Abstract

Keadilan dapat diartikan sebagai melakukan, memberikan, dan mendapatkan sesuatu sesuai dengan hak dan kewajibannya masing-masing. Keadilan tersebut seharunya di terapkan dalam kehidupan bermasyarakat, berbangsa dan bernegara, tak terkecuali dalam membuat suatu peraturan, kebijakan maupun undang-undang harus adil di semua kalangan dan bidang. Peraturan Menteri Pendidikan dan Kebudayaan Republik Indonesia Nomor 1 Tahun 2018 Tentang Petunjuk Teknis Bantuan Operasional Sekolah mengatur tentang bagaimana penggunaan dana BOS, untuk siapa dan untuk apa dana BOS tersebut. Salah satu penggunaan dari dana BOS dalam Peraturan Menteri tersebut adalah pengalokasian dana BOS tersebut kepada Guru Honorer. Dimana degan gaji upah yang dibawah upah minimum daerah mengakibatkan berbagai pihak berfikir dan meberikan spekulasi mengenai letak keadilan dari Permen tersebut, Sehingga pelu kiranya kita meninjau hal tersebut dari beragai sudut pandang maupun penghasilan dari tenaga Kependidikan guru honor yang masih jauh dari makna kesejahteraan dan keadilan tersebut, jika dibandingkan dengan status guru pegawai negeri sipil upah dari guru honorer masih sangatlah jauh. Maksud dari kesejahteraan dan keadilan disini adalah penyetaraan penghasilan untuk mendapatkan kesejahteran sebagai warga negara dan abdi negara Indonesia. Agar letak keadilan dari kebijakan tersebut dapat kita ketahui, maka penulis melakukan analisis Yuridis mengenai masalah tersebut yaitu dengan cara melakukan analisis data atau melakukan tinjauan pustaka baik tinjauan mengenai Peraturan Menteri Pendidikan dan Kebudayaan Republik Indonesia Nomor 1 Tahun 2018 Tentang Petunjuk Teknis Bantuan Operasional Sekolah, Undang-Undang Ketenagakerjaan,  maupun tinjauan dalam perpektif keadilan maupun Hak Asasi Manusia yang tercantum di dalam Undang-Undang Dasar 1945 BAB XA tentang Hak Asasi Manusia. Hal ini untuk mewujudkan keadilan bagi seluruh rakyat Indonesia dan perwujudan keadilan bagi masyarakat berdasarkan analisis yuridis dan aspek atau sudut pandang hukum. Justice can be interpreted as doing, giving, and getting something in accordance with their respective rights and obligations. Justice should be applied in the life of the community, nation and state, not least in making regulations, policies and laws must be fair in all circles and fields. Republic of Indonesia Minister of Education and Culture Regulation Number 1 Year 2018 Regarding Technical Guidelines for School Operational Assistance regulates how to use BOS funds, for whom and for what BOS funds are. One of the uses of BOS funds in the Ministerial Regulation is the allocation of BOS funds to Honorary Teachers. Where wage salaries below the regional minimum wage result in various parties thinking and giving speculation about the location of justice from the Permen, so we should review this from various perspectives and income from the teaching staff of honor teachers who are still far from the meaning of welfare and justice, when compared with the status of civil servant teachers the wages of honorary teachers are still very far away. The purpose of welfare and justice here is equalization of income to get welfare as citizens and servants of the Indonesian state. In order to find out the location of justice from the policy, the writer conducts juridical analysis of the problem, namely by conducting data analysis or conducting a literature review, both a review of the Republic of Indonesia Minister of Education and Culture Regulation Number 1 of 2018 concerning Technical Guidelines for School Operational Assistance, Labor Law, as well as a review of the perspectives on justice and human rights listed in the 1945 Constitution Chapter XA concerning Human Rights. This is to realize justice for all Indonesian people and the realization of justice for the community based on juridical analysis and legal aspects or points of view.

