Abstract

The provisions for the implementation of electronic transactions related to buying and selling followers are contained in article 18 which states that if the sale is carried out via the internet, the contract must be in the form of an electronic agreement that is legally binding. The jurists of the Hambali, Hanafi and al-Shafi'i madhhabs say that the object of the contract must be deliverable, the object must be present at the time the contract is performed, and it must not sell something that does not exist such as unfinished fruit (ripe). In contrast to the Maliki Madhhab which allows the buying and selling of immature fruit, on the basis that the immature part is included in the fruit that has already appeared, and only requires that the object must be present at the time of contract at the time of sacrifice of the fruit. In contrast to the view of law number 11 of 2008 where the provisions for the implementation of electronic transactions related to buying and selling followers are contained in article 18 which reads that if the sale is carried out via the internet, the contract must be in the form of an electronic agreement that is legally binding, then the applicable law must be in accordance with the basic principles of international criminal law and there are exceptions in article 20, namely in electronic agreements that With regard to the decision of both parties in relation to the agreement on the execution of the agreement, then the electronic transaction takes place only if the buyer has agreed and accepted the seller's offer. This research is included in the category of library research and uses methodology in the form of juridical, shari'i and sociological approaches. The data sources used are primary data sources, namely hadith, Qur'anic verses and the views of madhab imams while secondary data sources are journals, library books, data collected through reading, studying, and collecting a number of references related to the material. The journal of this study is, sellers and buyers who buy and sell followers to make an agreement before the contract is closed

Abstract

Technology is an entity of objects and non-objects that is created in an integrated manner through human thoughts to achieve a value that can be utilized in human life. Modern technology has made it easier for humans to communicate even in different places. Islam is not an obstacle to technological development, but Islam is part of technological development. Islam plays a role in development today. Islam really appreciates technology, but Islam does not want humans to use technology in the wrong direction. The presence of technology in the perspective of Islamic law brings various benefits, namely as a means of approaching God, as an instrument for spreading Islamic law and as a solution to solving contemporary problems in the current era. Besides having benefits, technology also has benefits, namely distortion of religious information, ablation of traditional religious practices and social isolation.

Abstract

The purpose of this study is to describe the implementation of policies in emergencies carried out by the government in terms of handling Covid-19 in Makassar City, the views of siyasa dusturiyah regarding constitutional law in emergencies in handling Covid-19. Regarding the abnormal (emergency) state of the country, appropriate actions can be based on ordinary law because the ordinary legal system cannot be applied as it should, to deal with the situation during the Covid-19 pandemic. This research is a field research using a Normative Syar'i approach and an Empirical juridical approach. Based on the results of this study, following the central government's stipulation regarding the Covid-19 pandemic emergency policy from several issued regulations such as Large-Scale Social Restrictions (PSBB), health quarantine and social assistance for the community, the Makassar City government implemented The policy stipulations are in accordance with central government policy regulations. In the siyasa dusturiyah perspective in implementing the functions and functions and authority of the state, the government in carrying out its duties as a state administration official is tasked with making a policy to realize the benefit of the community

