Abstract

The purpose of this research is to find out how the existence of TKI is in the protection of labor law, because along with the progress of the times (globalization era), problems in the field of employment are also increasing, especially if it is associated with other aspects such as economic, social and political. However, the basic problems in this field still do not deviate from the classic problems, namely the “master-worker” relationship, strikes and dismissals, and rights and obligations. Workers and employers in their respective positions have rights and obligations. However, in this case, it is the workers who need to be protected and guaranteed by law in exercising their rights. In the field of employment, these guarantees often include economic guarantees.

Abstract

Nursing services are an essential component of the healthcare system in hospitals, aimed at providing professional, safe, and standardized nursing care. In practice, nurses are obligated to perform their duties in accordance with professional standards, service standards, standard operating procedures (SOPs), and the nursing code of ethics. However, there is a possibility of errors or negligence that may give rise to allegations of nursing malpractice and potentially cause harm to patients.This study aims to analyze the legal liability of nurses in relation to alleged nursing malpractice in hospitals and to examine the forms of legal responsibility that may be imposed under applicable laws and regulations. The research employs a normative legal method using both statutory and conceptual approaches through the analysis of relevant legislation, legal literature, and scientific journals.The findings indicate that nurses may be held legally accountable if they are proven to have committed acts or omissions that deviate from professional standards and result in harm to patients. Such legal liability may take the form of civil, criminal, administrative, as well as ethical and professional disciplinary responsibility. Furthermore, hospitals as healthcare institutions may also be held liable for the actions of healthcare professionals acting within the scope of their authority.Therefore, it is necessary to enhance nurses’ competencies, ensure compliance with service standards, and implement effective supervision mechanisms in order to prevent alleged nursing malpractice and to guarantee legal protection for both patients and healthcare professionals.

Abstract

The development of information technology has driven the transformation of healthcare services towards a digital-based system, one of which is through telemedicine. The use of telemedicine in Indonesia is increasing because it can expand access to healthcare services, especially for communities facing geographical limitations and the distribution of medical personnel. However, the development of telemedicine has also given rise to various legal issues related to the legality of medical personnel's practice, the use of a Practice Permit (SIP), health data protection, and the division of responsibilities between medical personnel and telemedicine platform providers. This study aims to analyze the legal regulations for telemedicine in Indonesia and examine the forms of legal protection for medical personnel in teleconsultation services through telemedicine applications. The study uses a normative juridical method with a statutory and conceptual approach. The legal materials used consist of primary legal materials in the form of laws and regulations and secondary legal materials in the form of books, scientific journals, and relevant legal doctrines. The analysis is conducted qualitatively through the interpretation and synchronization of legal norms related to telemedicine. The research results show that telemedicine has obtained a legal basis through Law Number 17 of 2023 concerning Health, Government Regulation Number 28 of 2024, the Electronic Information and Transactions Law, and the Personal Data Protection Law. However, there remains unclear regulations regarding the use of SIP in teleconsultation services, the jurisdictional boundaries of digital practices, and the division of legal responsibilities between medical personnel and telemedicine platforms. Therefore, strengthening and harmonizing regulations are needed to provide legal certainty and more effective protection for medical personnel in the provision of teleconsultation services based on telemedicine applications.

Abstract

The circulation of unregistered cosmetics and traditional medicines (jamu) containing hazardous substances has continued to rise in Surakarta City and the wider Soloraya region over the past three years, despite a reasonably comprehensive legal framework, including Law Number 8 of 1999 on Consumer Protection, Law Number 17 of 2023 on Health, and various technical regulations issued by the National Agency of Drug and Food Control (BPOM). This article examines the effectiveness of law enforcement following cases of illegal cosmetics and traditional medicine circulation in Surakarta and identifies the obstacles hindering its optimal implementation. Using a normative juridical method with statutory, conceptual, and case approaches, this study analyzes primary, secondary, and tertiary legal materials through library research, employing Lawrence M. Friedman's legal system theory, Soerjono Soekanto's law enforcement theory, and Ahmadi Miru's consumer protection theory as the analytical framework. The findings show that although the normative framework covers preventive, repressive, and curative measures, its implementation is undermined by sentencing disparity, limited enforcement resources, and a weak legal culture among business actors and consumers, particularly in online transactions. These conditions weaken the deterrent effect of the law and make it difficult for consumers to obtain recovery for their rights.

