Abstract

Penelitian ini mengkaji implementasi Undang-Undang Nomor 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia (UU PPMI) di Kabupaten Sragen melalui peran Dewan Pimpinan Wilayah Himpunan Advokat Nahdlatul Ulama (DPW HIMANU) Jawa Tengah. Sebagai salah satu daerah kantong migran terbesar, Sragen menghadapi beragam persoalan, mulai dari penipuan agen ilegal, pekerja non-prosedural, hingga kontrak kerja yang merugikan. Hasil penelitian menunjukkan bahwa DPW HIMANU Jateng berperan penting tidak hanya dalam pendampingan litigasi, tetapi juga dalam edukasi hukum, mediasi berbasis komunitas, hingga penyuluhan hukum yang menyasar desa-desa migran. Implementasi UU PPMI melalui HIMANU terbukti mampu mengubah pekerja migran dari subjek pasif menjadi aktor kritis yang memperjuangkan haknya, sehingga perlindungan hukum bersifat substantif dan inklusif. Namun, tantangan seperti keterbatasan sumber daya, lemahnya koordinasi antarinstansi, dan resistensi pihak tertentu masih menjadi hambatan. Oleh karena itu, dukungan lintas sektor sangat diperlukan untuk memperkuat efektivitas UU PPMI di tingkat daerah.

Abstract

Social media in the digital era is like a double-edged sword: on one side, it facilitates communication, but on the other, it can cause harm, particularly when children become victims of cyberbullying. This research focuses on Legal Protection for Children Victims of Cyberbullying on Social Media based on Law No. 19 of 2016 concerning Electronic Information and Transactions (EIT Law) and the Child Protection Law, with a case study of Court Decision No. 71/Pid.Sus/2023/PN Pdl. The background of this study lies in the increasing number of cyberbullying cases that result in serious psychological impacts, such as depression and decreased academic motivation.The objective of this research is to describe the forms of legal protection provided under both laws and to examine their implementation in the verdict of the Pandeglang District Court. The methodology employed is normative and empirical juridical research, involving literature review, analysis of statutory regulations, and examination of related court decisions. The findings indicate two types of legal protection. Preventive protection is carried out through digital education and legal literacy, while repressive protection is implemented through law enforcement as stipulated in Article 27 paragraph (3) of the EIT Law and Articles 59 and 76C of the Child Protection Law. However, its implementation still encounters obstacles, particularly in the process of evidence and the lack of psychological rehabilitation for victims. In conclusion, although the legal framework already exists, the effectiveness of legal protection for children who are victims of cyberbullying remains limited. Optimization is required through collaboration among law enforcement, the enhancement of digital education, and the strengthening of social empathy. After all, in today’s world, “a single mistyped finger can land you in court faster than in a thesis revision session.”

Abstract

Latar belakang: Kanker merupakan penyebab kematian kedua (setelah kecelakaan) pada anak usia 5 hingga 14 tahun. Kanker dapat menyebabkan masalah psikososial berupa kecemasan yang nantinya akan menimbulkan masalah psikologis yang berdampak pada masa dewasa.Tujuan: Mengetahui hubungan jenis kanker terhadap kecemasan anak dengan kanker yang akan menjalani kemoterapi di RSUD Dr. Moewardi Surakarta .Metode: Penelitian ini menggunakan desain cross sectional. Pengambilan sampel dengan metode consecutive sampling dengan jumlah sampel sebanyak 51. Alat ukur menggunakan kuesioner yang telah diuji validitas dan reliablitas oleh peneliti sebelumnya yaitu berupa kuesioner kecemasan oleh Aidar (2011) dengan nilai dengan analisis cronbach alpha 0,862Hasil: Uji statistik menunjukan bahwa tidak ada hubungan bermakna jenis kanker dengan kecemasan p=0,168.Kesimpulan: Tidak ada hubungan bermakna jenis kanker dengan kecemasan pada anak kanker yang menjalani kemoterapiKata Kunci : kecemasan anak, jenis kanker, anak kanker

Abstract

Kemajuan teknologi yang semakin pesat memudahkan kita untuk mengakses berbagai hal menggunakan internet, salah satunya yaitu berbelanja online di platform e-comerce. Perkembangan ini memberikan dampak positif dan dampak negatif. Seperti memajukan perekonomian, serta bagaimanakah peran hukum terhadap melindungi konsumen online. Dalam peneltian ini bertujuan untuk mengetahui bagaimana perlindungan konsumen dalam dunia e-comerce. Penelitian ini menggunakan metode pendekatan yuridis normatif dan deskriptif. Hasil penelitian ini menunjukkan bahwa secara keseluruhan, masyarakyat cenderung menganggap belanja online sebagai bagian yang penting dan semakin terintegrasi dalam gaya hidup modern. Dan berdasarkan aturan Undang-undang Nomor 8 Tahun 1999, dan Undang-undang Nomor 27 Tahun 2022 tentang perlindungan konsumen dan perlindungan data pribadi.

Abstract

Penelitian yang dilakukan ini bertujuan untuk mengetahui kondisi harga bahan pokok di pasar untuk mengetahui peran pemerintah dalam menjaga stabilitas harga bahan pokok. Metode penelitian ini menggunakan metode pengumpulan data kualitatif, dengan melakukan wawancara dan observasi terhadap Pemerintah Kelurahan Jetis. Dari hasil penelitian menunjukkan bahwa Kondisi harga bahan pokok di Pasar terjadi fluktuatif namun cenderung stabil, karena kenaikan/penurunan harganya tidak terlalu signifikan. Peran Pemerintah Desa dengan mengawasi roda perekonomian seperti mengecek ketersediaan barang, keakuratan alat ukur pedagang, masa kadaluarsa dan barang tak layak jual, dan juga melakukan pencatatan harga sembako untuk dikirimkan kepada Bappeda yang selanjutnya dipublikasikan kepada masyarakat.

