Abstract

Collateral is part of an agreement as a result of financial obligations and serves to provide confidence that the debtor will fulfil these financial obligations, where the guarantee is something that is submitted to the creditor by the debtor. The guarantee itself is divided into two, namely material security and personal guarantee. The license agreement itself is an agreement made by the license owner and the party who wants to use the license. One of the uses of a license agreement is in the film industry, where the Product House as a license owner can enter into a license agreement with the Video on Demand platform so that the film or series that has been made can be shown on the Video on Demand platform. Government Regulation No. 2022 on Creative Economy has opened up opportunities for license agreements as collateral objects. The license agreement as a collateral object itself is not an impossible thing, because other countries such as Iran and the United States have allowed license agreements as collateral objects. One of the Video on Demand platforms that uses license agreements in the screening of films on their platform is Netflix. Therefore, the Production House can make the license agreement made as an object of collateral.

Abstract

Introduction: Digital Bank based on POJK No.12/POJK.03/2021 Concerning Commercial Banks, is a bank incorporated in Indonesia that provides and carries out business activities mainly through electronic channels without a physical office other than the head office or using limited physical offices. Digital banks are then explained in Article 7B and Article 20A of the PPSK Law stating that both commercial banks and Islamic commercial banks can operate as digital banks. Based on this, the business fields of digital banks are the same as the business fields of commercial banks or Islamic commercial banks. Digital banks are divided into digital banks that are subsidiaries of conventional banks and banks that have been purely digital banks since their inception.Purposes of the Research: Examine the potential of digital banks in supporting the economy and discuss the legal issues faced by digital banks.Methods of the Research: This writing uses a normative legal research method with a statutory approach and a conceptual approach.Results Main Findings of the Research: The results of the study show that in the current era of globalization where technology is not something that is difficult to access, digital banks are here to bring a breath of fresh air to the banking world. Customers will get instant services without having to come directly to the office to get 24-hour banking services. Digital banks have one problem, namely credit distribution carried out through applications or websites which causes credit analysis with the 5C method to not run optimally so that it will increase the ratio of non-performing loans or NPLs. Therefore, digital banks need to prepare a Bank Credit Policy (KPB) that accommodates digital bank credit distribution as part of digital bank risk management as mandated in Article 2 Number 1 of the Financial Services Authority Regulation Number 18/POJK.03/2016 concerning the Implementation of Risk Management for Commercial Banks. The policy must be able to make digital banks able to conduct credit analysis without sacrificing the principle of prudence. The policy can be in the form of a loan limit, tenor or examination of additional documents required so that there is no non-performing loan in the future.

Abstract

This study examined the relationship between digital literacy competencies and learning outcomes through the implementation of blended learning models in Indonesian higher education institutions during the post-pandemic period. Employing a qualitative research methodology, this investigation utilized semi-structured interviews were conducted with 25 university students and 15 faculty members across five Indonesian universities, complemented by a document analysis of institutional policies and learning management system data. Through thematic analysis, following Braun and Clarke's six-phase approach, four primary themes emerged: (1) Digital Competency Development, (2) Pedagogical Transformation, (3) Learning Engagement Adaptation, and (4) Institutional Infrastructure Challenges. The findings revealed that students with higher digital literacy levels demonstrated enhanced learning outcomes in blended environments, characterized by improved critical thinking skills, increased collaborative engagement, and greater autonomous learning capabilities. However, significant disparities exist in digital access and competency levels, creating educational inequities that require institutional interventions. The study concludes that successful blended learning implementation necessitates comprehensive digital literacy development programs, robust technological infrastructure, and adaptive pedagogical strategies that bridge the digital divide, while enhancing educational quality in post-pandemic higher education contexts

