Abstract

Fulfilment and protection of human rights in all aspects is a form of Constitutional Rights for Citizens that must be fulfilled by the State. Basic human rights also under no circumstances can be reduced even deprived. However, the fact is, human rights regulated in various laws and regulations in Indonesia have not been maximally implemented. The fulfilment and protection of human rights also faces its own challenges in implementing it in certain cases, for example disasters such as Pandemic Covid-19. Various legal instruments, both central and regional, were created to deal with and resolve the Covid-19 Pandemic problem. This study aims to examine the implementation of the fulfilment and protection of human rights in special situations such as Covid-19 Pandemic. This research is limited to the Semarang City area. This study wanted to find out and analyze various aspects of law and human rights in the implementation of various policies related to Covid-19 in the City of Semarang. This study seeks to find challenges and problems in the protection and fulfilment of human rights in the city of Semarang in the Covid-19 Pandemic. The method in this study uses empirical research, where researchers directly go to the field. The planned data was obtained from various related agencies in the city of Semarang, the community, and related NGOs. This research will assist the government in mapping human rights fulfilment policies in national disaster situations in this case the Covid-19 Pandemic.

Abstract

Disability groups are one of the groups that are vulnerable to various violations of their rights. In fact, the protection of this group has been regulated both nationally and internationally. The International Convention on the Rights of Persons with Disabilities or the United Nations Convention on the Rights of Persons with Disabilities (CRPD) clearly outlines the principles that must be met in providing protection for persons with disabilities, ranging from: (1) respecting the inherent dignity, autonomy the individual including the freedom to make one's own choices, and the freedom of people; (2) non-discrimination, (3) full and effective participation and inclusion in society; (4) respecting the differences and acceptance of people with disabilities as part of human diversity and humanity; (5) equality of opportunity; (6) accessibility; (7) equality between men and women; and (8) respect for the evolving capacities of children with disabilities and respect for the right of children with disabilities to maintain their identity.

Abstract

Juvenile delinquency includes all behaviors that deviate from the norms in society, status violations, and violations of criminal law. Violations of status such as running away from home, skipping school, smoking, drinking, illegal racing, and so on. Violations of this status are usually not recorded in quantity because they are not legal violations. While the so-called deviant behavior against the norm includes premarital sex among teenagers, abortion, and so on. This study aims to analyze the phenomenon of juvenile delinquency from a sociological juridical perspective in the city of Semarang. The method used in this study is a mixed method between empirical and normative studies. This method is used to answer substantially the juvenile delinquency case within the legal framework in the city of Semarang.

Abstract

This article explores about social justice in peoples lives according to Karl Marxs prespective of the concept of social class. It also discusses Marxs concept of the struggle of the social class to provide a solution for the proletariat, to free themselves from the chain of cruelty, violence and alienation in the capitalist system to achieve social justice. The essence of social justice in Karl Marxs prespective is that if a society has created a manifestation of self through compassion, and the collaboration of a classless society, without violence, and without oppression, and humans are free from all forms of human alienation. Our main analysis is to examine the relationship between the concept of social class struggle and the need for a social revolution as a tangible form of justice for the formation of classless societies and also analyze the inhumane living conditions of the proletariat class in modern society. Marx considers freedom as a possibility for all people to develop their human potential, so that this thinking is the background of their social justice theory. This shows that social justice in Indonesia is a very important thing in the life of society and state for the sake of prosperity, peace and security.

