Abstract

The Assignment of members of the Indonesian National Army and the National Police of the Republic of Indonesia active as acting regional heads by the Minister of Home Affairs reaped polemics. Law Number 10 of 2016 concerning Regional Elections even though it has clearly regulated the filling of vacancies in the positions of governor, regent and mayor, where acting (Pj.) are appointed from the position of intermediate leaders for the Acting Governor and primary leaders for the Acting Regent and Mayor. However, the Minister of Home Affairs issued Minister of Home Affairs Regulation Number 4 of 2023 concerning Acting Governors, Regents and Mayors as a reference to fill the position of Acting Regional Head. Article 3 paragraph (b) of Permendagri Number 4 of 2023, contains norms stating that the acting regional head is from an ASN official or an official in a certain ASN position who occupies JPT Madya within the Central Government or within the Regional Government for candidates for Pj. Governor and occupies JPT Pratama within the Central Government or within the Regional Government for candidates for Pj. Regent and Pj. Mayor. Therefore, there is an addition of position criteria and an expansion of meaning in Permendagri Number 4 of 2023 which then becomes a gap and opportunity for the Minister of Home Affairs to appoint active TNI and Polri members to become Acting (Pj.). The formulation of the problem in this study is: (1) How is the validity of the appointment of members of the Indonesian National Army and members of the Negatra Police of the Republic of Indonesia active as Acting Regional Heads? (2) What are the criteria for the ideal official who can be appointed as Acting Regional Head? (3) What is the ideal mechanism for appointing and appointing acting regional heads to fill regional head vacancies ahead of the 2024 simultaneous regional elections? This research is a normative legal research or literature, with the research specifications used are analytical descriptive research. The results of this study are: (1) The appointment of members of the Indonesian National Army and active members of the Indonesian National Police to become Acting Regional Heads is not legally positive Indonesia at this time. (2) The position of the official who should be appointed as Pj. Regional Head shall be JPT Madya within the Central Government or within the Regional Government. (3) the ideal mechanism for the appointment and appointment of acting regional heads is to involve the people through the Senators so that the appointed PJ. still has legitimacy from the people.

Abstract

Based on Article 67 letter b of Law Number 23 of 2014 concerning Regional Government, it is explained that the Regional Head as a State Administrative Officer has an obligation to comply with all provisions of the Legislative Law including Decisions issued by the State Administrative Court. In Decision Number 11/G/2020/PTUN.PDG Regarding Dismissal of Wali Nagari Kinari by the Regent of Solok and Decision Number 23/G/2018/PTUN.PDG Concerning Dismissal of the West Pasaman Regional Secretary by the West Pasaman Regent there are forms of non-compliance committed by the Head Regions as State Administrative Officials, among others, do not revoke disputed TUN Decrees, do not revoke and do not issue new TUN Decrees. The absence of the application of strict sanctions and the low level of awareness of the TUN officials concerned are factors in the non-implementation of PTUN decisions that have permanent legal force by the Regional Head. The Administrative Court's procedural law has regulated sanctions against TUN bodies/officials who do not comply with PTUN decisions, but these arrangements are not concrete because they still depend on implementing regulations which have not been realized until now, this condition provides an opportunity for officials to disobey PTUN decisions because there is no things to worry about if you don't comply. This situation is one of the factors for weak law enforcement in Indonesia.

Abstract

Children are very vulnerable to becoming victims of crime, many children are targets of acts of violence. In Padang city violence against children in 2021 there was 63 cases of violence recorded. Based on Article 59 paragraph (1) of Law Number 35 of 2014 concerning Child Protection, local governments are obliged to provide protection for child victims. This research focuses on two issues, First: How is the legal protection of child victims of violent crimes committed by DP3AP2KB Padang City, Second: How is the implementation of legal protection for child victims of violent crimes committed by DP3AP2KB Padang City.This study uses empirical juridical research methods with analytical descriptive characteristics. Sources were obtained from interviews, reports and documents. Secondary data comes from related laws and regulations, articles, journals, and internet sites. The results of the research, First, the legal protection carried out by DP3AP2KB is to provide consulting services and legal process assistance to ensure the fulfillment of children's rights so that they can recover and be able to carry out social functions in their environment, social field. Second, the implementation of legal protection for child victims of violent crimes by DP3AP2KB experienced several obstacles, namely a lack of human resources, a lack of special experts such as child clinical psychologists and a lack of budget, facilities and infrastructure. so it must coordinate with other agencies.

