Abstract

This study analyzes the phenomenology of cryptocurrency digital assets from the perspective of taxation and sharia law in Indonesia. Cryptocurrency, as a digital innovation based on blockchain technology, has received significant attention both as an alternative investment and a means of transaction. However, its existence poses regulatory challenges, especially in terms of taxation and compliance with sharia principles. This study uses a normative legal method with a legislative and conceptual approach to understand how tax regulations and sharia law regulate cryptocurrency transactions in Indonesia. Data were obtained through literature studies, analysis of relevant legal documents, fatwas, and Qanuns, and interviews with legal and sharia experts. The results of the study show that the Indonesian government has begun to regulate taxes on cryptocurrency transactions through several policies, although there are still challenges in their implementation, such as assessing transaction values and accurate reporting. From a sharia perspective, views on cryptocurrency vary. Some scholars accept cryptocurrency as halal, while others consider it haram due to speculative reasons and the lack of clear underlying assets. In Aceh, as a province with full implementation of sharia law, regulations related to sharia financial transactions are more complex. This study recommends harmonization between tax regulations and sharia law to create legal certainty and justice for all parties involved. The government is expected to strengthen regulations and supervision of cryptocurrency transactions and conduct socialization and education to the public regarding tax obligations and sharia principles related to cryptocurrency. With a comprehensive and integrative approach, it is hoped that a cryptocurrency regulatory system can be created that is fair, efficient, and in accordance with positive and sharia legal values in Indonesia.

Abstract

Background: The Indonesian Carbon Exchange (IDX Carbon) has emerged as a critical mechanism for carbon trading, introducing carbon units as securities rather than commodities. Despite this development, challenges remain in ensuring the integrity of carbon markets, including issues of double counting, manipulation of carbon unit measurements, and regulatory gaps. Objective: This study aims to examine the implementation of Carbon Emission Disclosure on Market Reaction with Green Investment as a mediating variable in companies listed on IDX Carbon. Methods: This study employed a quantitative research approach using SmartPLS with PLS-SEM. Hypothesis testing applied a t-statistic threshold of 1.96 and a significance level of α = 5% (p-value < 0.05). Results: All variables had Cronbach's Alpha values above 0.95 and AVE values above 0.66, indicating high reliability and validity. The R² value of Green Investment (Z) was 0.983 and Market Reaction (Y) was 0.925, indicating strong predictive relevance. Hypothesis testing revealed: (1) Green Investment significantly affects Market Reaction (t = 9.422, p = 0.000); (2) Carbon Emission Disclosure significantly affects Green Investment (t = 6.017, p = 0.000); (3) Carbon Emission Disclosure significantly affects Market Reaction (t = 2.655, p = 0.000); and (4) Carbon Emission Disclosure significantly affects Market Reaction through Green Investment as a mediating variable (t = 8.672, p = 0.000). All four hypotheses were accepted. Conclusion: Carbon Emission Disclosure has a significant direct effect on both Green Investment and Market Reaction in IDX Carbon-listed companies. Green Investment also serves as a significant mediating variable between Carbon Emission Disclosure and Market Reaction, highlighting the importance of transparent carbon emission reporting in supporting sustainable finance in Indonesia.

Abstract

Carbon exchange trading is an economic instrument developed to support greenhouse gas emission reduction and achieve sustainable development targets. In Indonesia, carbon trading is regulated by Presidential Regulation Number 98 of 2021 concerning the Management of Carbon Economic Value. This study aims to analyze the legal regulations for carbon exchange trading in Indonesia, the implementation of Presidential Regulation Number 98 of 2021 in achieving legal certainty, carbon trade governance, and the legal and institutional obstacles encountered in its implementation. The research method used is normative legal research with statutory, conceptual, and analytical approaches. Research data was obtained through a literature review sourced from laws and regulations, books, scientific journals, and other legal documents relevant to the research object. The results show that Presidential Regulation Number 98 of 2021 has provided a legal basis for the implementation of carbon trading through regulations regarding Carbon Economic Value, a national registration system, and mechanisms for measuring, reporting, and verifying emissions. However, its implementation still faces various obstacles, such as suboptimal regulatory harmonization, limited institutional coordination, unclear legal status of carbon units, and the need to strengthen the oversight system and legal protection for market players. Therefore, regulatory strengthening, institutional capacity building, and transparent and accountable governance are needed to create an effective, sustainable carbon market capable of supporting the achievement of Indonesia's greenhouse gas emission reduction targets.
