Abstract

This comparative study explores the insolvency test frameworks in Australia and Indonesia, focusing on the legal perspectives within their respective bankruptcy laws. In Australia, the insolvency test is governed by the Corporations Act 2001, which employs a dual approach: the balance sheet test, assessing whether liabilities exceed assets, and the cash flow test, evaluating a company's ability to meet debts as they fall due. This combination aims to offer a comprehensive picture of a company's financial health, facilitating early intervention to prevent insolvency. In contrast, Indonesia's insolvency regime, regulated by the Insolvency and Suspension of Debt Payment Obligations Law (UUPK), adopts a more creditor-centric approach, emphasizing the debtor's ability to meet debt obligations rather than focusing on asset-liability balances or cash flow. This disparity reflects differing legal frameworks and economic contexts, which in turn affect the efficiency and effectiveness of insolvency proceedings in each country. The study utilizes a comparative legal research approach, analyzing primary legal texts, case law, and secondary literature to examine the procedural differences, particularly in the initiation of bankruptcy claims and the protection of creditors' rights. It also explores how these divergent insolvency tests shape the resolution of financial distress, considering both legal and practical implications in the respective jurisdictions. The findings highlight key contrasts in how insolvency is defined and addressed, with Australia prioritizing preventative measures and a holistic view of financial health, while Indonesia's system places more emphasis on creditor protection and debt repayment capacity. The study concludes with recommendations aimed at improving alignment and efficacy within each legal framework, proposing adjustments that could enhance financial stability and optimize outcomes for stakeholders in both countries.

Abstract

The implementation of Syari'ah law in Aceh has been a significant and often contentious aspect of the region’s post-conflict reconstruction process. Following the 2005 peace agreement between the Indonesian government and the Free Aceh Movement (Gerakan Aceh Merdeka, GAM), Aceh became the only province in Indonesia with the legal mandate to enforce Syari'ah law. This research explores the intersection of faith, law, and society in Aceh, examining how Syari'ah has reshaped not only legal frameworks but also the daily lives of its people. Despite its importance, there exists a gap in understanding the broader social implications of Syari'ah’s implementation, particularly its effects on gender, civil rights, and the overall social fabric. Previous studies have focused on the legal and political aspects, yet little attention has been given to the lived experiences of Acehnese citizens under this system. This study aims to address this gap by analyzing the societal transformations resulting from Syari'ah law, specifically focusing on how religious practices and legal structures interact within the Acehnese context. The urgency of this research lies in the increasing global attention to Islamic legal systems and their integration into state governance, offering a comparative lens for other regions pursuing similar models. Novel in its approach, the research contributes to a deeper understanding of the real-world implications of Syari'ah law on faith, law, and society, with particular attention to its effects on minority groups and social cohesion. Ultimately, it highlights the broader implications for peace-building in post-conflict societies, offering valuable insights for scholars and policymakers alike.

Abstract

One type of waste can be distinguished from another, regardless of whether it was generated in an industrial, commercial, residential, or other setting. However, in the context of this investigation, it is of the utmost importance to do so. Malaysia, a developing country, has been using end-of-pipe treatment or regulation for some time now. The treatment and regulation done at the end of the pipe are, however, both inefficient and ineffective to a significant degree. Malaysia ought to pursue a variety of approaches to the management of waste, including the reduction of waste at its source and the minimization of waste. In order to reduce pollution, the laws that are currently in place need to be strengthened. The improper management of waste, both municipal and industrial, has the potential to have adverse effects on the health of humans. From a legal standpoint in Malaysia, we have compiled a summary of the published, studied, implemented, and discussed findings from around the world regarding food waste management. In total, 144 articles were examined. Coverage analysis of empirical studies was conducted using data from the case studies application to compare and contrast the two types of data. Finally, a research agenda was developed by extracting recommendations for future research from the articles in order to signal trends and assist academics, researchers, practitioners, and other stakeholders involved in the food chain in developing and studying practices to sustain and support stakeholders' actions to reduce food waste in urban areas, farms, retail, and other sustainable ecosystems.

