Abstract

Defamation is one of the criminal acts that fall into the qualification of insult. Defamation is regulated in Article 310 of the Criminal Code and in Article 27 Paragraph (3) of the Electronic Information and Transaction Law. The purpose of the existence of this legal rule on defamation is to protect the dignity and dignity of every person, especially regarding the honorable self-esteem (eer) and good name (goeden naam) of a person due to the use of social media that has a negative impact. The formulation of the problem discussed in this paper is to analyze (1) The regulation of the crime of defamation in the Criminal Code and Article 27 Paragraph (3) of the Law on Information and Electronic Transactions due to the use of social media that has a negative impact. The writing method used is normative research, which is research that relies on secondary data sources as the main reference data. The results obtained from the research were concluded (1) Regulations regarding the crime of defamation are regulated in Article 27 paragraph (3) of the Law on Information and Electronic Transactions. To determine whether the defamation element in the ITE Law has been fulfilled, it must refer to Article 310 of the Criminal Code. The negative impact caused is that the use of social media itself makes adolescents lazy and rarely socializes face-to-face with others so that it has the potential to make adolescents become anti-social individuals, addiction which leads to reduced time efficiency, consumption, mental health of adolescents, affects the decline of moral values and ethics of the younger generation, decreases the quality of critical thinking of adolescents, and the ease of being influenced by information that is not yet known to be true as seen from the ITE Law issued by the government to be a guideline in the implementation of Article 27 paragraph (3) of the ITE Law which aims to create legal certainty with solutions such as setting a healthy time limit; Build awareness of the emotional impact; Develop critical skills; Provide an understanding of online privacy; Focus on offline social interactions; Implementation of the ITE Law.

Abstract

Women's rights in divorce cases are not regulated explicitly in the Compilation of Islamic Law. This, however, has an impact on the inequality that is adhered to in the principle of marriage law. The purpose of this article is how the ijtihad of judges regarding women's rights after divorce is contested and their contribution to family law reform in Indonesia. The method of analysis is carried out qualitatively, with a normative approach. Data analysis techniques use the theory of mubilah and mashlahat. The results of the study show that the consideration of the Panel of Judges ex officio punishing husbands for providing iddah and mut'ah maintenance, or other rights, departs from a new interpretation of the nusyuz concept which applies to both parties (men and women). Another consideration is based on Supreme Court Jurisprudence Number 137 K/AG/2007. The Panel of Judges is also based on the Supreme Court Circular Number 3 of 2017. Such a decision is a legal breakthrough. In the reading of mubilah, such a decision is in accordance with the principles of interdependence, especially in the concept of nusyuz. Such a decision is also in accordance with the principle of benefit. In the end, the renewal of Islamic family law in Indonesia is a necessity.

Abstract

Purpose: This study aims to examine knowledge and understanding of the implementation of the tax system, including the quality of tax services provided by authorities, and to evaluate various factors influencing taxpayer compliance in Indonesia. Methodology: A juridical and sociological legal approach is used in this study, applying descriptive-analytical methods. Data were collected from literature and relevant sources, then analyzed qualitatively by organizing information into coherent narratives to draw conclusions. Results: Low tax compliance is influenced by several factors: limited public knowledge of tax regulations, low financial literacy, insufficient public awareness campaigns, and underutilized benefits of modernized tax services. Taxpayers are often unaware of the incentives offered through compliance. Additionally, cultural variables such as the perception of tax obligations as communal ideals—shaped by justice and social responsibility—play a role. However, there is still resistance due to unfamiliarity with online administrative procedures. Conclusion: Voluntary tax compliance improves when tax policies are perceived as fair and the benefits of paying taxes are recognized. Ethical and environmental elements, particularly those embedded in Indonesia’s communal culture, significantly influence taxpayer behavior. Although legal enforcement can increase compliance, social norms have limited impact on actual tax practices. Ultimately, tax compliance directly supports national development and public welfare. Limitations: This qualitative study may reflect some degree of subjectivity, and its findings are not universally generalizable. Citations are included to minimize bias. Contribution: The study suggests simplifying tax return terminology, utilizing free tools for profiling and monitoring taxpayer behavior, and improving outreach through Business Development Services (BDS) to enhance public understanding and compliance.

Abstract

The response to changes in legal frameworks is of paramount importance, particularly in the context of Indonesia's vision for an ideal legal system grounded in Pancasila. This article asserts that legal development should be attentive to existing legal sources, with a strong emphasis on norms that have been deeply integrated into cultural contexts and local wisdom. Central to Pancasila is a humanist philosophy, primarily encapsulated in its second precept, which underpins the values embraced by Indonesian society. The principles inherent in Pancasila humanism advocate for a shared national understanding, respect for democratic freedoms, social equity, and recognition of diverse religious beliefs, all while upholding human dignity and rights. This article constructs arguments for the integration of local wisdom into the legal framework governing environmental management and protection, highlighting its crucial role in ecological preservation and the well-being of the human environment. Indigenous knowledge, characterized by principles such as non-discrimination, deliberation, honesty, and harmony, emerges as a vital source of social capital that can significantly enhance the development of environmental law from the perspective of Pancasila humanism.

Abstract

The increasing complexity of physics learning in the Industrial Revolution 4.0 era demands innovative pedagogical strategies to address students’ conceptual difficulties, particularly in abstract topics like static fluid. Misconceptions about hydrostatic pressure remain prevalent due to traditional, non-contextual instructional approaches. This study aims to compare the effectiveness of two cooperative learning models CoCoAER and Jigsaw in improving students’ conceptual understanding of static fluid and to examine students’ perceptions of both methods. A quasi-experimental design with a non-equivalent control group was applied to 90 eleventh-grade students at MAN 3 Banda Aceh, divided into CoCoAER, Jigsaw, and conventional lecture groups. Data were collected through pre-and post-tests and student response questionnaires. Results from ANOVA and N-Gain analysis indicated that the CoCoAER model significantly outperformed both the Jigsaw and lecture models (p < 0.05), with 73.3% of students showing high improvement and an average post-test score of 86. Students' satisfaction also favored CoCoAER, with 96% indicating a “very satisfied” rating, compared to 50% and 40% for Jigsaw and conventional methods, respectively. The novelty of this study lies in applying the CoCoAER model to fluid dynamics, integrating contextual learning, collaboration, and error anticipation strategies. In conclusion, the CoCoAER model offers a highly effective and student-centered approach to teaching static fluid, contributing to the reduction of misconceptions and enhancing physics learning outcomes.
