Abstract

Religious  institutions  looked  having  an  important  role  in responding a violence, especially for women at domestic violence. It is because  our  understanding  that  any  religion  has  never  agreed  and received any kind of violence. However, time has changed, campaign and gender  mainstreaming  has  been  actively  issued  by  the  government  and non  government  organizations.  Therefore,  the  interpretation  of  the devine  text  by  the  religious  leaders  has  also  shifted.  This  article elaborates  the  role  and  paradigm  shift  in  the  religious  institutions  in anticipating and rehabiliting domestic violence in Yogyakarta.

Abstract

Penelitian ini berfokus ke pembuatan biobriket ramah lingkungan dengan memanfaatkan bahan sisa dari serbuk pohonkayu medang sebagai bahan bakunya. Pembuatan biobriket ramah lingkungan ini merupakan solusi yang inovatif dalamkonversi limbah menjadi sumber energi terbarukan. Dimana serbuk pohon kayu medang ini diarangkan ataudikarbonisasikan terlebih dahulu baru dihancurkan/ di crusher serta diayak dengan menggunakan ayakan mesh 20, 30,40, dan 50. Serbuk pohon kayu medang ini juga menggunakan tepung tapioka sebagai perekatnya. Setelah dicampurarang briket dengan perekat baru dicetak dengan alat press cetakan briket dengan ukuran panjang 3 mm dan lebar 2,8mm. Dari hasil pembuatan biobriket ini terdapat 3 pengaruh variasi yaitu, variasi mesh, variasi perekat, dan variasijenis kayu. Oleh karena itu pada pengujian dengan variasi mesh nilai yang tinggi yaitu kadar air 8,823%, kadar abu57,971%, volatile matter 32,5%, fixed carbon 14,915%, drop test 0,14025%, densitas 0,0454g/cm³ dan nilai kalor6718.9kal/g. Pengujian variasi perekat nilai yang tinggi yaitu kadar air 10,389%, kadar abu 59,09%, volatile mater33,497%, fixed carbon 18,767%, drop test 10,53921%, densitas 0,0467g/cm³ dan nilai kalor 6838.3kal/g. Danpengujian variasi jenis kayu yaitu, nilai kadar air pada kayu medang 7,1% dan kayu semaran 3,89%, kadar abu kayumedang 59,09% dan kayu semaran 50,638%, volatile matter kayu medang 22,33% dan kayu semaran 27,45%, fixedcarbon kayu medang 11,48% dan kayu semaran 17,932%, drop test kayu medang 10,5392% dan kayu semaran0,08417%, densitas kayu medang 0,045g/cm³ dan kayu semaran 0,037g/cm³, nilai kalor kayu medang 6838.3kal/g dankayu semaran 7187.7kal/g.Keywords: Biobriket, Serbuk Pohon Kayu Medang, Tepung Tapioka

Abstract

The purpose of this study is to analyze and explain the criminal law enforcement model for the crime of killing protected elephants (Elephas maximus) in Aceh Jaya, and the inhibiting factors and efforts to enforce criminal law against the crime of killing protected elephants (Elephas maximus) in Aceh Jaya. This study uses an empirical juridical research method with a qualitative approach. Based on the research that has been conducted, it can be concluded that the model of Criminal Law Enforcement for the Crime of Killing Protected Elephants (Elephas Maximus) in Aceh Jaya is using the Due Process Model. This is because the court has provided space for each defendant to present their defense before the trial as a form of protection of the human rights of the defendants and the judiciary also applies the principle of presumption of innocence. Factors that inhibit law enforcement, reviewed from Court Decision Number 51/Pid.B/LH/2021/PN Cag regarding the killing of protected elephants in Aceh Jaya, namely: a) Lack of personnel from the Natural Resources Conservation Agency (BKSDA); b) Lack of community participation. Criminal penalties against the perpetrators are considered insufficient to deter them. Other law enforcement alternatives include revoking permits for plantation activities, particularly those within conservation areas.