Abstract

The fulfillment of workers' rights in the form of health insurance is a program in accordance with the mandate of the Constitution. Realized through Law of the Republic of Indonesia Number 40 of 2004 concerning the National Social Security System regulates the basic rights to a sense of security owned by workers /employees. Among them, the right to welfare includes health insurance programs, work accident insurance (JKK), death insurance (JKM), and old age insurance (JHT). The formulation of the problem in this study is: 1). How is the arrangement or protection of health insurance for private workers with probation status or probation period in Padang City?, 2) Factors that play a role in fulfilling the right to health insurance for workers with probation status or probation period in Padang City?. This research uses normative juridical methods that focus their studies by viewing law as a complete system, including a set of legal principles, legal norms, and legal rules, in this study in addition to using secondary data also using empirical data, but does not eliminate the nature of this research as normative research. The results of this study are: 1) Non-implementation of the Law and all regulations governing health insurance for private workers with Probation status in general, 2) There must be a policy issued by the government strictly regarding the sanctions given if workers do not get health insurance.

Abstract

Criminal activities in the labor industry are illegal acts carried out by laborers, employers, or other persons not affiliated with the firm that face criminal penalties under the Criminal Code, Manpower Law, and/or other legislation, either alone or in combination. In the course of Civil Servant Investigators' criminal inquiries in the labor sector. The Manpower and Transmigration Service (Disnakertrans) employs Civil Servant Investigators who carry out their work in accordance with the Law Number 13 of 2003 concerning Manpower and the Regulation of the Chief of the National Police of the Republic of Indonesia Number 6 of 2010 concerning Investigation Management by Civil Servant Investigators (PPNS). Both laws provide authority for their operations. It seems sense in this instance that PPNS Disnakertrans's inquiry is coordinated with the police as well. One of the issues preventing the inquiry from operating at its best in its execution is the ineffective coordination. The following issues may be created based on the backdrop of the aforementioned difficulties: 1. How are criminal investigations in the area of labor being carried out by Civil Servant Investigators (PPNS) of the Manpower and Transmigration Office of West Sumatra Province? 2. What are the challenges facing the Civil Servant Investigators (PPNS) of the Manpower and Transmigration Office of the Province of West Sumatra in carrying out criminal investigations in the area of labor? Based on the study's descriptive methodology and empirical juridical approach, the following conclusions may be drawn from it: 1. The implementation of criminal investigations in the field of labor by PPNS Disnakertrans is a series of: examination, processing of crime scenes, Sprindik, SPDP, examination of witnesses and suspects, completion and submission of Case Files to be submitted by PPNS to the public prosecutor through police investigators. 2. The obstacles experienced by PPNS Disnakertrans in carrying out criminal investigations in the field of labor are the lack of supervisors and PPNS both in quantity and quality. In addition, the lack of facilities and infrastructure as well as limited budget are obstacles in the investigation. SOPs that are not fully implemented and lack of coordination between PPNS and the Police as Korwas are obstacles found in the implementation of criminal investigations in the field of labor. For better implementation of investigations, PPNS Disnakertrans West Sumatra must be able to improve coordination with Police Investigators. In addition, Disnakertrans is expected to be able to overcome internal obstacles so that the enforcement of criminal acts in the labor sector can run even better.

Abstract

Health services lead to health development which aims to achieve awareness, will, and the ability to live healthy for every resident in order to achieve optimal public health status as aspired to in Law Number 36 of 2009 concerning Health. In terms of optimal health services, it is certainly expected to create professional health workers in carrying out their profession, especially dentists. However, in carrying out medical practice, it is possible for a dentist to commit medical crimes that have an impact on the patient's health. Where medical negligence that results in disruption of patient health can result in disruption of medical health between doctors and patients. But not infrequently in terms of legal protection and in solving medical problems there are significant obstacles to solving legal problems. So to answer this problem, it is necessary to know the form of patient legal protection for the existence of medical justice by dentists and how to settle medical settlements between patients and their families and doctors based on the provisions in force in health law. The research method used is descriptive normative research. The results of the study revealed First, that legal protection for patients due to dentist negligence has been specifically accommodated in several laws related to health, but this legal protection has not run optimally because there are still massive obstacles originating from the legal substance of the legal structure and legal culture. who have not been able. Second, the causes for the medical settlement are qualified into three things, namely due to the absence of medical negligence, medical failure and medical malpractice, then in terms of the settlement of medical settlements it has not run optimally either through non-litigation or litigation, therefore the need for a Medical Dispute Settlement Court (PSSM) which specifically resolves cases related to health law in Indonesia.

