Abstract

This study aims to determine the factors that influence changes in the legal awareness of the community and nazhir in Bantul Regency towards the paradigm of fixed object waqf towards progressive waqf. The type of research is a field study. The method uses descriptive qualitative juridical data analysis. The primary data is conducted by interviewing the respondents with purposive sampling. The results showed that three determinant factors influenced the progressive waqf paradigm: 1) Public understanding of waqf property was limited to fixed objects (unmovable objects). 2) Public understanding of the allocation of waqf property is limited to educational and worship facilities. 3) Public understanding of the waqf reward is limited to education and worship.

Abstract

This article examines how the Besan Bali marriage tradition in the Muslim community of Banjarnegara and an overview of Islamic law. This type of research is a field research, using qualitative methods with a qualitative descriptive approach. The interview method was used to obtain direct data from the informants. The types of data are primary and secondary data. The results of this study show that the Besan Bali marriage tradition is a tradition of prohibition in marriages that occur between two brothers (besan) that someone who wants to hold a marriage is hindered if the-bride-to-be comes from the Besan family where previously her brother was married to her groom-to-be’s family and vice versa. If it is reviewed based on Islamic law, the prohibition of Besan Bali marriage is actually not in accordance with Islamic teachings, because the reason for the prohibition of Besan Bali marriage is not in accordance with Islamic teachings.

Abstract

The development of national law must be built through the process of discovery, development, and adaptation of Indonesian volkgeist as well as compromises with various laws that exist and live in the society. The development of national law covers several aspects including: the development of legal material, apparatus as well as infrastructure and facilities of Pancasila as the noble values and become the basis for the life of the nation and state. Therefore, the values in Pancasila must also be used as the foundation of our country in the development of national law, especially in the development of legal material and apparatus.

Abstract

This article aims to examines the implementation of government affairs. So that it excludes regi­ons to get involved directly and independently in order to manage and fight for the interests of the­ir regions. Therefore, the issue of authority relations is related to how to determine the house­hold affairs of the autonomous regions. Thus, the effort to find the ideal form of relationship between the center and the regions within the framework of a unitary state is not an easy problem to find. However, in the author's perspective, the relative autonomy model is a better choice of models to create a pattern of authority relations between the central government and regional governments

Abstract

Dalam perspektif etika lingkungan, manusia harus memperlakukan alam tidak semata-mata dalam kaitannya untuk kepentingan dan kebaikan manusia. Nilai-nilai etika Islam seharusnya berorientasi untuk mengembangkan kesadaran bahwa pelestarian lingkungan juga untuk kepentingan seluruh makhluk yang berimplikasi pada terwujudnya konsep ekonomi hijau (green economics) dan implementasi etika bisnis Islam terhadap green economy dalam pengaturan lingkungan hidup di Indonesia. Metode penelitian yang digunakan  adalah pendekatan yuridis normatif, sedangkan sifat penelitiannya adalah diskriptis analitis. Hasil penelitian menunjukkan bahwa: 1) Islam tidak memandang aktivitas bisnis hanya dalam tataran kehidupan dunia sebab semua aktivitas dapat bernilai ibadah jika dilandasi dengan aturan-aturan yang telah disyariatkan Allah. Etika bisnis Islam adalah tuntutan yang harus dilaksanakan oleh pelaku bisnis dalam menegakkan konsep keseimbangan ekonomi. Bisnis yang berdasarkan etika akan menjadikan sistem perekonomian akan berjalan secara seimbang. 2) Implementasi green economy adalah implementasi energi terbarukan, green economy merupakan rezim ekonomi yang mampu meningkatkan kesejahteraan manusia dan kesetraan sosial, dan sekaligus mengurangi resiko lingkungan secara signifikan, dikarenakan green economy  adalah perekonomian yang rendah karbon dan tidak menghasilkan emisi serta polusi lingkungan, hemat sumber daya alam, dan berkeadilan sosial.