Abstract

This study examines the impact of the digital revolution and artificial intelligence (AI) on personal privacy in Morocco, within the framework of the country’s national digital strategy. As AI technology rapidly evolves, it raises significant concerns about the privacy of individuals, particularly with the unauthorized use or disclosure of personal data through algorithms. These challenges extend to various sectors, including economics, where e-commerce thrives, and politics, where AI can influence election campaigns. The research contributes to understanding how Moroccan law addresses privacy protection in the digital age. It critically reviews key legal instruments such as the Civil Code, the Consumer Protection Law, the Personal Data Protection Law, and the Product Safety Law, assessing their adequacy in safeguarding individuals’ rights. The study highlights the gaps in existing legislation, emphasizing the need for stronger legal frameworks to protect privacy in the face of advancing AI technologies. Key objectives of the study include assessing AI's effects on private life, evaluating the effectiveness of Moroccan laws in protecting privacy, and exploring the roles of the state and civil society in promoting legal and technical awareness. Using a descriptive-analytical approach, the research analyzes privacy protection laws in light of AI’s development. The study concludes with several recommendations: raising awareness about AI risks, enhancing existing privacy laws, and creating a comprehensive legal and technical framework that ensures stronger digital security for Moroccan citizens. These contributions aim to guide the protection of privacy and substantive justice in the era of artificial intelligence.

Abstract

Penelitian ini menganalisis bentuk pelayanan publik dalam pemeriksaan keimigrasian serta merumuskan karakter, etika, dan kompetensi petugas imigrasi di Tempat Pemeriksaan Imigrasi (TPI) di Indonesia dalam kerangka profesionalisme. Permasalahan yang timbul adalah terdapat perbedaan pemahaman, perspektif, dan paradigma bentuk pelayanan publik dalam pemeriksaan keimigrasian dan terdapat perbedaan kompetensi, karakter, etika petugas imigrasi di TPI. Metode penelitian kualitatif dengan pendekatan analisis dokumen (document analysis) digunakan dengan pengumpulan data berupa publikasi ilmiah, buku-buku, peraturan-peraturan, serta laporan dari organisasi. Analisis data menggunakan analisis teoretis dan konseptual yang dapat merekomendasikan suatu model atau konsep. Hasil kajian ini menunjukkan bahwa bentuk pelayanan publik dalam pemeriksaan keimigrasian di TPI berbeda dengan pelayanan publik yang diterapkan di sektor publik lainnya karena ada aspek keamanan perbatasan, manajemen perbatasan, dan teknologi perbatasan. Karakter ASN sebagai petugas imigrasi di TPI menggunakan konsep professional courtesy bukan hospitality dengan rekomendasi berupa delapan kompetensi berikut elemennya.

Abstract

The procurement of goods and services within the public sector is a crucial function that supports the operation of government institutions and the delivery of public services. However, this process is often vulnerable to corruption, including bribery, collusion, and abuse of authority. This paper examines the criminal law aspects related to government procurement by analyzing various cases of corruption in Indonesia. Through a review of legal frameworks, including the Indonesian Criminal Code (KUHP) and Law No. 31 of 1999 in conjunction with Law No. 20 of 2001 on the Eradication of Corruption, this study explores how these regulations are applied in practice. Case studies highlight recurring issues such as inflated project costs, fictitious procurement, and favoritism in awarding contracts. The paper also evaluates the role of law enforcement agencies, particularly the Corruption Eradication Commission (KPK), in investigating and prosecuting procurement-related offenses. While significant progress has been made in combating corruption, challenges remain in the consistent application of the law, limited resources, and political interference. This analysis emphasizes the need for stronger preventive mechanisms, greater transparency, and capacity-building among procurement officials to reduce legal violations. By examining real-world cases and their legal outcomes, this study aims to contribute to a better understanding of the intersection between criminal law and public procurement, and to support the development of more effective anti-corruption strategies within the public sector. ABSTRAK Pengadaan barang dan jasa di sektor publik merupakan fungsi penting yang mendukung operasional lembaga pemerintahan serta pelayanan kepada masyarakat. Namun, proses ini sering kali rentan terhadap praktik korupsi, seperti suap, kolusi, dan penyalahgunaan wewenang. Artikel ini membahas aspek hukum pidana yang terkait dengan pengadaan pemerintah melalui analisis berbagai kasus tindak pidana korupsi di Indonesia. Dengan mengkaji kerangka hukum, termasuk Kitab Undang-Undang Hukum Pidana (KUHP) dan Undang-Undang Nomor 31 Tahun 1999 junto Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi, studi ini mengevaluasi penerapan hukum dalam praktik. Studi kasus menunjukkan berbagai permasalahan yang berulang, seperti penggelembungan anggaran, pengadaan fiktif, dan praktik nepotisme dalam pemberian kontrak. Artikel ini juga menyoroti peran lembaga penegak hukum, khususnya Komisi Pemberantasan Korupsi (KPK), dalam mengusut dan menindak pelanggaran terkait pengadaan. Meskipun telah ada kemajuan dalam upaya pemberantasan korupsi, masih terdapat tantangan dalam konsistensi penegakan hukum, keterbatasan sumber daya, serta intervensi politik. Analisis ini menekankan pentingnya mekanisme pencegahan yang lebih kuat, transparansi yang lebih tinggi, serta peningkatan kapasitas aparatur pengadaan untuk meminimalisir pelanggaran hukum. Dengan menelaah kasus-kasus nyata dan hasil hukumnya, studi ini bertujuan memberikan pemahaman yang lebih dalam mengenai hubungan antara hukum pidana dan pengadaan publik, serta mendukung pengembangan strategi anti-korupsi yang lebih efektif di sektor pemerintahan.

