Abstract

This research was conducted on corporate criminal liability arrangements in Indonesian legislation, with the long-term goal of harmonization of corporate criminal liability arrangements, so as to realize certainty, expediency and legal justice in law enforcement in Indonesia. To support the realization of harmonization in corporate criminal liability arrangements in the legislation, it is necessary to review corporate criminal liability arrangements in other countries, both those with the same legal system as Indonesia and with countries with a common law system, namely Australia. The research method used to achieve the research goals and targets is normative legal research with a statutory, and comparative approach method. The projected results of this study are in the form of real data on the implementation of corporate penal regulations for the National Legal System. The output of this research is in the form of published articles in accredited national journals

Abstract

Juvenile delinquency includes all behaviors that deviate from the norms in society, status violations, and violations of criminal law. Violations of status such as running away from home, skipping school, smoking, drinking, illegal racing, and so on. Violations of this status are usually not recorded in quantity because they are not legal violations. While the so-called deviant behavior against the norm includes premarital sex among teenagers, abortion, and so on. This study aims to analyze the phenomenon of juvenile delinquency from a sociological juridical perspective in the city of Semarang. The method used in this study is a mixed method between empirical and normative studies. This method is used to answer substantially the juvenile delinquency case within the legal framework in the city of Semarang.

Abstract

Disability groups are one of the groups that are vulnerable to various violations of their rights. In fact, the protection of this group has been regulated both nationally and internationally. The International Convention on the Rights of Persons with Disabilities or the United Nations Convention on the Rights of Persons with Disabilities (CRPD) clearly outlines the principles that must be met in providing protection for persons with disabilities, ranging from: (1) respecting the inherent dignity, autonomy the individual including the freedom to make one's own choices, and the freedom of people; (2) non-discrimination, (3) full and effective participation and inclusion in society; (4) respecting the differences and acceptance of people with disabilities as part of human diversity and humanity; (5) equality of opportunity; (6) accessibility; (7) equality between men and women; and (8) respect for the evolving capacities of children with disabilities and respect for the right of children with disabilities to maintain their identity.

Abstract

Law is a tool used to regulate human behavior and living order so that it is in accordance with applicable values ​​and norms, in the law there is a sanction. These sanctions have a strict and real nature so that sanctions cannot be contested by anyone. Someone if you break the law, you will get a sanction. Completion of a law is carried out by law enforcement agencies in Indonesia. In the law there are actions that are used to resolve a case. We often understand these actions as a legal process. The running of a legal process must be in accordance with the applicable provisions, cannot be arbitrary because the legal process is the most important thing in the world of law. The legal process is a reflection of the success or failure of a legal settlement. In a law, it must apply the aspects used to settle the case before the law. These aspects are things that must be applied for the continuity of a judiciary and law in the world and in Indonesia. Namely justice and legal certainty in the continuity of the law. Justice and legal certainty are at the same time the foundation in the law that must be applied and must be reflected in the law. Because without justice and legal certainty a legal process cannot work properly. If justice and legal certainty are not applied in the world of law, then the continuity of a law cannot be fair. As a result of not implementing justice and legal certainty, there arises an imbalance between rights and obligations in the law. The settlement of a matter must be fair between the rights and obligations of one party must be the same between the rights and obligations of the other party. So if you have applied justice in the law, you can achieve legal certainty. Legal certainty must be mutually beneficial for the parties concerned. Legal certainty cannot harm various parties. So that legal certainty must be balanced. So the case can be justified by the law. Hukum merupakan alat yang digunakan untuk mengatur tingkah laku manusia dan tata kehidupan agar sesuai dengan nilai maupun norma yang berlaku, didalam hukum terdapat suatu sanksi. Sanksi tersebut mempunyai sifat tegas dan nyata sehingga sanksi tidak dapat diganggu gugat oleh pihak siapapun. Seseorang jika telah melanggar hukum, maka akan mendapatkan suatu sanksi. Penyelesaian suatu hukum dilakukan oleh aparat-aparat hukum di Indonesia. Didalam hukum terdapat suatu tindakan-tindakan yang digunakan untuk menyelesaikan suatu perkara. Tindakan-tindakan tersebut sering kita pahami adalah suatu proses hukum. Berjalannya suatu proses hukum haruslah sesuai dengan ketentuan yang berlaku, tidak dapat sewenang-wenang karena proses hukum hal yang paling penting dalam dunia hukum. Proses hukum merupakan pencerminan dari berhasil atau tidaknya suatu penyelesaian perkara di dalam hukum. Di dalam suatu hukum harus menerapkan aspek-aspek yang di gunakan untuk penyelesaian perkara di depan hukum. Aspek tersebut merupakan hal yang harus di terapkan untuk kelangsungan suatu peradilan dan hukum di dunia maupun di Indonesia. Yaitu keadilan dan kepastian hukum di dalam kelangsungan hukum. Keadilan dan kepastian hukum merupakan pokok sekaligus landasan dalam hukum yang harus diterapkan dan harus di cerminkan dalam hukum. Karena tanpa keadilan dan kepastian hukum suatu proses hukum tidak dapat berjalan sebagaimana mestinya. Jika keadilan dan kepastian hukum tidak diterapkan dalam dunia hukum, maka kelangsungan suatu hukum tidak dapat berjalan degan adil. Akibat dari tidak diterapkannya keadilan dan kepastian hukum timbul suatu ketidak seimbangan antara hak dan kewajiban di dalam hukum. Penyelesaian suatu perkara harus adil antara hak dan kewajiban satu pihak harus sama antara hak dan kewajiban pihak yang lainnya. Sehingga jika sudah menerapkan keadilan di dalam hukum, maka dapat tercapainya suatu kepastian hukum. Kepastian hukum harus saling menguntungkan bagi pihak-pihak yang terkait. Kepastian hukum tidak dapat merugikan berbagai pihak-pihak. Sehingga kepastian hukum harus seimbang. Sehingga perkara tersebut dapat dipertanggungjawabkan hukumnya

