Abstract

This study aims to examine the application of restorative justice to children as criminal offenders based on the 2012 SPPA Law and the 2014 Qanun Jināyat. This study is an empirical legal study using a statutory approach and restorative justice theory. Data collection techniques were carried out through in-depth interviews and literature studies. The results of the study show that Article 5 paragraph (1) of the 2012 SPPA Law stipulates that if a child commits a crime or jarīmah, a restorative justice approach must be prioritized, and in Article 7 paragraph (1), it is stated that at investigation, prosecution, and examination level of a child's case in the district court, it is mandatory to attempt diversion. The Qanun Jināyat of 2014 does not separately regulate the settlement of children who commit crimes. However, it designates laws and regulations regarding juvenile justice. Qanun Jināyat regulates the handling of children who carry out a jarīmahikhtilaṭ to carry out an examination guided by the law mentioned above. However, in the case of children who commit crimes of ikhtilaṭ and are investigated by the police, the process is carried out in a restorative justice and diversionary manner. The forms of settlement in restorative justice are reconciliation with or without compensation, return to parents or guardians, social rehabilitation, and religious rehabilitation. This study argues that restorative justice treats children in a dignified manner oriented towards juctice and the interests of the child. Likewise, the study shows that SPPA Law and Qanun Jināyat complement each other.

Abstract

Nursing documentation is critical for ensuring quality patient care and effective communication among healthcare professionals. However, in low- and middle-income countries (LMICs), documentation practices often fall short due to resource limitations and cultural barriers. This mixed-methods study evaluated a culturally adapted roleplay-based intervention to improve nursing documentation quality among Indonesian nurses. Guided by Kolb's Experiential Learning Theory, this intervention focused on experiential, reflective, and technology-enhanced components to enhance nursing documentation practices. Using a quasi-experimental design, 132 nurses from three public hospitals in Jakarta were assigned to either the treatment or control group. The intervention integrated conventional roleplay, digital simulation, and reflective practice. Quantitative data were collected at baseline, post-intervention, and at a 12-week follow-up, measuring documentation quality, self-efficacy, and cognitive load. Additionally, qualitative data were gathered through semi-structured interviews with 15 experimental group participants. Results showed significant improvements in documentation quality (Cohen’s d=1.28 at T1; d=1.14 at T2), self-efficacy (d=0.99 at T1; d=0.85 at T2), and reductions in cognitive load (d=-0.84 at T1; d=-0.72 at T2), indicating significant and sustained improvements at the 12-week follow-up. Qualitative findings highlighted increased confidence, realism of the scenarios, integration of digital skills, and cultural considerations in documentation practices. Participants' hierarchical structure orientation moderated the effectiveness of the intervention. In conclusion, this study provides evidence that hybrid roleplay interventions can enhance nursing documentation practices in low- and middle-income countries, with a focus on culturally tailored healthcare education.

Abstract

This study aims to analyze the influence of professionalism, work discipline, work motivation, and organizational communication on the performance of employees of the Gunung Ciremai National Park Office (BTNGC). The method used is quantitative with a causal associative approach, involving 75 employees as a population taken as a sample. Linear regression analysis is used to test the hypothesis. The results of the study indicate that partially, professionalism, work discipline, work motivation, and organizational communication have a positive and significant effect on the performance of BTNGC employees. In addition, simultaneously, the four variables have a significant effect on employee performance, with a contribution of 47.0%. This study concludes that improving these aspects can improve employee performance at BTNGC.   ABSTRAK Penelitian ini bertujuan untuk menganalisis pengaruh profesionalisme, disiplin kerja, motivasi kerja, dan komunikasi organisasi terhadap kinerja pegawai Balai Taman Nasional Gunung Ciremai (BTNGC). Metode yang digunakan adalah kuantitatif dengan pendekatan asosiatif kausal, melibatkan 75 pegawai sebagai populasi yang diambil sebagai sampel. Analisis regresi linear digunakan untuk menguji hipotesis. Hasil penelitian menunjukkan bahwa secara parsial, profesionalisme, disiplin kerja, motivasi kerja, dan komunikasi organisasi berpengaruh positif dan signifikan terhadap kinerja pegawai BTNGC. Selain itu, secara simultan, keempat variabel tersebut berpengaruh signifikan terhadap kinerja pegawai, dengan kontribusi sebesar 47,0%. Penelitian ini menyimpulkan bahwa peningkatan aspek-aspek tersebut dapat meningkatkan kinerja pegawai di BTNGC.