Abstract

As we know that corruption is happening in Indonesia today, it has been in a very severe and entrenched position in every life. The development of corruption from year to year is increasing rapidly, both in losses suffered by the state and the quantity and quality that are increasingly systematic. The increase in corruption that is out of control will bring disaster to the life of the national economy and the life of the nation and state. The occurrence of corruption cases in Indonesia has no idea who the limits are, why or how. Even many state officials are corrupt. Not only only state officials who commit corruption. Now the corruption case in Indonesia seems to have been an ordinary thing and can be called a phenomenon. The implementation of a clean country is important and necessary to avoid corrupt practices in circulation which not only involve the state officials, but also their families and cronies, which if allowed by the Indonesian people will be in a disadvantaged position. Besides that, in practice there are still neglected matters, because the judges' decisions are unclear and unequivocal distinguish a nominal loss of the state lost due to the convict's actions. This means that the Judge has not distinguished a definition regarding the element of enriching or benefiting himself or anyone else. This difference should be put forward by the Judge in its decision, so that the classification between corruption acts that are detrimental to the state's economy (state losses have already occurred in real terms or state finances have also begun to decrease) should be seen. According to Nyoman Serikat Putra Jaya said that corruption is not only carried out by state administrators, or between state administrators, but also other parties, namely families, businessmen and cronies, so that damaging the welfare of the nation and state also endangers the existence of the country.Keywords: corruption, nepotism, state economy, welfare, collusion.

Abstract

Abstract. International human rights declarations urge the development of feminism in the world. Feminism whose essence is fighting for women's rights has so far been neglected by the community, so that a new spirit is sought so that women can again feel. This study aims to review unfairness actions that have been scattered in society between men and women. Justice is expressed in daily life in order to eradicate acts of gender discrimination. Indonesia as a legal state that always obeys the law and upholds the principles of justice and certainty is a reflection of an existing feminist movement. The role of women must be considered important by the progress of a nation, however in Indonesia there are still many issues of gender equality that occur, such as the absence of women's own beliefs in matters of occupying good power. The problem of sexual crimes that have been wiping out in all public relations has led to increasingly ineffective emancipation of women in Indonesia. This emancipation is a form or manifestation of the feminist movement that can benefit both men and women. The feminism movement can encourage relations in a harmonious society to maintain a stable condition. Feminisme yang hakikatnya memperjuangkan hak-hak perempuan sejauh ini telah diabaikan oleh masyarakat, sehingga semangat baru dicari sehingga perempuan dapat kembali merasakan. Penelitian ini bertujuan untuk mengkaji tindakan tidak adil yang telah tersebar di masyarakat antara pria dan wanita. Keadilan diekspresikan dalam kehidupan sehari-hari untuk menghapus tindakan diskriminasi gender. Indonesia sebagai negara hukum yang selalu mematuhi hukum dan menjunjung tinggi prinsip keadilan dan kepastian adalah cerminan dari gerakan feminis yang ada. Peran perempuan harus dianggap penting oleh kemajuan suatu bangsa, namun di Indonesia masih banyak masalah kesetaraan gender yang terjadi, seperti tidak adanya keyakinan perempuan sendiri dalam hal menduduki kekuasaan yang baik. Masalah kejahatan seksual yang telah memusnahkan di semua hubungan masyarakat telah menyebabkan emansipasi perempuan yang semakin tidak efektif di Indonesia. Emansipasi ini adalah bentuk atau manifestasi dari gerakan feminis yang dapat bermanfaat baik bagi pria maupun wanita. Gerakan feminisme dapat mendorong hubungan dalam masyarakat yang harmonis untuk mempertahankan kondisi yang stabil.Kata Kunci: Emansipasi, Kepercayaan, Keadilan, Perempuan, Kejahatan Аннотация.Международные декларации прав человека призывают к развитию феминизма в мире. Феминизм, суть которого заключается в борьбе за права женщин, до сих пор игнорировался сообществом, так что ищется новый дух, чтобы женщины снова могли чувствовать. Это исследование направлено на рассмотрение действий несправедливости, которые были разбросаны в обществе между мужчинами и женщинами. Справедливость выражается в повседневной жизни с целью искоренения актов гендерной дискриминации. Индонезия как правовое государство, которое всегда подчиняется закону и придерживается принципов справедливости и определенности, является отражением существующего феминистского движения. Роль женщин должна рассматриваться как важная для прогресса нации, однако в Индонезии по-прежнему существует много проблем гендерного равенства, таких как отсутствие собственных убеждений женщин в вопросах занятия хорошей властью. Проблема сексуальных преступлений, которая исчезла во всех общественных отношениях, привела к все более неэффективной эмансипации женщин в Индонезии. Эта эмансипация является формой или проявлением феминистского движения, которое может принести пользу как мужчинам, так и женщинам. Abstract

