Abstract

AbstrakKesiapan adalah kondisi seseorang yang membuatnya siap untuk memberi respon dalam cara tertentu terhadap situasi. Penelitian ini bertujuan untuk (1) mendeskripsikan kesiapan guru kelas melaksanakan layanan bimbingan dan konseling di sekolah dasar se-Kota Padang dilihat dari aspek pengetahuan, (2) mendeskripsikan kesiapan guru kelas melaksanakan layanan bimbingan dan konseling di sekolah dasar se-Kota Padang dilihat dari aspek keterampilan, (3) mendeskripsikan kesiapan guru kelas melaksanakan layanan bimbingan dan konseling di sekolah dasar se-Kota Padang dilihat dari aspek sikap. Jenis penelitian ini adalah penelitian deskriptif kuantitatif. Populasi penelitian berasal dari guru kelas sekolah dasar (SD) se-Kota Padang berjumlah 429 orang guru kelas 4, 5 dan 6. Sampel diambil menggunakan tekhnik Cluster random sampling, sehingga didapatkan jumlah sampel sebanyak 37 orang guru kelas 4, 5, dan 6. Penelitian dilaksanakan dengan mengadministrasikan insytrumen angket. Data dianalisisi dengan analisis persentase. Temuan penelitian menunjukkan hasil kesiapan guru kelas melaksanakan layanan bimbingan dan konseling di sekolah dasar se-Kota Padang berada pada kategori baik.Kata kunci: Kesiapan guru, Bimbingan dan Konseling di SD

Abstract

AbstractPerformance is a comparison of work results achieved by employees  with predetermined standards. This study aims to   (1) describeing the performance seen from the aspects of quality and quantity (2) describeing the performance seen from the aspects of discipline. (3) describeing the performance seen from the aspect of cooperation (4) describeing the performance seen from the aspect of  personality (5) desribeing the performance seen from the aspect of respontability. This type of research is quantitative descriptive. The research subjects were employees of PT. PLN (PERSERO) Rayon LubukBasug which numbered 54 people. The instrument used were questionnaires and analyzed by percentage techniques. Research findings show that employee performance results seen from (1) aspect of quality and quantity are in good category (2) discipline aspect are in good category (3) aspects of cooperation are in good category (4) aspects of personality are in good category (5) and aspects of respontability are in good category.  Keyword: Performance

Abstract

In general, this study aims to determine the protection of the rights of workers with disabilities in obtaining employment opportunities in the city of Padang and to find out the obstacles in obtaining employment opportunities in the city of Padang and their solutions. The formulation of the problem in this research is, first, how is the protection of the rights of workers with disabilities in getting work opportunities in the city of Padang? Second, what are the obstacles in protecting the rights of workers with disabilities in getting work opportunities in the city of Padang and efforts to solve them? This study uses empirical juridical research methods. The research results obtained were, firstly, protection of the rights of workers with disabilities in obtaining employment opportunities in the city of Padang, in this case, the Government through the Padang City Department of Labor and Industry formed a Disability Service Unit (ULD), condsucted outreach, appealed, provided training and debriefing of workers with disabilities and provide workplaces for persons with disabilities who choose to work in the informal sector. Second, there are obstacles in protecting the rights of workers with disabilities in getting work opportunities in the city of Padang, including the government being unable to intervene in companies, there are no sanctions for companies that do not implement these rules, and there is no clear valid data regarding the number of workers with disabilities. . The solutions that can be given are persuasively appealing to companies to employ people with disabilities, opening training, job training, the government must give appreciation or appreciation to companies that have employed people with disabilities. The conclusion in this study is that the protection of the rights of workers with disabilities in obtaining work opportunities in the city of Padang has not been implemented properly. Abstract

The focus of this research is on organizational communication in the perspective of Islamic education that has not been effective. By using relevant literature and references, this research determines the importance of communication in Islamic educational organizations. Data was collected through Google Scholar. Verses from the Qur'an are used to illustrate the role of communication within an organization. When members of the organization know how to communicate well, then organizational communication can run smoothly. Effective communication among organization members maintains good relationships in accordance with established rules. The verses from the Qur'an serve as a basis for communication within the educational institution. This study found that communication among organization members using hierarchical positions should be well-established and consider the tasks and positions of each.