Abstract

Even though it is still a long-standing debate within Muslims, visiting the wali’s tomb is still a routine ritual. Pilgrimages to the graves of saints in Indonesia and Malaysia present an interesting phenomenon, because both have different principles in applying the law, Malaysia applies sharia law while Indonesia does not. This research seeks to explore the construction of religious piety identity in the tradition of grave pilgrimages, pilgrim behavior and forms of government intervention in the management of saints' graves in Indonesia and Malaysia. This research is a qualitative-phenomenological research, which will reveal the awareness of experiences, social interactions, motives, actions and meanings of the phenomenon of visiting wali’s tomb in Indonesia and Malaysia. The results of this research are; First, the identity of religious piety in the practice of visiting saints emerged as a result of resistance from the religious purification movement which often condemned the practice of visiting wali’s tomb. Second, religious pragmatism can be seen from the motives of pilgrims who use the wali’s tomb as a means of speeding up the fulfillment of their wishes, as well as syncretic behavior by using the burial ground as a means of carrying out all their affairs. In contrast to Malaysia, in Indonesia, the government tends to be responsive to the management of guardian graves by designing them as part of business and tourism. Third, Malaysia uses a sharia law approach to stem deviant behavior from pilgrimage (khurafat), whereas in Indonesia it does not.

Abstract

Abstract: This study aims to describe the process of Islamic ecotheology character building in class VIII I students of SMPN 11 Banjarbaru through tree planting and environmental awareness activities, as well as identify the supporting and inhibiting factors of its implementation. The research uses a descriptive qualitative approach with observation, interview, and documentation methods. The results showed that the character of Islamic ecotheology was formed through structured activities that instilled the value of love of nature, realization of love of nature, and consistency towards the preservation of the environment. The main supporting factors are the role of teachers, enthusiastic students, and a supportive school environment. The obstacles include lack of individual awareness, limited teacher time, and lack of support from some parents. Tree planting is proven to be effective as a medium of learning Islamic values that are environmentally sound and forming characters that are responsible for nature. Keywords: Character Education, Environmental Care, Islamic Ecotheology, Tree Planting. Abstrak: Penelitian ini bertujuan untuk menggambarkan proses pembentukan karakter ekoteologi Islam pada siswa kelas VIII I SMPN 11 Banjarbaru melalui kegiatan penanaman pohon dan kepedulian lingkungan, serta mengidentifikasi faktor pendukung dan penghambat pelaksanaannya. Penelitian menggunakan pendekatan kualitatif deskriptif dengan metode observasi, wawancara, dan dokumentasi. Hasil penelitian menunjukkan bahwa karakter ekoteologi Islam terbentuk melalui kegiatan terstruktur yang menanamkan nilai cinta alam, realisasi cinta alam, dan konsistensi terhadap pelestarian lingkungan. Faktor pendukung utama adalah peran guru, siswa yang antusias, dan lingkungan sekolah yang mendukung. Adapun hambatannya meliputi kurangnya kesadaran individu, keterbatasan waktu guru, dan minimnya dukungan dari sebagian orang tua. Penanaman pohon terbukti efektif sebagai media pembelajaran nilai-nilai Islam yang berwawasan lingkungan dan membentuk karakter yang bertanggung jawab terhadap alam. Kata Kunci: Ekoteologi Islam, Kepedulian Lingkungan, Pendidikan Karakter, Penanaman Pohon.

Abstract

Penelitian ini bertujuan untuk mengetahui tinjauan hukum dan penerapan deposito berjangka dalam akad mudharabah pada BMT NU Cabang Randuagung Lumajang. Penelitian ini menggunakan metode deskriptif kualitatif dengan dua teknik pengumpulan data, yakni wawancara dengan general manager, account officer, teller serta anggota dan dokumentasi terhadap literatur lain yang relevan dengan masalah penelitian yang diteliti. Hasil penelitian ini adalah pelaksanaan deposito berjangka dalam akad mudharabah pada BMT NU Cabang Randuagung Lumajang berpedoman pada fatwa Dewan Syariah Nasional Nomor 03/DSN-MUI/IV/2000. Penabung sebagai pemilik harta (shahibul maal) dan BMT sebagai pemberi pinjaman melalui akad mudharabah (mudharib). Akad ini menggunakan akad mudharabah muthlaqah, yakni anggota simpanan tidak memberikan syarat apapun kepada BMT. Dalam akade ini, pembagian keuntungan bersama (nisbah) diberikan di depan atau di awal akad, di mana bagi-hasil langsung masuk ke rekening anggota penabung. Dari aspek hukum Islam, pelaksanaan akad mudharabah dengan penambahan saldo tabungan tidaklah tepat, karena metode bagi-hasil ini dihitung berdasarkan dana dari shahibul maal atau anggota penabung, sehingga pembagiannya menjadi fasakh (rusak)

