Abstract

The Criminal Provisions in Indonesian Immigration Law of 2011 are designed as acts of legislation for preventing transnational organized crimes in Indonesia. This law has existed for more than 10 years and has been no critical evaluation of the immigration criminal provisions. The construction of the criminal system has a non-uniform pattern of penal policy formation. This research employed the doctrinal research method with deductive reasoning that analyzed Articles on immigration criminal provisions from the perspective of Jeremy Bentham’s theory of punishment analyzing the quality of criminal Articles. The results indicate that there are reactive and not pre-empting immigration criminal provisions, poor criminal provisions during immigration examinations, disparities in Judge’s decisions at courts, varied patterns of punishment and sanctions, and inconsistency of criminal liability arrangements against corporations. Reconstruction of immigration criminal Articles is urged to achieve Bentham’s principles and objectives of the law in sentencing. Criminal Articles should be dominated to prevent cross-border crimes during immigration clearance.

Abstract

The tragic and heart-wrenching case of a five-year-old toddler becoming a victim of murder raises numerous questions about the circumstances leading to such a heinous act. This study provides an overview of the factors that might have contributed to this deeply distressing incident. It explores potential reasons, such as family dynamics, societal pressures, mental health issues, and the legal framework surrounding child protection. Understanding the complex interplay of these factors is essential for both preventing similar tragedies in the future and offering appropriate support to affected families. While the global COVID-19 pandemic is gradually receding, reflecting on the past two years reveals a relentless surge in cases that seemed to halt the world momentarily. Amidst the widespread reports of COVID-19 infiltrating Indonesia, the shocking occurrence of a fifteen-year-old taking the life of a five-year-old toddler in Sawah Besar Jakarta in March 2020 deeply unsettled the Indonesian populace. This incident prompts the question: what circumstances led to such a tragic event? What were the motivations driving the perpetrators’ actions? Why did a defenseless five-year-old child fall victim to murder? This study emphasizes the urgency of addressing the root causes of such acts of violence against children, shedding light on the need for comprehensive measures to protect the most vulnerable members of our society.

Abstract

Money laundering is an act attempts to conceal or disguise the origin of money/funds or wealth proceeds of crime through a variety of financial transactions in order to money or possessions that looked as if it came from a legitimate activity or legal. The term money laundering has been known since 1930 in the United States when the mafia buys a legitimate company and officially as one of its strategies. These illicit funds not only could damage the market, but also detriment the market, and always do not contribute towards the long-term economic development and stability of the markets where the fund is hidden. Problems of money laundering in English known as money laundering. Money laundering in Indonesia today has developed so alarmingly and requires serious treatment by law enforcement officials at both the police and the institutions established by the Anti Money Laundering Act, namely Transaction Reports and Analysis Center (INTRAC). This paper is intended to analyze the discourse of procedural criminal law on the following the money concept in the money laundering tracking process. This paper confirmed that some different interpretation and limitation has become one of the problems on money laundering tracking process. Especially on follow the money scheme in procedural criminal law. Moreover, it is also emphasized that some judgments have not enough power because of unclear determination in counting the amount of money laundering and counting the losses.

Abstract

Cybercrime is a new type of crime arising from globalization in this world. This crime is more dangerous than other crimes because the impact can cause world war. It is undeniable that this crime in the present has grown as time goes by until now, there are many cases of this crime. All countries compete to advance their technology for positive things, but many people abuse it for negative actions. We must be vigilant if we want to use technology because there are many bad people out there, if we are negligent then we can be affected by those bad people. Then the lack of public attention now that there is a new type of crime that is more dangerous than other crimes. We must protect each other so that we are not affected by cybercrime. This crime does not only have one sector but can be in all sectors, because this crime can be said to be an extraordinary crime.

Abstract

Criminal Law has the characteristics of a double-edged sword, because on one side it protects the victim but on the other side deprives the rights of the perpetrators. Therefore, the settlement of cases through criminal lines becomes ultimum remidium because Criminal Law is used as a last resort in solving criminal cases. One form that emerges today is the Penal Mediation effort which is used as a form of settlement of criminal cases, especially for insignificant crimes. The paper analyzes and looks deeper into the implementation of penal mediation at the Police level, in the Semarang City Police Department. The research uses an empirical juridical method with a research location in the city of Semarang. The research underlines that in the implementation of media penalties at the police level is carried out through a Progressive Law framework. In its implementation, the police must base on the principle of conflict resolution, process-oriented, and the process is informal. One of the penal mediation forms implemented and applied by Semarang City Police Department is on domestic violence cases, where the principle that is put forward is Victim Offender Mediation. This study concludes that the implementation of media penal is one form of restorative justice in Indonesia.

