Abstract

This research examines the significance of the Islamic law doctrine's role in the development of policies aiming to prohibit homosexuality as a crime against morality in Indonesia. The study focuses on the foundational contributions and core principles of Islamic law that form the basis for shaping policies concerning the issue of homosexuality. The research methodology involves an in-depth analysis of primary Islamic legal sources and an exploration of Indonesia's positive legal framework that influences the direction of these policies. Furthermore, the research encompasses legal case studies, an exploration of relevant literature, and an Islamic legal perspective regarding the efforts to prohibit homosexuality. Consequently, the research results deepen the understanding of the contributions and relevance of Islamic law in formulating policies that regulate homosexuality as a crime against morality in Indonesia. Moreover, this study aims to identify challenges and opportunities associated with implementing these policies.

Abstract

The international community is currently confronted with a severe humanitarian crisis involving the Uyghur population in Xinjiang, China, marked by pervasive reports of egregious human rights violations, encompassing forced labor, forced assimilation, and mass detention. This study accentuates the imperative for the International Criminal Court (ICC) to assert its jurisdiction and launch an investigation into the alleged crimes against humanity perpetrated against the Uyghur people. The Uyghur case presents a distinctive challenge for the ICC, given the complex political dynamics surrounding China's global influence and its non-membership in the Rome Statute. Nevertheless, this study contends that the ICC's role in addressing such severe human rights violations is now more crucial than ever. It delves into the legal avenues for ICC jurisdiction, exploring potential grounds under the principle of universality and the possibility that some alleged crimes may qualify as war crimes or crimes against humanity. Furthermore, the study delves into the ethical imperative compelling the international community to take decisive action against systemic abuses, asserting that justice and accountability stand as foundational tenets of international law. It also addresses foreseeable obstacles and objections to ICC jurisdiction, including challenges related to state sovereignty, geopolitical considerations, and the practicalities of prosecuting high-ranking officials. In conclusion, this study underscores the urgency of the ICC asserting jurisdiction in the Uyghur case, presenting an opportunity for the international community to showcase its dedication to upholding human rights and justice in the face of severe violations. The ICC's involvement in addressing these atrocities can serve as a beacon of hope for the victims and a deterrent against future perpetrators of similar crimes.

Abstract

Juvenile delinquency comes in many forms-one of which is theft. This delinquency is a social phenomenon with a continuation of criminology. Juvenile crimes are a major concern because children are generation of thenation. Children who commit criminal Acts certainly have both internal and external causes. The treatment of child criminals is part of the policy as a child protection effort as a form of law enforcement. Criminology plays an important role in this case because it is also called criminal sociology because it is the study of humans in its opposition to certain social norms. Criminology examines social symptoms in the field of crime occurring in the community or with the intent that the defendant has committed these crimes.

Abstract

This study critically examines the intricate nexus between law enforcement and political influences in the context of anti-corruption efforts within Indonesia's criminal justice system. The research navigates the multifaceted landscape of how corruption cases are handled, investigated, and prosecuted, aiming to unravel the subtle dynamics that shape outcomes. Beyond a mere exploration of statutory frameworks, the study delves into the complex interplay between legal processes and political considerations, shedding light on the political dimensions embedded in the enforcement of anti-corruption measures. In Indonesia, where corruption has been a persistent societal challenge, understanding the politics of law enforcement is paramount. The analysis encompasses the roles played by diverse actors, including law enforcement agencies, the judiciary, and political entities. The research adopts a multidisciplinary approach, integrating legal analysis and insights from political science to provide a holistic understanding of the complexities involved. Beyond a descriptive account of legal provisions, the study investigates how political considerations may impact the prioritization, investigation, and prosecution of corruption cases. The findings of this research hold significance for policymakers, legal practitioners, and scholars alike, offering insights that may inform potential reforms and strategies to strengthen the nation's resolve in combatting corruption. Abstract

This paper explores the incorporation and alignment of international human rights principles within Indonesia's latest Criminal Code. As nations strive to uphold fundamental rights and liberties, examining the compatibility of domestic legislation with international standards is imperative. This study employs a comprehensive analysis of Indonesia's new Criminal Code, focusing on the identification and assessment of provisions that either conform or diverge from established international human rights norms. By scrutinizing key legal aspects, such as due process, freedom of expression, and protection against discrimination, this paper aims to shed light on the extent to which Indonesia's legal framework reflects its commitment to global human rights standards. The findings contribute valuable insights into the ongoing discourse surrounding the harmonization of domestic laws with international human rights instruments, offering implications for policy development, legal reform, and fostering a culture of respect for human rights in Indonesia.

Abstract

This research critically examines the legal safeguards for children facing economic exploitation in three prominent ASEAN countries: Indonesia, Vietnam, and the Philippines. Despite the presence of protective legislation in these nations, the effective implementation of these laws encounters significant obstacles. In Indonesia, diverse regulations intended to shield children from economic exploitation coexist with the persistent issue of child labor. The continued prevalence of child labor is attributed to inadequate enforcement of labor laws and a general lack of community awareness regarding children's rights. Vietnam, while boasting a relatively comprehensive legal framework against child labor, faces challenges in certain rural areas where instances persist due to entrenched issues like poverty, cultural traditions, and limited access to education. Moreover, in the Philippines, the government has implemented measures such as the Child Labor Law and the Anti-Child Trafficking Act to protect children from economic exploitation. However, the effectiveness of these initiatives is impeded by resource constraints, corruption, and limited community awareness. In conclusion, this study reveals that legal protection for children in Indonesia, Vietnam, and the Philippines is hindered by a range of challenges, including deficient enforcement mechanisms, enduring cultural traditions, widespread poverty, systemic corruption, and limited community awareness. Addressing these complex issues requires collaborative efforts from governments, civil society, and communities to ensure the robust protection of children's rights.