This paper delves into the complex interplay between administrative and private law in environmental litigation within Indonesia's legal framework. Indonesia, rich in natural resources, faces pressing environmental challenges due to rapid industrialization and urbanization. Consequently, disputes often arise over environmental conservation, resource extraction, and pollution control, necessitating legal action to uphold environmental integrity. Administrative law governs governmental bodies responsible for environmental regulation, dictating procedures for permits, inspections, and sanctions. Conversely, private law regulates relationships between individuals and entities, encompassing tort liability, contractual obligations, and property rights. In environmental litigation, these legal domains intersect as plaintiffs seek remedies for harm caused by both public and private actors. The paper examines significant cases where administrative law intersects with private law doctrines, analyzing how administrative decisions may lead to civil claims under negligence, nuisance, or strict liability theories. It also explores the role of public interest litigation and citizen enforcement mechanisms in ensuring government accountability for environmental stewardship. Additionally, it evaluates the challenges and opportunities in navigating the convergence of administrative and private law, including issues of standing, jurisdiction, evidence, and remedies. Emphasizing judicial interpretation and legal harmonization, the paper underscores the symbiotic relationship between these legal realms in Indonesia's environmental litigation landscape. By shedding light on this intersection, it contributes to understanding environmental governance and access to justice while offering insights into global environmental law reconciling public and private interests.

This paper explores the complex landscape of religious freedom in Russia and Indonesia, despite constitutional guarantees in both nations. In Russia, historical legacies and state control have led to restrictions on religious pluralism, particularly affecting minority faiths and dissenting voices. The Orthodox Church's influence and government policies often contradict formal protections, creating a paradoxical environment. Similarly, in Indonesia, despite its religious diversity, state regulations, societal norms, and religious identity intersect to challenge genuine religious freedom. Discrimination and persecution against religious minorities persist amidst political interests and cultural tensions. This discourse analyzes the underlying factors contributing to this paradoxical situation, emphasizing historical contexts, political dynamics, and socio-cultural complexities. It underscores the need for nuanced approaches beyond legal frameworks to address deeper societal attitudes and power structures. By reflecting on these cases, this discourse prompts broader discussions on global religious freedom, advocating for genuine respect for religious diversity as a fundamental aspect of democracy and human rights. Abstract

In the contemporary digital age, corruption has evolved into a common enemy, transcending borders and becoming a transnational and extraordinary crime. Within the ASEAN framework, corruption is no longer perceived as the concern of a single nation but as a shared threat to all member states and the global community at large. Despite the pervasive and deeply entrenched nature of corruption, concerted efforts have been made to combat this scourge. Among these measures, asset recovery stands out as an extraordinary tool, addressing not only the prevention and enforcement aspects but also the crucial task of repatriating ill-gotten gains to their rightful country of origin. Indonesia and the ASEAN community have entered into various treaties aimed at facilitating asset recovery, with the ASEAN Mutual Legal Assistance Treaty (AMLAT) serving as a pivotal legal instrument in this endeavour. Recognizing the transnational nature of corruption, interstate relations and diplomatic cooperation have assumed a vital role in supporting the success of asset recovery processes. This study explores the evolving landscape of corruption in the digital age, its transformation into a transnational concern, and the collective efforts undertaken within ASEAN to combat it. By focusing on asset recovery as an extraordinary measure, it sheds light on the multifaceted dimensions of eradicating corruption and emphasizes the importance of international collaboration in returning misappropriated assets to their rightful owners.
