Abstract

This research aims to identify and analyze the integrity zone as an innovative strategy to combat corruption. The research methodology uses normative juridical analysis, which is legal research that examines law from an internal perspective, with the object of its study being the legal norm, which involves literature analysis, qualitative approach, and comparative approach on the implementation of the integrity zone and the administrative law policy through the Corruption-Free Zone (WBK) in Indonesian governmental institutions. The results of the study indicate that the integrity zone approach involves mapping corruption-prone areas and proactively implementing preventive measures in these zones. This strategy includes increasing awareness, enforcing regulations, and strengthening supervision. Furthermore, this paper also discusses the challenges and opportunities in implementing the integrity zone and the WBK in Indonesia, along with providing policy recommendations to maximize the effectiveness of this approach in minimizing corruption and enhancing integrity within the scope of the Indonesian government administration. Implementing the integrity zone concept is expected to bring about positive changes in the efforts to eradicate corruption and build more transparent and integrity-driven governance in Indonesia.

Abstract

The rapid expansion of digital technology has intensified the phenomenon of cyberbullying, with adolescents constituting a particularly vulnerable group. This study examines legal uncertainty in the construction of criminal liability for cyberbullying perpetrators and evaluates the effectiveness of its enforcement within the Indonesian criminal justice system. Employing a normative-empirical juridical method, the research analyzes statutory frameworks, including the Information and Electronic Transactions Law and the Indonesian Criminal Code, alongside selected court decisions with permanent legal force. The findings reveal that although existing legal instruments may be used to prosecute cyberbullying-related conduct, the absence of an explicit legal definition of cyberbullying generates interpretative ambiguity and inconsistency in the application of offense elements. Furthermore, structural constraints such as limited digital forensic capacity and procedural challenges in evidence collection weaken enforcement effectiveness. Socio-cultural factors, including stigma and low reporting rates among adolescent victims, further exacerbate under-enforcement. This study highlights that the current legal framework has not yet adequately addressed the specific characteristics of cyberbullying as a digitally mediated form of harm. It recommends regulatory harmonization through the explicit codification of cyberbullying as a distinct offense, alongside strengthening institutional capacity and promoting digital literacy as a complementary non-penal preventive strategy. The study contributes to ongoing debates on cybercrime regulation and child protection in digital environments.

Abstract

Rape was clearly defined as an offence in the Indian Penal Code of 1860, drafted by the First Law Commission. For over a century, criminal laws relating to rape cases remained unchanged until the Mathura Custodial Rape Case prompted the Criminal Law (Second Amendment) Act of 1983. Subsequent legislative responses followed major cases, the 2012 Delhi Rape Case led to the Criminal Law (Amendment) Act, 2013, which provided for the death penalty in rape cases in which the death of the victim is caused or she is left in a vegetative state; the Unnao Rape Case of 2017 precipitated the Criminal Law (Amendment) Act, 2018, which made the punishment more strict and inserted several provisions; and in July 2024, new criminal laws were enforced. Despite these successive legislative interventions, each considered revolutionary in its time, heinous incidents have continued unabated, from the Hyderabad Rape Case of 2019 and the Hathras Rape Case of 2020 to the Kolkata Rape Case of August 2024. The cases from Mathura custodial rape to Kolkata rape have witnessed no change in the mentality of the society, which revolves around gender injustice and questions the physical appearance of a girl/woman. This paper analyses the rape laws through a critical examination of the after-effects of the 2013 and 2018 amendments of old criminal laws and the provisions of new criminal laws. It also traces the evolving meaning of the "personal liberty" of women across this period. The analysis reveals that deterrent laws have become a necessity, yet their implementation in society remains ineffective. The core cause behind these recurring cases lies not merely in legislative gaps but in deeply entrenched social attitudes that successive amendments have failed to address. Legislative reform alone cannot deliver justice when societal mentality remains unchanged. This paper employs a doctrinal-analytical method, drawing on constitutional provisions, statutory texts, Supreme Court jurisprudence, parliamentary committee reports, and National Crime Records Bureau data to critically examine the legislative and judicial treatment of rape law in India. This paper criticizes the gap between law on paper and law in action, underscoring that the personal liberty of women demands not only stronger legal frameworks but their meaningful and consistent enforcement.

