Abstract

The absence of a legal theory that holistically integrates the four pillars legal certainty, substantive justice, social utility, and public participation, poses a key challenge in addressing the complexities of modern law, which is increasingly pluralistic and dynamic. This study aims to formulate and evaluate the Integrative-Tetradic Realism Theory as a new legal paradigm. Using a normative juridical method with a conceptual approach and theory-comparison techniques, the research develops a comprehensive and systematic synthesis relevant to contemporary legal dynamics. The results show that Integrative-Tetradic Realism offers a holistic and transformative paradigm, addressing limitations of classical theories such as positivism, natural law, realism, and Critical Legal Studies. By integrating normative, sociological, philosophical, and practical dimensions, and emphasizing its four pillars, this theory provides an adaptive framework that balances legal structures, moral values, social contexts, and public participation. It aims to create a legal system that is normatively valid, just, contextual, and responsive to societal changes. Acting as a bridge between ideal law and empirical reality, it offers a conceptual foundation for inclusive, ethical, and functional legal reform in modern society.

Abstract

This study examines consumer protection efforts against the distribution of hazardous illegal traditional herbal medicines in Serang City, Banten. The widespread circulation of such products—particularly those containing Chemical Drugs (Bahan Kimia Obat/BKO) and lacking distribution permits—poses a significant threat to public health. Between 2020 and 2025, the Inspection Division of the Food and Drug Monitoring Agency (BBPOM) in Serang secured and destroyed approximately 706 items, totaling 6,841 units, with an estimated economic value of IDR 91,158,350. The research focuses on two main issues: the mechanisms for protecting consumers from dangerous illegal traditional herbal medicines in Serang City, and the role of BBPOM in supervising their circulation. Employing an empirical juridical method with a qualitative-descriptive approach, the study collected data through literature reviews, documentation, and interviews with BBPOM Serang officials. The findings indicate that consumer protection is carried out through both preventive and repressive measures. Preventive efforts involve pre-market and post-market supervision to ensure that products meet safety and regulatory standards before and after they enter the market. Repressive actions include law enforcement against violations, confiscation and destruction of illegal products, and the imposition of administrative and criminal sanctions on offenders. BBPOM Serang plays a pivotal role in monitoring illegal herbal medicines by conducting regular inspections, surveillance, and investigations of production and distribution facilities, as well as educating the public about the dangers of unsafe products. Nevertheless, supervision efforts are hindered by challenges such as low public awareness regarding product safety and economic pressures that drive some producers and sellers to ignore legal requirements. Strengthening collaboration between regulatory agencies, law enforcement, and community stakeholders is essential to improving consumer protection and ensuring the circulation of safe traditional herbal products in the region.

Abstract

Advances in information technology have led to significant changes in the way people conduct buying and selling transactions, with digital agreements through e-commerce platforms becoming more commonplace. This study aims to evaluate the legality, binding force, and legal protection afforded to digital agreements between sellers and buyers in e-commerce transactions, in accordance with applicable Indonesian law. The method used in this study is normative juridical with a qualitative approach, emphasizing the analysis of laws and regulations such as the Civil Code (KUHPerdata), the Electronic Information and Transactions Law (UU ITE), and the Consumer Protection Law. The research findings indicate that digital agreements in e-commerce have the same legal force as traditional agreements provided they meet the requirements for a valid agreement, namely agreement, capacity of the parties, a clear object, and a legitimate cause. However, the implementation of digital agreements faces several challenges, such as issues of identity of the parties involved, electronic proof, and consumer protection from the risk of contract failure and fraud. Therefore, it is necessary to strengthen regulations, improve digital understanding, and develop adaptive dispute resolution mechanisms so that the principles of legal certainty and consumer protection can be optimally realized in digital transactions.

Abstract

Article 37 Minister of Health Regulation No. 06 of 2012 regulates the prohibition of the use of medicinal chemicals in traditional medicine, however in the field traditional medicines are still found that contain medicinal chemicals. In the 2022-2023 period in Surakarta, 571 items of traditional medicine were found containing medicinal chemicals. The problem that will be discussed in this research is how to regulate the circulation of traditional medicines containing medicinal chemicals and forms of consumer protection for traditional medicines containing medicinal chemicals in Surakarta. This research is empirical research using a sociological and legislative approach. This research is qualitative in nature where data is collected through interviews which are then analyzed descriptively. From the research results, it was concluded that there are regulations regarding the distribution of traditional medicines, but these regulations have not been effectively implemented in the community. Apart from that, it is known that the POM Center in Surakarta has provided legal protection for consumers of traditional medicines containing medicinal chemicals. The form of protection provided is in the form of pre-market and post market regarding the distribution of traditional medicines, apart from that it also provides sanctions to producers who violate the provisions.

Abstract

This research addresses persistent challenges in Indonesia’s agribusiness sector, including limited access to information, climate change, market fluctuations, and unequal technological adoption. The study aims to design a public innovation model integrating digital education to foster a sustainable agribusiness ecosystem. Employing a qualitative descriptive method, data were obtained through an extensive literature review of scholarly works, policy documents, and reports from international organizations. Thematic analysis and triangulation were applied to identify patterns, challenges, and best practices. The resulting model, Agro-EduHub 5.0, is a community-based hybrid platform linking education, smart farming technology, digital marketing, and multi-stakeholder collaboration. Key features include a hybrid governance model, hyperlocal AI language support, NFT-based incentives, predictive policy dashboards, creative economy villages, agricultural incubators, and CSR-led pilot projects. These innovations address the digital divide, enhance local adaptability, and encourage environmentally friendly practices. The model fosters active participation, cultural relevance, and policy responsiveness, strengthening both resilience and farmer empowerment. It concludes that implementing Agro-EduHub 5.0 through pilot regions and a digital agribusiness consortium will accelerate technology adoption, integrate local wisdom, and promote shared value creation between public and private sectors, ultimately supporting inclusive and sustainable agribusiness transformation.

Abstract

The main problem in this research is that the conventional legal system, which is primarily punitive, often fails to provide fair and holistic redress for both victims and offenders, thereby creating a gap between formal justice mechanisms and the social justice needs of local communities such as those in Pemalang. The purpose of this study is to analyze the strategies employed by Law Office & Associates “Solidaritas” Pemalang in implementing restorative justice as an alternative legal model that emphasizes reconciliation, community participation, and the restoration of social harmony. This study uses a descriptive-analytical method with qualitative analysis, combining literature review, participatory observation, interviews, and documentation to systematically examine the strategies, challenges, and impacts of restorative justice implementation by Law Office & Associates “Solidaritas” Pemalang. The research findings show that the restorative justice strategy of Law Office & Associates “Solidaritas” Pemalang reflects a progressive and participatory legal approach inspired by Marshall, Zehr, and Daly, emphasizing the restoration of social relations and empowerment of marginalized groups. Through mediation, consultation, and empathy-based assistance, the office addresses community needs effectively, fostering trust, awareness, and peaceful dispute resolution. Its success highlights law as social service rather than punishment. To enhance this role, recommendations include capacity building, systematic documentation, stronger collaborative networks, community legal education, and advocacy for supportive regulations, ensuring restorative justice becomes a sustainable and legitimate model.
