Abstract

Abstract This research examines the revitalization and pilot of the Office of Religious Affairs (KUA) in Indonesia, particularly in relation to the implementation of benefit-based Islamic law. The Ministry of Religious Affairs is under pressure to improve public services by embracing digitalization and making them more accessible. As a crucial part of the ministry's services, the KUA needs to reflect the commitment to nurturing the community. The revitalization involves digital applications for easier access to KUA services, improving infrastructure and human resources, and implementing good governance principles in e-government. The objective is to enhance the efficiency, transparency, and quality of public services. The digitalization efforts include online registration, information dissemination, consultations, digital document services, and monitoring and evaluation. The research findings indicate that the revitalization through digitalization strengthens public services, increases transparency, and meets the community's expectations for improved efficiency and accessibility. The efforts align with the KUA's functions and support the dynamics of Islamic law in Indonesia. Keywords: Revitalization, piloting, religious affairs office, Indonesia Abstrak Penelitian ini mengkaji revitalisasi dan uji coba Kantor Urusan Agama (KUA) di Indonesia, khususnya dalam kaitannya dengan implementasi hukum Islam berbasis kemaslahatan. Kementerian Agama berada di bawah tekanan untuk meningkatkan layanan publik dengan merangkul digitalisasi dan membuatnya lebih mudah diakses. Sebagai bagian penting dari layanan kementerian, KUA perlu mencerminkan komitmen untuk mengayomi masyarakat. Revitalisasi ini melibatkan aplikasi digital untuk memudahkan akses ke layanan KUA, meningkatkan infrastruktur dan sumber daya manusia, serta menerapkan prinsip-prinsip tata kelola yang baik dalam e-government. Tujuannya adalah untuk meningkatkan efisiensi, transparansi, dan kualitas layanan publik. Upaya digitalisasi tersebut meliputi pendaftaran online, penyebaran informasi, konsultasi, layanan dokumen digital, serta pemantauan dan evaluasi. Temuan penelitian menunjukkan bahwa revitalisasi melalui digitalisasi memperkuat layanan publik, meningkatkan transparansi, dan memenuhi harapan masyarakat untuk meningkatkan efisiensi dan aksesibilitas. Abstract

Abtrack This paper examines the concept of substitutional heir (plaatsvervulling) in Islamic inheritance law from the perspectives of ontology, epistemology, and axiology. The concept of substitutional heir regulates the inheritance mechanism when the primary heir (biological child) has passed away before the testator (parent). Differences in interpretation among Islamic legal scholars regarding this concept can affect the final outcome of inheritance distribution, especially in cases involving complex family structures. This paper aims to unify perspectives and develop a comprehensive guideline on the application of the substitutional heir concept. From the ontological aspect, the paper explores the essence and philosophical foundation of this concept within Islamic teachings. Epistemologically, the paper examines the sources and interpretive methods used. From the axiological perspective, the paper evaluates the values and objectives to be achieved through the implementation of this concept in realizing justice, utility, and general welfare in the distribution of inheritance according to Islamic law. Abstrak Makalah ini mengkaji konsep ahli waris pengganti (plaatsvervulling) dalam hukum kewarisan Islam dari perspektif ontologi, epistemologi, dan aksiologi. Konsep ahli waris pengganti mengatur mekanisme pewarisan ketika ahli waris utama (anak kandung) telah meninggal lebih dulu daripada pewaris (orang tua). Perbedaan interpretasi di kalangan ahli hukum Islam terkait konsep ini dapat mempengaruhi hasil akhir pembagian harta warisan, khususnya dalam kasus yang melibatkan struktur keluarga kompleks. Makalah ini bertujuan untuk menyatukan pandangan dan menyusun pedoman komprehensif mengenai penerapan konsep ahli waris pengganti. Dari sisi ontologi, dibahas hakikat dan landasan filosofis konsep ini dalam ajaran Islam. Secara epistemologi, dikaji sumber dan metode interpretasi yang digunakan. Dari sisi aksiologi, dinilai nilai-nilai dan tujuan yang ingin dicapai melalui implementasi konsep ini dalam mewujudkan keadilan, kemanfaatan, dan kemaslahatan umum dalam pembagian harta warisan. Abstract

