Abstract

This research is motivated by the curiosity of the law of marriage of a pregnant adulter to cover up her shame and family disgrace, which sometimes occurs in the community, while the Prophet Muhammad “peace be upon him” has forbidden men to marry a pregnant woman until she gives birth.And many other forbidden marriages that occur in the community. The formulation of the problems of this research are: 1) What are the opinions of the four ideology of thought towards the rule of "iqtidhou annahyi alfasad wal butlan"? 2) How is the application of this rule in prohibited marriages, such as marriages of men with adulterers who are pregnant, mut'ah marriages, marriages of men who have been proposed by other men, marriages in ihrom conditions, syigor marriages, bid'iy marriages, marriages without marriages proxy, marriage without witnesses, marriage by combining women who still have mahrom relations. This research was conducted by the literature review method, collecting and studying various references, especially from the four ideology of thought, then conducting in-depth analysis. The conclusions of this study are 1) the four ideology of thought differ on the the rule of "iqtidhou annahyi alfasad wal butlan" in some circumstances annahyu, and have the same view of this Qoidah in several circumstances annahyu. 2) In applying this rule in the case of marriage, they agree on its validity or sleaze in some marital matters, but also differing opinions in several other issues. Usually, their opinions on the issue of marriage are in line with their opinions on the issue of the rule of ushul, but sometimes they don’t.Penelitian ini dilatarbelakangi keingintahuan hukum nikahnya pezina yang hamil untuk menutupi aibnya dan aib keluarganya, yang kadang terjadi di masyarakat, sedangkan Nabi Muhammad Sholallohu ‘alaihi wa salam telah melarang lelaki untuk menikahi perempuan yang hamil sampai dia melahirkan. Dan banyak pernikahan-pernikahan terlarang lainya yang terjadi di masyarakat. Rumusan masalah dari penelitian ini adalah: 1) Apa pendapat empat madzhab terhadap qoidah “ iqtidhou annahyi alfasad wal butlan”? 2) Bagaimana penerapan qoidah ini dalam masalah pernikahan yang terlarang, seperti nikahnya lelaki dengan pezina yang hamil, nikah mut’ah, nikahnya lelaki atas perempuan yang sudah dilamar lelaki lain, nikah dalam kondisi ihrom, nikah syigor, tholak bid’iy, nikah tanpa wali, nikah tanpa saksi, nikah dengan menggabungkan perempuan yang masih ada hubungan mahrom. Penelitian ini dilakukan dengan metode kajian pustaka, dengan mengumpulkan dan mentelaah berbagai referensi terutama dari empat madzhab, dan menganalisanya. Kesimpulan dari hasil penelitian ini adalah 1) empatmadzhab berbeda pendapat tentang qoidah “ iqtidhou annahyi alfasad wal butlan” di beberapa keadaan annahyu, dan sama pandanganya tentang kaidah ini dalam beberapa keadaan annahyu. 2) Dalam penerapan qoidah ini dalam masalah pernikahan, mereka sepakat tentang keabsahanya atau kebatilanya dalam beberapa masalah pernikahan, dan kadang mereka juga berbeda pendapat dalam beberapa masalah lainya. Biasanya pendapat mereka dalam masalah pernikahan ini selaras dengan pendapat mereka dalam masalah qoidah ushul tersebut, tapi kadang tidak selaras. الملخص: قاعدة" اقتضاء النهي الفساد و البطلان " عند المذاهب الأربعة و تطبيقاتها في المناكحات، رسالة مقدمة لاستيفاء أحد الشروط للحصول على درجة الماجستير في تخصص الفقه و أصوله، إعداد الطالب: سورا تنو، رقم القيد:O200170020  تحت إشراف: د.عمران رشادي و د.معين دين الله بصري، عام:1441 ه / 2019م. قامت فكرة البحث على معرفة حكم نكاح الحامل بسبب الزنى لستر عيبها و عيب عائلتها الواقع في المجتمع ، مع أن النبي – صلى الله عليه و سلم – نهى عن نكاح الحامل حتى تلد كي لا يختلط النسب. قد وقعت الأنكحة الممنوعة الأخرى في المجتمع. تدور مشكلة البحث حول الأمرين التاليين: 1) ما أقوال المذاهب الأربعة في قاعدة " اقتضاء النهي الفساد و البطلان"؟ 2)كيف تطبيق هذه القاعدة  في مسائل المناكحات؟ اتّبع الباحث في هذه الرسالة البحث المكتبي، و ينهج هذا البحث منهج استقرائي و تحليلي. و توصل الباحث إلى النتائج الآتية: 1) اختلف المذاهب الأربعة في القاعدة الأصولية " اقتضاء النهي الفساد و البطلان " في بعض أحوال النهي، و اتفق في بعضها. 2) تطبيقات هذه القاعدة في المناكحات المنهي عنها في نكاح الزانية الحامل، نكاح المتعة، الخطبة على الخطبة، نكاح المحرم، نكاح الشغار، الطلاق البدعي، النكاح بدون ولي، النكاح بدون الشهود، الجمع بين المحارم في النكاح، اتفق المذاهب الأربعة على صحة بعضها أو فساده، و اختلفوا في بعضها، غالبا أن رأيهم موافق لرأيهم في القاعدة " اقتضاء النهي الفساد و البطلان"، و أحيانا مخالف لرأيهم في هذه القاعدة.