Abstract

Intimidasi verbal merupakan bentuk kekerasan kerja yang paling sering dialami apoteker, baik di tingkat global maupun di Indonesia. Apoteker di apotek maupun instalasi farmasi rumah sakit kerap menerima ancaman, hinaan, dan ucapan kasar dari pasien atau keluarga pasien, sementara hukum Indonesia belum memiliki satu instrumen yang koheren untuk menjawab persoalan ini. Pasal 34 UUD NRI 1945 memerintahkan negara menjamin pelayanan kesehatan yang layak, yang secara implisit menuntut adanya perlindungan bagi tenaga kesehatan yang menyelenggarakan pelayanan tersebut. Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan memberi tenaga kesehatan, termasuk apoteker, hak atas perlindungan hukum dan perlindungan dari perlakuan yang bertentangan dengan martabat manusia, namun instrumen pidana yang tersedia (Pasal 335 dan 336 KUHP, serta Pasal 448 KUHP baru yang berlaku 2026) tidak dirancang khusus untuk konteks pelayanan kefarmasian, dan standar profesi dalam Permenkes Nomor 73 Tahun 2016 lebih menitikberatkan pada mutu pelayanan ketimbang keselamatan pribadi apoteker. Penelitian ini memakai metode yuridis-normatif dengan pendekatan perundang-undangan dan konseptual. Penelitian ini memakai teori perlindungan hukum Hadjon, kerangka struktur-substansi-budaya hukum Friedman, dan formula Radbruch, serta menempatkan pembahasan dalam bingkai teori keadilan Rawls. Hasilnya menunjukkan bahwa Indonesia sesungguhnya sudah memiliki rantai perlindungan yang menurun dari konstitusi ke undang-undang, hukum pidana, dan etika profesi, tetapi rantai itu terfragmentasi, bersifat reaktif, dan jarang digunakan apoteker dalam praktik. Rekonstruksi diusulkan untuk memadukan perlindungan preventif di lingkup tempat kerja dengan perlindungan hukum represif, sehingga amanat keadilan sosial dalam Pasal 34 UUD NRI 1945 benar-benar terwujud bagi apoteker.

Abstract

A prevalent issue in contemporary discourse concerns how love, typically understood as a personal motivation, influences the dynamics of Sharia-based economic transactions, particularly within familial relationships and Muslim business communities. The aim of this study is to analyze love as an economic motive within the context of Islamic economics, mapping its connection to Sharia principles such as justice, transparency, and mutual assistance. The research employs a descriptive qualitative approach, utilizing literature review as its methodology, with data analysis conducted through content analysis techniques to explore the conceptualization of love within the framework of Islamic economics. The findings reveal that love plays a critical moral foundation in Sharia-compliant economic transactions, reinforcing honesty, trustworthiness, and justice. Love influences economic decisions in family and business contexts, fostering cooperation; however, it also carries the potential for misuse if misaligned with Sharia principles. While love can drive ethical behavior and social welfare, the study highlights the duality of its role, which requires careful regulation to prevent injustice. Therefore, the application of Sharia principles must prioritize justice, transparency, and collective welfare.

Abstract

Business ethics plays a key role in building strong, competitive companies through strategic planning, good organization, transparency in procedural systems, and a corporate culture supported by good and consistent ethics. This research was conducted using the direct observation method. With a sampling technique collected through interviews with several employees at PT. Nesia pan pacific clothing The results of this research show that good business ethics can improve the quality of employee work by creating a positive work environment and providing motivation. Ethical business practices include transparency, fairness, and social responsibility, which can create a sense of employee trust and loyalty. This can motivate them to work more efficiently and contribute positively to the overall quality of work.
