Abstract

The tradition of money panai in the marriage of the Makassar Bugis people not only reflects cultural values and family honor, but also gives birth to social dynamics and religious issues, especially in the practice of borrowing money from the family. This research aims to analyze in depth the religious reality surrounding the practice of money and identify the typology of Islamic law that arises from this phenomenon. The method used is a descriptive qualitative research with a philosophical and sociological approach, which focuses on the analysis of cultural practices in the local context of the Makassar Bugis community. Data were collected through participatory observation, in-depth interviews with traditional leaders, scholars, and couples who have experienced money loans, as well as documentation and normative literature reviews. The results of the study show that the practice of borrowing money has become a plural social reality and is even considered a pragmatic solution in meeting customary demands. However, this practice also raises complex legal problems, especially in the perspective of Islamic law. Normatively, a panai loan is categorized as mubah if it does not cause harm or burden the groom. On the other hand, this practice can be haram if it has implications for disproportionate economic pressure or is carried out with detrimental speculative intentions. These findings show that people's perceptions of Islamic law in the context of money are contextual and varied, depending on social motives, agreements between families, and locally applicable religious interpretations. This research emphasizes the need for a more adaptive approach to Islamic law to local traditions without ignoring the principles of justice and benefit.

Abstract

The phenomenon that occurs in the people of Tinambung District, Polewali Mandar Regency is that people do not have marriage books because they are still underage so their marriages cannot be registered. If marriage registration is not carried out, it will lead to irregularities in people's lives which will lead to legal smuggling. To get a marriage book, the couple must attend the marriage isbat at the Polewali Mandar Religious Court Office. However, the people of Tinambung District find it difficult to apply for marriage isbat because the distance to the Polewali Mandar Religious Court is quite far, transportation costs are expensive, and they are old. Starting from this problem, the Polewali Mandar Religious Court, in collaboration with the Polewali Religious Office, held a mobile marriage isbat program so that people could get marriage certificates. This research is included in field research (qualitative) which uses the Normative Syar'i Approach which refers to approaching problems from the perspective of Islamic law. From the results of research conducted by researchers regarding mobile marriage isbat, it was concluded that mobile marriage isbat in Tinambung District is very effective in increasing accessibility and if viewed from a maslahah perspective, mobile marriage isbat can be categorized as maslahah murlah. Because marriage isbat has many benefits compared to its harms, one of which is in terms of protecting offspring. With the marriage isbat, children born out of wedlock will receive a birth certificate which can be used to register for school. Not only will the couple benefit, but the offspring born from the marriage will also benefit if both parents follow the marriage isbat.

Abstract

This study aims to find out the practice of early marriage, express the community’s views on early marriage and make an analysis based on Islamic law about the practice of early marriage in the Darul Istiqamah Lappa'e Islamic Boarding School, Sinjai. This research is a field study using a descriptive qualitative approach. The results of the study show that early marriage at the Darul Istiqamah Lappa’e Islamic Boarding School is based on parental approval and encouragement. In addition, the community views early marriage in Islamic boarding schools as a positive thing because it aims to foster young people to achieve piety and avoid promiscuity that is contrary to Islamic teachings. According to Islamic law, early marriage at the Darul Istiqamah Islamic Boarding School does not violate religious law because it is considered a solution to prevent greater dangers, such as adultery or pregnancy out of wedlock, by referring to the rules of Dar’u al-Mafasid. In addition, early marriage is carried out with the consent of the students themselves without coercion, with various considerations of benefits, namely efforts to achieve greater goodness and benefits.