Abstract

Sindon Village is one of the vegetable center villages in Boyolali district. Vegetable production in the village is quite abundant, but there has not been optimal flour processing practice. The purpose of this community service activity is to improve community skills in processing flour-based vegetable products prepared for commercialization. The partners of the community service activities consisted of 3 groups, namely PKK, women farmer groups (KWT) and Aisyiyah groups. The activity begins with training in making cookies products with the addition of spinach flour. Then a spinach flour-based product processing competition was conducted. The results of the activity showed that the three partner groups were skilled at practicing the process of making spinach cookies. In the product competition, each partner group has featured its fine products. The result of the competition is the identification of flour-based vegetable products that will be continued in the commercialization process.

Abstract

This research aims to describe the values of supply chain management that develop in a tourism village that is managed through the community-based tourism (CBT) model. This is qualitative research with ethnographic design. The data of the present research were collected through in-depth interviews, observation, and documentation. The resource persons of the research were tourism village managers and traders in Papringan Market, Temanggung, Central Java, Indonesia. To ensure the trustworthiness of the research data, source triangulation analysis and participant observation were performed. Several steps were involved in data analysis, namely data reduction, data presentation, and conclusion drawing. The results showed that the values of supply chain management found in Papringan Market traders included: (1) Self-knowledge, the traders already knew about the business and carried out their own production and marketing processes, (2) Search skills, the traders could easily get raw materials for their business and implemented an effective marketing system to attract customers, (3) Computation skills, traders prepared themselves with the risks that would come. They did not only focus on sales in the Papringan Market but also have other jobs, 4) Practical knowledge, the traders had understood enough to make innovations in their business, but the changes were not significant, 5) Communication skills, communication between sellers and consumers in the Papringan Market was well-established and conducive, even among fellow traders and market managers, 6) Imagination, traders had insufficient idea and imagination to develop their products because they still relied on market demand, 7) Foresight, traders still followed the flow of the Papringan Market and did not yet have thoughts or idea for their products in the future.

Abstract

As the existance of green products and services are increasing, the property industry is trying to develop their product such as green supply chain management concept. Most of the green supply chain management concept that offered by the property industry are including green environmental, waste management, water management and many others. The objectives of this research is to identify the value of customer engagement model. Conceptual model is developed to idenfity the relationship between the variables and its indicators (exogenous) which affecting the customer engagement value (endogenous). This relationship identification has been done by using Structural Equation Modeling. Although, the measurement of customer engagement value is conducted by using system dynamics simulation. The result of this research prove that the relationship of five exogenous variables  toward the endogenous are significant. Also, it is obtained the prediction value of customer engagement per unit of time.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaruh dari variabel Work From Home (WFH) terhadap kinerja pegawai pada pada KPPN Nabire, KPPN Jayapura dan Kanwil DJBP Provinsi Papua. Variabel yang digunakan adalah WFH sebagai variabel bebas dan kinerja pegawai sebagai variabel terikat. Teknik pengambilan sampel adalah dengan menggunakan metode sensus, dimana semua populasi menjadi sampel. Data primer diperoleh dengan cara penyebaran kuesioner dengan jumlah responden 39 pegawai. Analisis data menggunakan bantuan program SPSS versi 25 for Windows. Untuk menguji kuesioner menggunakan Uji validitas dengan menggunakan Product Moment Pearson dan Uji reliabilitas dengan menggunakan Cronbach Alpha. Analisis data menggunakan regresi linier sederhana, dimana keabsahan persamaan regresi linier sederhana yang terbentuk diuji dengan menggunakan uji asumsi klasik. Hasil Uji t menunjukan nilai thitung variabel bebas yaitu WFH sebesar 4.584 lebih besar dari nilai ttabel sebesar 2.026 dengan probablitas signifikansi thitung sebesar 0.000 lebih kecil dari 0.050 atau 5%. Adapun Uji F hasilnya nilai Fhitung sebesar 21.012 lebih besar dari Ftabel sebesar 2.026 dengan probablitas signifikansi Fhitung sebesar 0.000 lebih kecil dari 0.050 atau 5%. Dengan demikian hasil penelitian menunjukan bahwa variabel WFH mempunyai pengaruh yang positif dan signifikan terhadap kinerja pegawai pada pada KPPN Nabire, KPPN Jayapura dan Kanwil DJBP Provinsi Papua. Untuk Uji Koefisien Determinasi/R Square (R²) nilai Koefisien Adjusted R² sebesar 0.345, hal ini memberikan gambaran bahwa sumbangan variabel bebas yaitu WFH dalam pengaruhnya naik atau turun kinerja pegawai pada pada KPPN Nabire, KPPN Jayapura dan Kanwil DJBP Provinsi Papua sebesar 34.5% dan sisanya sebesar 65.5% merupakan sumbangan dari variabel lain yang tidak dimasukan dalam model/tidak diteliti dan tergabung dalam variabel pengganggu (e) dalam model regresi linear sederhana yang dipakai dalam penelitian ini.