Abstract A classic issue that still raises debate is the adaptability of Islamic law. Scholars of Islamic law are required to broaden the approach in responding to problems in the community. Philosophy, sociology, and anthropology are considered appropriate to be used as an approach in determining the law. This research uses a library research method that aims to describe the determination of Islamic law through philosophical, sociological, and anthropological approaches. From this research, it is found that in the context of determining the law, the disciplines of sociology, philosophy, and anthropology are a tool to approach in determining the law, not a methodology. The methodology of Islamic law istinbath is considered sufficient by using methods that have been developed by fuqaha scholars both salaf and contemporary. Keywords: Ijtihad, Taklid, Istinbath, Abstrak Persoalan klasik yang masih menimbulkan perdebatan adalah kemampuan adaptasi hukum Islam. Para sarjana hukum Islam dituntut untuk melakukan perluasan pendekatan dalam merespon permasalahan di umat. Filsafat, sosiologi, dan antropologi dipandang tepat untuk dijadikan alat pendekatan dalam menetapkan hukum. Penelitian ini menggunakan metode penelitian kepustakaan atau library research yang bertujuan untuk mendeskripsikan penetapan hukum Islam melalui pendekatan filosofis, sosiologis, dan antropologis. Dari penelitian ini ditemukan bahwa dalam kontkes penetapan hukum, disiplin sosiologi, filsafat, dan antropologi adalah sebuah alat untuk melakukan pendekatan dalam penetapan hukum, bukan merupakan metodologi. Metodologi istinbath hukum Islam dipandang telah mencukupi dengan menggunakan metode yang telah dikembangkan oleh para ulama fuqaha baik salaf maupun kontemporer. Abstract

Abstract The emergence of digital assets such as cryptocurrencies, e-wallets, and non-fungible tokens (NFTs) has significantly impacted societal transactions and interactions. However, the inheritance of these digital assets poses challenges due to the lack of clear regulations in both positive and Islamic law. This study employs a normative juridical approach with a comparative law method to analyze the provisions of positive law in Indonesia and the principles of Islamic law related to the inheritance of digital assets. The study aims to identify gaps between the two legal systems and provide recommendations for regulatory harmonization. The findings reveal that positive law in Indonesia does not explicitly regulate digital assets in the context of inheritance, leading to uncertainty and potential disputes among heirs. Islamic law also lacks clear provisions regarding digital assets, making it difficult to apply inheritance principles based on sharia. The study highlights the urgent need to harmonize positive and Islamic law to accommodate the unique characteristics of digital assets and ensure fair and transparent distribution among heirs. Collaboration between policymakers, academics, and the public is essential to develop regulations that address the needs and characteristics of digital assets in the context of inheritance law. The study concludes by emphasizing the importance of understanding both legal systems to overcome challenges in digital asset inheritance and create a more just and effective legal framework for all parties involved. Keywords: Digital assets, Legacy, Regulation, E-wallet, Non-Fungible Token (NFT) Abstrak Kemunculan aset digital seperti mata uang kripto, dompet elektronik, dan token yang tidak dapat dipertukarkan (NFT) telah memberikan dampak yang signifikan terhadap transaksi dan interaksi masyarakat. Namun, pewarisan aset digital ini menimbulkan tantangan karena kurangnya peraturan yang jelas baik dalam hukum positif maupun hukum Islam. Penelitian ini menggunakan pendekatan yuridis normatif dengan metode perbandingan hukum untuk menganalisis ketentuan hukum positif di Indonesia dan prinsip-prinsip hukum Islam terkait pewarisan aset digital. Penelitian ini bertujuan untuk mengidentifikasi kesenjangan antara kedua sistem hukum tersebut dan memberikan rekomendasi untuk harmonisasi peraturan. Temuan menunjukkan bahwa hukum positif di Indonesia tidak secara eksplisit mengatur aset digital dalam konteks pewarisan, sehingga menimbulkan ketidakpastian dan potensi perselisihan di antara para ahli waris. Hukum Islam juga tidak memiliki ketentuan yang jelas mengenai aset digital, sehingga menyulitkan penerapan prinsip-prinsip waris berdasarkan syariah. Studi ini menyoroti kebutuhan mendesak untuk menyelaraskan hukum positif dan hukum Islam untuk mengakomodasi karakteristik unik aset digital dan memastikan distribusi yang adil dan transparan di antara para ahli waris. Kolaborasi antara pembuat kebijakan, akademisi, dan masyarakat sangat penting untuk mengembangkan peraturan yang sesuai dengan kebutuhan dan karakteristik aset digital dalam konteks hukum waris. Studi ini diakhiri dengan menekankan pentingnya memahami kedua sistem hukum untuk mengatasi tantangan dalam pewarisan aset digital dan menciptakan kerangka hukum yang lebih adil dan efektif bagi semua pihak yang terlibat. Abstract

