Abstract

The witness became an important element in the trial, especially in matters of criminal law. As the main evidence, of course a witness has a very large contribution in efforts to uphold law and justice. In resolving a criminal case, the position of the witness is an important matter in proving a criminal case. The Criminal Justice System clearly regulates how the witness should provide information about his testimony in the trial. The rights and obligations of witnesses are also regulated, including rights and witness protection. However, it cannot be denied that the information provided by witnesses is not necessarily the truth. Some of them, gave testimony by adding elements of lies or even conveying false statements. Ironically, the testimony or statement submitted was an oath statement, which meant the witness dared to lie even though he had taken an oath. False information under oath is a statement that is partially or completely incorrect, so that in the implementation of article 242 of the Criminal Code (KUHP), punishment is arranged for the person so that the offender who has deliberately provided the false information, can be sentenced. This paper analyzes how the criminal liability of witnesses gave false information in the trial.

Abstract

Tujuan dalam penulisan ini adalah untuk mengetahui bentuk pencucian uang yang dilakukan oleh pelaku korporasi, untuk mengetahui bentuk pertanggungjawaban sebuah perusahaan dalam tindak pidana pencucian uang, untuk mengkaji mengenai bentuk pertanggungjawaban tindak pidana korporasi dalam peraturan yang ada dalam perundang–undangan serta mengkaji mengenai pertanggungjawaban tidak pidana korporasi dalam kasus tindak pidana pencucian uang. Penulisan ini bersifat deskriptif guna untuk mengetahui gambaran permasalahan yang ada, yang kemudian dianalisis secara deduktif. Bentuk pidana pencucian uang oleh korporasi ada tiga jenis yaitu penempatan, pelapisan, dan penggabungan. Subjek korporasi akan mendapatkan hukuman pidana sesuai dengan perbuatannya. Seperti yang telah disebutkan dalam pasal 6 UU No 8 tahun 2010 bahwa dalam tindakan pencucian uang sebagaimana yang dimaksud dalam pasal 3, 4 dan pasal 5 dilakukan oleh korporasi sehingga pidana akan dijatuhkan kepada personil pengendali korporasi. Apabila personil tidak mampu membayar maka akan diganti dengan penyitaan korporasi dan personil pengendali perusahaan. Dan apabila belum cukup maka penjara dapat diganti oleh denda kontrol perusahaan.

Abstract

This writing aims to determine the impact of bullying crime from the point of view of victims of bullying who get stressed post-traumatic stress disorder so that victims need to get protection from the incident. In the 1945 Constitution article 28B (paragraph 2) it has been explained that: "Every child has the right to survival, growth and development, and is entitled to protection from violence and discrimination". But in fact, this crime of bullying is increasingly widespread by not seeing the opponent as material for consideration of reducing the effects of the crime he committed. Bullying itself has been happening for a long time and seems to be part of the culture of community social behavior both at school and in the environment at home. Victims also generally have feelings of being helpless, afraid, and threatened because they experience forms of intimidation such as threatening, spreading rumors, taunting, cursing, and alienating someone from a group whether done directly or through technology is an example of bullying. The act of bullying is considered only part of the way children play, even though the impact of this action greatly affects the psychological health of its victims. In addition, Bullying has a negative impact on mental health and well-being of adolescents so that parents, school teachers, and the government should pay more attention to victims of bullying and do not just look at the nature of the crime. Protection of victims of bullying needs to be given more attention, improved, and taught early on to children whose development is in the process of becoming adults so that the state can minimize bullying that occurs wherever someone lives. And victims of the impact of bullying can be reduced every year.

Abstract

A clean and healthy lifestyle (PHBS) is a set of behaviors that are practiced on the basis of awareness as a result of learning that makes a person, family, group or community able to help themselves (independently) in the health sector and play a role in realizing public health. The student group KKN BMC UNNES 2020 has a mission to make the people of Kalirancang Village, Alian District, Kebumen Regency, Central Java aware of implementing a clean and healthy lifestyle (PHBS) in their daily life, especially during the Covid-19 pandemic. The method of implementing KKN includes socialization and counseling on the application of a clean and healthy lifestyle (PHBS) directly to the people of Kalirancang Village, Alian District, which is the object. Several activities are carried out, such as weighing the baby every month, using clean water, washing hand use soap, healthy eating patterns, and doing bodily activities. The results achieved through these activities are being able to make people aware of the importance of implementing a clean and healthy lifestyle (PHBS) and can provide knowledge to the community regarding how to properly implement a clean and healthy lifestyle so that people can implement PHBS regularly in their daily life.