Abstract

Indonesia's bitter experience of the embargo became a hard slap and a reminder of the importance of the National Defense Industry in meeting the needs of the TNI's defense equipment and encouraging the quality of the TNI's performance in carrying out the territorial defense of the Republic of Indonesia. Over time the development of the National Defense Industry continues to grow and is supported by regulations at the level of the Law, namely Law no. 16 of 2012 concerning the Defense Industry in realizing the Independence of the National Defense Industry. However, over time the implementation of Law no. 16 of 2012 does not work properly, challenges and problems arise, there are two problems in the National Defense Industry, namely Research and Development (R&D) and Defense Clustering. In this paper, a deeper review of the complex defense industry uses the research method, namely normative juridical research with two approaches including the statute approach and the conceptual approach. The results of the research in this paper carry the Core Indonesia Military-Industrial Complex which supports the strengthening of Research by initiating the Concept of Feedback and Clustering of the Defense Industry by forming 7 Defense Industry Clusters which include Raw Material Industry, Production Industry, Assembly Industry, Production, Support Industry (Components, Spare Parts), Electronic Industry, Maintenance.

Abstract

Environmental damage caused by corporations in Indonesia poses a serious threat to ecological sustainability and community welfare. This paper aims to analyze the legal framework and implementation of corporate criminal liability in environmental crimes. The main issue discussed is the ineffectiveness of law enforcement in holding corporations accountable despite their significant role in causing environmental damage. Using a normative juridical method, this research examines laws, doctrines, court decisions, and relevant legal literature. This study identifies several legal theories used to establish corporate liability, including the theory of identification, strict liability, and vicarious liability. The research findings reveal that although the Indonesian legal system, particularly Law No. 32 of 2009 and the new Criminal Code (Law No. 1 of 2023), recognizes corporations as criminal law subjects, their practical enforcement remains weak. The main challenges include corporate structural complexity, difficulties in proving mens rea, regulatory ambiguity, and political or economic influences. This study concludes that more effective enforcement mechanisms are needed, involving not only criminal sanctions but also remedial actions such as environmental restoration and corporate accountability. Strengthening institutional capacity, inter-agency coordination, and public participation are crucial steps toward improving environmental justice. This research underscores the urgency of comprehensive legal reform to ensure that corporations can be held criminally liable and contribute to sustainable environmental governance.

Abstract

The lack of good stigma is attached to student activists, ranging from the unsatisfactory level of academic quality, graduating on time, not responsive and very reactive, hard and opposing views, to demonstrations that are colored by violence. The stigma is only in a few cases, not all activists face such conditions, but this stigma seems to have been far attached. The development of student activists today demands that activists must also have three literacy abilities: data literacy, humanitarian literacy, and technological literacy. However, based on the preliminary results of this activity, 90 percent of UNNES Law School student activists agreed that activists must have a critical attitude and critical writing skills, but only about 10 percent of activists who had taken it seriously (thought publications in various forms). This activity is aimed at developing the critical abilities of student activists through increased publications in various media. This activity also aims to establish a critical writing community for student activists and present a concrete forum for channeling ideas and solutions for student activists in writing that can be read by many people. This activity is carried out through a critical thinking approach in legal studies using the IRAC (Issue, Rule, Application, Conclusion) method which is commonly used in analyzing various cases in legal study thinking.

Abstract

Law faculty students are currently required to have abilities not only in terms of theoretical and scientific capacity, but also practice. Law faculty students in many conditions are also very much needed directly by the community in solving various problems faced by the community ranging from small and minor legal issues, to complex and complicated matters. The needs of the community for legal assistance and legal assistance have become unavoidable, especially in the midst of the development of information and technology flows and industry in the industrial revolution era 4.0.