Abstract

Fulfilment and protection of human rights in all aspects is a form of Constitutional Rights for Citizens that must be fulfilled by the State. Basic human rights also under no circumstances can be reduced even deprived. However, the fact is, human rights regulated in various laws and regulations in Indonesia have not been maximally implemented. The fulfilment and protection of human rights also faces its own challenges in implementing it in certain cases, for example disasters such as Pandemic Covid-19. Various legal instruments, both central and regional, were created to deal with and resolve the Covid-19 Pandemic problem. This study aims to examine the implementation of the fulfilment and protection of human rights in special situations such as Covid-19 Pandemic. This research is limited to the Semarang City area. This study wanted to find out and analyze various aspects of law and human rights in the implementation of various policies related to Covid-19 in the City of Semarang. This study seeks to find challenges and problems in the protection and fulfilment of human rights in the city of Semarang in the Covid-19 Pandemic. The method in this study uses empirical research, where researchers directly go to the field. The planned data was obtained from various related agencies in the city of Semarang, the community, and related NGOs. This research will assist the government in mapping human rights fulfilment policies in national disaster situations in this case the Covid-19 Pandemic.

Abstract

This study critically examines Indonesia's new penal code through the lens of international legal norms, exploring whether it genuinely embodies the principles of global justice. Despite the code's ambitious reforms aimed at modernizing Indonesia's legal framework, our analysis reveals significant gaps between its provisions and internationally accepted standards, particularly in areas such as human rights, due process, and equality before the law. The urgency of this research lies in Indonesia's important role in Southeast Asia, where legal frameworks can influence regional governance and human rights practices. Novelty arises from our comparative approach, juxtaposing Indonesia’s penal code against a backdrop of global legal norms while considering local cultural and societal contexts. This study uncovers how the interplay between domestic priorities and international expectations can lead to compromises that undermine the integrity of justice. Our findings contribute to the ongoing discourse on legal reform in emerging democracies, highlighting the challenges of aligning national legislation with international standards. By providing concrete recommendations for policy makers, legal practitioners, and civil society, this research emphasizes the need for a holistic approach to legal reform that respects both local values and global commitments. Ultimately, we argue that Indonesia's new penal code is not just a legal document but a reflection of its aspirations for justice, demanding scrutiny and ongoing dialogue to ensure it meets the standards of global justice in practice.

Abstract

Drug trafficking and terrorism have seriously threatened many countries' global stability and national security. However, in recent years, there has been an increasing trend of convergence between drug trafficking and terrorism, forming a phenomenon known as narco-terrorism. The article seeks to reveal the relationship between narcotics trafficking and terrorism, a phenomenon often called narco-terrorism. This study's normative legal research method utilizes conceptual and comparative approaches. The results reveal that the convergence between drug trafficking and terrorism seriously impacts security, economy, and social stability. The drug trade provides a substantial source of income for terrorist groups, enabling them to expand their networks, purchase weapons, and launch terror attacks. Conversely, terrorist groups provide drug traffickers protection, infrastructure, and access to drug markets. This study provides important insights for governments, law enforcement agencies, and international organizations in designing effective strategies and policies to counter narco-terrorism. By understanding the dynamics and mechanisms of convergence between drug trafficking and terrorism, appropriate preventive and countermeasures can be taken to mitigate the threats faced by the global community.

Abstract

This study explores the model of fulfilling refugee rights through community collaboration, with a specific focus on the Cisarua Refugee Learning Centre (CRLC) in Indonesia. Refugees, as one of the most vulnerable groups globally, often face significant challenges in accessing their basic rights, including education, healthcare, and legal protection. The research analyzes how community-based initiatives, especially through the CRLC, contribute to the realization of refugee rights in the context of international law, such as the 1951 Refugee Convention. This study emphasizes the importance of collaboration between refugees, local communities, and international organizations in fostering an inclusive environment for refugees to access essential services. By examining the CRLC's efforts in providing education, skills, and advocacy for refugees, this paper proposes a sustainable model for refugee rights fulfillment that aligns with international legal standards.

