Abstract

The rapid development of Artificial Intelligence (AI) technology particularly in the forms of deepfakes and voice cloning has significantly impacted the lives of Indonesians. While AI offers various conveniences and innovations, it also poses serious threats, especially the misuse of digital identities for commercial purposes. This study aims to analyze the adequacy and effectiveness of Indonesia's criminal law, particularly the Indonesian Criminal Code and Law No. 11 of 2008 on Electronic Information and Transactions (ITE Law), in addressing AI-based digital identity crimes. Using a normative juridical approach, this research finds that current legal frameworks do not specifically regulate AI-related offenses. As a result, perpetrators often exploit legal and technological loopholes to avoid prosecution. The consequences of these crimes are far-reaching, including financial losses, reputational damage, and psychological trauma for victims. The study recommends revising the ITE Law, strengthening personal data protection, forming an AI-based digital forensics task force, and fostering cross-sectoral collaboration to combat digital identity crimes without stifling technological innovation.

Abstract

This paper delves into the proactive measures adopted by Interpol to counter the pervasive issue of human trafficking, focusing specifically on the activities of non-procedural migrant worker networks in East Nusa Tenggara. Human trafficking remains a grave violation of human rights globally, with vulnerable migrant workers often falling victim to exploitation and abuse. In regions like East Nusa Tenggara, where such networks operate with relative impunity, concerted efforts are necessary to dismantle their operations and bring perpetrators to justice. Interpol plays a crucial role in this endeavor by leveraging legal assistance treaties to enhance international cooperation in combating transnational crimes, including human trafficking. Through these treaties, Interpol facilitates information exchange, joint investigations, and coordinated law enforcement actions among member countries, thereby strengthening the collective response to this multifaceted challenge. In East Nusa Tenggara, where the complexities of jurisdiction and cross-border activities complicate law enforcement efforts, Interpol's involvement becomes particularly significant. By collaborating with local law enforcement agencies and leveraging its global network of resources, Interpol can identify, disrupt, and dismantle the networks involved in human trafficking. This paper will explore the mechanisms through which Interpol utilizes legal assistance treaties to support investigations, apprehend perpetrators, and rescue victims of human trafficking in East Nusa Tenggara. Additionally, it will assess the effectiveness of these strategies in mitigating the impact of non-procedural migrant worker networks and advancing the overarching goal of eradicating human trafficking. Through a comprehensive analysis of Interpol's efforts in this context, this paper aims to contribute to the discourse on international law enforcement cooperation and the fight against human trafficking.

Abstract

The transformation of international criminal justice principles into Indonesia's national criminal justice system reflects the country's commitment to aligning domestic law with global human rights and accountability standards. Indonesia, as a member of the international community, has progressively incorporated international norms and principles into its legal framework, particularly in response to the rise of international crimes such as genocide, war crimes, and crimes against humanity. The adoption of these global values in domestic law requires a nuanced approach, as Indonesia navigates its national sovereignty, cultural context, and legal traditions while integrating the broader principles of international justice. The study examines the mechanisms through which Indonesia has absorbed international criminal justice norms, focusing on key developments such as the ratification of the Rome Statute of the International Criminal Court (ICC) and the establishment of domestic legal provisions for addressing crimes under international law. It also evaluates the challenges Indonesia faces in harmonizing its criminal justice system with international standards, such as issues related to jurisdiction, the independence of the judiciary, and the political will to prosecute international crimes effectively. This paper analyzes the legal reforms in Indonesia’s national criminal justice system, exploring both the successes and limitations of these efforts. It highlights the role of international treaties, national legislation, and judicial practice in shaping a more comprehensive and fair criminal justice system. Moreover, the research emphasizes the importance of fostering international cooperation and strengthening domestic institutions to ensure the effective implementation of global principles. Ultimately, this study underscores the dynamic interaction between domestic law and international criminal justice, emphasizing the need for continuous adaptation to uphold global human rights values in a national context.

Abstract

The principle of public information openness is a cornerstone of democratic governance, yet its implementation within Indonesia’s State Administrative Court remains underexplored. This research addresses the urgent need to assess how transparency and public access to information can enhance justice in administrative litigation. In a time when citizen trust in the legal system is fragile, and the accessibility of court decisions is increasingly crucial, the study explores whether the openness of public information can serve as a catalyst for greater accountability and fairness in the administrative justice system. The novelty of this research lies in its critical examination of the relationship between information transparency and judicial effectiveness in the context of administrative courts. By analyzing existing practices and identifying gaps in public access to court processes, the study presents an innovative approach to improving the delivery of justice. Through qualitative case studies and a comparative analysis of international practices, the research proposes actionable recommendations for reform. This study contributes to ongoing discussions on judicial transparency and its impact on public perception, aiming to create a more open, inclusive, and accountable State Administrative Court. The findings suggest that public information openness is not merely a procedural formality, but a fundamental aspect of building trust in the judiciary and empowering citizens in their pursuit of justice.