Abstract

Terrorism is a form of extraordinary crime that is an enemy to mankind. Terrorism throughout history has been a very frightening specter. This is inseparable from the impact it causes, the loss is not only property, life, physical, psychological, but also creates an atmosphere of terror that grips all levels of society. Therefore, victims and witnesses of acts of terrorism must receive protection in view of these various things. As a state of law, Indonesia has established several laws and regulations governing the protection of victims of terrorism, including Law no. 15 of 2003, as amended by Law no. 5 of 2018 concerning Amendments to Law Number 15 of 2003 concerning Stipulation of Government Regulations in Lieu of Law Number 1 of 2002 concerning Eradication of Criminal Acts of Terrorism into Law, Law no. 13 of 2006, as amended by Law no. 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning the Protection of Witnesses and Victims and other regulations. With the legal footing that regulates, it is hoped that it will provide protection for witnesses and victims of acts of terrorism. In addition, various parties also play a role in the recovery of victims from acts of terrorism, including police institutions, social services, hospitals, Kesbangpol, PMI, NGOs, LPSK, and so on. However, witnesses and victims of criminal acts of terrorism in obtaining legal protection through the above regulations are not always in line with the existing reality. This is inseparable from the existence of inhibiting factors, both in the aspect of legal substance, legal structure, and legal culture components.

Abstract

Indonesia as Unitary State consists of various kinds of tribes, customs, and even religions. The legal system adopted in Indonesia is not only civil or criminal law, but also mulually related religious and customary laws. Until recent years, Indonesia still uses European law as the national law and still try to make the customary law to be a national law. In fact, the implementation of European law is considered incompatible with the soul of the Indonesian people, especially in the the case family law. This paper seeks to uncover customary influences and effects in the development of family law in the national legal system.

Abstract

Law and justice are one of the important issues in the development of law in Indonesia. Many studies show that there is a gap in the paradigm of justice that is obtained by the community. The community considers that justice in practice is heavily influenced by politics, even though the law should provide a sense of justice for the community, one of which is the victim in the crime of domestic violence (KDRT). The cases of domestic violence are increasing every year, and unfortunately women and children are the groups most vulnerable to becoming victims. This study aims to analyze the legal and justice aspects for women in cases of domestic violence. This study uses a normative juridical approach. This study finds and confirms that legal protection for women has been regulated in various legal instruments, ranging from the Law on the Elimination of Domestic Violence, the Law on Human Rights, and even the Law on the Protection of Witnesses and Victims.

Abstract

Various conflicts experienced by the state are denied or there are no interventions from other countries both on a large and small scale, either directly or indirectly. Interventions have the meaning of dictatorial interference by a country against other countries’ internal affairs. This has caused controversy because it is contrary to the principle of state sovereignty and the principle of non-intervention in international law. The practice of intervention that is happening now is one of the conversations by the community. The validity of the intervention of other countries is one of them sticking out in the Arab Spring conflict, where Saudi Arabia and Iran make Syria an arena for proxy war where opponents of strength use third parties instead of fighting directly with each other. Saudi Arabia openly supports the opposition in the form of finance, a tool of war. On the other hand, Iran totally supports Bashar al-Assad with financial assistance, weapons of war and sends military forces. This paper analyzes how the position of foreign country intervention in a country's conflict in the study of international law. This paper focuses on the Syrian conflict, the Arab Spring where in the study of international law, intervention is seen as a state effort, and this paper analyzes the legitimacy of the state to carry out such interventions.