Abstract

Recommendations are suggestions from the examiner based on the results of the examination contained in the Audit Report (LHP) of the Supreme Audit Agency (BPK). Law No. 15/2004 mandates that recommendations must be followed up by responsible officials or parties. On several occasions, BPK has stated that its audit results are final and binding. A common recommendation in BPK's LHP is to return state losses to the state or regional treasury by stating the amount of money to be returned. Meanwhile, in other provisions, namely PP No. 38 of 2016 and BPK Regulation No. 3 of 2007, it is stated that the BPK audit results are one of the sources of information on the occurrence of losses, which will then be processed for imposition and compensation claims. In its provisions, all decisions arising from the process may differ from the state losses stated in the BPK's LHP. The purpose of this article is to examine the nature of the recommendations for the recovery of state losses in the BPK's LHP. This research is normative legal research with the approach of principles, cases, laws, and regulations. The results show that the BPK's recommendation is final and binding since the LHP is issued and submitted to the representative institution, so it must be followed up by providing answers and explanations to the BPK. Meanwhile, the state loss stated in the LHP BPK is not final. This is related to the authority of BPK, where the recommendation to recover state losses in the LHP BPK is not in the context of exercising the authority to calculate state losses, as well as assessing and/or determining the amount of state losses.

Abstract

Outsourced labor is a part of employment growth in various economic sectors. As part of the workforce, outsourcing workers must also receive protection for their rights as outsourcing workers. One of the things that needs to be protected is in the event of a transfer of service provider company. Therefore, it is necessary to study the protection of the rights of outsourced workers. In this case, the research was conducted at the M. Zein Painan Hospital. Outsourced workers at M. Zein Painan Hospital must be protected by Indonesian law. The study used empirical research methods by collecting data from related parties, namely outsourcing workers, service provider companies, and service users, in this case, Dr. M Zein Painan. One form of legal protection and certainty, especially for workers, is through the implementation of work agreements. Analysis and discussion of the results obtained are: (a) Forms of legal protection for outsourced workers in work agreements at RSUDi Dr. M. Zein Painan, namely protection of wages, protection of working time, and protection of rest time as well as protection against termination of employment (b) Implementation of work agreements for outsourced workers when there is a change in service provider company can be implemented well with the existence of an agreement Work.

Abstract

In Indonesia, it is known that there is a hierarchy of statutory regulations, known as the hierarchy of statutory regulations, which is based on the provisions of Article 7 paragraph (1) of Undang-Undang Nomor 12 Tahun 2011. This hierarchy of laws and regulations has the consequence of the provision that lower laws and regulations must not conflict with higher laws and regulations. Regional regulations as part of statutory regulations are also subject to this hierarchical concept. To guarantee the concept of hierarchy, it was then determined that there would be harmonization of regional regulations which were standardized in Undang-Undang Nomor 12 Tahun 2011, which was last amended by Undang-Undang Nomor 13 Tahun 2022. However, the provisions for the harmonization process contained in the Law were not accompanied by the establishment of implementing regulations that discussed in detail the procedures and methods for harmonization. This article will discuss further the position of the harmonization process for regional regulations in theory and how the process of harmonizing regional regulations is implemented in practice in Indonesia. So it is hoped that in the future recommendations will be able to be formulated for the process of harmonizing regional regulations which will make a positive contribution to efforts to overcome overregulation in the region.