Abstract

This paper examines the role of national education in strengthening Indonesian identity in border regions, where nationalism, state sovereignty, and local identities often intersect. Areas such as Papua, North Kalimantan, and Aceh face distinct challenges due to historical tensions, geographic isolation, and political dynamics. The study analyzes how the national education system can promote a cohesive Indonesian identity while accommodating diverse local contexts. Using a qualitative legal and policy approach, the paper reviews key regulations, including the National Education System Law (No. 20/2003), to assess their effectiveness in fostering national unity. The findings indicate that although existing policies emphasize nationalism, they frequently overlook the specific needs and historical experiences of border communities, contributing to identity tensions. This research highlights gaps in the current legal framework and proposes integrating region-specific content into the national curriculum to create a more inclusive approach to identity-building. It argues that a balanced model—combining national values with local relevance—can strengthen both unity and legitimacy in border areas. The paper concludes by recommending legal reforms to enhance regional flexibility in educational content while maintaining national principles of sovereignty and cohesion. Suggested measures include revising the National Education System Law and expanding the Local Government Law (No. 23/2014) to support context-sensitive curriculum development aligned with both local histories and national identity.

Abstract

This study explores the dual role of Artificial Intelligence (AI) in improving operational effectiveness and fostering organizational agility, two critical factors for success in today’s dynamic business environment. By leveraging technologies such as machine learning, predictive analytics, and robotic process automation, organizations can streamline workflows, enhance cost efficiency, and enable data-driven decision-making. The research adopts a qualitative approach, analyzing case studies and expert insights to uncover key findings. Results indicate that AI implementation significantly enhances process speed, decision accuracy, and adaptability while reducing operational costs. However, challenges such as resistance to change, high implementation costs, and ethical concerns—particularly regarding data privacy—pose barriers to adoption. To address these, organizations must adopt strategic measures such as phased implementation, robust training programs, and ethical frameworks. The study introduces a conceptual model that illustrates AI's central role in driving efficiency and adaptability, supported by comparative performance metrics demonstrating tangible benefits. This research contributes to the broader understanding of AI’s transformative impact, emphasizing its potential as a catalyst for innovation and competitiveness. Furthermore, it provides practical recommendations for overcoming barriers to adoption, ensuring sustainable integration of AI technologies. By addressing both opportunities and challenges, the findings serve as a roadmap for organizations aiming to harness AI's full potential. Future research should focus on industry-specific applications and strategies to tailor AI adoption to unique organizational needs, thereby maximizing its impact across diverse sectors. Abstract

International human rights law is often celebrated for its universal principles, yet its doctrinal foundations remain deeply shaped by Eurocentric legal traditions and postcolonial power dynamics. This paper critically examines the colonial genealogy of key human rights instruments and institutions, arguing that the prevailing model of universality often excludes indigenous, communal, and non-Western legal epistemologies. Drawing on case studies from Africa, Southeast Asia, and Latin America, the paper highlights how Global South actors have both resisted and reinterpreted international human rights law to reflect local norms of justice and dignity. The novelty of this research lies in its methodological approach, which integrates postcolonial legal theory, legal pluralism, and comparative constitutional analysis to interrogate the foundational assumptions of universality. Rather than rejecting the human rights project altogether, the paper advocates for a transformative approach that centers legal pluralism and intercultural dialogue. This contribution is timely in the context of growing international debate on the legitimacy, effectiveness, and inclusivity of the human rights system. It offers a critical intervention into global legal discourse by proposing a decolonial framework that affirms both the contextual relevance and global applicability of human rights. The paper concludes by calling for institutional reforms within the United Nations system and a shift toward multi-normative understandings of human rights grounded in historical accountability and epistemic justice.