Abstract

Abstract: This article describes the law of insurance waqf. Insurance waqf benefits are a combination of cash waqf and waqf benefits, because the assets used are in the form of money. Waqf insurance is included in the category of waqf money because the waqf property is in the form of money that is deposited with an insurance company, then part of the sum insured on insurance is used as a waqf object. The benefits of insurance waqf can also be said to be waqf of lease rights, because participants give money to insurance companies to use. After the rental period is over, the money will be returned along with the balance in the form of sum insured. Waqf lease rights are permissible, with the opinion of Imam Maliki, Syafi'i, and other jurists that lease rights can be leased. The benefits of this insurance waqf can also be said to be a waqf will, because the participant bequeaths the insurance company to donate the insurance coverage money. the permissible amount is one-third of the total assets. Therefore, waqf insurance benefits are permissible. Benefits of insurance as waqf in juridical law in Indonesia. Based on Article 503 of the Civil Code, insurance benefits can be classified as intangible objects, because they cannot be touched by the five senses, in the form of the right to compensation due to risks experienced. It is an object that cannot be frozen for consumption, because it is regulated by laws and government regulations, namely demands for the amount of money that can be billed for movable objects, as written in Article 505 of the Civil Code. In addition, insurance benefits have the nature of movable objects due to the stipulation of the law, as written in Article 511 of the Civil Code. This insurance benefit qualifies as a waqf object.Abstrak: Artikel ini menjelaskan tentang hukum wakaf asuransi. Wakaf manfaat asuransi merupakan gabungan antara wakaf uang dan wakaf manfaat, karena harta yang digunakan berupa uang. Wakaf asuransi termasuk ke dalam golongan wakaf uang karena harta yang diwakafkan adalah berupa uang yang ditabungkan ke perusahaan asuransi, untuk kemudian sebagian dari uang pertanggungan atas asuransi dijadikan sebagai obyek wakaf. Wakaf manfaat asuransi juga dapat dikatakan sebagai wakaf hak sewa, sebab peserta memberikan uang kepada perusahaan asuransi untuk dimanfaatkan. Setelah masa sewa selesai, uang akan dikembalikan beserta imbalan dalam bentuk uang pertanggungan. Wakaf hak sewa diperbolehkan, dengan melihat pendapat Imam Maliki, Syafi’i, dan para fuqaha lain bahwa hak sewa dapat disewakan. Wakaf manfaat asuransi ini juga dapat dikatakan sebagai wakaf wasiat, karena peserta mewasiatkan kepada perusahaan asuransi untuk mewakafkan uang pertanggungan asuransi. besaran yang diperbolehkan adalah sebesar sepertiga dari total harta. Oleh karena itu, wakaf manfaat asuransi diperbolehkan. Manfaat asuransi sebagai wakaf dalam hukum yuridis di Indonesia. Berdasarkan Pasal 503 KUHPer, manfaat asuransi dapat dikategorikan sebagai benda yang tidak berwujud, karena tidak dapat diraba dengan panca indera, berupa hak atas ganti rugi akibat risiko yang dialami. Merupakan benda tidak dapat dihabiskan untuk dikonsumsi, karena diatur oleh undang-undang dan Peraturan Pemerintah, yaitu tuntutan atas jumlah uang yang dapat ditagih atas benda bergerak, seperti yang tertulis pada Pasal 505 KUHPer. Di samping itu, manfaat asuransi mempunyai sifat benda bergerak karena penetapan undang-undang, sebagaimana yang tertulis dalam Pasal 511 KUHPer. Manfaat asuransi ini memenuhi syarat sebagai objek wakaf.