Abstract

Maslahat dalam perkembangannya dipahami sebagai kebaikan atau manfaat yang membawa nilai-nilai positif bagi berbagai aspek kehidupan manusia. maslahat menjadi bagian penting dalam hukum Islam, meskipun sering kali memicu perbedaan pendapat dan perselisihan di kalangan akademisi, baik pada masa Sahabat, para Imam Mazhab, maupun para peneliti modern. Tujuan untuk mencapai maslahat dapat terpenuhi, dan segala bentuk kemudaratan yang dapat mengakibatkan kerusakan dapat dihindari. Maslahat juga meliputi upaya menjaga tujuan syariat, termasuk perlindungan agama, jiwa, akal, keturunan, dan harta. Dengan demikian, apa pun yang memelihara kelima prinsip dasar ini adalah maslahat, sementara yang bertentangan dengan tujuan ini dianggap mafsadat atau kemudaratan.

Abstract

This study examined the conditions of religious life in Manggala District during and after the pandemic, especially in worship, as well as the community’s response to the fatwa issued by the Indonesian Ulema Council concerning Covid-19. A qualitative field study was adopted with an interview technique. The primary data were interviews with the Manggala District community, and the secondary included literature, books, journals, and scientific works related to this study. The results showed that the condition of the Manggala District community during Covid-19 in religious matters was significantly impacted and underwent drastic changes, including the implementation of Friday and congregational prayers and the non-observance of Eid al-Fitr and Eid prayers. The worship condition of the people after the pandemic was operating properly and could be implemented as stipulated in Islamic law. Furthermore, there were differences in attitudes among the community. Some agreed, and others disagreed with the issuance of the MUI fatwa on Covid-19 according to their respective reasons.

Abstract

This study aims to examine whether talak raj’I, in Islamic law, terminates the marriage bond or not. Talak raj’I is a single or double divorce in which the husband has the right to reconcile during the iddah period. Talak, in Islam, is a means to terminate the marriage bond between husband and wife. However, not all divorces have the same impact. Talak raj’I is a type of divorce that gives the husband the right to reconcile his wife during the iddah period. This study will examine in more depth the consequences of talak raj’I, especially whether the divorce terminates the marriage bond or not, and how it has implications for marital status. This study uses a qualitative approach with a library research method. Data were collected from various sources such as classical fiqh books, contemporary fiqh books, and related laws and regulations, especially the Compilation of Islamic Law (KHI). Data analysis was carried out descriptively-qualitatively to understand the concept of talak raj’I and its implications for marriage bonds.

Abstract

Kaidah fikih al-masyaqqah tajlibut taysir (kesulitan mendatangkan kemudahan) merupakan prinsip penting dalam hukum Islam, terutama ketika seorang mukallaf menghadapi kondisi menyulitkan. Penelitian ini dilatarbelakangi oleh kebutuhan umat Islam untuk merespons dinamika kehidupan kontemporer yang sering diwarnai oleh dilema hukum, di mana dua keburukan tidak dapat dihindari sekaligus. Studi ini bertujuan mengkaji makna, dalil, syarat, dan penerapan kaidah dalam situasi darurat dan problematika kekinian. Penelitian dilakukan dengan pendekatan kualitatif dan kuantitatif melalui studi pustaka, wawancara, dan analisis data lapangan. Hasil kajian menunjukkan bahwa kaidah ini merupakan derivasi dari prinsip umum “ad-dharar yuzal” dan sejalan dengan maqashid al-syari’ah. Dalil-dalil dari Al-Qur’an dan Hadis, seperti QS. Al-Baqarah: 286 dan sabda Rasulullah “agama ini mudah”, menjadi landasan kuat dalam penerapannya. Kaidah ini juga diperkuat oleh pendapat ulama klasik dan kontemporer, serta memiliki hubungan erat dengan kaidah-kaidah fikih lainnya. Contoh aplikatif ditemukan pada kebolehan tayamum menggantikan wudhu, atau rukhsah saat safar dan sakit. Kesimpulannya, pemahaman dan penerapan kaidah ini menjadi penting dalam menjawab tantangan hukum Islam masa kini, dengan syarat tidak bertentangan dengan nash dan tidak disalahgunakan untuk kemaksiatan. Edukasi dan sosialisasi fikih kaidah harus ditingkatkan agar umat Islam mampu mengambil keputusan yang maslahat, proporsional, dan sesuai tuntunan syariah dalam situasi sulit