Abstract

Keberhasilan dalam pengembalian aset hasil tindak pidana korupsi menjadi salah satu indikator keberhasilan dalam upaya pemberantasan korupsi di Indonesia. Tren korupsi yang lintas negara dan melibatkan banyak aktor, menyebabkan upaya pengembalian aset (asset recovery) menjadi tidak mudah. Paper ini bertujuan untuk mengkaji tiga hal penting, yakni: (1) upaya pengembalian aset hasil korupsi yang berada di luar negeri, (2) peran lembaga negara dan aparat penegak hukum, dan (3) faktor hambatannya. Penelitian paper ini menggunakan pendekatan yuridis sosiologis, penelitian kualitatif dengan spesifikasi penelitiannya deskriptif analitis, teknik pengumpulan data dengan cara wawancara dan dokumentasi. Paper ini menggarisbawahi bahwa p pengembalian aset dapat dilakukan melalui jalur formal dengan MLA dan informal melalui hubungan diplomatik. Tahap pengembalian aset terdiri atas: (1) identifikasi dan penelusuran, (2) proses hukum, dan (3) perampasan aset. Hambatan dalam pengembalian aset meliputi sistem hukum yang berbeda, lemahnya putusan hakim, kemauan politik pemerintah, dan berlakunya asas kerahasiaan bank di beberapa negara. Permasalahan yang muncul dalam pengembalian aset bisa diatasi dengan perjanjian bilateral, meningkatkan kompetensi aparat penegak hukum, dan memantapkan aturan dan sarana prasarana pendukung. Peran pemerintah baik Kejaksaan Agung, NCB Interpol Indonesia, KPK, Kemenkumham, dan Kemenlu, semuanya saling mendukung satu sama lain dalam upaya pengembalian aset sesuai dengan aturan hukum yang berlaku. Paper ini menyimpulkan bahwa dalam pengembalian aset membutuhkan kerjasama antar lembaga dan aparat penegak hukum baik yang berada di dalam maupun di luar negeri.One of aimed indicators on corruption eradication in Indonesia is the successful of assets recovery. Trend of corruption that cross border nations and involved many actors caused the assets recovery process was not easy to be done. This paper would examine three main points: (1) the effort of corrupted asset which save abroad; (2) roles of state institutions and law enforcement officers on assets recovery; and (3) the obstacles on assets recovery. The paper used a socio-legal approach, qualitative research with descriptive analytical research specifications, and techniques of data collection through interviews and documentation methods. This paper was underlined that assets recovery can be optimized by two ways, one of formal track through MLA and other is informal track with diplomatic relations. The process of assets recovery started from (1) identify and trace, (2) legal proceedings, and until (3) repatriate. The obstacles on asset recovery was concerning to a different legal system, a weakness of judicial verdict, good and political will of government, and the implementation of bank secrecy principle in some countries. Some problems faced in assets recovery process resolved by conducting bilateral agreements, improving the competence of law enforcement officers, and establishing the rules and supporting infrastructure. The roles of government, whether it’s Attorney General, National Central Bureau Interpol Indonesia, KPK, Kemenkumham, or Kemenlu, all of which mutually support one another in an effort to return the assets in accordance with the rules of the applicable law. This paper concluded that the asset recovery requires cooperation between institutions and law enforcement agencies both within and outside the country.

Abstract

Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE) was originally born as a legal product in response to the advancement of information and communication technology developments in the world which have significantly changed the pattern of people's lives in multi-sectors of human life. The purpose of the establishment of the ITE Law is to guarantee the rights of the community and maintain the stability of the internet flow from things that can damage it. However, in fact there are still many defects contained in the content of the a quo Law which is multi-interpretable and can be misused by certain parties. Baiq Nuril is an honorary teacher who was sexually harassed by his superiors, but was found guilty by the Supreme Court and charged with Article 27 paragraph (1) in conjunction with Article 45 paragraph (1) of the ITE Law. From the point of view of victim protection, victim protection also contributes to the realm of criminal law, especially regarding criminal matters and punishment for the creation of a law. Victimology is an applied science that makes criminal and criminal charges against perpetrators more equal and accountable. With the clarity of the position and role of the victim in the occurrence of a crime, it can be used as one of the considerations for judges as decision makers to decide the type and amount of criminal punishment that will be assigned to the perpetrator as victim protection. Through this simple article, the author will provide an explanation and understanding of the case experienced by Baiq Nuril in Indonesian criminal law in terms of victimology perspective through normative juridical research methods of library law research, as well as data collection through library research methods.

