However, the public has the right not to implement the government's message if the contents of the circular contradict the applicable regulations. This is done through a judicial review process. However, in general, government circulars are understood, accepted and implemented by the public

Abstract

Perlindungan  hukum  untuk  buruh / pekerja  perusahaan  x  yang  mendapatkan  peutusan  hubungan kerja (PHK) secara sepihak merupakan bahwa pemutusan hubungan kerja (PHK) untuk buruh terkait diputuskan batal demi hukum karena berdasar pada Pasal 151 ayat (3) Undang-undang Nomor   13   Tahun   2003   tentang   Ketenagakerjaan, jika pengusaha ingin melaksanakan  pemutusan hubungan kerja terhadap  buruhnya,  harus  lebih  dulu  mendapatkan  penetapan dari  Lembaga  Penyelesaian  Perselisihan  Hubungan  Industrial. Metode  penulisan dalam  penulisan ini menggunakan  jenis  penelitian hukum doktrinal  atau  normatif,  yang  mengkaji  hukum  sebagai  norma. Sedangkan apabila dilihat dari sumber data yang tersaji adalah penelitian doktrinal atau normatif. Teknik  analisa  data  yang  dipakai  adalah teknik  analisis  isi (content  analysis). Hasil  pembahasan  menggaris-bawahi bahwa semestinya ada  sanksi  yang lebih tegas  bagi setiap  pelanggaran pada  praktik  ketenagakerjaan  yang  dilaksanakan  oleh  pihak  pengusaha, hal ini agar  berkurang  terjadinya  lagi  PHK  sepihak  yang  sangat merugikan pihak buruh  dan  pekerja pengawas ketenagakerjaan dari Pemerintahan pusat maupun daerah harus lebih intensif melakukan pemantauan ketenagakerjaan terhadap kasus pemutusan hubungan kerja  secara sepihak.

Abstract

Indonesia terkenal dengan tenaga kerja yang murah dan jumlah yang sangat banyak. Pembayaran upah kepada pekerja merupakan salah satu unsur penting dalam hubungan kerja yang adil dan seimbang antara pengusaha dan pekerja. Namun, kerapkali para pemberi kerja memberikan upah di bawah upah minimum bagi karyawannya. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian kualitatif dengan pendekatan yuridis normatif. Metode ini dipilih karena memungkinkan peneliti mendapatkan wawasan mengenai perubahan hukum terkait pengusaha yang membayar pekerja di bawah upah minimum setelah Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja disahkan. Berdasarkan UUD NRI 1945 ditetapkan bahwa upah harus membantu umat manusia memperoleh penghidupan yang layak, sehingga menjamin upah yang layak untuk hidup dan kemanusiaan merupakan konsep pengupahan yang diterapkan secara konstitusional di Indonesia. Sejatinya dalam Konstitusi telah diatur mengenai pentingnya hak upah bagi para pekerja yang termaktub dalam Pasal 28D ayat (2) UU NRI 1945. Hal ini kemudian diatur lebih lanjut dalam Pasal 81 angka 28 Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja yang menyatakan bahwa pemberi kerja dilarang untuk membayarkan upah di bawah upah minimum yang telah ditetapkan kepada pekerja. Bagi pekerja yang tidak mematuhi ketentuan ini maka dapat dikenakan sanksi sebagaimana yang diatur dalam Pasal 88 angka 66 Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja.

Abstract

The rapid advancement of digital technology has heightened the risk of personal data misuse, thereby necessitating effective law enforcement under Law Number 27 of 2022 on Personal Data Protection (PDP Law). This study aims to examine judges’ legal reasoning in adjudicating cases of personal data misuse and to analyze the application of the PDP Law within Indonesia’s criminal justice system. Specifically, it assesses the alignment between the ideal legal principles (das sollen) and the practical implementation (das sein). Employing a normative juridical approach combined with qualitative analysis, this research examines three court decisions: Decision No. 77/Pid.Sus/2024/PN Tangerang, Decision No. 78/Pid.Sus/2024/PN Tangerang, and Decision No. 5/Pid.Sus/2023/PN Karanganyar. The findings reveal that judges have begun to internalize the paradigm of personal data protection through the application of Articles 67 and 68 of the PDP Law, although variations in interpretation and implementation persist. The study concludes that Indonesia’s judicial practice is undergoing a gradual transition toward a more consistent enforcement of privacy law, yet further development of jurisprudential guidelines and enhanced judicial capacity remain essential to strengthening privacy protection in the digital era.