Abstract

The leadership of the Regional People's Representative Council (DPRD) can be dismissed at any time before their term of office ends, as happened in Solok Regency, Bukittinggi City and West Pasaman Regency. The three DPRD Chairmen were dismissed from their positions before the end of their terms of office. The problem in this research is what are the arrangements and procedures for dismissing the chairman of the district/city Regional People's Representative Council according to the relevant laws and regulations and whether the dismissal of the Chairman of the Regional People's Representative Council is in accordance with the governing regulations. This research aims to determine the arrangements for dismissing the chairman of the district/city DPRD according to relevant laws and regulations during his term of office according to regional government regulations, the mechanism for dismissing the Chair of the DPRD and the legal consequences of dismissing the Chair of the DPRD during his term of office on the implementation of the functions and duties of the DPRD in accordance with the problem formulation and the planned research objectives, the method used in this research is empirical juridical. The research results show that: there are two types of procedures for dismissing the chairman of the district/city Regional People's Representative Council, namely, through a proposal from a political party or through a complaint to the Honorary Board of the district/city Regional People's Representative Council. Research carried out in three regions, can be concluded that first the dismissal of the chairman of the district DPRD. Solok could not be carried out because there was not enough evidence of violating the code of ethics, while the dismissal of the Chairman of the Bukittinggi City DPRD could not be carried out after the Padang PTUN decision which stated that Parizal Hafni as Chairman of the Bukittinggi City DPRD won his lawsuit against DPP Gerindra and finally the dismissal of the Chairman of the District DPRD. West Pasaman can be implemented because it is in accordance with existing procedures/mechanisms.

Abstract

Proses penyelidikan kasus dugaan pelanggaran disiplin dan kode etik profesi Polri (KEPP) yang dilakukan oleh oknum kepolisian di wilayah kerja Polda Sumbar yang dilaksanakan oleh Unit Subbidpaminal mengacu kepada Pasal 9 s/d Pasal 27 Perkadiv Nomor 1 tahun 2015 tentang Standar Operasional Prosedur Penyelidikan Pengamanan Internal Di Lingkungan Kepolisian Negara Republik Indonesia dilakukan dalam beberapa tahapan yang meliputi perencanaan, pengumpulan, pengolahan dan pelaporan. Permasalahan dalam tesis ini adalah 1) Bagaimanakah penegakan disiplin dan kode etik profesi Polri di Polda Sumbar? 2) Aspek-aspek apa saja yang berkaitan dengan peran Sub Bidang Pengamanan Internal Bidpropam Polda Sumbar dalam penetapan hasil penyelidikan dugaan pelanggaran disiplin dan kode etik profesi Polri? 3) Bagaimanakah cara mengoptimalkan peran Sub Bidang Pengamanan Internal Bidpropam Polda Sumbar dalam menetapkan hasil penyelidikan dugaan pelanggaran disiplin dan kode etik profesi Polri? Metode yang dipakai adalah metode pendekatan yuridis empiris atau sosiologis dengan tipe penelitiannya yaitu deskriptif dengan menggunakan data primer dan data sekunder. Hasil Penelitian dan pembahasan memperlihatkan bahwa: 1) Penegakan disiplin dilakukan dengan memperhatikan prinsip legalitas, profesionalistas, proporsionalitas, akuntabilitas dan tidak diskriminatif. Setiap penegakan disipilin terhadap anggota polri sudah sesuai dengan standar operasional proses prosedur yang berlaku dalam lingkungan polri. Penegakan disiplin dan Kode Etik Profesi Polri (KEPP) yang telah dilaksanakan di wilayah hukum Polda Sumbar. 2) Aspek yang berkaitan dengan peran Subbidpaminal Bidpropam Polda Sumbar dalam penegakan hukum terkait penyelidikan terhadap dugaan pelanggaran disiplin dan pelanggaran KEPP dipengaruhi oleh faktor internal dan eksternal, diantaranya adalah: sumber daya manusia, sarana atau fasilitas, anggaran dan masyarakat. 3) Pengoptimalan peran Subbidpaminal Bidpropam Polda Sumbar dalam menetapkan hasil penyelidikan dugaan pelanggaran disiplin dan KEPP dilakukan melalui strategi sebagai berikut: a) Meningkatkan jumlah personel Polri b) Mengadakan kendaraan operasional dan peralatan komunikasi handy talky (HT) sesuai kebutuhan c) Menyiapkan anggaran sesuai kebutuhan d) Menyusun tata cara terkait proses pengaduan yang dilakukan pelapor ke instansi kepolisian dan sosialisasi.