Abstract

Abstract. International human rights declarations urge the development of feminism in the world. Feminism whose essence is fighting for women's rights has so far been neglected by the community, so that a new spirit is sought so that women can again feel. This study aims to review unfairness actions that have been scattered in society between men and women. Justice is expressed in daily life in order to eradicate acts of gender discrimination. Indonesia as a legal state that always obeys the law and upholds the principles of justice and certainty is a reflection of an existing feminist movement. The role of women must be considered important by the progress of a nation, however in Indonesia there are still many issues of gender equality that occur, such as the absence of women's own beliefs in matters of occupying good power. The problem of sexual crimes that have been wiping out in all public relations has led to increasingly ineffective emancipation of women in Indonesia. This emancipation is a form or manifestation of the feminist movement that can benefit both men and women. The feminism movement can encourage relations in a harmonious society to maintain a stable condition. Feminisme yang hakikatnya memperjuangkan hak-hak perempuan sejauh ini telah diabaikan oleh masyarakat, sehingga semangat baru dicari sehingga perempuan dapat kembali merasakan. Penelitian ini bertujuan untuk mengkaji tindakan tidak adil yang telah tersebar di masyarakat antara pria dan wanita. Keadilan diekspresikan dalam kehidupan sehari-hari untuk menghapus tindakan diskriminasi gender. Indonesia sebagai negara hukum yang selalu mematuhi hukum dan menjunjung tinggi prinsip keadilan dan kepastian adalah cerminan dari gerakan feminis yang ada. Peran perempuan harus dianggap penting oleh kemajuan suatu bangsa, namun di Indonesia masih banyak masalah kesetaraan gender yang terjadi, seperti tidak adanya keyakinan perempuan sendiri dalam hal menduduki kekuasaan yang baik. Masalah kejahatan seksual yang telah memusnahkan di semua hubungan masyarakat telah menyebabkan emansipasi perempuan yang semakin tidak efektif di Indonesia. Emansipasi ini adalah bentuk atau manifestasi dari gerakan feminis yang dapat bermanfaat baik bagi pria maupun wanita. Gerakan feminisme dapat mendorong hubungan dalam masyarakat yang harmonis untuk mempertahankan kondisi yang stabil.Kata Kunci: Emansipasi, Kepercayaan, Keadilan, Perempuan, Kejahatan Аннотация.Международные декларации прав человека призывают к развитию феминизма в мире. Феминизм, суть которого заключается в борьбе за права женщин, до сих пор игнорировался сообществом, так что ищется новый дух, чтобы женщины снова могли чувствовать. Это исследование направлено на рассмотрение действий несправедливости, которые были разбросаны в обществе между мужчинами и женщинами. Справедливость выражается в повседневной жизни с целью искоренения актов гендерной дискриминации. Индонезия как правовое государство, которое всегда подчиняется закону и придерживается принципов справедливости и определенности, является отражением существующего феминистского движения. Роль женщин должна рассматриваться как важная для прогресса нации, однако в Индонезии по-прежнему существует много проблем гендерного равенства, таких как отсутствие собственных убеждений женщин в вопросах занятия хорошей властью. Проблема сексуальных преступлений, которая исчезла во всех общественных отношениях, привела к все более неэффективной эмансипации женщин в Индонезии. Эта эмансипация является формой или проявлением феминистского движения, которое может принести пользу как мужчинам, так и женщинам. Abstract