Abstract

This paper discusses the rules of jurisprudence regarding the combination of two similar acts of worship in one implementation with one intention. In the practice of worship, a Muslim is often faced with a condition where two acts of worship that have the same type and purpose occur at the same time. Based on the rules of jurisprudence: “If two similar acts of worship come together then their implementation is combined and it is sufficient to carry out one of them if both have the same purpose”, then this combination is permitted with certain conditions. This research uses a qualitative method based on literature study by reviewing relevant literature regarding the rules of jurisprudence and their application. The results of the discussion show that combining two similar worship services is permissible if it meets conditions such as: the type of worship is the same, the time is the same, it is not a qadha or accompanying worship service, and the intention of a larger worship service if there is a difference in degree. Examples of implementation include: janabah bathing at the same time as Friday bathing, tawaf ifadhah and tawaf wada’, as well as sunnah ablution, qabliyah and tahiyyatul mosque prayers simultaneously. In conclusion, this rule shows the ease in Islamic law while maintaining the validity and value of worship.

Abstract

Dalam realitas kehidupan yang kompleks, manusia sering dihadapkan pada dilema moral dan hukum yang melibatkan dua keburukan (mafsadat) yang tidak dapat dihindari sepenuhnya. Syariat Islam menawarkan solusi sistematis melalui kaidah fikih: “Jika dua mafsadat saling bertentangan, maka diperhatikan yang lebih besar bahayanya dengan melakukan yang lebih ringan.” Kaidah ini merupakan turunan dari prinsip dasar “kemudharatan harus dihilangkan” (al-darar yuzal) dan selaras dengan tujuan utama syariat (maqashid al-syari’ah), yaitu menjaga agama, jiwa, akal, keturunan, dan harta. Artikel ini mengkaji makna teoritis dan aplikatif dari kaidah tersebut dengan menelaah konstruksi bahasanya, landasan dalil dari Al-Qur’an dan Hadis, serta penguatan dari para ulama seperti Al-Suyuthi dan As-Syatibi. Hasil kajian menunjukkan bahwa kaidah ini menjadi kerangka penting dalam pengambilan keputusan hukum Islam, terutama dalam isu-isu kontemporer yang tidak memungkinkan penghindaran mafsadat secara total. Contoh penerapan termasuk kebolehan aborsi demi menyelamatkan nyawa ibu dan wacana etis tentang euthanasia pada penderita AIDS stadium akhir. Temuan ini menegaskan bahwa penerapan keburukan yang lebih ringan bukan bentuk pembolehan mutlak, melainkan sebagai langkah darurat untuk mencegah kerusakan yang lebih besar. Studi ini menyimpulkan bahwa pemahaman dan penerapan kaidah ini sangat penting agar umat Islam mampu membuat keputusan yang bijak dan sesuai syariat dalam situasi sulit. Diperlukan upaya edukasi dan sosialisasi kaidah-kaidah fikih agar umat mampu merespons tantangan etis masa kini dengan cermat.

Abstract

The concept of ‘illat in the proposal of fikih as the basis of the establishment and change of Islamic law. By raising the principle of “al-ḥukmu yadūru ma‘a ‘illatihi wujūdan wa ‘adaman” (the law revolves along with its ‘illat, existence or non-existence), the author explains that social change and cultural context can affect the applicability of Islamic law. ‘Illat is defined as a real property that is the rational basis of a Sharia law’. This article studies the various definitions of ‘illat according to the scholars usul fikih and describe the kinds of ‘illat based on the permanence of the Shari’ah’ and considerations of goodwill. Thus, an understanding of ‘illat becomes essential in order to ensure that Islamic law remains relevant, fair, and contextual in responding to the dynamics of community life. This article demonstrates that the flexibility of Islamic law does not conflict with divine principles, but precisely reflects the mercy and benevolence that are its goals.
