Abstract

This study aims to analyze the influence of intrinsic motivation and organizational culture on employee performance mediated by employee engagement. The object of this research is the employees of PT XYZ. A total of 100 respondents filled out a questionnaire, the sample was taken using a saturated sample of 100 employees. This research was conducted from October 2019 to April 2020 at the PT XYZ office. The sampling technique used was saturated sampling. Data were analyzed using the Smart PLS (Partial Least Square) path analysis application. The results of this study indicate that Intrinsic Motivation and Organizational Culture have a positive and significant effect on performance. Meanwhile Employee Engagement becomes a mediation between Intrinsic Motivation and Organizational Culture on Performance. Employee Engagement perfectly mediates Intrinsic Motivation. And Employee Engagement partially mediates Organizational Culture.

Abstract

This study critically examines Indonesia's new penal code through the lens of international legal norms, exploring whether it genuinely embodies the principles of global justice. Despite the code's ambitious reforms aimed at modernizing Indonesia's legal framework, our analysis reveals significant gaps between its provisions and internationally accepted standards, particularly in areas such as human rights, due process, and equality before the law. The urgency of this research lies in Indonesia's important role in Southeast Asia, where legal frameworks can influence regional governance and human rights practices. Novelty arises from our comparative approach, juxtaposing Indonesia’s penal code against a backdrop of global legal norms while considering local cultural and societal contexts. This study uncovers how the interplay between domestic priorities and international expectations can lead to compromises that undermine the integrity of justice. Our findings contribute to the ongoing discourse on legal reform in emerging democracies, highlighting the challenges of aligning national legislation with international standards. By providing concrete recommendations for policy makers, legal practitioners, and civil society, this research emphasizes the need for a holistic approach to legal reform that respects both local values and global commitments. Ultimately, we argue that Indonesia's new penal code is not just a legal document but a reflection of its aspirations for justice, demanding scrutiny and ongoing dialogue to ensure it meets the standards of global justice in practice.

Abstract

Intellectual property rights by nature provide economic benefits to the creator or holder of copyright and also to the state. Among the European countries that are members of the Euroean Union (EU) and in America, this awareness of economic benefits has been firmly planted. In these developed countries, several economic studies have been conducted which have proven the rapid growth of copyright contribution to the national income of the country. The need to recognize, protect and reward individuals or companies for their inventions and access to their work for the benefit of humans is beginning to be felt in Indonesia. In the context of copyright ownership over anything related to intellectual property rights, the law acts and guarantees the creator to control and enjoy exclusively the results of his work and if necessary with the assistance of the state for law enforcement. The results showed that legal protection can be carried out with supervision by the government and involves legal entities that already have the authority, socializing both the creators of a work or the copyright holder of a related rights product on the importance of registering or recording the work and the copyright holder submits lawsuit to the Commercial Court.Keywords:Legal Protection, Intellectual Property Rights, Copyright, Legal Entity

Abstract

The legal clinic, a pivotal component of law school programs, offers law students valuable practical experience while providing pro bono legal services to diverse clients. In the context of the ASEAN Economic Community (AEC) Era, the challenges posed to regional communities, especially Indonesia, in navigating a free trade area underscore the importance of legal education in employment law. Given the heightened trade activities, a profound understanding of employment law becomes essential not only for practitioners but also for students and law school graduates. In response to the changing landscape, an employment law clinic emerges as a crucial resource, offering free legal advice on various employment matters to address the escalating drop in claims due to the introduction of employment fees. This service becomes indispensable in mitigating non-litigated violations of employment law resulting from financial barriers. This paper explores three key aspects: first, the role of an employment law clinic in law school legal education as a foundational preparation for the AEC era; second, its utilization by students to enhance their capacity in employment matters; and third, its provision of legal services in the international trade law context, particularly focusing on labor and employment law issues. Emphasizing employment law issues such as illegal pay deductions, employment discrimination, unfair dismissal, zero-hour contracts, and trade union freedom in Southeast Asia, the paper advocates for collaboration between the clinic, companies, governments, practitioners, and lawyers to ensure its effectiveness and relevance.

Abstract

Human rights was recognized as a fundamental issue both international community and regional community like ASEAN. The student capability to transfer their knowledge concerning to the human rights was become very important thing for legal development as well as law enforcement. Through clinical legal education, students were be prepared to be available bring a justice in their real lives. Clinical legal education which specifically for human rights issues prepares student for lifelong careers in social justice advocacy around the globe. Through the Clinic, students join a community advocates working to promote human rights and recalibrate the global power imbalances that drive economic and political inequity, exploitation, threats to physical security, poverty, and environmental injustice. Through fact-finding, reporting, litigation, media engagement, advocacy, training, and innovative method, the Clinic seeks to prevent abuse, advance respect for human rights, and promote accountability for violations. The paper divided into three main folds, first, how was the human rights issues on clinical legal education in some practices, second, how was the student encourage the basic knowledge of human rights through clinical legal education, and three, how was the student use their knowledge in their reality lives. The paper emphasized that, at the intersection of theory and practice, the Clinic can be used as a laboratory for testing and modeling new and innovative modes of human rights work, and seeks to be a model of rigorous and critical human rights advocacy. This includes a focus on enhancing human rights methods through interdisciplinary partnerships, critical reflection on human rights practice, and sustainable advocacy through attention to vicarious trauma and resilience.

