Abstract

The determination of 1 Syawal is a significant issue in the Islamic calendar, closely related to the observance of religious rituals among Muslims. In this context, rukyatul hilal (crescent moon sighting) has been the primary method employed since the time of the Prophet Muhammad. This study aims to analyze the opinion of Imam al-Shafi’i regarding the determination of 1 Syawal based on the testimony of rukyatul hilal, as documented in his works, particularly in Kitab al-Umm, and to explore its relevance in the modern context. This research adopts a qualitative approach with a descriptive analytical method and is conducted as a library study. The findings show that Kitab al-Umm is one of the primary legal sources in the Shafi’i school, providing a normative foundation for the determination of lunar months, particularly 1 Syawal, by prioritizing the testimony of rukyatul hilal. Imam al-Shafi’i affirms that the sighting of the moon is a valid basis for declaring a new month, even if performed by a single just person. In the modern era, his perspective remains relevant and can be harmonized with the hisab (astronomical calculation) approach through the principle of taḥqīq al-manāṭ in contemporary ijtihad, supporting transparency and accuracy without disregarding the requirements of Islamic law.The implications of this study indicate that Imam al-Shafi’i’s thought remains highly relevant in contemporary discourse, particularly in preserving the authority of rukyat as a legitimate Islamic method. Despite the increasing complexity posed by technological developments in hisab and variations in religious authority, the Shafi’i approach offers a foundational framework for constructing an integrated system for determining the beginning of lunar months—one that combines traditional and modern methods while remaining grounded in authentic Islamic legal principles.

Abstract

Digital transformation has significantly reshaped the evidentiary system within the Indonesian judiciary, particularly through the recognition of electronic evidence such as emails, chats, and digital documents. This shift raises critical issues regarding the legitimacy and limitations of such evidence from the perspective of Islamic law, which traditionally relies on the concept of bayyinah. This study aims to analyze the validity and boundaries of electronic evidence by employing the legal maxim L? yunkaru taghayyur al-a?k?m bi taghayyur al-zam?n as an analytical framework. The research adopts a normative qualitative method with approaches rooted in usul al fiqh, statutory analysis, and conceptual examination. Data sources include classical and contemporary Islamic legal texts, legal maxims, statutory regulations, and relevant academic literature. The findings indicate that electronic evidence can be accepted as valid within Islamic law by positioning it as a form of modern qarinah, provided it meets criteria of authenticity, integrity, and relevance. However, such acceptance is not absolute, as it must remain within the boundaries of justice and public interest. Therefore, a structured evaluative framework is essential to ensure that the use of electronic evidence aligns with the fundamental objective of achieving truth and justice.

Abstract

This study aims to analyze islamic legal philosophy as a conceptual framework that explains the nature, objectives, and relevance of islamic law in addressing the challenges of modern society. The research employs a library research method with a qualitative-descriptive and analytical approach through the examination of classical and contemporary literature on islamic law, legal theory (uṣūl al-fiqh), and maqāṣid al-sharī‘ah. The findings reveal that islamic legal philosophy is a reflective discipline integrating the ontological, epistemological, and axiological dimensions of islamic law. Its primary objectives are embodied in the concept of maqāṣid al-sharī‘ah, which seeks to protect religion, life, intellect, lineage, and property, while promoting public welfare and justice. The study further demonstrates that islamic legal philosophy remains highly relevant in responding to contemporary issues such as human rights, democracy, and digital technological development through adaptive and contextual ijtihād. Therefore, islamic legal philosophy may be positioned as a dynamic, rational, and future-oriented paradigm for legal development.

Abstract

This study aims to examine the actualization of the philosophical meaning of sulapa eppa in choosing leaders in Bugis society. This research is qualitative in nature. The research design is a literature review. The results of this study indicate that the actualization of sulapa eppa in political ethics is inseparable from pangadereng, which is implemented in rapang, specifically discussed in rapang tana. Rapang tana is a norm that regulates the pattern of life of the Bugis people in governing their country, where the Bugis people uphold ethics in politics. Political ethics in Bugis society encompass values and principles that are highly regarded in participating in political life. The following are some of the political ethics commonly applied by the Bugis people. The Bugis people value honor and integrity in politics. They expect politicians to act honestly, fairly, and without corruption. This ethic emphasizes the importance of maintaining reputation and public trust. The Bugis people value fair and just leadership. They expect political leaders to fight for the interests of the community equally and not favor certain groups.

Abstract

This study uses a qualitative approach with a desk research approach and a normative analysis of jurisprudence proposals. Data were obtained from classical literature of the endowment of jurisprudence, rules of jurisprudence, as well as contemporary sources such as scientific journals and halal fatwas. The results of the study show that the rules of certainty do not go away by siyak, provide a strong epistemological basis for determining the law of the origin of food sweetness, so that doubts without strong evidence cannot cancel out the halal status that was previously believed. This rule is relevant in answering the problem of modern culinary consumption that is full of siofat elements, while emphasizing the importance of verification through halal certification and wisdom (ihtiat).