Abstract

Perkembangan teknologi informasi saat ini telah berkembang menjadi sebuah pedang bermata dua karena selain memberikan kontribusi bagi peningkatan kesejahteraan dan kemajuan peradaban manusia juga sekaligus menjadi faktor penting dalam perbuatan melawan hukum. Perbuatan melawan hukum menggunakan sarana atau dengan bantuan teknologi internet ini disebut dengan cybercrime. Cybercrime kini telah diatur dalam aturan UU Nomor 19 Tahun 2016. Studi ini didasarkan pada gagasan bahwa Undang-Undang Nomor 19 Tahun 2016 bertujuan untuk pengaturan pemanfaatan teknologi informasi, khususnya dalam bidang informasi dan transaksi elektronik, agar dapat dilaksanakan dengan baik serta dapat menjaga keamanan dan kepentingan kemanusiaan, namun penggunaannya bisa berpotensi mengakibatkan tindak pidana jika melawan aturan hukum dalam UU Nomor 19 Tahun 2016. Salah satu kejahatan cybercrime adalah kejahatan kesusilaan melalui media elektronik yang secara khusus diatur dalam ketentuan Pasal 27 ayat (1). Penulisan ini bertujuan untuk memeriksa dan pertanggungjawaban tindak pidana dalam ketentuan Pasal 27 ayat (1) yang diatur terdapat pada Undang-Undang Nomor 19 Tahun 2016 yang merupakan revisi dari Undang-Undang Nomor 11 Tahun 2008 tentang “Informasi Elektronik dan Transaksi”. Penelitian ini menggunakan hukum normatif dengan pendekatan statuta, analitis dan kasus. Kesimpulan yang diperoleh, menunjukkan bahwa penerapan pasal 27 ayat (1) ini sebagian besar didasarkan pada apakah kejahatan tersebut memenuhi unsur-unsur pada pasal 27 ayat (1) atau tidak, berdasarkan informasi dari investigasi serta bukti-bukti. Selain itu, juga menunjukkan bahwa tanggung jawab pidana pelaku dapat diberikan kepada pelaku sebagai pribadi ataupun pelaku sebagai korporasi. Dalam aturan UU ITE, terhadap perbuatan yang dilarang diancam dengan sanksi pidana. Adapun jenis-jenis sanksi pidananya yang telah ditentukan adalah sanksi pidana penjara dan sanksi pidana denda. Jenis sanksi ini sudah terdapat dalam ketentuan Pasal 10 KUHP, serta tidak ditentukannya jenis pidana tambahan. Maka dengan demikian tidak ada pengembangan mengenai jenis pidana khusus yang ditujukan bagi pelaku tindak pidana dalam bidang informasi dan transaksi elektronik.

Abstract

Cases of bullying on children are still rampant in Indonesia. Many of these cases occur in the school environment, even with the rapid flow of information, bullying cases also often occur online. This study aims to analyze the legal protection for children provided by the Government through Law Number 35 Year 014 concerning Child Protection in cases of bullying. This study uses a normative juridical approach, where the study covers various related legal regulations. This study found that cases of child abuse in which the perpetrator and victim are children have special mechanisms for handling them. Children as legal subjects have different characteristics through Juvenile Criminal Law and Juvenile Justice. However, a psychological and familial approach is needed in dealing with cases of child bullying.

Abstract

The State of Indonesia has never been separated from existing regulations, given that the State of Indonesia is a rule of law and all actions taken refer to the applicable law. The problem of a law lies in the procedure for the application of the law and the implementation of the law, in legal protection for children in Indonesia, both victims and perpetrators have the right to be protected, for this reason a rule of law has been set against the child’s own misconduct applicable. Problematics of arrest and detention and punishment of crimes committed by children enactment of article 43 of Act No. 3 of 1997 which explains that child detainees are basically still in effect the provisions of the Criminal Procedure Code (KUHAP) are the loss of children's rights and protection against applicable law. The development of the rights of the child is a public concern because at this time child perseverance has spread and the application of the law continues to apply to that the rights of children must also be considered to see that children's rights must also be fought for. Above everything discussed above that neglected the rights of children and their protection was due to the lack of attention from parents and families and a small part of this resulted from an environment that was not good for the character of the child himself. To create high peace and stability then the basis of the change is parents. Improvements made to the guidance of children that are carried out fundamentally with love and love, it does not rule out the possibility of child delinquency or criminal acts that are done less, other things if the child is allowed to grow without attention then does not rule out the greater the crime that will be committed.

Abstract

Indonesia is a country oriented to the democratic system. As stated in the 1945 Constitution Article 1 Paragraph (2) which states "Sovereignty is in the hands of the people and carried out according to the Constitution." 2019 is a political year. Soon the Indonesian people will hold a democratic party for the umpteenth time. The rise of Negative Campaigns and Black Campaigns is unavoidable ahead of general elections in Indonesia. The emergence of a black campaign became a reflection of the dilapidated morale of the Indonesian people today. It cannot be denied that black campaign has a very bad impact on the political education of the Indonesian people. The phenomenon that occurs is SARA participation in politics. Where we know that Indonesia has pluralism, we not only have one religion, culture, and tribe. Religious issues may be familiar to the public ahead of the 2019 presidential election, which raises some perspectives and assumptions that they are a form of religious politicization, embodiment of religious values ​​in politics, and the opinion of the khilafah government system in Indonesia. Differences of opinion must always exist amid a pluralistic society. The differences and diversity that exist in Indonesia can lead to conflict and division if not addressed wisely. Conversely, plurality can be an adhesive in society if it is able to be managed properly without uniformity. Therefore, ahead of the 2019 Presidential Election, the public is expected to be able to filter all the news obtained, whether the campaign used is included in the negative campaign or is it a black campaign? It is hoped that free and fair democratic parties can be realized in the upcoming 2019 Presidential Election, so that it can maintain harmony in the life of the nation and state. The community must be clever in digesting the information that is obtained and it is hoped that it will not be easily provoked for the integrity of the nation.

