Abstract

Islamic family law is a normative instrument that has a strategic position in maintaining social stability and household harmony in Muslim society. In the Indonesian context, the challenges of implementing family law are increasingly complex along with the increasing domestic conflicts and limited public access to fair and dignified dispute resolution mechanisms. Advocacy of Islamic family law is an alternative means of realizing substantive justice through a non-litigative approach based on the values ​​of maqāṣid al-sharī‘ah. This study aims to analyze the effectiveness of Islamic family law advocacy in enforcing family law and to identify factors that support and hinder its implementation. The method used is a qualitative approach with a descriptive-analytical library research technique. Data sources are obtained from normative documents, scientific journals, and previous research results that are relevant to the issue of family law advocacy. The results of the study show that family law advocacy based on sharia mediation and Islamic values ​​has been proven to be able to reduce conflict escalation and increase public legal literacy. However, its effectiveness is still hampered by the dominance of litigative approaches, weak professionalism of advocates, and suboptimal synergy between institutions. This study concludes that the effectiveness of Islamic family law advocacy is influenced by three main variables: the capacity of legal actors in understanding maqāṣid al-sharī‘ah, solid institutional integration, and the state policy's bias towards an inclusive and transformative advocacy system. Thus, the reformulation of contextual and collaborative advocacy strategies is urgent in building a just and civilized family law system.

Abstract

The issue of gender justice in the Indonesian justice system continues to be a major concern amidst various legal reform efforts. This study aims to analyze the extent to which the principle of gender justice is implemented in court decisions, especially in cases involving women as plaintiffs, defendants, witnesses, or victims. This study uses a qualitative method with a normative-empirical approach, namely through a literature study of regulations and court decisions and supported by field data from interviews and relevant documents. Five main references are used as the basis for the analysis, including the implementation of PERMA No. 3 of 2017, jurisprudence practices in the Banyumas and Purwokerto Religious Courts, and a case study at the Banda Aceh Sharia Court. The results of the study show that although normatively the principle of gender equality has been accommodated in the constitution, national law, and ratified international instruments, in practice there are still inequalities. Several judges show gender sensitivity in their legal considerations, but not a few still maintain biased, demeaning, or even discriminatory views of women in the courtroom. PERMA No. 3 of 2017 is considered a strategic instrument, but its implementation still faces structural, cultural, and capacity constraints of the judicial apparatus. The conclusion of this study emphasizes the importance of strengthening the capacity of judges and court officials in implementing a gender justice perspective, as well as the need for continuous evaluation of the implementation of established judicial guidelines. Recommendations are directed at the need for reformulation of legal education, gender-responsive judicial oversight, and inter-institutional collaboration to encourage the creation of a fairer and more equal justice system for all parties.

Abstract

Domestic violence (DV) is a complex problem that includes legal, social, and cultural aspects. Although it has been regulated in Law No. 23 of 2004 concerning the Elimination of Domestic Violence, this phenomenon remains high, especially against women. This article aims to analyze efforts to overcome domestic violence through a positive legal approach, socio-religious development, and Islamic values, especially the concept of mu'āsyarah bil ma'rūf. The method used is a literature study by reviewing literature from scientific journals, laws and regulations, and the perspectives of Islamic figures and teachings. The results of the study indicate that a repressive approach through law alone is not effective enough without being supported by healthy relationship education, strengthening the role of society, and equal understanding of the rights and obligations of husband and wife. An integrative approach involving education on harmonious families, provision of victim protection, and internalization of the value of justice in the household is a strategic step in reducing the number of domestic violence in Indonesia.

