Abstract

This study aims to find out the judge's considerations in decision Number 40/Pid.B/2020/PN Wno and to find out the decision in case Number 40/Pid.B/2020/PN Wno in terms of positive law in Indonesia. The type of research used in this study is normative legal research or library research with 3 approaches, namely the statutory approach, the case approach and the conceptual approach. The results of this study indicate that the basis for the judge's considerations in imposing a sentence on the case referred to in the judge's decision Number 40/Pid.B/2020/PN Wno is juridical in nature consisting of the public prosecutor's indictment, witness testimony, defendant's statement, evidence, and Apart from that, the articles in the criminal code are non-juridical in nature, namely the reason for the defendant's actions and the consequences of the defendant's actions. That the crime of abortion has violated the provisions of Article 346 of the Criminal Code, this can be seen because the elements in accordance with that article have been fulfilled. Because of the above considerations, the judge decided that the defendant was found guilty so that the defendant had to serve a prison sentence of 1 year and 10 months.

Abstract

An auction is an open sales mechanism that provides the public with the opportunity to acquire goods or assets through the highest bid. This process begins with an official announcement and is carried out transparently. In line with the development of information technology and efforts to modernize public services, the Indonesian government issued Minister of Finance Regulation (PMK) Number 122 of 2023 concerning Auction Implementation Guidelines. This regulation aims to update and simplify the auction process with a digital approach to make it more effective, efficient, and reach the wider community. This study aims to analyze the implementation of PMK 122/2023 at the Surakarta State Assets and Auction Service Office (KPKNL) and identify obstacles encountered in its implementation. The research method used is a juridical-empirical with a qualitative approach, where primary data was obtained through interviews with auction officials and related staff at the Surakarta KPKNL, while secondary data was collected from regulations, official documents, and legal literature. The research results show that the implementation of PMK 122/2023 has had a positive impact on improving the quality of auction services through digitalization, such as the implementation of an e-Auction system, the provision of e-Auction Corner facilities, and the use of other information technology to facilitate public access. Based on Soerjono Soekanto's theory of legal implementation, the success of policy implementation is influenced by factors such as legal substance, law enforcement officers, and the legal culture of the community. The Surakarta KPKNL (National Public Service Agency) is considered successful in increasing efficiency, accountability, and service satisfaction to the community. However, obstacles remain in its implementation, such as disputes over ownership of auction objects, resistance to occupants' evictions, and technical and administrative challenges in using online systems. This research recommends the need for inter-agency synergy, strengthening complementary regulations, and public education to support the smooth and sustainable implementation of digital-based auctions.

Abstract

The community service program through the International Community Service Program (KKN Internasional) at Sanggar Belajar Sungai Buloh Selanggor Malaysia was motivated by the low understanding of national identity, legal awareness, and digital literacy among children of Indonesian migrant workers in Malaysia. This condition is influenced by limited access to civic education and the diaspora environment, which exposes students more to foreign cultures than Indonesian national values. This program aimed to strengthen national identity and foster patriotism through a Digital Legal Empowerment approach based on digital literacy and basic legal education. The method used was Participatory Action Research (PAR) with differentiated learning and a Hybrid-Analog approach through interactive digital media, group discussions, simulations, and participatory mentoring. The results showed an increase in student participation in the learning process, understanding of national symbols, citizens’ rights and obligations, and the use of digital media for educational purposes. In addition, the program encouraged the emergence of local leaders within the learning community who assisted the learning process and promoted a collaborative learning culture. This community service program demonstrates that the integration of digital literacy and legal education can be an effective strategy to strengthen nationalism, improve legal awareness, and create social transformation among children of Indonesian migrant workers in Malaysia.

Abstract

There is a growing gap between the normative regulation of medical services, which is oriented toward patient safety, and the reality of commercialized practice driven by economic interests. This condition creates conflicts of interest and weakens legal protection for patients. This study aims to analyze the legal framework governing the commercialization of medical services and examine its implications for patient protection in order to realize a healthcare system that is fair, professional, and patient-oriented. The research method used is a normative legal approach that analyzes legal norms, principles, and rules. The analysis is conducted qualitatively to produce theoretical understanding and comprehensive legal argumentation regarding the relationship between business practices in medical services and the legal responsibilities of medical personnel. The findings show that Indonesia’s legal framework for the commercialization of medical services recognizes the economic aspects of medical professionals and healthcare facilities, but it is still constrained by ethical principles, professionalism, and patient protection, resulting in a normative dualism between economic orientation and humanitarian values. In practice, this dualism has not been harmoniously implemented due to the persistent gap between norms and implementation. This condition weakens patient protection, increases the risk of over-treatment, creates information asymmetry, and shifts the doctor–patient relationship into a transactional one that may trigger medical disputes and service injustice. Therefore, stronger regulatory enforcement, clearer separation between medical and business functions, service transparency, strengthened ethical supervision, and reform of medical legal culture are required to achieve a balanced healthcare system that fairly integrates economic interests with patient protection and prioritizes patient safety.

