Abstract

This study aims to analyze mining management through the reconstruction of maqasid sharia in order to realize sustainable mining governance and formulate a welfare village implementation model as a solution to the negative impacts of mining in Indonesia. The research method used is library research with a normative juridical approach and sharia theology, analyzing laws and regulations, maqasid sharia literature, mining journals, and government data related to mining. The results of the study indicate that current Indonesian mining management causes more environmental damage, social conflict, and economic inequality than benefits, with regulations that tend to benefit certain interests and ignore the people's maslahah. The reconstruction of maqasid sharia in the mining context includes expanding the classical meaning into four principles: hifz al-mal (distributive justice of mining results), hifz al-bi'ah (environmentally friendly mining), hifz al-'umran (village sustainable development), and hifz al-nafs wa al-sihhah (public health protection). The study's conclusion proposes a welfare village model as an implementation of the reconstruction of the maqasid sharia (Islamic principles) that integrates economic, social, and environmental values through CSR-Maqasidiyyah instruments, local sharia institutions, and maqasid-based audits. This model shifts the paradigm of mere extraction to the development of sustainable collective benefits, placing the community as the primary subject of welfare while maintaining a balance between economic, humanitarian, and ecological interests.

Abstract

Democracy in Indonesia faces several major problems and challenges, including rampant corruption, persistent social and economic inequality, political polarization that affects national stability and consensus-building, as well as an inefficient bureaucracy that hampers democratic progress. This study explores the concept of just leadership according to Ibn Taymiyyah and its relevance to Indonesia’s democratic system. Using a qualitative approach with a literature study method, the research aims to identify how principles of justice in leadership can strengthen democracy in Indonesia. The findings suggest that Ibn Taymiyyah’s ideas can enrich the Indonesian democratic framework, especially in terms of justice, offering a significant contribution to the development of Islamic leadership studies and democracy in the country. His emphasis on honesty and justice in governance, the establishment of an Islamic state to uphold Islamic law, and the necessity of the state to protect religion and society align with Indonesia's democratic aspirations. The study concludes that Ibn Taymiyyah’s principles of just leadership remain relevant and applicable to Indonesia’s governance, particularly in the context of elections.

Abstract

Abstract Restorative justice has emerged as an alternative approach to handling minor assault cases in Indonesia, particularly within police and prosecutor institutions. Empirical studies indicate that this mechanism typically involves mediation among the perpetrator, victim, and community figures via platforms such as Restorative Justice Houses, offering a more humane form of justice compared to formal litigation. From the perspective of Islamic criminal law, this approach aligns with the principles of al-‘afwu (forgiveness), al-islah (reconciliation), and diyat (compensation) as core elements of restorative justice since the early era of Sharia. However, practical implementation faces obstacles such as unclear compensation standards and limited mediation duration. This study aims to analyze the compatibility of restorative justice in minor assault cases with Islamic criminal law, identify challenges, and formulate normative recommendations to ensure a more equitable, consistent practice within the framework of Sharia. Through a combined normative legal and case-based methodology, the findings indicate that modern restorative justice is grounded in Islamic theological principles and presents a promising avenue for harmonious integration within the national legal system. Keywords: restorative justice; Islamic criminal law; minor assault; al-‘afwu; diyat.

Abstract

The development of the digital era has opened up great opportunities for women in public leadership, but often their presence is reduced to symbolic representation that does not touch the substance of power, exacerbated by gender stereotypes and conservative religious interpretations. This study aims to analyze the legitimacy and contribution of women's leadership in the digital era from the perspective of Siyasah Syar'iyyah, positioning it as a contextual managerial and ethical foundation. Using a descriptive qualitative approach through library research, primary data in the form of the Qur'an and classical books and secondary data in the form of relevant books and journals are analyzed through content analysis to connect the principles of Siyasah Syar'iyyah with digital reality. The results of the study conclude that leadership legitimacy is based on the integration of al-quwwah (competence) and al-amanah (integrity) as fundamental managerial values. The transition to substantive leadership is achieved through the implementation of tahqiq al-maslahah (realization of benefits) and mas'uliyyah (accountability), which demands real-time accountability in the digital space. Therefore, the practical implication is the need for digital and political ethics education based on Islamic values to ensure that women's roles are effective and have integrity.