Abstract

Sexual violence against children is a crime that needs serious attention. In this crime, children as victims often do not get adequate legal protection and fulfill their rights as victims. This study aims to analyze child sexual crimes in the context of victimology and victim protection. This study uses a normative legal study approach by analyzing the applicable laws and regulations as well as literature review related to the protection of children as victims of sexual crimes. This study proves and confirms that the protection of children in cases of sexual crimes has been legally guaranteed through the Law on the Protection of Witnesses and Victims, the Law on Child Protection, and the Law on Human Rights. However, the process of fulfilling the rights of children as victims in these crimes does not yet have adequate aspects of justice for children. The existing criminal law instruments are only oriented towards punishment and deterrence of perpetrators of sexual crimes. Kekerasan seksual terhadap anak menjadi salah satu tindak pidana yang perlu mendapatkan perhatian serius. Pada tindak pidana ini, anak sebagai korban seringkali tidak mendapatkan perlindungan hukum dan pemenuhan hak-haknya sebagai korban secara memadai. Studi ini bertujuan untuk menganalisis kejahatan seksual anak dalam konteks viktimologi dan perlindungan korban. Studi ini menggunakan pendekatan studi hukum normatif dengan menganalisis aturan perundang-undangan yang berlaku serta kajian kepustakaan berkaitan dengan perlindungan anak sebagai korban kejahatan seksual. Studi ini membuktikan dan menegaskan bahwa perlindungan anak dalam kasus kejahatan seksual telah dijamin secara yuridis melalui Undang-Undang Perlindungan Saksi dan Korban, Undang-Undang Perlindungan Anak, dan Undang-Undang Hak Asasi Manusia. Namun demikian proses pemenuhan hak-hak anak sebagai korban dalam tindak pidana tersebut belum memiliki aspek keadilan yang memadai bagi anak. Instrumen hukum pidana yang ada hanya berorientasi terhadap pemidanaan dan penjeraan terhadap pelaku kejahatan seksual.

Abstract

This study to analyze the guarantee of halal products for SMEs development in Indonesia. This normative juridical research uses legislation and conceptual approach. Sources of data are obtained from primary and secondary legal materials. The research results showed halal product guarantee for SMEs is very important because with halal certification, then a product has have gained legality and legal protection. The importance of halal product guarantees for SMEs in Indonesia, i.e.: Indonesian population is dominated by Muslims; the awareness of the Indonesian Muslim in consuming halal products; Indonesia has many SMEs; non-Muslim consumers consider that every halal product is of high quality, safe and hygienic; and the role of religious norms in the implementation of halal product guarantees. Law Number 33 of 2014 concerning Guarantee of Halal Products, requires SMEs to have halal certification so that BPJPH gave the authority to do socialization and assistance of halal certification. However, it’s experiencing problems, i.e.: complicated requirements, limited facilities, the lack of information about the procedures for filing the halal label and high costs for the halal certification process. Therefore, the government must assist and facilitate SMEs to obtain the halal certificate, so there is legal certainty in developing their business.

Abstract

Transfrontier pollution due to forest and land fires in Indonesia not only has a negative impact on domestic areas, but also extends to neighboring countries such as Malaysia and Singapore. Massive deforestation, reaching around 72% of the total original forest area and continuing at a rate of 1.8 million hectares per year, has made Indonesia one of the main contributors to global carbon emissions. The problem of forest fires has become an urgent national issue, demanding serious attention from the government and strong cooperation at the ASEAN regional level. This research analyzes in depth the international legal responsibilities of states, especially Indonesia, in preventing transnational pollution due to forest fires. By using a normative juridical approach and referring to various legal sources, this research aims to examine the extent to which Indonesia has fulfilled its obligations in the context of international law. ASEAN has launched several initiatives to overcome the problem of transnational haze, one of which is the ASEAN Agreement on Transboundary Haze Pollution (AATHP). Through the ratification of this agreement, Indonesia is committed to working with ASEAN member countries in efforts to control forest fires. Even though various mitigation efforts have been carried out, such as aerial bombing and weather modification technology, as well as cross-sector coordination, law enforcement regarding environmental pollution in Indonesia still needs to be improved. Consistent implementation of national legal provisions, such as Law Number 32 of 2009 concerning Environmental Protection and Management, as well as international legal norms is the key to effectively dealing with transnational pollution.

Abstract

This research examines the legal implications of changing the nomenclature from “environmental permits” to “environmental approvals” in Indonesia’s environmental licensing law. Moving beyond a conventional public law focus, it highlights the role of private law instruments in advancing climate change mitigation and adaptation. The core question addressed is whether this terminological shift aligns with the principles of ecological justice and how environmental licensing law should be reconstructed to uphold these values. Using a doctrinal legal research method, the analysis integrates statutory, conceptual, and philosophical perspectives, employing techniques of interpretation and construction. The findings indicate that while certain reforms under the Job Creation Law support ecological justice, others undermine it. The research concludes that the current framework requires comprehensive reconstruction to more effectively embody ecological justice and strengthen climate action.