Abstract

This paper is qualitative research, discusses and examines how government combating radicalism and terrorism in relation with global and international perspective. From these incidents, various investigations have also been carried out by the authorities to arrest every actor in acts of radicalism and terrorism, which resulted in a discovery that there were ; people out there dedicated their lives to being terrorists, recruiting potential terrorists, teaching terrorism, spreading understanding of Islamic religion that deviates, and convincing them to follow the teachings of Islamic religion in the style of terrorism. Radicalism and Terrorism in the global world, including Indonesia, have become one of very serious problems, because this phenomenon not only related to the home security but also global threat. The global waves of terrorism and radicalism have the international characteristic, borderless and transnational activity, even transnational organized crime. Therefore, this paper underlined and emphasized that combating international terrorism and radicalism cannot only be supported by one Country, but also it needed the international cooperation.

Abstract

Abstract: Abuse of power for the sake of business and trade profit has become an increasingly average occurrence in the practice of public procurement in this era of moral disruption. It is commonplace that government officials make an illicit arrangement with companies through bribery scheme to win tenders in the procurement of goods and services. This practice resulted in a shift of ideology and abuse of authority by government officials. This practice is contrary to the professional code of ethics, so it is necessary to settle such cases through juridical channels. The intervention of public officials in determining the award of contracts of government projects to certain parties has resulted in a crisis of public trust in law enforcement in Indonesia. This article reviews the basic principles of the criminal act of corruption and the commitment and integrity of government officials in implementing the professional code of ethics, and upholding honesty in order to achieve equitable law enforcement. This paper proves and confirms that the abuse of power by government officials for the sake of business profit in the public procurement has weakened Indonesia’s investment sector. In many cases, these activities may even lead to unfair competition in the trade and business sectors.Abstrak: Memperdagangkan otoritas guna melancarkan praktik bisnis dan perdagangan merupakan hal yang banyak terjadi di era disrupsi moral ini. Para pejabat pemerintah sering kali bekerja sama dengan para pengusaha dengan cara membantu memberikan stimulus berupa kemenangan tender dalam pengadaan barang dan jasa. Praktik tersebut mengakibatkan terjadinya penyalahgunaan wewenang oleh para pejabat pemerintah. Hal ini bertentangan dengan kode etik profesi, sehingga diperlukan penyelesaian perkara melalui jalur yuridis. Adanya intervensi pejabat publik dalam penetapan pihak yang menangani proyek pemerintah menyebabkan terjadinya krisis kepercayaan publik terhadap penegakan hukum di Indonesia. Artikel ini menelaah ulang dasar pokok aturan-aturan tentang tindak pidana korupsi serta bagaimana komitmen dan integritas para pejabat pemerintah dalam melaksanakan kode etik profesi, menjunjung tinggi kejujuran guna mewujudkan penegakan hukum yang adil. Tulisan ini membuktikan dan menegaskan bahwa perdagangan otoritas dalam praktik bisnis melemahkan sektor investasi Indonesia. Pada banyak kasus, kegiatan ini bahkan cenderung memperkuat kondisi persaingan tidak sehat dalam sektor perdagangan dan bisnis.

Abstract

Reforming the criminal application legislation in the national legal system is critical. This research uses the paradigm of legal constructivism and the type of research used is juridical-sociological. Criminal law enforcement regulations are currently still scattered in various laws and regulations, it is not impossible that they will disrupt the law enforcement system, especially in the implementation of criminal decisions/actions. Character building is an effort to establish a conservation value system to achieve the value of justice, the value of certainty and the value of benefit in law enforcement for the implementation of criminal law. Therefore, efforts are needed to enforce the law on the implementation of criminal law through a juridical-scientific-religious approach that is oriented (guided) on “science” (criminal implementation law) and “God’s guidance”. The juridical-scientific religious approach is realized as a concrete effort to reform the law through reforming the substance and culture of the law. In reforming the legal substance, the religious approach is carried out by making religious teachings a source of motivation, inspiration, and creative evaluation source in building legal people with noble character, so that concrete efforts must be developed in the content of national legal development policies.

Abstract

Most countries in the world choose the form of Federal state or Unity within organizing a government. The selection of this form of state based on political, s­ocial will include the culture and history of a country. Each form of this country has advantages and disadvantages. The Unitary State emphasizes the administration of government in the government centers and regions in the province do not have extensive autonomy in managing their regions. Unlike the Federal State, where the position of the Federal State and the State are equal. The concept of federalism has been applied in many countries. The state is given the widest possible autonomy to take care of their area. Regional autonomy aims to improve community service, develop democratic life, and encourage the community empowerment to foster creativity. Regional autonomy also has a positive impact and a negative impact on the region. This paper intends to analyze the concept of federalism and regional autonomy with practical analysis in Indonesia.

Abstract

The realm of human rights presents a complex interplay between protection, fulfillment, and law enforcement, particularly evident in the case of Indonesia. This abstract delves into the multifaceted landscape of human rights within the Indonesian context. Indonesia's transition to democracy marked a important juncture for human rights. The government ratified numerous international treaties and established a National Human Rights Commission, reflecting its commitment to protection. However, challenges persist as minority rights, notably those of religious and ethnic groups, face intermittent infringement, revealing gaps between rhetoric and reality. Fulfillment of rights poses another intricate facet. Economic and social rights, essential for human dignity, demand equitable distribution of resources.