Abstract

The absence of a model that simultaneously integrates the social, legal, and health dimensions hinders efforts to build community resilience in the era of global health crises. This study develops the Integrative Tridomain Model (Social–Legal–Health) to design comprehensive interventions that sustainably strengthen community resilience amid global health crises. Employing a conceptual approach with a descriptive orientation, this research constructs the Integrative Tridomain Model through a systematic synthesis of cross-disciplinary literature to broaden the understanding of community resilience in the context of global health emergencies. The findings indicate that the development of the Integrative Tridomain Model marks a paradigmatic leap in conceptualizing and fostering community resilience during global health crises. The model offers an epistemological synthesis that unites social, legal, and health knowledge; an ontological framework that perceives resilience as a systemic and relational entity; and an axiological foundation that prioritizes humanitarian values, justice, and sustainability as its core objectives. By merging the strengths of these three domains, the model not only addresses existing challenges but also shapes a more adaptive and inclusive order, enabling communities to endure and thrive in the face of complex and recurrent uncertainties.

Abstract

This study aims to find out the judge's considerations in decision Number 40/Pid.B/2020/PN Wno and to find out the decision in case Number 40/Pid.B/2020/PN Wno in terms of positive law in Indonesia. The type of research used in this study is normative legal research or library research with 3 approaches, namely the statutory approach, the case approach and the conceptual approach. The results of this study indicate that the basis for the judge's considerations in imposing a sentence on the case referred to in the judge's decision Number 40/Pid.B/2020/PN Wno is juridical in nature consisting of the public prosecutor's indictment, witness testimony, defendant's statement, evidence, and Apart from that, the articles in the criminal code are non-juridical in nature, namely the reason for the defendant's actions and the consequences of the defendant's actions. That the crime of abortion has violated the provisions of Article 346 of the Criminal Code, this can be seen because the elements in accordance with that article have been fulfilled. Because of the above considerations, the judge decided that the defendant was found guilty so that the defendant had to serve a prison sentence of 1 year and 10 months.

Abstract

Illegal motorbike and car racing behavior in the city of Surakarta has disturbed the public. Illegal racing behavior has been categorized as a social pathological condition so that it needs to be dealt with immediately to prevent more victims from falling. Illegal racing is carried out by teenagers without paying attention to traffic regulations, not using established motorbike safety standards (not wearing helmets, jackets and leg protectors, full exhaust, no mirrors, no number plates). Illegal racing seriously endangers the safety of the perpetrators and surrounding road users. Illegal racing is usually done at night. The aim of this research is to find out the general picture of illegal racing in real terms and to find out how criminal law is enforced against perpetrators of illegal motorbike or car racing at the Surakarta Police Traffic Unit. This research method uses normative legal research methods using qualitative data analysis. The results of the research show that the majority of illegal racing activities in the city of Surakarta are carried out by teenagers who want to show their identity and share their hobby of driving but do not pay attention to traffic regulations, resulting in irregularities and unlawful acts as well as a lack of knowledge among teenagers about traffic regulations. Enforcement of criminal law against illegal racing activities is carried out with preventive and repressive measures. Factors that influence the effectiveness of law enforcement are legal factors, law enforcement factors, facility factors, community factors and cultural factors. It is hoped that the existence of law enforcement and outreach to juvenile perpetrators of illegal racing can minimize the existence of illegal racing activities in the city of Surakarta.

Abstract

The rapid development of the times not only creates a need related to clothing, food and shelter, but also creates other needs in the form of beauty needs. This is the reason many business actors have begun to switch to offering services in the beauty sector.  There is an overlap regarding the duties and authority of nurses who perform invasive actions in the practice of independent surgery.  This study utilizes a normative legal method as its research foundation in examining beauty salons in Indonesia. This method is known for its emphasis on analyzing written legal norms and related references concerning regulations on beauty and aesthetics. Actions taken by nurses without the supervision of a doctor can be considered a violation of the applicable law. Thus, it is important for the government and consumer organizations to continue to supervise and control beauty salon practices in order to ensure that the services provided comply with consumer health and safety standards. This supervision is also important to prevent unnecessary invasive actions that could potentially harm consumers.

Abstract

Amicus Curiae, or friends of the court, is an important instrument in constitutional proceedings in Indonesia even though it does not yet have a standard legal basis. This study discusses the authority of Amicus Curiae in providing additional information, enriching the judge's consideration, and supervising the proceedings of the Constitutional Court. The method used is the literature study approach, which is a research method whose series of research is related to the method of collecting library data, or research whose object of research is studied through various literature information, such as: books, journals, articles and documents. Amicus Curiae is filed in the form of a written document containing legal arguments and other relevant analysis. The Constitutional Court has the authority to reject Amicus Curiae that are judged irrelevant or filed with improper motives. On the other hand, a quality Amicus Curiae can have a positive influence on the decisions of the Constitutional Court and contribute to law enforcement and democracy in Indonesia. Amicus Curiae has not been clearly regulated in Indonesia, but in principle it is accepted under article 5 paragraph 1 of the Law on Judicial Power "Judges and constitutional judges are obliged to explore, follow and understand the legal values and sense of justice that live in society. Furthermore, the confession of the Amicus Curiae can be found in article 180 paragraph 1 of the Code of Criminal Procedure which states that "In the event that it is necessary to clear up the sitting of the matter arising in court, the presiding judge of the trial may request expert testimony and may also request to submit new material by the interested person.