Abstract

The development of digital technology has a major influence on the lives of teenagers, including the emergence of negative impacts such as social media addiction, cyberbullying, hoaxes, and declining student morale. Islamic Religious Education (PAI) teachers at SMAN 1 Puri Mojokerto have a strategic role in guiding students to be able to use digital media wisely. This study aims to: 1) Describe the negative impact of digital content on students at SMAN 1 Puri Mojokerto. 2) Describe the educational actions of PAI teachers in overcoming the negative impact of digital content. Based on its form, this study uses a qualitative approach with the type of case study research. Data collection techniques include participant observation, in-depth interviews, and documentation. Data is analyzed through three stages, namely data reduction, data presentation, and conclusion/verification. The results of the study showed: 1) The negative impact of digital content on students includes social media addiction, the spread of hoaxes, cyberbullying, declining morale, and consumptive attitudes. 2) Educational actions of PAI teachers include digital ethics guidance, counseling on the dangers of negative content, the use of exemplary methods, and approaches to religious values in the use of social media. 3) The implication of these educational actions is the increase in students' awareness in filtering information and using social media more wisely. Based on the results of the study, several recommendations can be given, namely the need to increase digital literacy in the PAI curriculum and strengthen the role of PAI teachers in shaping student character in the digital era.

Abstract

Penelitian ini bertujuan untuk mendeskripsikan dan menganalisis pengaruh dari kualitas pelayanan terhadap kepercayaan dan kepuasan muzakki pada Baitul Maal Hidayatullah Pusat, baik secara parsial maupul simultan. Dari 40 sampel Amil Baitul Maal Hidayatullah Pusat Kualitas Pelayanan didapatkan hasil thitung (16.070) > ttabel (1.66) dan sig (0,000) < (0,05) artinya variabel Kualitas Pelayanan berpengaruh positif terhadap Kepercayaan Baitul Mall Hidayatullah Pusat. Dari 100 sampel Muzakki BMH Jakarta. Baitul Maal Hidayatullah Pusat Kualitas pelayanan didapatkan hasil thitung (3.415) > ttabel (1,66) dan nilai sig (0,000) < (0,05) dan artinya Kualitas Pelayanan sangat berpengaruh positif terhadap Kepuasan Muzakki Baitul Mall Hidayatullah Pusat. Baitul Maal Hidayatullah Pusat Kepuasan didapatkan hasil thitung (9.549) > ttabel (1,66) dan nilai sig (0,000) < (0,05) dan artinya Kualitas Pelayanan sangat berpengaruh positif terhadap Kepuasan Muzakki Baitul Mall Hidayatullah Pusat. Dari 100 sampel Amil Baitul Maal Hidayatullah Pusat Budaya Organisasi dan Pelatihan Kerja didapatkan hasil F hitung (164090) > F tabel ( 270) dengan nilai sig 0,000 < 0,05. Maka secara simultan atau bersamaan Kualitas Pelayanan dan kepercayaan memiliki pengaruh positif terhadap Kepuasan. Dari hasil penelitian menunjukan bahwa terdapat pengaruh dan belum berpengaruh, baik secara secara parsial maupun secara simultan variabel Budaya Organisasi dan Pelatihan Kerja terhadap Kinerja Amil dengan nilai R Square 0,382 atau memberikan pengaruh terhadapn kinerja karyawan sebesar 38,2 % dimana sisanya 61,8 % dipengaruhi oleh variabel lain yang tidak diteliti dalam penelitian ini.

Abstract

This research is a results description conducted to describe the social problem at the Melekan Manten event and the role of Mudin in reducing the social problem at the Melekan Manten event through Khataman al-Qur'an. The research is carried out by going directly into the field to investigate phenomena that appear in the real-life context. The process is by constructing phenomena based on the  obtained data and critical evaluation based on relevant theories so that the essence of events can be found to be compared to other data and with relevant theories so that their validity, robustness and suitability can be tested and concluded. The study results concluded that the social problem in the Melekan Manten event in Delik and Kedungmaling, Mojokerto, namely playing cards, betting dice and dominoes, and drinking alcoholic beverages until drunk. The role of Mudin in reducing the ill behavior of the society is to implement da'wah management through a cultural approach. The role carried out is the role of community leader and spiritual leader to invite the youth to make Khataman al-Qur'an tradition at every Melekan Manten event.