Abstract

This research aims to determine the influence of digitalization strategies on the development of MSMEs which are moderated by technology. This research uses quantitative research with an accident sampling technique where the selection is made by chance. Data were analyzed using the Structural Equation Model Partial Least Square (SEM PLS) method. The research results show that the Digitalization Strategy and Digitalization Strategy for the Development of MSMEs Moderated by Technology have a positive influence on the development of MSMEs. However, technological moderation shows that there is no influence on the development of MSMEs.

Abstract

Kekerasan Dalam Rumah Tangga (KDRT) khususnya terhadap isteri terus muncul dan meningkat di berbagai wilayah Indonesia termasuk Aceh. Di Aceh, ekses dari kondisi ini mendorong tingginya angka gugatan cerai di Mahkamah Syar‟iyah oleh isteri sebagai upaya keluar dari lingkaran kekerasan dengan persentase mencapai 83%. Penelitian ini ingin menjawabpertanyaan bagaimana perlindungan hukum atas perempuan dalam kasus gugat cerai akibat tindak KDRT di Mahkamah Syar‟iyah dengan mengambil lokasi penelitian di wilayah hukum Kota Banda Aceh. Pendekatan yang dipakai adalah pendekatan perundang-undangan (Statute Approach), serta pendekatan kasus (Case Approach). Hasil penelitian menunjukkan bahwa: Pertama,tindak pidana KDRT tidak dituntut secara pidana melainkan secara perdata, karenanya hakim tidak dapat memberi putusan pidana lebih dari apa yang dimohon oleh Penggugat dalam petitum-nya. Sehingga bentuk perlindungan hukum bagi perempuan dilakukan melalui beberapa hal; mempercepat proses persidangan danmengabulkan gugatancerai untuk menghindarkan isteri dari kemungkinan terulangnya tindak KDRT dan menjauhkannya dari trauma.Kedua, Hakim Mahkamah Syar‟iyah Kota Banda Aceh belum mengintegrasikan UU Nomor 23 Tahun 2004 tentang PKDRT sebagai acuan maupun dalil dalam putusan. Sebaliknya, hakim mendasarkan putusannya pada pertimbangan: (1) Ketidakberhasilan proses mediasi;(2) Penolakan Penggugat atas nasehat majelis hakim untuk membatalkan gugatan cerai;(3) Ketidakhadiran pihak Tergugat dalam proses mediasi (Peraturan Mahkamah Agung Nomor 1 tahun 2008) dan dalam persidangan sehingga perkara tersebut diadili secara verstek (Pasal 149 R.Bg. ayat (1));(4) Perselisihan yang terus menerus terjadi antara kedua pihak telah memenuhi syarat dan alasan hukum dalam Pasal 39 ayat (2) Undang-undang Nomor 1 tahun 1974 jo Pasal 65 Undang-undang Nomor 7 tahun 1989 dan Pasal 19 huruf (f) Peraturan Pemerintah Nomor 9 Tahun 1975 jo Pasal 116 huruf (f) Kompilasi Hukum Islam;(5) Keyakinan majelis hakim bahwa kedua pihak tidak mungkin lagi dipertahankan sebagai suami isteri; (6) Kaidah-kaidah maslahat dalam hukum Islam. Ketiga, Putusan Mahkamah Syar‟iyah Kota Banda Aceh dalam penyelesaian perkara cerai gugat akibat KDRT adalah mengabulkan gugatan cerai secara verstek akibat ketidakhadiran pihak suami (tergugat) dalam proses mediasi dan persidangan, dan menjatuhkan putusan talak satu ba‟in sughra Tergugat atas Penggugat. Hal ini menunjukkan bahwa putusan hukum di Mahkamah Syar‟iyah Kota Banda Aceh sudah sesuai dengan konsep hukum perlindungan korban tindak pidana KDRT di mana hakim mempertimbangkan nasib korbandalam putusan hukum.Namun tidak semua butir-butir dapat diimplementasikan karena isteri menganggap putusan cerai dari suaminya sudah cukup.

Abstract

In discussions about education, early childhood education has become a primary focus. The question is, when is the ideal time to begin this education? While many believe that education starts after a child enters school or preschool, research indicates that education actually begins during pregnancy. Al-Qur’an, as the guiding principle for Muslims, emphasizes the importance of early education. Therefore, studying Al-Qur’an is an obligation for every Muslim. This study focuses on early childhood education based on the Surah Maryam (Chapter of Mary) in the commentary by Imam Al-Qurthubi. The research method employed is a literature review using primary data from Al-Qurthubi’s Tafsir. The findings reveal that early childhood education, according to Al-Qurthubi, particularly in Surah Maryam verse 12, centers around Al-Qur’an education. Memorizing and practicing Al-Qur’an are integral parts of this education. Al-Qur’an education should ideally commence during early childhood, around the ages of 2-3 years. At this stage, it is crucial to introduce children to the oneness of Allah (Tawhid) and teach them the fundamental declaration of faith (Kalimat Tauhid). This research provides fresh insights into early childhood education within Islam. By studying Al-Qur’an from an early age, it is hoped that children will grow into individuals who are faithful and possess noble character.