Abstract

Intellectual property rights by nature provide economic benefits to the creator or holder of copyright and also to the state. Among the European countries that are members of the Euroean Union (EU) and in America, this awareness of economic benefits has been firmly planted. In these developed countries, several economic studies have been conducted which have proven the rapid growth of copyright contribution to the national income of the country. The need to recognize, protect and reward individuals or companies for their inventions and access to their work for the benefit of humans is beginning to be felt in Indonesia. In the context of copyright ownership over anything related to intellectual property rights, the law acts and guarantees the creator to control and enjoy exclusively the results of his work and if necessary with the assistance of the state for law enforcement. The results showed that legal protection can be carried out with supervision by the government and involves legal entities that already have the authority, socializing both the creators of a work or the copyright holder of a related rights product on the importance of registering or recording the work and the copyright holder submits lawsuit to the Commercial Court.Keywords:Legal Protection, Intellectual Property Rights, Copyright, Legal Entity

Abstract

This study explores the model of fulfilling refugee rights through community collaboration, with a specific focus on the Cisarua Refugee Learning Centre (CRLC) in Indonesia. Refugees, as one of the most vulnerable groups globally, often face significant challenges in accessing their basic rights, including education, healthcare, and legal protection. The research analyzes how community-based initiatives, especially through the CRLC, contribute to the realization of refugee rights in the context of international law, such as the 1951 Refugee Convention. This study emphasizes the importance of collaboration between refugees, local communities, and international organizations in fostering an inclusive environment for refugees to access essential services. By examining the CRLC's efforts in providing education, skills, and advocacy for refugees, this paper proposes a sustainable model for refugee rights fulfillment that aligns with international legal standards.

Abstract

The growth of Indonesia’s logistics industry has significantly streamlined the distribution of goods, both domestically and internationally. However, alongside these advancements, there is an increasing risk of misuse of logistics services for illegal activities, such as the smuggling of narcotics, unauthorized firearms, and other prohibited items. PT. Shippindo Teknologi Logistik, as one of the logistics service providers operating within Indonesia’s vast and complex geography, faces particular vulnerability to such illicit practices. In this context, logistics companies are expected to implement due diligence in every shipping transaction to prevent involvement in criminal activities. This study aims to analyze the construction of corporate criminal liability under the Indonesian legal system, particularly in relation to the alleged involvement of PT. Shippindo Teknologi Logistik in the shipment of illegal goods. Additionally, the research evaluates the effectiveness of law enforcement in similar cases within the logistics sector. The method employed is normative legal research using a descriptive approach, relying on secondary data such as legal theories, concepts, and relevant legislation. The findings indicate that a corporation can be held criminally liable if it is proven to have committed or allowed a criminal act to occur due to negligence or failure within its management system. In the case of PT. Shippindo Teknologi Logistik, criminal liability may be imposed if systemic negligence or willful disregard for suspicious activities in its operations can be demonstrated. While Indonesia’s legal framework does provide the basis for prosecuting corporate entities, enforcement in practice faces several challenges, particularly in proving fault and ensuring coordination among law enforcement agencies. Therefore, it is essential to strengthen regulations and ensure stricter implementation of compliance and due diligence principles, especially for logistics providers engaged in cross-border trade.

