Abstract

Brand infringement case between POSKOTA owned by PT. Media Anatarkota Jaya and POSKOTACO owned by PT. Millennial Voice Media is listed in Court Decision No. 39 /Pdt.Sus-Merek/2022/PN Niaga Jkt.Pst, PT. Media Anatarkota Jaya (POSKOTA) as the aggrieved party sued for the cancellation of the PT. Media Suara Millenial (POSKOTACO). The object of the case in the decision is trademark infringement which is the same. The panel of judges granted the plaintiff's claim and ordered the defendant to cross out and cancel the registration of the POSKOTACO Mark. The purpose of this research is to find out the legal protection for trademarks that have been registered and the legal consequences of trademark equality disputes and to analyze the Decision of Court Decision No. 39 /Pdt.Sus-Merek/2022/PN Niaga Jkt.Pst. The approach method in this journal research is normative juridical by studying the Trademark Law and relating it to practice in the field. The results of this journal writing research are that brand owners who feel aggrieved due to parties who commit equality violations can apply for trademark cancellation based on the reasons in Articles 20 and 21 of Law Number 20 of 2016 Concerning Marks and Geographical Indications. The legal basis for the judge's consideration in deciding the trademark cancellation case is based on Article 76 jo. Article 20, Article 21 of Law Number 20 of 2016 concerning Marks and other relevant regulations.

Abstract

In its implementation, the General Meeting of Shareholders (GMS) is recorded in the form of meeting notes in the form of a notarial deed and/or backhand deed which is then recorded in the form of a deed. This research method uses a sociological legal approach. The purpose of this study was to determine the role of a notary in making the decision deed of the General Meeting of Shareholders (GMS) of a limited liability company in the city of Semarang. From the results of the examination, the notary is not involved in the decision- making process of the GMS. The task of a notary in making a deed of the decision of a meeting of shareholders of a company is very limited, such as in making a party deed, the notary is only limited to pouring it into a legalized deed.

Abstract

The development of technology, information and communication in the era of society 5.0 makes notaries have to be able to keep up with their ability to provide the best legal services, the best solution for notaries in facing the challenges of changing times is to implement cyber notaries and remote notaries, but this is not immune from the clash of the Indonesian legal system. Things that need to be considered are the reasons why Indonesia has not implemented it, such as the suitability of the application of long distance notaries and cyber notaries from common law to the Indonesian legal system, namely civil law and legal reasons that prevent them from being applied.

Abstract

A person certainly has bad traits, one of the bad traits is that in the case of gambling, psychologically he is more afraid of the reality that will be faced when dealing with the police than of the punishment that will be imposed by the judge if he is caught in the act. Gambling according to Islamic law does not receive heavy sanctions such as intentional murder or adultery. Although gambling is still a sin for the perpetrators. The aim of this research is to compare the criminal provisions for gambling perpetrators in terms of positive Indonesian criminal law with Islamic criminal law. This research method is normative legal research, namely conducting a study of literature related to the research object. The criminal provisions for gambling players viewed from the positive criminal law aspect are that the criminal threat for online gambling players is heavier when compared to conventional gambling players. The criminal provisions for gambling perpetrators viewed from the aspect of Islamic law are that there are great sins and several benefits for humans, but the sins are greater than the benefits. At this time, everyone has the potential to gamble online. Thus, a special approach is needed from a religious perspective to prevent these unlawful acts

Abstract

Many credit capital is used as a way to develop a business or start a business. However, there are quite a few that can save credit from various problems. So there needs to be a solutionconcrete way to overcome the problem of blacklisted bad credit. The main problem of this research is about the policy of the Bank Rakyat Indonesia Gondosari Kudus Unit in resolving bad credit for blacklisted MSMEs and how to implement the policy for resolving bad credit for blacklisted MSMEs. This research uses empirical juridical methods. This study aims to determinepImplementation of policies for resolving bad credit for MSMEs that are blacklisted and how the policy of the Indonesian People's Bank, Gondosari Kudus Unit regarding resolving bad loans of blacklisted MSME debtors.Resolving blacklisted bad credit can be done by submitting a credit agreement restructuring application. Furthermore, settlement can also be done through the Bank Indonesia Dispute Resolution Agency. The last is settlement through court. Settlement through court is the stage of resolving bad credit which is carried out through legal channels.

Abstract

Disciplinary education is an educational process that aims to help students grow and develop attitudes of discipline, obedience and respect in everyday life. Implementing discipline in schools is certainly not enough to just rely on the learning process in the classroom, but there needs to be a special team tasked with enforcing student discipline. This aims to ensure that the application of discipline is more controlled both when students are in class and outside of class, so that students will get used to being disciplined in carrying out any activity. Given this phenomenon, the aim of this research is to find out whether the School Discipline Enforcement Team (TPDS) program has a positive impact on student behavior at Ar-Ruhul Jadid Integrated Elementary School Jombang. This research is a type of narrative descriptive research and is qualitative in nature. Ar-Ruhul Jadid Jombang Integrated Elementary School students from grades one to five were used as research subjects. In this research, observation, interviews and documentation methods were used to collect data. The observation data will be checked up to the data display stage, after which the results will be confirmed and validated. Data from interviews and observations are used as the basis for documentation. The results of research conducted at the Ar-Ruhul Jadid Jombang Integrated Elementary School show the influence of the School Discipline Enforcement Team (TPDS) program on student discipline, including reducing student tardiness, students' ability to comply with regulations, and students' ability to be disciplined with time, worship, rules, and in learning activities. This impact leads to the conclusion that the School Discipline Enforcement Team (TPDS) program can have a very good impact on students, enabling them to develop a disciplinary attitude towards others and themselves.

