Abstract

Indonesia merupakan sebuah Negara hukum, yang dimana pada masa pandemi covid-19 ini mengeluarkan kebijakan terkait Vaksinasi yang tertuang di dalam Peraturan Menteri Kesehatan Nomor 84 Tahun 2020 tentang Pelaksanaan Vaksinansi dalam Rangka Penanggulangan Pandemi Corona Virus Disease 2019 (covid-19). Tujuan penelitian ini adalah untuk mengetahui apakah sudah tepat lahirnya kebijakan terkait vaksinasi yang tertuang di dalam Permenkes Nomor 84 Tahun 2020, serta bagaimana pelaksanaannya menurut perspektif teori sistem hukum. Penelitian ini menggunakan pendekatan yuridis empiris yang dimana dalam melaksanakan penelitian mengamati bagaimana bekerjanya hukum di masyarakat. Kemudian metode yang digunakan untuk menganalisis data ialah dengan metode deskriptif analitis, dan dalam mengumpulkan data yaitu melalui wawancara dan observasi secara langsung mengenai implementasi kebijakan di lapangan. Hasil penelitian menunjukkan bahwa lahirnya kebijakan vaksinasi di tengah pandemi covid-19 yang tertuang di dalam permenkes nomor 84 tahun 2021 dalam perspektif teori sistem hukum adalah sudah sesuai sebagaimana teori-teori hukum yang dikemukakan oleh L. M. Friedman maupun Gustav Radburch.

Abstract

The emergence of the Job Creation Act, one of the aims of creating employment opportunities. In general, the administrative licensing process in Indonesia is a barrier to business transformation. Many licensing processes do not have clear protocols, demanding, lack transparency, and costly. So that the fundamental transformation in the Job Creation Law is the transformation of the business licensing paradigm in Indonesia. Switch from the traditional license-based licensing approach to risk-based licensing. This research aims to reveal how risk-based licensing actually is and what problems can arise in licensing when risk-based licensing is applied. This is a doctrinal study that takes a conceptual and legal approach. The analysis is in the form of primary, secondary, and tertiary legal materials. The data and materials collected were analyzed qualitatively and described by descriptive analysis. This paper concludes that risk-based licensing relies more on a thorough risk analysis. In the implementation of risk-based licensing, the regulator assesses several factors such as business activities, business performance history, and the risk management system in place. Based on these matters, the regulator then places business actors into several groups, according to the level of risk. Risk-based licensing, on the other hand, has a couple of problems. The first issue is ambiguous risk assessment as a result of the omnibus legislative format. Second, the volatile risk hasn’t been taken into account. Third, neither cumulative nor systemic risks have been taken into account. Fourth, there are unanticipated implementation challenges. Finally, there is the possibility of regulatory capture.

Abstract

In general, the product of legislation is a work that is normative. So that everything that is normative is open to legal deviations. This potential deviation from the law will create what is called a legal error (legal gap). Therefore, this paper aims to formulate the character of legal products that are responsive and participatory (democratic) in the reform era. This paper is a library research or normative legal research. The approach used is a normative juridical approach. Data sources such as primary legal materials related to the issue of law formation. While secondary legal materials such as books, journals, and all secondary materials related to the focus of the study. The analysis uses the doctrinal method. This paper concludes that the responsive and participatory character of legal products in the reform era requires a public space that is free from the interests of political elites and power. There needs to be civil society involvement in the formation of laws and regulations, starting from the stage of drafting academic texts to public notification before the ratification of the legislation.Pada umumnya produk legislasi merupakan sebuah karya yang bersifat normatif. Sehingga semua yang bersifat normatif ini terbuka sekali terjadinya penyimpangan-penyimpangan hukum. Potensi penyimpangan dari hukum ini akan mencipatakan apa yang disebut sebagai kekosongan hukum (legal gap). Oleh karena itu, tulisan ini bertujuan merumuskan karakter produk hukum yang responsif dan partisipatif (demokratis) dalam era reformasi. Tulisan ini merupakan penelitian kepustakaan (library research) atau penelitian hukum normatif. Pendekatan yang digunakan adalah pendekatan yuridis normatif. Sumber data seperti bahan hukum  primer yang terkait dengan isu pembentukan hukum. Sedangkan bahan hukum sekunder seperti  buku, jurnal, dan semua bahan sekunder yang terkait dengan fokus kajian. Analisis menggunakan metode doktrinal. Tulisan ini menyimpulkan bahwa karakter produk hukum yang responsif dan partisipatif dalam era reformasi diperlukan ruang publik yang bebas dari kepentingan elit politik dan dominasi kekuasaan. Perlu adanya keterlibatan masyarakat (civil society) dalam pembentukan peraturan perundang-undangandari menyusun naskah akademik hingga mengadakan public hearing sebelum undang-undang disahkan