Abstract

The research was conducted to analyze the legal impact on the position and obligations of the bank as the holder of mortgage rights (HT) for HT which has been determined to have no legal force by a court decision. With regard to lending, the existence of guarantees is a matter of sufficient concern to banks. Until now, land has been highly favored by banks as collateral for loans with mortgage rights. Cancellation of land ownership certificates can be submitted for land that has become HT. By canceling the mortgage right, the bank will lose the guarantee for the credit that has been issued, especially if the debtor is in bad credit status. Normative juridical is the method been used in this research. It is concluded from the discussion result that the legal consequences of the mortgage rights that have been determined to be non-forceable by a court decision on the position and obligations of the bank as the mortgage holder is that the bank will lose its position as preferred creditor. The cancellation of the agreement on the transfer of land rights also causes the cancellation of the mortgage agreement, considering that the object of the agreement does not meet the legal requirements of the agreement. The contractual relationship between the debtor and the bank as the creditor in the said rights agreement is considered non-existent and must be returned to its original state before the mortgage agreement. Penelitian dilakukan untuk menganalisis dampak hukum terhadap kedudukan dan kewajiban bank sebagai pemegang hak tanggungan (HT) untuk HT yang telah ditetapkan tidak memiliki kekuatan hukum oleh putusan pengadilan. Terkait pemberian kredit, keberadaan jaminan menjadi hal yang cukup diperhatikan oleh bank. Tanah hingga saat ini menjadi sangat disukai bank sebagai jaminan kredit dengan hak tanggungan. Pembatalan atas sertifikat kepemilikan atas tanah dapat diajukan terhadap tanah yang telah menjadi HT. Dengan pembatalan hak tanggungan, bank akan kehilangan jaminan atas kredit yang telah dikeluarkannya terlebih jika debitur dalam status kredit macet. Yuridis normative adalah metode penelitian yang digunakan dalam penelitian ini. Kesimpulan yang dapat diambil dari hasil pembahasan bahwa akibat hukum terhadap hak tanggungan yang telah ditetapkan tidak berkekuatan hukum oleh putusan pengadilan terhadap kedudukan dan kewajiban bank selaku pemegang hak tanggungan adalah bahwa bank akan kehilangan kedudukan sebagai kreditur preferen. Pembatalan perjanjian peralihan hak atas tanah turut menyebabkan pembatalam perjanjian hak tanggungan, mengingat objek perjanjiannya menjadi tidak memenuhi syarat sah perjanjian. Hubungan kontraktual antara debitur dan bank selaku kreditur dalam perjanjian hak tersebut dianggap tidak ada, sehingga keadaannya harus dikembalikan seperti semula.

Abstract

Identifikasi kandungan mineral pada tanah merupakan hal yang sangat penting agar dapat mengetahui sifat tanah. Salah satu teknik untuk mengetahui mineral yang terkandung pada tanah dapat dilakukan dengan mengunakan alat X-Ray Diffraction (XRD). Tanah pasir merupakan tanah yang tersebar cukup banyak di wilayah Indonesia. Penelitian ini dilakukan untuk mengetahui kandungan mineral Tanah pasir pantai Tanjung Pasir. Sampel tanah pasir pantai Tanjung Pasir diambil pada titik pengambilan sampel yang terletak pada 6o00’54,5”S; 106o40’51,5”E. Uji kandungan mineral dilakukan setelah uji sifat fisik tanah berupa uji kadar air tanah dan uji gradasi saringan. Kandungan mineral pada sampel tanah di uji di Pusat Teknologi Bahan Industri Nuklir - BATAN (Badan Tenaga Nuklir Nasional) yang berlokasi di Serpong. Hasil penelitian menunjukkan bahwa kandungan mineral dalam tanah pasir pantai Tanjung Pasir dapat disimpulkan bahwa tanah pasir tersebut mengandung Magnetite (Fe2+Fe3+2O4) sebesar 62,1 % dan kandungan mineral Quartz (SiO2) sebesar 37,9 %.

Abstract

Covid-19 virus that is attacking Indonesia has caused economic turmoil in Indonesia. This study aims to determine whether there is an influence of the buyback decision during the covid pandemic 19 on changes in stock prices (case study at PT Ramayana Lestari Sentosa, Tbk). The study uses descriptive research methods to thoroughly describe the problems that occur and relate to the buyback decision made by PT Ramayana Lestari Sentosa, Tbk during this co-19. In this study secondary data, namely the daily stock price data of PT Ramayana Lestari Sentosa, Tbk, were taken from stock trading on IDX.co.id. List of stock prices taken from March 16-18, 2020 to see the movement of stock prices before and after the announcement of buy back from PT. Ramayana Lestari Sentosa, Tbk. The results of this study are the stock price of PT. Ramayana Lestari Sentosa, Tbk continued to experience a decline from before and after the Buyback announcement. Because investors respond negatively to this buyback because they assume that the business in the retail sector is not very good in this co-19 condition. PT. Ramayana Lestar Sentosa changes other business strategies to increase the number of shares purchased so that the price of PT. Ramayana Lestari Sentosa can rise again.