Abstract

Purpose  – Wealth is an essential and fundamental aspect of human life. It not only plays an important role in sustaining life, but also serves as a means to achieve prosperity and happiness, both in this world and in the hereafter. Although the Qur'an explicitly prohibits the acquisition of wealth through unlawful means, violations of this provision still occur frequently. In fact, seeking halal livelihood is an obligation for every Muslim. Therefore, it is important to conduct in-depth research on sources of income that are haram, so that they can be avoided, while also examining the perspective of Islamic economics in managing haram wealth for those who are already involved and wish to purify it. Method – This study uses a normative-descriptive method with a sociological-legal approach. Data collection was conducted through literature study by examining various relevant sources, such as fiqh books, scientific journals, fatwas from scholars, and previous research results. Result – The results of the research show in Islamic jurisprudence, unlawful wealth refers to assets acquired through forbidden means, such as gambling, oppression, usury, theft, corruption, or the sale of prohibited goods, as explicitly forbidden by the Quran and Hadith. The management of illicit wealth in the context of Islamic economics must be based on the principles of justice, purification, and divine trust (istikhlāf). Scholars such as al-Ghazālī, Ibn Qudāmah, Wahbah al-Zuḥaylī, and Yūsuf al-Qaraḍāwī agree that wealth obtained unlawfully must be returned to its rightful owner. If the owner is unknown, then the wealth must be allocated for the public good. Therefore, individuals, groups, and governments are obliged to manage unlawful wealth in a manner that brings public benefit and is in accordance with divine justice. Implication – As a practical implication these Islamic legal principles is that Muslims are strictly obligated to cleanse their finances of unlawfully acquired wealth, primarily by returning it to its rightful owner or, failing that, by dedicating it to public good, preferably, the government should establish an institution to facilitate this.

Abstract

Carbon dots are a novel carbon-based material with the appealing properties of inexpensive nanomaterials, low toxicity, environmental tolerance, abundance, photostability, and simplicity of synthesis. Carbon dots (CDs) have effectively distinguished themselves from other materials due to their superior properties, such as ultra-small size, good photostability, excellent biocompatibility, and tunable fluorescence properties. This study synthesized carbon dots from green algae using a hydrothermal method at 180 °C and doped with nitrogen. Green algae contain carbohydrates, proteins, and poly-unsaturated fatty acids, allowing them to produce more carbon and be used as a precursor in synthesizing carbon dots. The FT-IR and UV-Vis spectra reveal the distinct functionalization and energy gap between the surface states of CDs and N-CDs. The carbon nanoparticles were then used as photocatalysts to degrade methyl red. The results indicate that nitrogen doping is superior for reducing methyl red and has tremendous potential for environmental applications.

Abstract

The tradition of uang panai’ has been rooted in the Makassar Bugis tribe's marriage until now giving birth to several meanings, the higher the uang panai’ given shows the higher the Social strata of the family. Another meaning is also said to be that if there is no uang panai’ then there is no marriage. This tradition affects people's behavior in deciding to get married. Perhaps some of them choose to continue their relationship through silariang (elopement) and even commit suicide because they are frustrated that they cannot meet the demand for uang panai’. This paper examines community behavior in making decisions on the amount of uang panai’ influenced by financial behavior, Social strata, education and religiosity. This research uses a mixed method approach by using SMART-PLS data analysis and analyzing qualitatively with mashlahah analysis. The sampling technique is non-probability sampling with a purposive sampling method by taking samples based on certain criteria and selecting subjects according to the right informant. The results showed that financial behavior does not affect decision-making. The stronger the financial behavior of the community, the less likely the decision to meet the demands of the amount of money panai'. This is in line with the theory of planned behavior, the decision is to make considerations by making specific plans. Religiosity also does not influence decision-making. The stronger one's religious beliefs, the weaker the decision to fulfill the demands of panai'. This religious belief fosters responsibility so it is cautious in making decisions. The description of community behavior towards panai' money decision-making is more appropriate to explain in the concept of mashlahah mursalah.

Abstract

This research aims to evaluate Context implementation of the Adiwiyata Program, Input for program implementation, implementation process and supporting and inhibiting factors, and product from program implementation. This research is evaluative with a qualitative approach using the CIPP evaluation model. Data collection was carried out through interviews, observation and document study. Data analysis techniques include collection, reduction, data presentation, and verification, with validation using triangulation and cross-check. The research results show that in aspects Context, There is a need for schools to create a clean, green and comfortable environment, which encourages school participation in the Adiwiyata Program. In aspect Input, the availability of human resources, budget, infrastructure, and program design supports program implementation in schools. In aspect Process, the program has been running according to Adiwiyata guidelines, although there are still challenges in increasing the involvement of all school members. Meanwhile, on aspects Product, The Adiwiyata program has contributed to the formation of an environmentally caring character in schools, although there are still aspects that need to be improved to achieve program sustainability. Factors supporting the success of the program include policy support, involvement of competent human resources, school commitment, budget, and availability of facilities and infrastructure. Meanwhile, inhibiting factors include the lack of individual awareness in protecting the environment and limited active participation from all school members. This research recommends that schools continue to increase the participation of all school members through intensive mentoring and encourage the role of the Makassar City Environmental Service (DLH) to be more active in supporting the sustainability of the Adiwiyata Program at the SDN Bawakaraeng UPT Complex. Abstract