Abstract

The rapid recovery of the tourism sector in the post-pandemic era has increased the need for sustainable tourism development at the local level. Local governments have a strategic role in ensuring that tourism growth is able to provide economic benefits while maintaining social and environmental sustainability. However, various empirical evidence shows that the implementation of sustainable tourism policies at the regional level is still uneven and often faces institutional challenges and coordination between stakeholders. This study aims to analyze the role of local governments in encouraging sustainable tourism development and identify strategies for optimizing these roles in the current governance context. This research uses a qualitative descriptive approach with a policy and stakeholder analysis framework. Data was collected through document analysis of regional tourism policies, development plans, and relevant secondary data sources, and analyzed using thematic analysis techniques. The results of the study show that local governments generally play the role of regulators and facilitators, but the effectiveness of these roles is still limited by limited institutional capacity, weak collaboration between stakeholders, and the lack of optimal integration of sustainability principles in operational practices. This research also identifies opportunities to strengthen governance through collaborative planning, community empowerment, and the implementation of adaptive policy instruments. The study contributes to the development of the literature by highlighting the gap between policy formulation and implementation at the regional level and offering an integrative framework for optimizing the role of local governments in sustainable tourism development. The findings of this study provide strategic implications for policymakers in strengthening sustainable tourism governance at the regional level.

Abstract

The management of Village-Owned Enterprises (BUMDes) in Wirogunan Village, Kartasura, Sukoharjo, is still predominantly conducted using manual systems, with limited utilization of information technology, low digital literacy among village officials, and suboptimal legal and administrative accountability. This condition creates a gap between the demands of digital-based good governance and existing practices at the village level. This community service program aims to enhance the institutional capacity of BUMDes through the implementation of an integrated information system to strengthen legality, transparency, and the effectiveness of village business management. The method used is a participatory-empirical approach, including needs assessment, system design, hybrid implementation (offline and online training), and evaluation through pre-test and post-test. The results show a significant improvement in participants’ understanding, where the average pre-test score of 45% increased to 82% in the post-test. This indicates that the mentoring program effectively improves digital literacy, legal awareness, and governance quality of BUMDes. The program contributes to the development of a digital-based BUMDes governance model that is more transparent, accountable, and sustainable.

Abstract

Perlindungan pasien dalam pelayanan kesehatan merupakan aspek fundamental untuk menjamin hak asasi, keselamatan, dan kualitas layanan medis. Di Indonesia, kerangka hukum dan etika untuk melindungi pasien telah diatur melalui Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan, Undang-Undang Nomor 44 Tahun 2009 tentang Rumah Sakit, serta Peraturan Pemerintah Nomor 71 Tahun 2019 tentang Penyelenggaraan Sistem dan Transaksi Elektronik, disertai kode etik profesi tenaga kesehatan. Meskipun regulasi ini memberikan dasar hukum yang kuat, implementasinya di lapangan masih menghadapi berbagai tantangan, seperti kurangnya penerapan informed consent, ketidakseragaman penerapan prinsip etika medis, risiko kebocoran data pasien pada layanan kesehatan digital, dan akses yang terbatas bagi pasien terhadap mekanisme penyelesaian sengketa formal. Penelitian ini menggunakan pendekatan kualitatif normatif dan komparatif, dengan menganalisis dokumen hukum, pedoman etika profesi, literatur akademik, dan laporan kasus malpraktik untuk mengidentifikasi kesenjangan dan tantangan dalam perlindungan pasien. Hasil analisis menunjukkan bahwa meskipun Indonesia memiliki kerangka hukum yang kuat secara normatif, efektivitas perlindungan pasien sangat bergantung pada implementasi, kesadaran pasien, kompetensi tenaga kesehatan, serta keamanan sistem digital. Temuan utama meliputi: sekitar 35% kasus malpraktik disebabkan oleh tindakan medis tanpa informed consent yang memadai; lebih dari 40% fasilitas kesehatan yang menggunakan rekam medis elektronik memiliki risiko kebocoran data; dan pasien masih memiliki pemahaman terbatas mengenai mekanisme hukum untuk menyelesaikan sengketa haknya. Berdasarkan temuan tersebut, penelitian ini merekomendasikan beberapa strategi penguatan, antara lain: peningkatan kapasitas tenaga kesehatan melalui pelatihan hukum dan etika, edukasi pasien mengenai hak-hak mereka dan prosedur tindakan medis, penguatan protokol keamanan data digital, pelaksanaan audit dan pengawasan rutin, pemberian pendampingan hukum bagi pasien, serta adopsi praktik terbaik internasional dalam pelayanan kesehatan. Implementasi strategi-strategi ini diharapkan dapat meningkatkan keselamatan pasien, kepatuhan etika, serta kualitas layanan kesehatan di Indonesia, sehingga sistem kesehatan nasional menjadi lebih adil, transparan, dan terpercaya.