Abstract

Indonesia merupakan sebuah Negara hukum, yang dimana pada masa pandemi covid-19 ini mengeluarkan kebijakan terkait Vaksinasi yang tertuang di dalam Peraturan Menteri Kesehatan Nomor 84 Tahun 2020 tentang Pelaksanaan Vaksinansi dalam Rangka Penanggulangan Pandemi Corona Virus Disease 2019 (covid-19). Tujuan penelitian ini adalah untuk mengetahui apakah sudah tepat lahirnya kebijakan terkait vaksinasi yang tertuang di dalam Permenkes Nomor 84 Tahun 2020, serta bagaimana pelaksanaannya menurut perspektif teori sistem hukum. Penelitian ini menggunakan pendekatan yuridis empiris yang dimana dalam melaksanakan penelitian mengamati bagaimana bekerjanya hukum di masyarakat. Kemudian metode yang digunakan untuk menganalisis data ialah dengan metode deskriptif analitis, dan dalam mengumpulkan data yaitu melalui wawancara dan observasi secara langsung mengenai implementasi kebijakan di lapangan. Hasil penelitian menunjukkan bahwa lahirnya kebijakan vaksinasi di tengah pandemi covid-19 yang tertuang di dalam permenkes nomor 84 tahun 2021 dalam perspektif teori sistem hukum adalah sudah sesuai sebagaimana teori-teori hukum yang dikemukakan oleh L. M. Friedman maupun Gustav Radburch.

Abstract

The emergence of the Job Creation Act, one of the aims of creating employment opportunities. In general, the administrative licensing process in Indonesia is a barrier to business transformation. Many licensing processes do not have clear protocols, demanding, lack transparency, and costly. So that the fundamental transformation in the Job Creation Law is the transformation of the business licensing paradigm in Indonesia. Switch from the traditional license-based licensing approach to risk-based licensing. This research aims to reveal how risk-based licensing actually is and what problems can arise in licensing when risk-based licensing is applied. This is a doctrinal study that takes a conceptual and legal approach. The analysis is in the form of primary, secondary, and tertiary legal materials. The data and materials collected were analyzed qualitatively and described by descriptive analysis. This paper concludes that risk-based licensing relies more on a thorough risk analysis. In the implementation of risk-based licensing, the regulator assesses several factors such as business activities, business performance history, and the risk management system in place. Based on these matters, the regulator then places business actors into several groups, according to the level of risk. Risk-based licensing, on the other hand, has a couple of problems. The first issue is ambiguous risk assessment as a result of the omnibus legislative format. Second, the volatile risk hasn’t been taken into account. Third, neither cumulative nor systemic risks have been taken into account. Fourth, there are unanticipated implementation challenges. Finally, there is the possibility of regulatory capture.

Abstract

In general, the product of legislation is a work that is normative. So that everything that is normative is open to legal deviations. This potential deviation from the law will create what is called a legal error (legal gap). Therefore, this paper aims to formulate the character of legal products that are responsive and participatory (democratic) in the reform era. This paper is a library research or normative legal research. The approach used is a normative juridical approach. Data sources such as primary legal materials related to the issue of law formation. While secondary legal materials such as books, journals, and all secondary materials related to the focus of the study. The analysis uses the doctrinal method. This paper concludes that the responsive and participatory character of legal products in the reform era requires a public space that is free from the interests of political elites and power. There needs to be civil society involvement in the formation of laws and regulations, starting from the stage of drafting academic texts to public notification before the ratification of the legislation.Pada umumnya produk legislasi merupakan sebuah karya yang bersifat normatif. Sehingga semua yang bersifat normatif ini terbuka sekali terjadinya penyimpangan-penyimpangan hukum. Potensi penyimpangan dari hukum ini akan mencipatakan apa yang disebut sebagai kekosongan hukum (legal gap). Oleh karena itu, tulisan ini bertujuan merumuskan karakter produk hukum yang responsif dan partisipatif (demokratis) dalam era reformasi. Tulisan ini merupakan penelitian kepustakaan (library research) atau penelitian hukum normatif. Pendekatan yang digunakan adalah pendekatan yuridis normatif. Sumber data seperti bahan hukum  primer yang terkait dengan isu pembentukan hukum. Sedangkan bahan hukum sekunder seperti  buku, jurnal, dan semua bahan sekunder yang terkait dengan fokus kajian. Analisis menggunakan metode doktrinal. Tulisan ini menyimpulkan bahwa karakter produk hukum yang responsif dan partisipatif dalam era reformasi diperlukan ruang publik yang bebas dari kepentingan elit politik dan dominasi kekuasaan. Perlu adanya keterlibatan masyarakat (civil society) dalam pembentukan peraturan perundang-undangandari menyusun naskah akademik hingga mengadakan public hearing sebelum undang-undang disahkan

Abstract