Abstract

This paper delves into the intricate challenge of striking a delicate balance between national security imperatives and the protection of individual liberties in the context of contemporary counterterrorism laws. In the aftermath of global terrorist threats, governments worldwide have enacted a myriad of legislative measures aimed at preventing and combating acts of terrorism. However, the implementation of these measures often raises concerns about potential encroachments on civil liberties, privacy rights, and due process. The study critically examines the evolving landscape of counterterrorism laws, analyzing key legal frameworks and their impact on individual freedoms. It scrutinizes the delicate equilibrium required to effectively address security threats without sacrificing the fundamental rights and values that underpin democratic societies. Drawing on case studies from diverse jurisdictions, the research explores the implications of counterterrorism measures on marginalized communities, surveillance practices, and the rule of law. Furthermore, the paper assesses the effectiveness of oversight mechanisms and judicial review processes in mitigating the risks of abuse and overreach. It considers the role of technology, international cooperation, and intelligence sharing in contemporary counterterrorism efforts and evaluates their potential impact on individual privacy and human rights. In addition, this paper aims to contribute to the ongoing discourse on counterterrorism policy by offering insights into the challenges of balancing security imperatives with the preservation of civil liberties. It advocates for a thoughtful and nuanced approach that fosters security without compromising the core values that define democratic societies.

Abstract

Terrorism is a form of extraordinary crime that is an enemy to mankind. Terrorism throughout history has been a very frightening specter. This is inseparable from the impact it causes, the loss is not only property, life, physical, psychological, but also creates an atmosphere of terror that grips all levels of society. Therefore, victims and witnesses of acts of terrorism must receive protection in view of these various things. As a state of law, Indonesia has established several laws and regulations governing the protection of victims of terrorism, including Law no. 15 of 2003, as amended by Law no. 5 of 2018 concerning Amendments to Law Number 15 of 2003 concerning Stipulation of Government Regulations in Lieu of Law Number 1 of 2002 concerning Eradication of Criminal Acts of Terrorism into Law, Law no. 13 of 2006, as amended by Law no. 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning the Protection of Witnesses and Victims and other regulations. With the existence of a legal footing that regulates, it is hoped that it can provide protection for witnesses and victims of acts of terrorism. In addition, various parties also play a role in the recovery of victims from acts of terrorism, including; police institutions, social services, hospitals, Kesbangpol, PMI, NGOs, LPSK, and so on. However, witnesses and victims of criminal acts of terrorism in obtaining legal protection through the above regulations are not always in line with the existing reality. This is inseparable from the existence of inhibiting factors, both in the aspect of legal substance, legal structure, and legal culture components.

Abstract

The rapid evolution of technology, particularly the ubiquitous presence of the internet, has brought about significant societal changes. While technological advancements have brought numerous benefits, they have also introduced new challenges and risks. Among these challenges is the alarming rise of child grooming, a form of sexual harassment perpetrated against minors, facilitated by the online environment. In Indonesia, the incidence of child grooming is increasingly prevalent, with several reported cases highlighting its emergence as a pressing societal issue. However, the absence of specific legal frameworks addressing this crime has posed significant challenges for law enforcement authorities tasked with its prevention and prosecution. The lack of dedicated legislation targeting child grooming underscores the need for a comprehensive legal response to effectively combat this form of exploitation. Currently, law enforcement officials rely on discretion in the absence of specific legal provisions, resulting in ad-hoc approaches to addressing these cases. This paper employs a normative juridical approach, utilizing The Statute Approach, to examine the legal landscape surrounding child grooming in Indonesia. By synthesizing existing literature and statutory regulations, this study aims to shed light on the legal complexities inherent in combating this emerging crime. In conclusion, while child grooming remains a relatively new phenomenon in Indonesia, its detrimental impact on minors necessitates urgent legislative action. By enacting dedicated laws and policies, the Indonesian government can provide law enforcement agencies with the necessary tools to effectively address and mitigate the prevalence of child grooming, ensuring the protection and well-being of the nation's youth.

Abstract

This paper critically examines stolen assets recovery in Indonesia, employing Gustav Radbruch's legal philosophy, which asserts that justice is the purpose of law and any rule failing to promote justice is invalid, along with Lawrence Friedman’s sociological theory. The aim is to illuminate Indonesia's challenges and opportunities in recovering ill-gotten assets, an issue intertwined with corruption, transnational crime, and international cooperation. Radbruch’s formula serves as the moral and ethical basis for evaluating asset recovery. It prioritizes justice in legal systems, insisting that just laws are the only legitimate ones. This paper applies Radbruch’s formula to assess Indonesia's legal frameworks and processes for asset recovery, emphasizing principles like fairness, equity, and legitimacy within this context. Furthermore, this study incorporates Friedman’s sociological theory, which examines how law evolves in response to social norms and values. It explores how sociocultural factors in Indonesia influence the development of legal mechanisms, public attitudes, and enforcement strategies regarding asset recovery. These perspectives offer valuable insights into Indonesia’s asset recovery challenges. They underscore the need for a holistic approach that integrates ethics, law, and sociology to enhance fairness and effectiveness. International collaboration is also emphasized due to the transnational nature of illicit financial flows. This paper contributes to a nuanced examination of Indonesia’s stolen assets recovery. By bridging legal philosophy and sociological theory, it provides a comprehensive framework for policymakers, legal professionals, and scholars engaged in pursuing justice and asset recovery in Indonesia and beyond.