Abstract

Health is a fundamental right guaranteed by the constitution and a key pillar in the development of a welfare state. Health law serves as a normative instrument that regulates the provision of services, protects patient rights, regulates the obligations of medical personnel, and ensures the accountability of healthcare institutions. However, the reality in Indonesia demonstrates a significant gap between normative construction and empirical implementation. Key challenges include disparities in access to services, a deficit in National Health Insurance funding, an unequal distribution of healthcare workers, and regulatory fragmentation. The COVID-19 pandemic further emphasizes the importance of health law not only as an administrative tool but also as a mechanism for state resilience in the face of public health crises. This study aims to analyze health law in three dimensions: theoretical, practical, and prospective. Theoretically, health law affirms the state's responsibility to guarantee the right to health as part of a welfare state. Practically, it reflects the effectiveness of public policy and healthcare system governance. Prospectively, health law must adapt to the digitalization of services, the protection of patient data, and the global commitment to universal health coverage. Thus, health law serves not only as a regulatory framework but also as a strategic foundation that unites human rights protection, policy effectiveness, and social justice in building a sustainable welfare state.

Abstract

Study This aim analyze phenomenon discrimination to patient Guarantee National Health Insurance (JKN) and limitations knowledge patient about his rights . Space scope study service - focused House sick in Indonesia with review aspect legal , social , and access health . The method used is study normative with approach studies literature , through secondary data review from the Indonesian Ombudsman, BPJS Watch, Riskesdas 2018, and various publication academic . Data includes surveys and reports national which shows more of 21% of JKN patients experienced treatment discriminatory , time wait an average of 3–5 hours, and low level knowledge rights (47%). Findings confirm existence discrimination systemic which has implications for injustice structural , reinforced by gaps information patient . Analysis test literature support the need reform service and socialization right patient . This study underscores the importance of improving both the dissemination of information about patients' rights and the responsiveness of healthcare services, to ensure equitable and just treatment for all individuals under the JKN program.

Abstract

The rapid development of artificial intelligence technology has significantly transformed the healthcare sector, including the emergence of AI-based medical chatbots used for diagnosis support, symptom checking, health consultation, and patient education. In Indonesia, the adoption of medical chatbots has increased alongside the expansion of digital health services. However, the legal framework governing transparency obligations and informed consent mechanisms in the operation of AI-based medical chatbots remains fragmented and insufficient. This study analyzes the urgency of establishing comprehensive regulations concerning transparency and informed consent in the use of medical chatbots in Indonesia. The research employs a normative juridical method through statutory, conceptual, and comparative approaches. The study examines Indonesian laws relating to health services, electronic information systems, personal data protection, consumer protection, and medical ethics. The findings indicate that AI-based medical chatbots may create legal uncertainty regarding accountability, patient autonomy, data privacy, algorithmic bias, and medical malpractice risks when transparency and informed consent principles are not adequately regulated. Furthermore, existing regulations have not specifically addressed the obligations of developers and healthcare providers to disclose AI system limitations, decision-making processes, data usage practices, and potential risks to users. Therefore, Indonesia urgently requires a specific and harmonized regulatory framework to ensure legal certainty, patient protection, ethical healthcare innovation, and responsible AI governance. This article recommends the formulation of detailed transparency standards, mandatory informed consent procedures, algorithmic accountability principles, and supervisory mechanisms to support the safe and ethical implementation of AI-based medical chatbots in Indonesia.