Abstract

This study aims to find a solution or policy in the case of the termination of the Senior High Officials (Regional Secretary of West Pasaman Regency) by Civil Service Officers (Regent of West Pasaman Regency). The Regional Secretary of West Pasaman Regency who was terminated then filed a lawsuit to Padang Administrative Court (PTUN Padang) which court stating that the decision that termination was invalid, so the Terminated Official had the right to be reinstated. The court decision could not be implemented and came to a dead end because the position had also been filled by another Official (the new Regional Secretary of West Pasaman Regency) by the merit system according to the State Civil Apparatus Law (ASN Law) which was elected by the Committee. The selection of the leaders of the Primary High Offices are based on the recommendations of the State Civilian Bureaucracy Commission (KASN). This research was conducted using a sociologic and juridical method that analyzes the application of laws and regulations. The results showed that the termination of the Regional Secretary of West Pasaman Regency in terms of authority was in accordance with the regulations but in terms of procedural the Regent did not follow the provisions contained in the Civil Servant Discipline Regulation because the tenure of the regional secretary was less than 2 years without any summons, but immediately issued a Termination Letter based on the recommendation from the Inspectorate and the Governor of West Sumatra. Implications of the reappointment of Manus Handri as regional secretary based on the court decision which states that the termination of the regional secretary is illegal, but cannot be implemented because the new regional secretary has been elected based on KASN recommendations during the process of resolving Manus Handri's lawsuit at court. Termination and reinstated are difficult to be implemented because there are unclear provisions on how long the Human Resources Officer can reinstate terminated Officials who submit their cases to the Court. Therefore, there must be clear provisions in Law Number 30 Year 2014 and / or in Law Number 5 Year 1986 concerning the position of Officials who challenge the Decree on Transfer or termination during the trial process until the court's decision has permanent legal force. There should be a clause so that the Civil Service Officer (PPK) does not fill a new official with a position that is currently being processed in court.

Abstract

Secara psikologis, anak bukanlan miniatur orang dewasa, namun anak adalah suatu subyek yang masih dalam tahap perkembangan dengan kapasitas yang rawan, yang mana berkaitan dengan hubungan sebab akibat antara pemenuhan dan perlindungan akan hak hidup, hak bertahan hidup, hak tumbuh dan berkembang anak, yang mana juga termasuk hak untuk mendapatkan perlindungan dari kekerasan dan diskriminasi. Perlu ditekankan bahwa hak untuk hidup tidak bisa dilepaskan dengan hak atas kelangsungan hidup, dan hak untuk tumbuh dan berkembang. Terutama bagi anak-anak yang masih dalam masa pertumbuhan dan perkembangan, dimana setiap luka, kerusakan, atau mengurangi hak anak untuk kelangsungan hidup akan mengakibatkan suatu akibat yang serius dan fatal terhadap kondisi anak. Kecenderungan untuk membawa anak ke peradilan anak, mengakibatkan anak akan selalu menjadi target kriminalisasi. Jadi tidak boleh dibawa ke pengadilan jika tidak perlu. Hal ini tentu saja tidak hanya mempengaruhi anak secara fisik, tetapi juga psikologis. Sistem pemidanaan edukatif yang berlaku di Indonesia saat ini belum seperti yang diharapkan. Perlindungan anak yang dikualifikasikan sebagai seorang kriminal benar-benar harus mendapatkan perhatian serius dari pemerintah. Anak yang berkonflik dengan hukum dalam posisi anak sebagai seorang kriminal yang membutuhkan perlindungan dan keamanan membutuhkan perlindungan khusus yang menjamin kepentingan anak.

Abstract

Penelitian ini mengkaji implementasi pelayanan publik administrasi perkawinan di Kantor Urusan Agama (KUA) Kecamatan Medan Tembung, dengan fokus pada tantangan yang dihadapi dan solusi yang diterapkan. Menggunakan pendekatan studi kasus kualitatif, data dikumpulkan melalui observasi, wawancara mendalam dengan petugas KUA dan pengguna layanan, serta analisis dokumen. Temuan menunjukkan bahwa pelayanan administrasi perkawinan menggabungkan sistem manual dan digital, dengan penerapan aplikasi ELSIMIL sebagai inovasi digital yang belum sepenuhnya optimal. Tantangan utama meliputi keterbatasan pemahaman masyarakat terhadap aplikasi digital, fasilitas yang kurang memadai, serta beban kerja petugas yang tinggi dengan pengembangan sumber daya manusia yang masih perlu ditingkatkan. Penelitian ini juga menyoroti peran penting sumber daya manusia dan partisipasi masyarakat dalam meningkatkan kualitas pelayanan. Untuk mengatasi permasalahan tersebut, KUA telah melakukan pelatihan SDM, meningkatkan pemanfaatan aplikasi digital, dan memperbaiki fasilitas pelayanan. Penelitian ini memberikan kontribusi empiris baru terkait adaptasi pelayanan administrasi keagamaan di era digital pada tingkat pemerintahan lokal, serta melanjutkan kajian terdahulu mengenai administrasi kesejahteraan dan tantangan pelayanan publik.