Abstract

Abstract-Since the implementation of Special Autonomy law, the system of governance of Papua province experiencing changes in terms namely institutional establishment of the Papuan People's Assembly (MRP). The presence of MRP institutions greatly affect the implementation of the Provincial Government of Papua, especially in the manufacture of specific local regulations. The purpose of this study was to determine the effectiveness of the network between local governance institutions in the manufacture of specific local regulations (Perdasus) in Papua province. This study uses "triangulation" that combines qualitative and quantitative methods. The use of this method to produce a general overview of the phenomenon to be studied. In this study suggest that the making of specific local regulations (Perdasus) involving the three institutions namely the provincial government, the DPRP and MRP have done quite effectively. It is characterized by involvement, commitment, roles, and the implementation of mechanisms of each institution towards making Perdasus based authority. The study recommends that the need for institutional capacity development, especially against the MRP as a representative institution of the Papuan people.

Abstract

The purpose of  this study is to look at the impact of  the implementation of the policy Business Tegal. In evaluating the program Business Tegal viewed from the aspect of  productivity policy, financial efficiency and level of  community satisfaction policy Business Tegal. By using a mixed method research approach hopes this research can include aspects of  qualitative and quantitative. Based on the results of  research carried out showed that the productivity of the policy can not boost industrial production and the quality of  many of  the home industry go bankrupt due to the government can not provide assistance in the form stimulant funds. Although the government has provided some training still can not help improve the quality of  the industry because the training is not only limited to assisting the industry as expected by the public. With the impact, then the public is not satisfied about the implementation of  the Business Tegal policy because no positive impact on the sustainability of  the industry and welfare.

Abstract

Indonesian constitution no. 1 year of 2004 about the state treasury that can open the new corridor for the performance-based budgeting application in government circumtances. The article 68 and article 69 of the constitutionsassert that the government instance have the main duty and function to serves the public society. It also able to applythe flexible budgeting managent pattern by accentuated the productivity, efficiency, and effectivity in a form of thePublic Services agency (BLU). BLU is expected as the real image of performance-based budgeting managementapplication. IAIN Sulthan Thaha Saifuddin has been a BLU since November 23rd 2009. In performance of BLU, IAINSulthan Thaha Saifuddin experiences the change of budgeting systems, Organization structure, and organizationperformance achievement. This research tried to know the evaluation of BLU in IAIN STS by using Balanced Scorecard.The Application of BSC based on 4 perspectives, encompases the monetary perspectives, consumer perspectives,internal bussiness perspectives,and learning and developing perspectives. The evaluation of BLU is proposed toknow the effort of public services quality improvement, transparancy and accountability of government budget managementin IAIN Sulthan Thaha Saifuddin. The approach of this research is qualitative describtive and the methodealso use the qualitative methode. While, the data collecting use the questionaire to the BLU group-based respondents.The result of the research shows the work of Public Service Agency in IAIN Sultan Thaha Saifuddin Jambi is alreadywork effectively but it still need to be improved, especially the implementation of Standard Operational Procedure(SOP) and the minimal standard of services / Standar Pelayanan Minimal (SPM) in order to expected to be prominentconcrete examples of the application of financial management based on the results (performance).