Abstract

AbstractMurder cases in Indonesia from year to year continue to increase. There are at least 500 homicides throughout 2018 (until November 2018). Even in many cases, this murder was preceded by torture and even mutilation of victims. Several murder cases accompanied by mutilation of victims have emerged in Indonesia, for example the case of Ryan Jombang and Babe Baikuni. Both were included in the list of controversial homicides. In fact, the killings were explicitly threatened with severe crimes, and were specifically regulated in the Criminal Code, in Chapter XIX Book II as Crimes against Life. This paper intends to discuss three main points, namely, first, how legal arrangements for criminal acts of premeditated murder accompanied by torture and mutilation are regulated in Indonesian national law, second, how criminal law views cases of mutilation in Indonesia, and third, factors what lies behind the occurrence of premeditated murder with mutilation cases in Indonesia. This study uses a socio-legal research method with a qualitative approach, where the author looks at the facts in cases of mutilation that have occurred in Indonesia and analyzes the cases using relevant laws and legal theories. The cases that I use in this paper are obtained from print and online media. Opinions of legal experts in this study also the authors get through various print media and related previous research. The results of this study confirm that there are differences in criminal threats for mutilating cases of life (accompanied by previous killings) and mutilation of bodies. Criminal law views corpses as limited to inanimate objects, so it is only subject to Article about destruction or destruction of goods. In the view of Criminology Victimology, this study proves that mutilation cases that have occurred in Indonesia are motivated by factors: (1) Romance and relationship (including infidelity), (2) Economy (debt), (3) Mental Disorders (occult whispers, sadism), and (4) Revenge. This research underlines that it is necessary to attempt appropriate law enforcement accompanied by community oversight of the potential emergence of these criminal acts in the context of crime prevention. Keywords: Premeditated Murder, Mutilation, Torture, Legal Review AbstrakPeristiwa pembunuhan di Indonesia dari tahun ke tahun terus mengalami peningkatan. Sedikitnya terhadi 500 kasus pembunuhan sepanjang tahun 2018 (hingga November 2018). Bahkan dalam banyak kasus, pembunuhan ini didahului dengan penganiayaan dan bahkan mutilasi terhadap korban. Beberapa kasus pembunuhan disertai mutilasi terhadap korban pernah mencuat di Indonesia, misalnya kasus Ryan Jombang dan Babe Baikuni. Keduanya masuk ke dalam daftar kasus pembunuhan kontroversial. Padahaln, pembunuhan secara tegas diancam dengan pidana yang berat, dan diatur khusus dalam Kitab Undang-Undang Hukum Pidana, pada Bab XIX Buku II sebagai Kejahatan terhadap Nyawa. Tulisan ini hendak membahas tiga hal pokok, yakni, pertama, bagaimana pengaturan hukum atas tindak pidana pembunuhan berencana yang disertai dengan penganiyaan dan mutilasi diatur dalam hukum nasional Indonesia, kedua, bagaimana hukum pidana memandang kasus-kasus mutilasi di Indonesia, dan ketiga, faktor-faktor apa saja yang melatarbelakangi terjadinya kasus mutilasi di Indonesia. Penelitian ini menggunakan metode penelitian yuridis sosiologis dengan pendekatan kualitatif, dimana penulis melihat fakta-fakta pada kasus-kasus mutilasi yang pernah terjadi di Indonesia dan menganalisisnya menggunakan peraturan perundangan-undangan dan teori-teori hukum yang terkait. Kasus-kasus yang penulis gunakan dalam tulisan ini didapatkan dari media cetak dan online. Pendapat pakar-pakar hukum dalam penelitian ini juga penulis dapatkan melalui berbagai media cetak dan penelitian terdahulu yang berkaitan. Hasil penelitian ini mengegaskan bahwa terdapat perbedaan ancaman pidana bagi kasus mutilasi terhadap nyawa (disertai pembunuhan sebelumnya) dan mutilasi terhadap mayat. Hukum pidana memandang mayat hanya sebatas benda mati, sehingga hanya dikenakan Pasal tentang pengrusakan tau penghancuran barang. Dalam sudut pandang Kriminologi Viktimologi, penelitian ini membuktikan bahwa kasus-kasus mutilasi yang pernah terjadi di Indonesia dilatarbelakangi karena faktor: (1) Asmara dan Percintaan (termasuk selingkuh), (2) Ekonomi (hutang), (3) Gangguan Jiwa (bisikan-bisikan gaib, sadisme), dan (4) Dendam. Penelitian ini menggarisbawahi bahwa diperlukan upaya penagakan hukum yang tepat disertai dengan pengawasa masyarakat terhadap potensi munculnya tindak pidana ini dalam konteks crime prevention. Kata Kunci: Pembunuhan Berencana, Mutilasi, Penganiayaan, Kajian Hukum