Abstract

Corruption is a disease outbreak for Indonesia and for the whole world. Corruption is the use of money which is usually carried out by certain parties. Corruption often occurs within the scope of the company as well as within the scope of government, this is because they feel less about what is obtained from their specified salary or income. Corruption is a criminal act or a criminal act, it is recorded in the Law and if there are perpetrators of corruption there will be sanctions equal to what he has done. At this time law enforcers are less assertive in facing serious problems such as corruption cases, they are lacking in handling one of the factors because there are so many corruption and because of the lazy of the enforcers in handling them, they prefer their shortcuts, namely by pura -pura doesn't know what really happened. At this time there are indeed many perpetrators of corruption, especially in the legislature. They should arrange finances to be donated to the community or to those who are more in need but not in practice, they instead tamper with the funds they should channel to the community. Law enforcers are lacking in handling corruption cases, especially in the legislature because they usually feel they are in a higher position and can play with money. It can be said that there is money with freedom. The solution to this is in the community, the community needs to help cases of corruption, especially in the legislature, and full awareness of individuals or law enforcers who are obliged to carry out their duties to eradicate all cases of corruption, especially those in Indonesia. Korupsi merupakah wabah penyakit bagi Indonesia dan bagi seluruh dunia. Korupsi merupakan penylahgunaan uang yang biasah dilakukan oleh pihak-piak tertentu. Korupsi biasah terjadi dalamm ruang lingkup perusahaan maupun dalam ruang lingkup pemerintahan, hal ini dikarenakah mereka merasa kurang dengan apa yang diperoleh dari gaji atau pendapatan mereka yang sudah ditentukan. Korupsi merupakan suatu tindak pidana atau suatu tindakan kriminal, ia tercatat dala Undang-Undang dan apabila ada pelaku korupsi maka akan ada sanksi yang setara dengan apa yang sudah dilakukannya. Pada saat ini para penegak hukum kurang tegas dalam menghadapi masalah serius seperti kasus-kasus korupsi ini, mereka kurang dalam penanganannya salah satu faktornya karena sangat banyaknya para korupsi dan karena malasnya para penegak dalam menanganinya, mereka lebih memilih jalan pintasnya masing-masing yaitu  dengan pura-pura tidak tahu menahu apa yang terjadi sebenarnya. Pada saat ini memang banyak sekali para pelaku korupsi terutama pada kalangan legislatif. Mereka seharusnya mengatur keuangan untuk dapat didanakan kepada para masyarakat atau kepada yang lebih membutuhkan namun tidak seperti itu pada prakteknya, mereka malah mengotak-atik dana yang seharusnya mereka salurkan pada masyarakat. Para penegak hukum pun kurang dalam menangani kasus korupsi terutama pada kalangan legislatif karena biasanya mereka merasa berada di posisi yang lebih atas dan mbisa bermain dengan uang. Bisa dikatakan ada uang ada kebebasan. Solusi untuk hal ini ada di masyarakat, masyarakat perlu dalam membantu kasus-kasus korupsi yang terutama pada badan legislatif, dan kesadaran penuh dari oknum atau para penegk hukum yang sudah sewajibny menjalankan tugasnya untuk memberantas seua kasus-kasus korupsi terutama yang ada di seluruh Indonesia ini.

Abstract

Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE) was originally born as a legal product in response to the advancement of information and communication technology developments in the world which have significantly changed the pattern of people's lives in multi-sectors of human life. The purpose of the establishment of the ITE Law is to guarantee the rights of the community and maintain the stability of the internet flow from things that can damage it. However, in fact there are still many defects contained in the content of the a quo Law which is multi-interpretable and can be misused by certain parties. Baiq Nuril is an honorary teacher who was sexually harassed by his superiors, but was found guilty by the Supreme Court and charged with Article 27 paragraph (1) in conjunction with Article 45 paragraph (1) of the ITE Law. From the point of view of victim protection, victim protection also contributes to the realm of criminal law, especially regarding criminal matters and punishment for the creation of a law. Victimology is an applied science that makes criminal and criminal charges against perpetrators more equal and accountable. With the clarity of the position and role of the victim in the occurrence of a crime, it can be used as one of the considerations for judges as decision makers to decide the type and amount of criminal punishment that will be assigned to the perpetrator as victim protection. Through this simple article, the author will provide an explanation and understanding of the case experienced by Baiq Nuril in Indonesian criminal law in terms of victimology perspective through normative juridical research methods of library law research, as well as data collection through library research methods.