Abstract

Throughout Islamic civilization, the synergy between economics and constitutional law has played a crucial role in achieving community welfare based on the principles of Maqāṣid al-Syarī‘ah. This study aims to analyze the contribution of Islamic constitutional law to the development of an equitable Islamic economic system. The research employs a qualitative descriptive approach through literature studies, examining various sources related to Islamic constitutional law and Islamic economics. The findings indicate that the principles of Islamic constitutional law, such as justice (‘adl), consultation (syurā), trust (amānah), and the protection of individual and communal economic rights, significantly influence the formation of a more inclusive and sustainable economic system. The implementation of Maqāṣid al-Syarī‘ah in Indonesia’s economic policies is reflected in regulations on zakat, Islamic banking, halal investment, and resource management aimed at public welfare. However, key challenges remain, including the harmonization of Islamic law with positive law and disparities in wealth distribution. Strengthening Maqāṣid al-Syarī‘ah-based policies is therefore necessary to ensure that the Islamic economic system can optimally contribute to improving societal well-being.

Abstract

Marriage law has a very important place in Islam, because marriage law directs the implementation of family life which is an important aspect of social life, according to a person's position which is respected above other creatures. Marriage law is one of the teachings of the Islamic religion that must be followed and implemented based on the commands of the Al-Quran and the Sunnah of the Prophet. As time goes by, various issues related to marriage begin to increase. One of the influences is changes in tradition or culture, as well as the rapid development of modern technological devices, such as communication tools. The purpose of this research is to understand the dynamics of telephone marriages and analyze telephone marriages. This research is a literature study (library research) using descriptive methods. The results of the research show that getting married by telephone is basically the same as holding a wedding ceremony in general, but the difference is that it is not done in the same place or far apart. This marriage can take place if the conditions are met and there are certain reasons behind the marriage by telephone, such as differences in countries that do not allow prenuptial agreements to be signed in person.

Abstract

This study examines the moral decline in Indonesian politics by focusing on transactional political practices that contradict Islamic law. Practices such as corruption and abuse of power have diminished political integrity and public trust. Using a normative legal approach, this research analyzes relevant regulations and Islamic legal principles of justice (‘adl) and trust (amanah). The findings reveal that transactional politics not only violate existing laws but also contradict the objectives of Islamic law (maqāṣid al-syarī‘ah), which emphasize justice, integrity, and social responsibility. From the perspective of Islamic law, political power is a trust that must be exercised for the welfare of the people, not for personal gain. Therefore, moral reform in politics should begin with Islamic ethical education, strengthened public accountability, and strict law enforcement to restore politics as a means of upholding justice and promoting social welfare.

Abstract

The study aims to analyze the practice of natural resource exploitation in Indonesia’s mining sector from the perspective of Sharia economic law, particularly through the concepts of maslahah (Benefit) and mafsadah (harm). The research focuses on assessing the extent to which mining activities generate not only economic benefits but also environmental, social, and distributive justice implications in natural resource governance. This study employs a qualitative design using a library research approach. Data were collected from statutory regulations, scholarly journal articles, books, official reports, and relevant Islamic legal literature. The data analyzed using a descriptive-analytical approach through content analysis in order to connect empirical findings on mining practices with the normative framework of Sharia economic law. The findings indicate that Indonesia’s mining sector makes an important contribution to economic growth, particularly in supporting industrial expansion and investment. However, these benefits do not fully reflect public maslahah, as they are accompanied by environmental degradation, deforestation, pollution, social conflict, public health risks, weak governance, and unequal distribution of benefits among communities living near mining areas. From the perspective of Sharia economic law, such conditions suggest that mining practices tend to lean more toward mafsadah when economic gains are not balanced by ecological responsibility, community protection, and distributive justice. The limitation of this study lies in its reliance on library-based research, which is not supported by direct field verification. The originality of this study lies in its effort to integrate Sharia economic law with issues of mining, environmental governance, and social justice within a more applicable framework of maqasid al-syariah. Keywords: Exploitation; Mining; Sharia Economic Law.