This article discusses the benefits and benefits of modern technology from a maslahah perspective which aims to provide an explanation regarding the benefits of modern technology on the development of Islamic law, and how it has a negative influence on the development of Islamic law. This article is a literature review sourced from several relevant references to the topic discussed. Data collection techniques come from researching relevant reference sources in the form of journals, articles, websites, books and other scientific works. Islam has full care and attention for its ummah so that it continues the process of exploring the potential of nature and the environment to become the center of a glorious civilization. In this context, there is no conflict between science and Islam, where both work in balance and harmony to create scientific treasure and human civilization that is better than before. Current technological advances cannot be separated from people's lives. We can now know various information that occurs in various parts of the world directly thanks to technological advances (globalization). Previously, we knew the saying "the world is not as wide as a moringa leaf", now that saying should be changed to today's world as wide as a moringa leaf, because the rapid access to information in various parts of the world makes this world seem narrower because we can see what is happening in America for example, even though we are in Indonesia.

Abstract

Makassar City, as a central socio-economic hub in Eastern Indonesia, faces a development paradox that is rapid progress in industry, trade, and investment has simultaneously generated severe environmental pressures. Massive urbanization has led to the reduction of green spaces, an increase in waste production reaching 868 tons per day, and recurring floods caused by spatial violations. This study examines the implementation of Corporate Social Responsibility (CSR) through the lens of maslahah and ecological balance, aiming to achieve social and environmental justice. The research employs a field research design, utilizing normative and empirical juridical methods, which include observation, interviews, and document analysis based on legal frameworks such as Law No. 40 of 2007 and Makassar Regional Regulation No. 2 of 2016. The findings indicate that CSR in Makassar serves as an ethical, legal, and spiritual instrument for realizing maqāṣid al-sharī‘ah, particularly hifz al-nafs (protection of life) and hifz al-bi’ah (environmental preservation). CSR practices, including waste management and environmental education, embody the principles of dar’ al-mafāsid (preventing harm) and jalb al-masālih (promoting benefit), affirming CSR’s role in fostering collective welfare and ecological justice toward sustainable development grounded in Islamic values.

Abstract

The purpose of this study was to obtain empirical evidence and to examine the effect of the independent variables on firm size, firm financial leverage, firm age, audit quality, independent commissioners, managerial ownership, institutional ownership and profitability on earnings management as the dependent variable in non-financial companies that listed on the Indonesia Stock Exchange (IDX). Financial statements can be used to assess the good or bad of a company so that companies often carry out earnings management to set off the financial statements. This study uses 151 non-financial companies listed on the Indonesia Stock Exchange (IDX) from year 2018 until year 2020. The method used in sampling is purposive sampling by determining five sample criteria and using multiple linear regression as a data analysis method. This study uses discretionary accruals which are calculated using the modified Jones model as a proxy for earnings management, natural logarithm to measure firm size variable, logarithm to measure firm age variable, audit quality variable and management ownership using dummy variable, and firm financial leverage variable, independent commissioner, institutional ownership and profitability are measured using a ratio scale. The results of this study indicate that firm size and profitability have an influence on earnings management, while firm age, firm financial leverage, audit quality, independent commissioners, managerial ownership and institutional ownership have no effect on earnings management.