Others brainware as became pioneer from the appear of Indonesia Islamic thought is Abdurrahman Wahid in 1980s. Harun Nasution, Moeslim Abdurrahman are influential figure in Indonesia islamic thought context. Islamic thought which was pioneered by the several figure then was becoming as background from appeared ofislamic liberal as long as very controversial thought among muslim society. But the thougt becoming a part of dynamic Indonesia Islamic thougt as new pattern or new over in islamic world, Especially an over to observe islamic to be more rasional. Using of rasio in this idea was becoming a special characteristic, however using of brain was pointed to bring islamic from thought deterioration.

Abstract

There is no doubt that optimizing the internet and learning media has a positive impact on student performance and learning achievement. Learning in the post-pandemic transition period also requires optimizing the use of the internet and interactive learning media so that learning can run according to the desired targets and catch up during the pandemic. This technical guidance was carried out at Cawan View Resto which is located in Glagah District, Banyuwangi Regency and was attended by madrasa teachers in the district. The presentation of the material was carried out by FKIP lecturers at the University of 17 August 1945 Banyuwangi and the material was divided into material about PTK and its implementation, material about learning strategies and models, material about interactive learning media, and technical guidance for PTK and Learning Media as well as structured assignments. The training was carried out using lecture and discussion methods and from the results of the training it was concluded that this training provided participants with additional knowledge about the material mentioned above which could be applied in the classroom and produce PTKM reports which could be published and could increase the performance points of the participants.

Abstract

Abstrak: Tujuan penelitian ini adalah mendeskripsikan pembelajaran kooperatif tipe STAD menggunakan Algebraic Experience Material (AEM) dalam upaya meningkatkan hasil belajar siswa kelas VIII B MTsN Poso Pesisir pada materi perkalian bentuk aljabar. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian tindakan kelas yang mengacu pada model Kemmis dan Mc. Taggart yang terdiri dari empat komponen, yaitu (1) perencanaan, (2) pelaksanaan tindakan, (3) observasi dan (4) refleksi. Subjek dalam penelitian ini adalah siswa kelas VIII B MTsN Poso Pesisir. Penelitian ini dilakukan dalam dua siklus. Data dalam penelitian ini diperoleh melalui observasi, tes tulis, wawancara dan observasi. Hasil penelitian menunjukkan bahwa terjadi peningkatan hasil belajar siswa kelas VIII MTsN Poso Pesisir pada materi operasi perkalian bentuk aljabar dengan model pembelajaran kooperatif tipe STAD menggunakan AEM melalui beberapa langkah yaitu: 1) menyampaikan tujuan pembelajaran dan motivasi siswa, 2) penyajian materi denga menggunakan AEM, 3) tim studi dan monitoring, 4) evaluasi, 5) skor perkembangan individu dan 6) penghargaan. Kata Kunci : hasil belajar, operasi perkalian bentuk aljabar, model pembelajaran kooperatif tipe STAD, AEM. Abstract: The objective of this research is to describe cooperative learning of STAD with using Algebraic Experience Material (AEM) to improve learning outcomes of students in grade VIII MTsN Poso Pesisir on multiplication of algebra. This research is classroom action research that refers to Kemmis’ and Mc.Taggart’s research design that consist of four components, those are (1) planning, (2) action, (3) observation, and (4) reflection. The subjects of this research are students of grade VIII MTsN Poso Pesisir. This research was conducted in two cycles. Data in this research were obtained through observation, written test, and interview. The result of this research indicating that there was enhancement of student’s learning outcomes in grade VIII MTsN Poso Pesisir on multiplication of algebra through cooperative learning of STAD with used AEM through some steps those are: 1) conveying learning objectives and motivating student, 2) material presentation with using AEM, 3) study team and monitoring,4) evaluation, 5) individual enhancement score, and 6) appreciation. Abstract

This study aims to explore the nature of philosophy through a conceptual approach that emphasizes a deep understanding of the ideas, basic concepts, and methodologies used in the study of philosophy. Through a qualitative-descriptive literature review, this study analyzes the definition of philosophy, its objects of study, and the main branches that form the framework of philosophical thinking. In addition, the relevance of philosophy in contemporary life and its contribution to developing critical reasoning, ethics, and a reflective worldview are also discussed. The results of the study show that a conceptual approach in the study of philosophy provides a strong foundation for understanding the dynamics of human thought across eras and civilizations. Thus, this approach not only enriches theoretical insights but also encourages intellectual awareness in facing existential and social problems.