Abstract

Tujuan penelitian ini adalah memberikan pengenalan tentang mediasi dan bagaimana tata cara serta proses penyelesaian sengketa bisnis menggunakan mediasi. Bisnis telah muncul sejak zaman dulu, dari mulanya menggunakan sistem barter sampai kini beralih menggunakan nilai uang. Kegiatan bisnis merupakan kegiatan yang dijalankan dengan melibatkan lebih dari 2 individu agar tercapai tujuan bersama, kegiatan bisnis yang dijalankan dengan jumlah transaksi kecil maupun besar setiap harinya tidak dapat dipungkiri memungkinkan terjadinya sengketa. Sengketa bisnis umumnya timbul akibat perselisihan pada saat melakukan kegiatan isi kontrak bisnis, perbedaan pendapat antara pihak yang terlibat dalam melakukan kegiatan bisnis, benturan kepentingan, adanya pelanggaran perundang-undangan, pelanggaran perjanjian bisnis yang telah disepakati yang semua hal ini dapat diartikan sebagai wanprestasi atau tindakan inkar janji. Salah satu cara menyelesaikan sengketa dengan cara damai adalah mediasi yaitu penyelesaian sengketa dengan musyawarah yang akan dibantu oleh pihak ketiga (ke-3) sebagai pihak netral yang tidak memihak siapapun. Tahap mediasi sebagai penyelesaian sengketa bisnis memiliki 4 proses. Mediasi menjadi cara penyelesaian sengketa bisnis yang mengutamakan kedamaian dan kesepakatan bersama bagi pihak yang terlibat.

Abstract

The protection of maternity leave rights for female workers represents an embodiment of the principles of social justice and humanity as mandated in Article 27(2) of the 1945 Constitution. However, in practice, violations of these rights continue to occur across various employment sectors. This study aims to analyze the legal provisions governing maternity leave rights under Law No. 13 of 2003 on Manpower and to evaluate the extent to which their implementation reflects the principles of justice, legal certainty, and humanity. Employing a normative juridical approach through the analysis of primary and secondary legal materials as well as industrial relations court cases, the study finds that although the normative framework provides clear legal protection, its implementation remains weak due to inadequate supervision, low legal awareness, and persistent gender bias in the workplace. In conclusion, the Indonesian labor law system formally upholds legal certainty but has yet to fully achieve substantive justice and humanitarian protection for pregnant female workers.

Abstract

This study is motivated by the widespread practice of employers withholding employees’ diplomas as a form of job security, which raises serious concerns from both labor law and human rights perspectives in Indonesia. The purpose of this research is to assess the conformity of this practice with the principles of justice, freedom of contract, and human rights protection, as well as to analyze the legal remedies available to employees for reclaiming ownership of their diplomas through non-litigation and litigation mechanisms. The study employs a normative juridical approach, analyzing relevant laws and regulations, legal doctrines, and court decisions. The findings indicate that the withholding of diplomas violates fundamental principles of labor law and infringes upon employees’ personal property rights. The most effective means of resolution is mediation, and if such efforts fail, legal action through the Industrial Relations Court. In conclusion, this practice should be explicitly prohibited through legislative reform to ensure justice and the protection of workers’ rights.

Abstract

This article examines the normative conflict between Law No. 6 of 2023 on the Establishment of Government Regulation in Lieu of Law on Job Creation and the Basic Agrarian Law (UUPA), specifically within the land law cluster. Using a normative approach and the theory of derogation, the article identifies three core areas of legal inconsistency: (1) the strengthening of Land Management Rights (Hak Pengelolaan), (2) foreign ownership of apartment units, and (3) the granting of land rights in aboveground and underground spaces. These legal inconsistencies not only create normative dualism but also generate legal uncertainty and threaten the principle of the rule of law. The article discusses the legal and policy implications of this dualism and proposes pathways for harmonization, including affirming the UUPA as a lex specialis, revising sectoral laws, or filing for judicial review. The analysis ultimately seeks to reclaim coherence in Indonesia’s land governance framework amidst the rising trend of autocratic legalism in pro-investment legislation.

Abstract

General Background: Outsourcing has become a prevalent labor practice in Indonesia, yet its implementation often creates legal uncertainty for permanent workers, particularly during termination of employment (PHK). Specific Background: The Industrial Relations Court (PHI) Decision No. 267/Pdt.Sus-PHI/2022/PN.Jkt.Pst highlights inconsistencies in applying normative protections for outsourced workers following unilateral termination by PT G4S Security Services. Knowledge Gap: Despite existing regulations and judicial guidelines such as SEMA No. 3/2015, limited studies examine the judicial deviation from these norms and its implications for legal certainty and substantive justice. Aims: This study analyzes judicial reasoning behind the non-application of SEMA No. 3/2015 and assesses its juridical consequences for worker protection in the outsourcing system. Results: Findings indicate that the judges prioritized substantive justice by granting full process wages and reinstatement, deviating from the six-month wage limit mandated by SEMA. Novelty: The study offers a comparative analysis between the PHI decision and Supreme Court Decision No. 393 K/Pdt.Sus-PHI/2024, revealing structural inconsistency in enforcing legal certainty. Implications: These inconsistencies highlight the urgent need to harmonize judicial guidelines and strengthen regulatory protections to ensure fairness and clarity for outsourced workers. Highlights: Emphasizes the tension between substantive justice and legal certainty in PHK cases for outsourced permanent workers.