Abstract

This study aims to analyze in depth the application of wills in the distribution of inheritance, reviewed from a juridical perspective both in Islamic law and positive law in Indonesia. The main purpose of this study is to find out more comprehensively about the legal provisions that govern wills, how the implementation of wills in the practice of inheritance distribution, and its impact on the creation of justice in the distribution of inherited inheritance assets to their heirs. The method used in this study is a qualitative method with a normative-juridical approach. This approach is carried out through a literature study that includes a review of various legal sources, official documents, and relevant literature. Among the legal documents studied in this study are Law Number 1 of 1974 concerning Marriage, the Compilation of Islamic Law (KHI), as well as various books and scientific journals that discuss wills and inheritance law. In addition, supporting data was obtained through direct interviews with religious leaders, legal practitioners, and employees of the Office of Religious Affairs (KUA) who have direct experience in handling inheritance issues. The results of the study show that a will in Islamic law is allowed with the provision that a maximum of one-third of the total inheritance property of the heir. The will should not be given to the legal heirs if it could reduce their predetermined inheritance rights. However, in practice, the implementation of a will is often not accompanied by legally valid written evidence, thus causing disputes and conflicts among the heirs. This problem is exacerbated by the low public understanding of inheritance law, both sharia and legal formality. From this study, it can be concluded that the application of a will in accordance with the applicable legal provisions can be an effective means in preventing family conflicts and maintaining justice in the distribution of inheritance. For this reason, it is recommended that there be regular training and counseling on inheritance law for the community, assistance from the KUA, and encouragement to make a will formally and legally valid so that its implementation is more guaranteed.

Abstract

The family is a basic institution in society that plays an important role in shaping generations and maintaining social stability. In Islam, the family is not only a biological relationship, but also a vehicle for fostering morals, faith, and spiritual well-being. However, the challenges of modern life such as divorce, role conflict, and domestic violence threaten the harmony of Muslim families. This study aims to examine the role of Islamic family law advocacy in building family harmony amidst these dynamics. In the context of Islam, family advocacy is not just legal defense in court, but includes comprehensive efforts such as education, religious counseling, mediation, and family counseling. This study uses a descriptive qualitative approach based on a literature study of scientific literature, laws and regulations, and institutional practice documents. The results of the study indicate that sharia mediation and advocacy based on Islamic values ​​are highly effective in preventing divorce, improving communication between couples, and maintaining the mental stability of children as the most vulnerable party in household conflicts. Institutions such as BP4 and religious counselors play a key role in family law advocacy, especially in promoting the values ​​of sakinah, mawaddah, and rahmah. However, there are still challenges in implementing advocacy, such as low family law literacy, stigma against counseling, and limited resources. This study concludes that Islamic family law advocacy is an important instrument in maintaining the integrity of the household and creating a harmonious and resilient Muslim society.

Abstract

Digital transformation has had a significant impact on the pattern of delivery and acceptance of Islamic legal teachings, especially in the field of family law. As one of the important instruments in maintaining social order and protecting family rights, Islamic family law is faced with complex challenges as well as strategic opportunities in the digital era. This study aims to analyze the dynamics of Islamic family law advocacy in the context of advances in information technology, using a qualitative approach based on library studies of relevant literature. The results of the study show that the digital era expands the reach of legal advocacy through various digital platforms such as social media, podcasts, Islamic applications, and online discussion forums. However, the ease of access to information is also accompanied by serious challenges in the form of dissemination of non-authoritative religious content, narrowing of legal substance, and shifting of religious authority from ulama to non-competent digital figures. This reality demands the formulation of a responsive, adaptive, and maqāṣid al-syarī‘ah-based advocacy strategy in order to maintain the authenticity, relevance, and justice of Islamic family law. Advocacy strategies in the digital era need to integrate aspects of legal education, digital literacy, and a collaborative approach between formal institutions, religious figures, academics, and digital communities. The use of technology must be accompanied by strengthening the capacity of ulama and da'i in managing legal communication in a contextual, interesting manner, and still based on sharia principles. Within this framework, advocacy of Islamic family law in the digital era is not only an instrument for disseminating legal norms, but also a transformative medium in building religious awareness and protecting family rights in a more comprehensive and equitable manner.