Abstract

Penelitian ini mempelajari pengaruh penambahan partikel grafit sebagai penguat terhadap kemampuan material removal rate( MRR) dan electrode relative wear (ERW) dari komposit Cu-Fe sebagai elektroda EDM yang dibuat dengan metode metalurgi serbuk. Grafit sebesar 0 wt%, 2,5 wt%, 5,0 wt%, dan7,5 wt% ditambahkan pada Cu-1wt% Fe. Tiap komposisi serbuk dicampur dengan menggunakan mixing rotator kemudian dikompaksi menjadi green body menggunakan uniaxial pressing single action, kemudian disinter dengan horizontal tube furnace dalam lingkungan gas argon. Pengujian MRR dan ERW dilakukan pada mesin EDM Genspark 50P dengan polaritas normal dan besar arus 10 A. Untuk menentukan komposisi komposit paling optimum dan ekonomis, digunakan metode kuota dan hasil kemampuan MRR terbaik sebesar 0.037g/menit dan ERW terkecil 29,12 % dicapai oleh komposit dengan komposisi 5 wt% grafit yang dikompaksi pada tekanan 650 MPa dan disinter pada temperatur 870 ºC.

Abstract

To handle a specific criminal act, a justice collaborator is greatly required. The concept and term of justice collaborator is something new in Indonesia. This method is practically used to eradicate an organized crime. Both conceptual and statutory approaches were used in this research. Juridical-normative techniques were implemented to descriptively explain the existing problems. This research aimed to deeply and conceptually examine justice collaborator’s position and function in the perspective of Human Rights to protect and provide special treatments to the main actors in cooperating with law enforcement officials (justice collaborators) against an organized crime. The position of justice collaborator either as a witness or suspect to provide information in court and then used as a judge's consideration is to mitigate the sentence to be imposed. This collaboration can provide various benefits, so that law enforcement officials can fight against serious criminal acts. Thus, a justice collaborator has a specific rule (lex specialis derogerat lex generalis) to guide law enforcers, such as police officers, prosecutors, and judges to uncover a specific crime committed by a syndicate deliberately violating laws in very systematic and organized ways.

Abstract

Law Number 13 of the Year 2012 on Yogyakarta Special Region’s privileges containing a legal affirmative democracy system leads to the weakening of democracy and has implications for non-substantive democracy. It furthermore reflects the normative ambiguity of the democratic system which legitimizes Yogyakarta’s privileged affairs. Therefore, this research aims to analyze Yogyakarta’s privileged affairs based on Islamic Law Eclecticism by reconstructing the democratic system in Law Number 13. Using the normative-doctrinal method accompanied by statutory and conceptual approaches, this research used the content analysis method and legal descriptive techniques. This research shows that the democratic system of DIY is crystallized and simultaneously presented in the form of the Trilogy of Yogyakarta Democratic Principles. Those consist of ngencengke oyot, ngencengke pang, and njagani godhong lan kembang. Based on this, the reconstruction of the democratic system of Yogyakarta’s privilege affairs leads to communal democracy as a form of revitalizing its privilege affairs. Besides, that trilogy, based on Islamic Law Eclecticisms, refers to the interconnection of maqâṣid al-syarī’ah cum-rechtsidee and al-‘urf. The reconstruction of the democratic system in Law Number 13 potentially revitalizes Yogyakarta’s privileged affairs by making local wisdom its core value.