Abstract

Tesis ini menitik beratkan pada proses rekrutmen calon Kepala Daerah Kota Baubau pada pemilihan KepalaDaerah Kota Baubau Tahun 2012, dimana peneliti studi yang dilakukan pada DPC Partai Amanat Nasional (PAN)Kota Baubau. Proses rekrutmen Kepala Daerah Kota Baubau pada pemilihan Tahun 2012 yaitu mengadakanseleksi baik internal maupun formal, membuka penjaringan, menyusul pengkaderan pada pengurus yangmasuk dalam struktur organisasi, namun setelah melihat kenyataan dilapangan Kader-kader atau penguruspartai yang akan mencalonkan diri sebagai Kepala Daerah belum sesuai dengan prosedur atau persyaratanyang partai amanat nasional adakan, sehingga Partai Amanat Nasional tidak lagi melakukan penyeleksian, dansehingga Partai Amanat Nasional hanya menetapkan 1(satu) nama saja.Adapun permasalahan yang diangakatdalam penelitian ini adalah proses rekrutmen Calon Kepala Daerah melalui Partai Politik (PAN) pada pemilihanKepala Daerah Kota Baubau Sulawesi Tenggara Tahun 2012, dan Faktor-faktor apakah yang mempengaruhiproses rekrutmen calon Kepala Daerah melalui partai politik (PAN) pada pemilihan Kepala Daerah Kota BaubauSulawesi Tenggara Tahun 2012. Metode yang digunakan dalam penelitian ini adalah deskriptif kualitatif yaitumenggunakan pendekatan pada kenyataan yaitu data primer dan data sekunder. Sumber data primer adalahsumber data yang diperoleh langsung dari responden atau obyek yang diteliti, sedangkan sumber datasekunder adalah sumber data yang diperoleh melalui Dokumen-dokumen tertulis, arsip maupun yang lainnyapada instansi atau lembaga yang berhubungan dengan penelitian. Hasil penelitian ini telah menunjukan bahwa,proses rekrutmen Calon Kepala Daerah melalui partai politik (PAN) Kota Baubau Sulawesi Tenggara Tahun2012, sudah berjalan dengan obtimal meskipun ada beberapa faktor penghambat yang mempengaruhi prosesrekrutmen tersebut, yaitu (1) terjadinya perpecahan didalam partai itu sendiri dalam mengusung calon, dariketidak kekompakan tersebut terjadilah dualisme karena adanya kepentingan di masing-masing pengurus, (2).Adanya penekanan dari wilayah untuk membuka penjaringan, (3). Dilihat dari gelar akademik, mempunyaikekayaan (finansial), mempunyai jabatan tinggi dari birokrasi (Indikator Topeng), (4). Dilihat dari kualitaspengalaman kerjanya, dan mempunyai prestasi pada masyarakat setempat dan sekitarnya (Indikator Kinerja).Meskipun ada beberapa faktor yang mempengaruhi proses rekrutmen calon kepala daerah Kota Baubau diatasnamun ada faktor yang mendukungnya yaitu, (1). Dukungan pengurus partai amanat nasional yang dari DPD,DPW, dan DPP, (2). Tim-tim dari pemenang dari luar yang mampu meyakinkan calon tersebut, (3). Tim seleksimelihat dari socil backroundnya calon yaitu dari keluarga yang mampunyai kemampuan untuk maju menjadicalon Kepala Daerah (finansial) dan dari keluarga elit, (4). Tim seleksi melihat calon dari seorang figure dalambirokrasi atau pemerintahan, (5). Bakal calon tersebut mempunyai motivasi untuk mewujudkan pembangunandan kesejahteraan masyarakat Kota Baubau sehingga mempunyai visi-misi yaitu Kota Baubau menjadi DaerahOtonom di kawasan Daerah Provinsi Sulawesi Tenggara.

Abstract

The purpose of  this study was to describe the quality of  public services in the Air Abik dan Pejam, Gunung Muda in2012-2013. While the service quality measurement instrument in this study using Zeithaml thinking that; direct evi-dence / keterwujudan (tangible), responsiveness (responsiveness), reliability (Reliability), assurance (assurance)and empathy (empathy). Accompanied programs, practices and factors of quality of health care in the hamlet Air Abikand closed. The method used is the method mix (mix method). The results of  the study indicate that the quality ofhealth services provided by Polindes and Pustu to Komunitas Adar Terpencil (KAT) People in Dusun Air Abik dan Pejam,Desa Gunung Muda and closed is good with 3:50 cumulative index value of a maximum value of  5. The dimensions ofempathy into the dimension with the highest value ie 4:10 and indicators assurance to a low of  2:30. tangible scored3.73, responsiveness got 3.78 and reliability with a value of  3.62. The service practices are in accordance SOP, andthe health care program is still equated with the program in the  district. Is a factor that affects the law of  customary/local knowledge, infrastructure, location and quality of the resource geogerafis aparatur. Conclusion of this researchis that the quality of  health services provided by Polindes and Pustu on KAT People Lom in Hamlet Air Abik and closedeither with the index value 3.50 of  the maximum value. The practice of health care provided was appropriate SOPexisting health services. The recommendation is that the government should pay more attention Bangka khsusunyahealth care quality improvement and  infrastructure  facilities.