Abstract

This community service activity carried out at SMA Muhammadiyah 9 Makassar aims to increase students' understanding of the concept of sharia entrepreneurship, foster innovation and creativity, and provide motivation and support in shaping an independent and ethical entrepreneurial spirit. Sharia-based entrepreneurship education emphasizes the importance of conducting business in accordance with Islamic principles, such as honesty, trustworthiness, justice, and social benefit. This activity was implemented through a series of stages including observation, interactive material presentation, direct practice in making creative products, and evaluation. Students learned about the meaning of sharia entrepreneurship, Muhammadiyah business principles, and the role of entrepreneurship in empowering the ummah. The results of the activity showed an increase in students' knowledge, interest, and confidence to start simple, ethical business ventures. It is hoped that this activity will become the foundation for building future Muslim entrepreneurs who contribute to sustainable economic growth.

Abstract

ABSTRACT Vaginal discharge is one of the reproductive health problems experienced by women throughout the world. The occurrence of vaginal discharge is caused by various factors, one of which is a lack of knowledge and behavioral patterns regarding personal hygiene. 61% of vaginal discharge cases were experienced by women aged 14-21 years and 39% of those aged 23-45 years. Objective: This study aims to determine the influence of vulva hygiene knowledge and behavior on the incidence of flour albus at MA Attarbiyah Lauwa in 2023. Research method: Quantitative type of research with an Analytic Correlational research design with a cross sectional method. This research was conducted at MA Attarbiyah Lauwa in 2023 using a total sampling technique with 49 people as the population. Data collection was carried out by filling out questionnaires directly by female students who were respondents. Data collection was carried out by the researcher himself, when filling out the questionnaire by the female students, he was guided directly by providing an explanation of each questionnaire question by the researcher, so that it was hoped that more objective answers would be obtained which would then be processed and analyzed using chi-square. Research Results: There is a relationship between knowledge and the incidence of vaginal discharge (p value = 0.001), there is a relationship between Vulva Hygiene Behavior and the incidence of vaginal discharge (p value = 0.002). The conclusion of this research is that knowledge and behavior of vulva hygiene are related to the incidence of vaginal discharge at MA Attarbiyah Lauwa in 2023.

Abstract

A very common form of business in society is buying and selling. In muamalah fiqh, the law of buying and selling itself is defined as “buying and selling”, which in fiqh terms is referred to as “al-bai”, which means “selling, replacing, and exchanging something for something else”. The purpose of this research is to discuss the problems and solutions of cases related to the law of buying and selling in Islam. This research method uses a type of qualitative research through literature study by applying content analysis that focuses on library data, such as books, journals, archives, and so on. The results of this research related to the law of buying and selling in Islam are a solution to many forms of contemporary buying and selling that violate sharia, such as price manipulation, fraud, and selling goods that do not exist. Consequently, in order to ensure that buying and selling transactions are Shariah-compliant, an in-depth understanding of Islamic law and the application of that law in specific contexts is required. It is hoped that these findings will help strengthen a just and sustainable Islamic economic system.

Abstract

According to Islamic law or the science of faraidh, the distribution of inheritance is one of the important aspects that has strict rules. Since the calculation of the inheritance share for each heir varies depending on their status and relationship, this process often leads to problems for some members of society. Injustice, and even family conflicts, can arise from mistakes in calculating the inheritance shares. Various applications have been developed in today's digital era to facilitate the calculation of inheritance in accordance with Islamic law. One of them is the inheritance calculator. The aim of this research is to examine how effective and easy it is to use the inheritance calculator in assisting the process of dividing inheritance based on Islamic law. The results of the research show that the inheritance calculator application is very helpful in calculating the inheritance shares quickly and accurately, using case studies involving users of the application. This application can help the general public better understand the science of inheritance and reduce errors in manual calculations. Additionally, since it complies with Islamic law, this application enhances time efficiency and provides a sense of justice. Thus, the inheritance calculator application can be used to address issues related to the distribution of inheritance in a practical and educational way. Moreover, it can also function as a medium for da'wah that brings society closer to fair and systematic Islamic law.
