Abstract

This study aims to analyze the application of the Integrated Assessment Team (TAT) to suspects suspected of being narcotics abusers at the National Narcotics Agency (BNNK) of Langkat Regency from a juridical perspective. TAT is a mechanism formed based on Law Number 35 of 2009 concerning Narcotics, by involving medical and legal elements to provide recommendations for appropriate treatment for narcotics abusers. The procedure for implementing TAT starts from submitting an assessment application by investigators, administrative examinations, medical and legal assessments, to determining recommendations in the form of medical and social rehabilitation or follow-up legal processes. The results of the study show that the implementation of TAT at BNNK Langkat in general is in accordance with the provisions of the law, where most suspected narcotics abusers are recommended to undergo rehabilitation. However, several obstacles were still found, including the limitations of rehabilitation facilities, differences in perception between TAT elements, and public stigma against narcotics abusers. Therefore, the existence of TAT is very important to realize more humane, proportional, and fair law enforcement, while supporting rehabilitation efforts for narcotics abusers in Lalat Regency.

Abstract

The modernization of Indonesian criminal law constitutes an essential part of national legal reform efforts in responding to the development of modern society, technological advancement, and the dynamics of contemporary crime. Criminal law reform is not merely aimed at replacing the colonial legal system, but also at establishing a national legal system capable of ensuring legal certainty while providing social utility for society. This study aims to analyze the modernization of Indonesian criminal law from the perspectives of legal certainty and social utility, as well as to examine the challenges of its implementation within the national criminal justice system. The research employs a normative legal research method using statutory, conceptual, and philosophical approaches. The findings indicate that the modernization of Indonesian criminal law through the enactment of the new Criminal Code (KUHP) reflects a paradigm shift toward a more adaptive, humane, and socially justice-oriented criminal law system. Nevertheless, various issues remain in its implementation, particularly concerning the balance between legal certainty and social utility. Law enforcement that is excessively formalistic often neglects aspects of social benefit and the public sense of justice, whereas an overly flexible approach may create legal uncertainty. Therefore, the modernization of Indonesian criminal law should be directed toward the establishment of a balanced and responsive legal system capable of addressing the challenges of contemporary developments without disregarding the fundamental principles of the rule of law.

Abstract

Judicial pardon is one of the significant reforms introduced by Law Number 1 of 2023 concerning the Indonesian Criminal Code, authorizing judges to refrain from imposing criminal punishment or other legal measures even after a defendant has been lawfully proven guilty. Although this concept is intended to promote substantive justice, its regulation raises concerns regarding the limits of its application and the principle of legal certainty. This study aims to analyze the regulation of judicial pardon under the Indonesian Criminal Code, examine its application from the perspective of legal certainty, and formulate an ideal regulatory framework that ensures legal certainty while preserving judicial discretion. This research employed a normative legal research method using statutory and conceptual approaches. Legal materials were collected through library research and analyzed qualitatively using a descriptive-analytical method. The findings indicate that judicial pardon constitutes an integral part of the sentencing guidelines under the Criminal Code, yet its implementation lacks clear normative parameters, potentially resulting in inconsistent interpretation and sentencing disparity. Accordingly, clearer legal standards, implementation guidelines, and more comprehensive judicial reasoning are necessary to achieve a balanced realization of justice, legal certainty, and legal utility within Indonesia's criminal justice system.

Abstract

Restaurant Tax is a tax on services provided by restaurants for a fee, which also includes restaurants, cafeterias, canteens, stalls, bars, and the like including catering/catering services, which are regulated in North Labuhanbatu Regency Regional Regulation Number 9 of 2011 concerning Local tax. This Empirical Legal Research focuses on how is law enforcement regarding restaurant tax violations in the North Labuhanbatu District in terms of Regional Regulation Number 9 of 2011? And what are the inhibiting factors in collecting restaurant tax in North Labuhanbatu Regency? The data source used is primary data, obtained from field research and documents, and supplemented with secondary data. The results of the research conducted show that law enforcement regarding restaurant tax violations in North Labuhanbatu Regency based on North Labuhanbatu Regency Regional Regulation Number 9 of 2011 concerning Regional Taxes is still very lacking, especially criminal law enforcement in accordance with the provisions contained in this regulation.

Abstract

Drug crimes are special crimes regulated in Law number 35 of 2009 concerning Narcotics crimes. The research aims to find out the role of the Padang Lawas Police Drug Investigation Unit in handling drug crimes, what obstacles are experienced in the investigation process for handling drug crimes. The type of research used is empirical juridical research (field study). This research is descriptive in nature, the location of this research was carried out at the Padang Lawas Resort Police Drug Research Unit. The subject of this research is the police who have the authority to handle drug crimes in the Padang Lawas Resort Police Drug Investigation Unit. Data collection techniques were carried out by means of observation, interviews, document study. The research results show the role of the Padang Lawas Resort Police's drug investigation unit in accordance with Law Number 2 of 2002 concerning the Republic of Indonesia Police and Law no. 35 of 2009 concerning Narcotics Crimes, the obstacles experienced in the investigation process are,Lack of budget, inadequate facilities and infrastructure, lack of drug investigation personnel, a culture of society that still covers things up, each perpetrator being tied to each other and changing illegal crime techniques, in terms of efforts to overcome these obstacles, the Padang Resort Police Narcotics Investigation Unit Lawas making the village drug-free is a solution to minimizing the illegal circulation of drugs.

Abstract

Children are a gift from God Almighty that we must always protect because in Him the dignity and rights inherent in the whole human being must be respected and protected. Child protection is a series of activities aimed at guaranteeing and protecting children and their rights so that children can live, grow, develop and participate optimally in accordance with their dignity, human rights, and are protected from violence and discrimination. As required by the 1945 Constitution of the Republic of Indonesia, Article 28B paragraph (2). Child protection activities are legal activities with legal consequences. Therefore, there is a need for legal protection efforts for child protection activities. This research focuses on how the Integrated Service Center for the Empowerment of Women and Children (P2TP2A) in the city of Banda Aceh protects children's rights and the factors that hinder them. In this research, the research method that the author uses in this research uses empirical juridical methods and the author uses Observational Research methods. The data source for this research is analytical descriptive and comes from primary data from interviews with subjects and secondary data from books, journals, articles, theses, seminars and literature on the issues discussed in the Law. This research draws conclusions from general things to specific things. The conclusion from this research is that the efforts made by the government and the state to protect children who are victims of sexual violence are actually acceptable. However, there are several things that need to be considered in order to provide optimal protection to children as expected. Several factors that cause these difficulties include obstacles in the field which result in existing regulations appearing to be not as effective as expected.
