Abstract

At this time globalization has penetrated the dynamics of human life and brought changes that essentially point to the problem of unbalanced regulation of human life in law and a sense of human justice. In everyday life we often hear people demanding justice, because they feel they have received unfair treatment. This can occur between citizens and the government, or perhaps also between individuals and their groups or because there are differences in the fulfillment of personal rights and so on. Justice is closely related to attitudes and relationships with fellow human beings because justice demands that every human being be treated as they are done. The problem is How is the nature of law and justice related to the philosophy of law and How is the form of justice pursued by judges? The method used in writing this paper is normative juridical, which is an approach based on law as the main material, the research specification used is descriptive analytical, which is research that aims to provide an overview of justice in Indonesia. While the data sources are secondary and primary data through primary field studies used as supporting data or supporting secondary data. From the research, the results were obtained: The nature of law and justice is very relative, because from which side we look at it there is a negative that law and justice are something that is not heavy after there are also those who say that justice is not necessarily found with field results and the form of justice in this case can be done by judges and rulers by trying to comply with laws and regulations and a sense of public justice, but judges are ordinary human beings who can make mistakes. Mistakes can occur due to inadvertence and can also be made can arise from people who are deliberate, this is what will plunge humans. True justice is the justice of Allah SWT.

Abstract

Submission:2025-04-21Review:2025-05-17Accepted:2025-05-22Publish: 2025-5-31ABSTRACT: National development aims to create a prosperous, just, and equitable society, both materially and spiritually, based on Pancasila and the 1945 Constitution. Efforts to improve public services include health, narcotics, psychotropics, and other addictive substances. Drug crimes are generally not committed by individuals alone, but rather collectively, even by organized, well-organized, and highly secretive syndicates. Furthermore, drug trafficking is transnational in nature, carried out using sophisticated methods and technology. To combat drug abuse, the government has issued Law No. 5 of 1997 concerning Psychotropics and Law No. 22 of 1997 concerning Narcotics. Law No. 22 of 1997 has been revoked and replaced by Law No. 39 of 2009. Abstract

The general definition of adolescents is our young people who are still considered children, for example, if we look at it from the perspective of the general understanding or stance of society, usually their ages are between 13 and 15 years (unmarried). And when viewed in terms of age, they may seem like adults, but in terms of behavior they actually still have a lot to learn, both through parental education and experiences in life. If we look at the contents of the Civil Code, Article 330 explains that those categorized as minors are those who are 21 years old and even then must have never been married. From other aspects such as religious and customary in general, those who are considered adults are those who have menstruated if a woman and if a man has ejaculated while unconscious, his voice changes to a high pitch. Meanwhile, in the Criminal Code in Article 45, it is regulated that those who are considered minors are those who are under 16 years old. The sheer number of differing opinions, as outlined above, demonstrates the importance of understanding the concept of children and adolescents. This is because it is closely related to the judicial process or the handling of crimes committed by these children and adolescents.