Abstract

This paper analyzes the fulfillment of rights for workers in the case in Tangerang (fulfillment of a decent salary). Whereas, one form of the implementation of the mandate of the 1945 Constitution in realizing decent livelihoods, especially for workers, is the minimum wage policy based on Law No. 13 of 2003 concerning Manpower which aims to provide protection for workers and their families, this is stated by clear in consideration of letter (d) of Law Number 13 of 2003 concerning Manpower, namely that the protection of labor is intended to guarantee the basic rights of workers and guarantee equal opportunity and treatment without discrimination on any basis to realize the welfare of workers and their families with still pay attention to the development progress of the business world. The disharmony in employment relations or labor turmoil is mostly caused by wage problems that are felt to be still very low. The low level of wages in Indonesia is caused by the abundant supply of labor, the level of labor skills is very low, and the government has an interest and seeks to create and expand employment opportunities.

Abstract

Kaidah dasar yang melandasi pembangunan dan perlindungan lingkungan hidup Indonesia terdapat dalam pembukaan Undang-Undang Dasar 1945 pada alinea ke-4 yang pada pokoknya mewajibkan pemerintah untuk mendayagunakan sumber daya alam yang ada untuk sebanyak-banyak kesejahteraan rakyat. Pemikiran tentang kewajiban negara ini secara konstitusional tersebut lebih dijabarkan lagi dalam Pasal 33 Undang-Undang Dasar 1945, yaitu prinsip negara, bumi dan segala kekayaan yang terkandung di dalamnya serta menjadi hajat hidup orang banyak dikuasai oleh negara untuk digunakan untuk kehidupan orang banyak atau dengan kata lain negara bertindak sebagai penyelenggara kepentingan umum. Lingkungan hidup yang baik dan sehat meruoakan hak asasi setiap warga negara Indonesia sebagaimana diamantkan dalam Pasal 28H UUD RI 1945.

Abstract

Corruption is one of Indonesia’s biggest problems. Various efforts have been made not only in enforcement of corruption cases, but also in various preventive efforts. Kebumen Regency is one of the poorest districts in Central Java with a high rate of corruption among other city districts in Central Java. Several large-scale corruption cases also involved the Kebumen district government. Various attempts have been made, but anti-corruption attitudes must be encouraged. One of them is through various educational networks. The anti-corruption character strengthening program for students is the basic provision for the nation's next generation to not only eradicate corruption collectively but also have high integrity. This program is carried out at SDN Tlogodepok, Kebumen Regency where through this program an anti-corruption character will be formed for students as an anti-corruption fortress from an early age. This program will be implemented in several methods: (1) lectures and outreach, (2) anti-corruption games, (3) anti-corruption learning assistance, (4) initiation of honesty stalls, (5) formation of anti-corruption student cadres, and (6) establishment of an integrity zone at SDN Tlogodepok

Abstract

The number of domestic violence from year to year continues to increase. Many studies show that the increasing trend is motivated by many factors, one of which is the economy. This study aims to analyze the provision of legal aid for victims of domestic violence. This research is one of the community services programs in collaboration with the Center for Legal Aid, Faculty of Law, Universitas Negeri Semarang. This study shows that access to legal aid for victims of domestic violence has not been evenly distributed. This is due to several factors, ranging from not being exposed to cases of domestic violence, to the lack of information on legal aid for victims.

Abstract

Character becomes the identity of a nation, establishing Pancasila as an ideological foundation. Implicitly states that Indonesia is a nation that places customary values, cultural values, and religious values at the top of the legal hierarchy. Strengthening Character Education is the government's effort to pay attention that character education is important to highlight. Using a literature review research method and comparing it with people's behavior in welcoming the times. As well as focusing on implementing the practice of Pancasila using examples of problems from each subject. The influence of foreign cultures makes moral degradation and it seems that Indonesia has lost its identity. So the formation of national character through practice and implementation taught in elementary schools is the best solution in strengthening the foundation, using the educational concept of Thomas Lickona ideas can be a consideration for the government that the contribution of Pancasila education through a personal approach and involving parents in shaping the character of their children. It is hoped that the correlation between knowledge and technology combined with etchial human beings will be able to make Indonesia a developed nation, and have ethical human resources.