Abstract

Penelitian ini bertujuan untuk mengetahui pengaruh cyberloafing memediasi antara work stres dan dukungan organisasi terhadap kinerja. Penelitian ini dilakukan pada Pegawai Negeri Sipil di Kantor Kementerian Agama Kabupaten Indragiri Hulu dengan sample sebanyak 213 responden. Variabel independen pada penelitian ini adalah work stress dan dukungan organisasi, sedangkan variabel dependen adalah kinerja yang dimediasi oleh cyberloafing. Pengukuran variabel dilakukan dengan menggunakan skala linkert.  Data yang didapatkan  kemudian dianalisa dengan metode statistik Partial Least Square (PLS). Hasil analisa menunjukan bahwa (1) work stressor berpengaruh  negatif dan signifikan terhadap variabel cyberloafing. (2) dukungan organisasi berpengaruh positif dan tidak signifikan terhadap cyberloafing. (3) cyberloafing berpengaruh positif dan signifikan terhadap variabel kinerja. (4) work stress berpengaruh negatif dan signifikan terhadap kinerja melalui cyberloafing. dan (5) dukungan organisasi berpengaruh positif dan tidak signifikan terhadap kinerja melalui cyberloafing.

Abstract

Learning Islamic religious education can not be separated from the results of learning or assessment. The assessment of Islamic religious education subjects did not describe students' attitudes. This study aims to assess attitudes toward Islamic religious education in elementary schools. This study used the descriptive qualitative method. Sources of data obtained from primary data and secondary data. Primary data are from 19th-grade and 5th-grade students.Meanwhile, secondary data includes principals, teachers, parents, and classmates. Data collection techniques used are observation, interviews, and documentation. The collected data will be processed using inductive qualitative analysis through data reduction, data display, and conclusion drawing or verification. The study results reveal that Islamic religious education is less successful because parents still view that schools only carry out the task of educating children. Parental attention to children is only in the form of fulfilling material needs such as clothing, food, and board needs. At the same time, the problem of moral formation and development is left entirely to the school. In addition, because it underestimates the existence of Islamic religious education lessons, it is a lesson that is not too important and easy to learn without having to think.

Abstract

Artikel ini membahas pentingnya suara pendidik dalam gerakan kesetaraan dan keberagaman, khususnya terkait pendidikan inklusi anak usia dini. Meskipun pendidikan inklusi semakin diterima secara luas, kontribusi dan pengalaman pendidik mengenai praktik terbaik dan tantangan yang dihadapi seringkali diabaikan. Melalui pendekatan fenomenologi dan metode kualitatif,  tujuan penelitian berskala kecil ini mengeksplorasi pemahaman dan pengalaman lima pendidik anak usia dini tentang pendidikan inklusi di lima taman kanak-kanak di Jawa Timur. Analisis tematik data penelitian menggarisbawahi inklusi sebagai hak untuk diterima dan berpartisipasi penuh; kebutuhan untuk modifikasi guna mewujudkan budaya penerimaan, keberagaman, dan inklusi; kurangnya dukungan dan pengembangan profesional yang tidak memadai; serta pentingnya dukungan praktik yang efektif melalui hubungan dengan keluarga, para ahli, dan anak-anak. Temuan penelitian ini menyoroti implikasi pentingnya pengembangan profesional berbasis bukti yang lebih berfokus pada kebutuhan sehari-hari pendidik anak usia dini.

Abstract

The Government has promulgated Law of the Republic of Indonesia Number 11 of 2008 concerning Electronic Information and Transactions as first amended by Law of the Republic of Indonesia Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions and amended again by Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions; and The government has also made derivative regulations in the form of Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions. Currently, the Government through the Ministry of Communication and Information Technology has also granted permission to agencies or legal entities authorized as Electronic Certification Providers (PSrE) that provide electronic certificate and electronic signature services. However, the fact is that today people still rarely or do not know how to use electronic signatures or electronic transactions in every agreement. Often people also do not know about the difference between electronic signatures or signature scans. People today also still doubt the legal consequences and legal risks that occur if electronic transactions and/or electronic documents are signed through electronic signatures. With the existing facilities and infrastructure made by the current government, people should be able to use electronic signatures in electronic transactions, both in buying and selling transactions, accounts receivable or the implementation of other agreements that are often carried out in the community. Therefore, this study aims to discuss and elaborate the implementation of provisions regarding the use of Electronic Signatures in electronic transactions and electronic contracts and also to provide an understanding of legal protection to facilitate and convince the public to be able to carry out transactions and agreements electronically.