Abstract

This paper examines the application of the doctrine of impossibility of performance in the context of environmental contracts in Indonesia, using the 2010 Merapi volcano eruption as a case study. The eruption, one of the most significant in recent decades, caused widespread destruction to infrastructure, agriculture, and local communities in Central Java. The paper investigates how businesses and government entities, bound by contractual obligations related to the affected regions—particularly in agriculture, tourism, and infrastructure—dealt with their inability to fulfill performance due to the eruption’s catastrophic consequences. Through an analysis of specific contracts and the invocation of force majeure and impossibility of performance clauses, this research seeks to understand how these legal doctrines were applied or misapplied, and whether they provided adequate relief or recourse for affected parties. The paper also explores the balance between contractual freedom and public interest in the face of natural disasters, considering the impact on long-term environmental recovery and business continuity. By analyzing case studies from key industries such as agriculture and tourism, the paper contributes to a deeper understanding of how environmental disasters challenge the enforcement of contractual obligations. It offers recommendations for adapting  Indonesian contract law to better address environmental risks and unforeseen natural events, ensuring more robust protections for businesses and affected communities. This research contributes to the ongoing dialogue on improving the resilience of environmental contracts in the face of unpredictable natural phenomena.

Abstract

This paper delves into the complex interplay between administrative and private law in environmental litigation within Indonesia's legal framework. Indonesia, rich in natural resources, faces pressing environmental challenges due to rapid industrialization and urbanization. Consequently, disputes often arise over environmental conservation, resource extraction, and pollution control, necessitating legal action to uphold environmental integrity. Administrative law governs governmental bodies responsible for environmental regulation, dictating procedures for permits, inspections, and sanctions. Conversely, private law regulates relationships between individuals and entities, encompassing tort liability, contractual obligations, and property rights. In environmental litigation, these legal domains intersect as plaintiffs seek remedies for harm caused by both public and private actors. The paper examines significant cases where administrative law intersects with private law doctrines, analyzing how administrative decisions may lead to civil claims under negligence, nuisance, or strict liability theories. It also explores the role of public interest litigation and citizen enforcement mechanisms in ensuring government accountability for environmental stewardship. Additionally, it evaluates the challenges and opportunities in navigating the convergence of administrative and private law, including issues of standing, jurisdiction, evidence, and remedies. Emphasizing judicial interpretation and legal harmonization, the paper underscores the symbiotic relationship between these legal realms in Indonesia's environmental litigation landscape. By shedding light on this intersection, it contributes to understanding environmental governance and access to justice while offering insights into global environmental law reconciling public and private interests.

Abstract

Climate change presents an unprecedented challenge to the international legal order, raising urgent questions about responsibility, compliance, and enforcement. This article examines whether the International Court of Justice (ICJ) can meaningfully shape global climate action through its legal authority and judicial functions. It analyzes the Court’s potential role in clarifying states’ obligations under international law, particularly in relation to environmental protection, human rights, and the principle of due diligence. By assessing both contentious cases and advisory opinions, the article explores how the ICJ may influence state behavior even in the absence of direct enforcement mechanisms. The study situates the ICJ within the broader framework of international climate governance, including treaties such as the United Nations Framework Convention on Climate Change and the Paris Agreement. It evaluates how the Court’s interpretations of customary international law, state responsibility, and transboundary harm could contribute to greater legal accountability for climate-related conduct. Particular attention is given to the growing momentum behind climate litigation and recent initiatives seeking advisory opinions on states’ climate obligations. While acknowledging institutional limitations—such as jurisdictional constraints, state consent, and political resistance—the article argues that the ICJ possesses significant normative power. Its judgments and opinions can shape legal discourse, influence domestic courts, and strengthen the legitimacy of climate obligations under international law. Ultimately, the article contends that the ICJ can play a transformative, though indirect, role in global climate action by reinforcing legal standards, enhancing accountability, and contributing to the development of a coherent international response to climate change.