Abstract

Bentuk upaya negara dalam memberikan pelayanan kesehatan kepada warga negara Indonesia diwujudkan melalui penyelenggaraan Program Jaminan Kesehatan Nasional (JKN) yang dikelola oleh Badan Penyelenggara Jaminan Sosial Kesehatan (BPJS Kesehatan). Pemerintah terus berupaya meningkatkan mutu pelayanan kesehatan dengan melakukan pembaruan aturan dan kebijakan, salah satunya adalah perubahan skema kelas rawat inap yang sebelumnya terbagi menjadi kelas 1, 2, dan 3 menjadi kelas rawat inap standar. Penelitian ini bertujuan untuk mengetahui dan menganalisis pengaturan Kelas Rawat Inap Standar BPJS Kesehatan serta hak pasien dalam menentukan pelayanan kesehatan yang diperlukan dalam konteks Kelas Rawat Inap Standar tersebut. Metode yang digunakan adalah penelitian hukum normatif, yaitu dengan menganalisis peraturan perundang-undangan dan data hukum sekunder lainnya untuk menarik kesimpulan. Hasil penelitian menunjukkan bahwa Kelas Rawat Inap Standar merupakan standar minimum pelayanan yang diterima oleh peserta BPJS Kesehatan berdasarkan 12 kriteria yang harus dipenuhi oleh rumah sakit menuju kelas tunggal. Penerapan standar ini mencerminkan prinsip sosial dan ekuitas dalam penyelenggaraan jaminan kesehatan nasional. Namun, pelaksanaan ini dinilai belum sepenuhnya sesuai dengan tanggung jawab negara dalam menyediakan fasilitas pelayanan kesehatan yang layak, sehingga setiap individu dapat mencapai derajat kesehatan yang optimal. Pasien, sebagai penerima layanan kesehatan, memiliki hak untuk memilih fasilitas kesehatan yang diperlukan secara mandiri dan bertanggung jawab, sebagaimana diatur dalam undang-undang tentang kesehatan.

Perbedaan luasan terhadap HGU No. 4 Kabupaten Agam atas nama PT Mutiara Agam yang semula seluas 8.625 Ha (delapan ribu enam ratus dua puluh lima hektar) menjadi 6.067,79 Ha (enam ribu enam puluh tujuh koma tujuh puluh sembilan hektar) pada saat perpanjangan haknya. Salah satu penyebabnya karena terkena ketentuan PIPPIB seluas 405,8 Ha (empat ratus lima koma delapan hektar). Namun area PIPPIB tersebut dapat dikeluarkan dari ketentuan PIPPIB dengan adanya pengajuan permohonan klarifikasi terhadap areal PIPPIB oleh PT Mutiara Agam. Namun belum ada harmonisasi hukum antara Standar operasional prosedur (SOP) dalam pengurusan permohonan perpanjangan Hak Guna Usaha dan SOP permohonan klarifikasi PIPPIB di Kementeriann Lingkungan Hidup dan Kehutanan. Dengan menggunakan metode penelitian hukum empiris dengan menggunakan data primair yang diperoleh dengan cara mewawancarai Dinas Kehutanan Provinsi Sumatera Barat, Kantor Wilayah Badan Pertanahan Nasional Provinsi Sumatera Barat dan PT Mutiara Agam dan juga menggunakan data sekunder berupa dokumen terkait permasalahan dimaksud. Dari hasil Penelitian diperoleh:1) Mengapa terjadi perbedaan luas lahan Hak Guna Usaha (HGU) No. 4/Kabupaten Agam atas nama PT Mutiara Agam semula seluas 8.625 Ha menjadi 6.067,79 Ha pada saat perpanjangan Hak Guna Usaha 2) Penyelesaian perbedaan luas lahan pada Hak Guna Usaha (HGU) No. 4/Kabupaten Agam atas nama PT Mutiara Agam berdasarkan Amar ke 11 dan 12 Keputusan Menteri Lingkungan Hidup Dan Kehutanan No.SK.7594/MSNLHK-PKTL/IPSDH/PLA.1/9/2022 dan Surat Direktur Inventarisasi dan Pemantauan Sumber Daya Hutan Direktorat Jenderal Planologi Kehutanan dan Tata Lingkungan Kementerian Lingkungan Hidup dan Kehutanan Nomor S.1568/IPSDH/PSDH /PLA.1/12/2022 Tanggal 14 Desember 2022, sehingga dalam prakteknya terdapat disharmonisasi hukum antara Standar operasional prosedur (SOP) dalam pengurusan permohonan perpanjangan Hak Guna Usaha dan SOP permohonan klarifikasi PIPPIB di Kementeriann Lingkungan Hidup dan Kehutanan.