This study is a modest but objective comparative evaluation of internal security threats facing two sub-regional large countries of Africa and South Asia-Nigeria and Pakistan. Considering the fact that ethnicity, sectarianism and economic instability are fundamental variables of internal security threats in both countries, the study argued that religious extremism has created an unenviable image of both nations in the eyes of the rest of the world, undoubtedly, this has affected both nations adversely. The study also identified inter-regional grievances as potential causes of damages to both federations. Also identified is ethno-sectarian problem as a major security threat to both nations. This in the opinion of the authors will remain a huge impediment to the goals of economic prosperity to both nations. Consequently, the focus of this study is to examine interdependence of these multifaceted challenges and their overall impact on internal security in both countries. To achieve this, the study employed qualitative research method in which analytical approach was used to examine the similarities in the security challenges in Nigeria and Pakistan. Structural questionnaire was used as the instrument for data collection.  The employment of thematic analytic approach was adopted to analyse data collected for the study. The study concludes among others, the need for both countries to individually address these national security threats and find viable solutions to the problems of socio-economic and political reforms and unemployment within a reasonable timeframe to mitigate future threats.Keywords: Internal Security; Ethnicity; Sectarianism; Challenges Dua Bangsa Satu Tantangan: Analisis Politik dan Hukum pada Ancaman Keamanan dalam Negeri (Internal Security) di Nigeria dan PakistanAbstrak Penelitian ini merupakan evaluasi komparatif sederhana namun objektif terhadap ancaman keamanan internal yang dihadapi dua negara besar sub-regional Afrika dan Asia Selatan-Nigeria dan Pakistan. Mempertimbangkan fakta bahwa etnisitas, sektarianisme, dan ketidakstabilan ekonomi adalah variabel fundamental dari ancaman keamanan internal di kedua negara. Penelitian ini berpendapat bahwa ekstremisme agama telah menciptakan citra yang tidak baik dari kedua negara di mata dunia. Tidak diragukan lagi, ini telah mempengaruhi kedua negara secara merugikan. Penelitian ini juga mengidentifikasi kasus-kasus antar-regional sebagai penyebab potensial kerusakan pada kedua federasi. Juga diidentifikasi masalah etno-sektarian sebagai ancaman keamanan utama bagi kedua negara, dimana akan tetap menjadi hambatan besar bagi tujuan kemakmuran ekonomi kedua negara. Fokus penelitian ini adalah untuk menguji saling ketergantungan dari tantangan beragam ini dan dampaknya secara keseluruhan terhadap keamanan internal di kedua negara. Untuk mendapatkan data tersebut, penelitian ini menggunakan metode penelitian kualitatif dimana pendekatan analitik digunakan untuk menguji kesamaan dalam tantangan keamanan di Nigeria dan Pakistan. Kuesioner struktural digunakan sebagai instrumen pengumpulan data. Penggunaan pendekatan analitik tematik diadopsi untuk menganalisis data yang dikumpulkan untuk penelitian ini. Studi ini menyimpulkan antara lain, perlunya kedua negara untuk secara individual mengatasi ancaman keamanan nasional ini dan menemukan solusi yang layak untuk masalah reformasi sosial-ekonomi dan politik dan pengangguran dalam jangka waktu yang wajar untuk mengurangi ancaman di masa depan.Kata Kunci: Keamanan dalam Negeri; Etnisitas; Sektarianisme; Tantangan Две нации, разные регионы, одинаковые вызовы: правовой и политический анализ угроз внутренней безопасности в Нигерии и Пакистане АбстрактныйЭто исследование представляет собой скромную, но объективную сравнительную оценку угроз внутренней безопасности, с которыми сталкиваются две субрегиональные крупные страны Африки и Южной Азии - Нигерия и Пакистан. Учитывая тот факт, что этническая принадлежность, сектантство и экономическая нестабильность являются фундаментальными переменными угроз внутренней безопасности в обеих странах, в исследовании утверждается, что религиозный экстремизм создал незавидный имидж обеих стран в глазах остального мира, несомненно, это повлияло на обе нации неблагоприятно. Исследование также определило межрегиональные жалобы как потенциальные причины ущерба для обеих федераций. Также определена этно-сектантская проблема как серьезная угроза безопасности для обеих стран. Это, по мнению авторов, останется огромным препятствием на пути достижения целей экономического процветания обеих стран. Следовательно, целью данного исследования является изучение взаимозависимости этих многогранных вызовов и их общего воздействия на внутреннюю безопасность в обеих странах. Для достижения этой цели в исследовании использовался качественный метод исследования, в котором использовался аналитический подход для изучения сходства проблем безопасности в Нигерии и Пакистане. Структурная анкета использовалась в качестве инструмента для сбора данных. Для анализа данных, собранных для исследования, был использован тематический аналитический подход. В исследовании, среди прочего, делается вывод о необходимости для обеих стран индивидуально противодействовать этим угрозам национальной безопасности и находить жизнеспособные решения проблем социально-экономических и политических реформ и безработицы в разумные сроки для смягчения будущих угроз.Ключевые слова: внутренняя безопасность; Этническая принадлежность; Сектантство; Вызовы

Abstract

The International Red Cross has different characteristics so that in its development, this organization is accepted as one of the subjects of international law. However, the International Red Cross has limitations in the subject of law. International treaties such as the 1949 Red Cross Conventions provide certain rights and obligations. The rights and obligations are given by the convention indirectly to individuals through the country that is a participant in the convention. Through such construction, many individual circumstances or events that are subject to international law based on a convention can be returned to the countries that are participants in such a convention, namely the Convention on the Settlement of Investment Disputes between States and Nationals of Other States and The European Convention on Human Rights. This study analyzes recent developments regarding the International Red Cross as a subject of international law. This study also analyzes the position of the International Red Crescent as one of the subjects of international law in practice.