Abstract This study examines the division of Islamic law into immutable laws (tsawâbit) and changeable laws (mutaghayyirât) within the framework of Sharia. The article highlights the importance of understanding immutable laws as an unchanging foundation, while flexible laws should be interpreted and implemented according to the continuously evolving social and cultural dynamics. In the post-revelation era, the task of Muslims is to interpret and apply the revelation in the context of the modern and ever-changing society. The plurality of interpretations and the diversity of expressions in practicing Islam are considered inevitable and not erroneous as long as the methodology used is accountable. The concept of the "Islamic peaceful path" developed by Nusantara scholars is expected to provide solutions to resolve conflicts and tensions, as well as to promote progress in various aspects of life, including science and economy. Keywords: Division, Immutable and Changeable Laws Abstrak Penelitian ini mengkaji pembagian hukum Islam menjadi hukum yang tetap (tsawâbit) dan yang berubah (mutaghayyirât) dalam konteks syariah. Artikel ini menyoroti pentingnya pemahaman terhadap hukum yang bersifat tetap sebagai fondasi yang tidak berubah, serta fleksibilitas hukum yang bersifat berubah agar dapat diinterpretasikan dan diimplementasikan sesuai dengan dinamika sosial dan budaya yang terus berkembang. Pasca era pewahyuan, tugas umat Islam adalah menafsirkan dan mengaplikasikan wahyu dalam konteks masyarakat modern yang terus berubah. Pluralitas penafsiran dan keragaman ekspresi pengamalan Islam dianggap tak terhindarkan dan bukan merupakan kesalahan selama metodologi yang digunakan dapat dipertanggungjawabkan. Konsep "jalan damai Islam" yang dikembangkan oleh ulama Nusantara diharapkan dapat menjadi solusi untuk menyelesaikan konflik dan ketegangan, serta mendorong kemajuan dalam berbagai aspek kehidupan, termasuk ilmu pengetahuan dan ekonomi. Abstract

Abstrack The customary court of Badamai is a significant cultural heritage preserved in various regions of Indonesia, reflecting local wisdom in resolving disputes and upholding justice. Among the Banjar community in South Kalimantan, Badamai is a deeply rooted form of dispute resolution that prioritizes deliberation and consensus. This practice not only reflects the social values of the Banjar community but also demonstrates the flexibility of Islamic law in adapting to local contexts. This study aims to explore the application of Islamic inheritance law within the framework of the Badamai customary court from the perspectives of the Madrasah Ahlul Hadis and the Madrasah Ahlurra’yi. By examining how these two schools of thought interpret and apply Islamic inheritance laws, the research provides a comprehensive understanding of the interaction between Islamic jurisprudence and local traditions. The findings highlight the adaptability of Islamic law in accommodating local customs, contributing to the broader discourse on the integration of Islamic principles with indigenous practices. This exploration offers valuable insights into the dynamic relationship between religious jurisprudence and cultural heritage, emphasizing the importance of contextualizing Islamic law within the unique socio-cultural landscape of the Banjar community. Dengan meneliti bagaimana kedua aliran pemikiran ini menafsirkan dan menerapkan hukum kewarisan Islam, penelitian ini memberikan pemahaman komprehensif tentang interaksi antara yurisprudensi Islam dan tradisi lokal. Temuan ini menyoroti kemampuan adaptasi hukum Islam dalam mengakomodasi adat setempat, berkontribusi pada diskursus yang lebih luas tentang integrasi prinsip-prinsip Islam dengan praktik-praktik adat. Abstract

Takalar Regency is a region in South Sulawesi Province where rice is the leading agricultural commodity, surpassing other crops such as corn, tubers, and legumes. Along with the rising incidence of degenerative diseases particularly diabetes mellitus (DM), which is suspected to be linked to excessive consumption of high glycemic rice public awareness of choosing healthier rice options has increased. One of the innovations currently being developed to address this issue is parboiling technology, which can reduce the glycemic index (GI) of rice. In addition to its health benefits, parboiled rice also holds high economic value and has the potential to empower local rice farmers and traders. This activity aimed to educate the community on the benefits of consuming parboiled rice and to provide hands-on training in its production. The method used involved both counseling and practical training sessions, conducted in Tala Village, Sombalabella Subdistrict, Pattalassang District, Takalar Regency. The participants consisted of 40 women who are farmers and rice traders, economically unproductive at the time. The program was delivered in two sessions: a material presentation and practical training. Based on the participants’ questionnaire responses, knowledge about parboiled rice increased significantly from only 47% awareness before the activity to 100% afterward. In terms of skills, none of the participants initially knew how to make parboiled rice, but after the training, 90% were able to do it independently. The conclusion of this activity is that the counseling and training on the utilization of parboiling technology can broaden the community's knowledge and enhance their skills in producing parboiled rice.