Abstract

The application of business licensing as a part of the ease of doing business has shifted the obligations present for business actors. One of the forms of said change is the absence of an obligation to conduct EIAs as a basic requirement to acquire a business license. This could boost investment in Indonesia. On the other hand, it also can prompt legal risks that are the revocation of business licenses towards actors that had failed to fulfill business license through OSS RBA. This provision impacts the application of the sustainable finance principle. Without the requirement of EIAs as the prerequisite of business licenses, banks gain the challenge of adjusting their approach towards the gaining of profits from long-term investments depends on a sustainable future on administering of credits by banks. The article aims to analyze the legal implications of changing regulation upon EIAs requirement on business licensing through Online Single Submission towards the application of the sustainable finance principle and the juridical consequences of the use of licenses based on commitments in the approval of bank credit. This research uses a normative juridical approach specifying in the descriptive analysis of primary and secondary law sources. The changed regulation upon EIAs requirement on business licensing through Online Single Submission has legal consequences for the bank to adjusting lending based on the debtor’s business activity stages and requiring EIA as the basis to provide credit on the applications of sustainable finance principle. Sustainable principle pushed out the alteration of banks' approach in the initiation of sustainable economic development with the gaining of profits from long-term investments dependant on future sustainable policy frameworks. The bank must take that approach is through policy frameworks that support sustainable economic development by crystallizing EIAs as a tool for credit decision.

Abstract

This study analyses the role of company owners based on the number of shares owned by institutions, the largest shareholder, and foreign owners on tax planning of manufacturing companies from 2014 to 2019. Using STATA on panel data after purposive sampling, this study concludes that institutional owners play a role in encouraging management in tax planning towards aggressive minimisation of tax burden, but foreign owners are known to encourage management in tax planning towards compliance, and concentrated ownership has no significant effect. These results contribute to stakeholders who have an interest in corporate tax procedures and burdens to consider the company's shareholders for their role in tax planning by management. The use of Effective Tax Rate and Penalty (ETRP) as an indicator of tax planning developed in this study shows maximum results so that it can be used in further research.

Abstract

The aim of this research is. Analyzing the impact of good governance and its occurrence on integrated reporting with company size as a moderate variable. The research was conducted on mining companies. the period 2019-2021. The research sample was obtained as many as 44 companies with purposive sampling method. The data analysis technique used multiple linear regression, Moderated Regression Analysis. The results of data analysis found that independent commissioner reporting and sustainability had no effect on integrated reporting, and Firm Size is able to moderate the relationship between Good Governance and Sustainability Reporting on integrated reporting. Based on the research results, investors can consider and pay attention to the presence of the audit committee as an internal company before investing.

Abstract

Penelitian ini bertujuan untuk menguji daya hasil dan adaptasi klon-klon kentang harapan introduksi di dataran medium. Penelitian dilakukan di Desa Sukasari Kidul, Kecamatan Argapura, Kabupaten Majalengka dengan ketinggian 600 m dpl.  Materi yang ditanam sebanyak 11 klon introduksi dan 2 varietas kentang (Granola dan MB 17). Hasil pengujian menunjukkan semua klon dan varietas yang ditanam memperlihatkan pertumbuhan vegetatif yang baik. Penyakit yang terdeteksi di lapangan antara lain layu bakteri Ralstonia solanacearum, penyakit akibat virus (mosaik), dan kudis. Sedangkan hama yang muncul di lapangan adalah trips dan penggorok daun Liriomyza huidobrensis.  Klon-klon  CIP-391846.5; CIP-395192.1 dan CIP-396311.1 mempunyai produksi ubi di atas 350 gram per tanaman. Klon-klon tersebut mampu beradaptasi di dataran medium Majalengka dan berpotensi untuk dilanjutkan dalam uji daya hasil lanjutan.Kata kunci:  daya hasil, Solanum tuberosum L., suhu tinggi ABSTRACTThe objective of this trial was to evaluate the yield and adaptation of potato clones at medium altitude. The trial was carried out in Sukasari Kidul, Argapura Sub-district, Majalengka, West Java at 600 m asl. The material were planted as many as 13 advance clones and varieties of potatoes. The result showed that all the clones have good vegetative growth. The disease was detected in the field were bacterial wilt (Ralstonia solanacearum), viral diseases (mosaic), and scab, while pests in the field were trips and Liriomyza huidobrensis. Clones CIP-391846.5; CIP-395192.1 and CIP-396311.1 have the tuber production above 350 grams per plant.