Abstract

This research aimed to analyse where the legal politics concerning outsourcing in Indonesia's legal system by scrutinizing its regulation in Book III of the Civil Code and enforcement of the Government Regulation in lieu of Law concerning Job Creation Law Number 6/2023, with its following implication to protect workers at the national level. This research employed doctrinal legal research on legal instruments related to outsourcing with statutory, conceptual, and historical approaches. The research showed that legal politics concerning outsourcing had experienced dynamic congruence with the political configuration when the legislative product on outsourcing was made. The differences emerge where outsourcing is not restricted to certain occupations in Book III of the Civil Code of Indonesia. However, Law Number 13/2003 restricted the definition of outsourcing to occupations not related to core businesses. Law Number 11/2020 and Government Regulation Number 35/2021 fit employers. Both laws govern the legal protection for outsourced employees with the transfer of undertaking to protect employment regarding changing vendors with the condition that the jobs are still available. Meanwhile, the type of work outsourced is unlimited, resulting in a deficit compared to the previous norm.

Abstract

Upacara adat Ceprotan merupakan salah satu budaya lokal di Indonesia khususnya dari daerah Pacitan tepatnya di Desa Sekar, Donorojo yang masih eksis hingga saat ini. Ironinya budaya lokal kini mulai tergerus karena adanya era globalisasi yang mengubah gaya hidup modern serta minimnya generasi penerus bangsa yang enggan melestarikan budaya lokal. Dengan saling mengenalkan budaya lokal ke masyarakat luas serta generasi penerus, maka budaya bisa tetap lestari dan hidup. Berdasarkan hal tersebut pencipta terdorong untuk mengekspresikan serangkaian acara Upacara Adat Ceprotan melalui bentuk karya seni lukis. Tujuan penciptaan ini untuk mengenalkan Upacara Adat Ceprotan kepada masyarakat melalui bentuk sebuah karya seni lukis dekoratif dengan mengangkat tentang Upacara Adat Ceprotan yang selalu dilaksanakan setahun sekali pada bulan Longkang (DzulQa'idah) hari Senin Kliwon. Metode penciptaan penelitian ini menggunakan metode dari Alma Hawkins yang terdiri atas tiga tahapan yaitu eksplorasi, improvisasi, dan pembentukan. Karya lukis yang dihasilkan berjumlah 6 karya yang memvisualkan bagaimana proses awal hingga akhir dalam pelaksanaan Upacara Adat Ceprotan. Karya seni ditampilkan sebagai upaya pelestarian serta pengenalan budaya kepada masyarakat luas khususnya kepada generasi penerus bangsa. Kata kunci: upacara adat Ceprotan; seni lukis; kebudayaan Ceprotan Traditional Ceremony as a Source of Painting Inspiration The Ceprotan traditional ceremony is one of the local cultures in Indonesia, especially from the Pacitan area, precisely in Sekar Village, Donorojo which still exists today. The irony is that local culture is now starting to be eroded due to the era of globalization that has changed modern lifestyles and the lack of future generations who are reluctant to preserve local culture. By introducing each other to local culture to the wider community and the next generation, the culture can remain sustainable and alive. Based on this, the creator was compelled to express a series of Ceprotan Traditional Ceremony events through the form of painting. The purpose of this creation is to introduce the Ceprotan Traditional Ceremony to the public through the form of a decorative painting by raising the Ceprotan Traditional Ceremony which is always held once a year in the month of Longkang (DzulQa'idah) on Monday Kliwon. The method of creating this research uses the method of Alma Hawkins which consists of three stages, namely exploration, improvisation, and formation.
