Abstract

Pancasila, the philosophical foundation of the Indonesian state, encapsulates the principles of justice, humanity, and social harmony. However, as the world becomes increasingly interconnected, questions arise regarding the relevance and translatability of Pancasila in the global context of justice. This paper explores the significance of translating Pancasila's principles into global justice frameworks, examining its implications and challenges. Drawing on philosophical, legal, and sociopolitical perspectives, this paper argues that while Pancasila offers valuable insights into justice, its translation into global contexts requires careful consideration of cultural, political, and ethical nuances. Through comparative analysis and case studies, this paper investigates the feasibility and desirability of integrating Pancasila into global justice discourses, shedding light on the potential contributions and limitations of cross-cultural ethical frameworks.

Abstract

This research was conducted on corporate criminal liability arrangements in Indonesian legislation, with the long-term goal of harmonization of corporate criminal liability arrangements, so as to realize certainty, expediency and legal justice in law enforcement in Indonesia. To support the realization of harmonization in corporate criminal liability arrangements in the legislation, it is necessary to review corporate criminal liability arrangements in other countries, both those with the same legal system as Indonesia and with countries with a common law system, namely Australia. The research method used to achieve the research goals and targets is normative legal research with a statutory, and comparative approach method. The projected results of this study are in the form of real data on the implementation of corporate penal regulations for the National Legal System. The output of this research is in the form of published articles in accredited national journals

Abstract

This study explores the critical question of whether the environment should be prioritized in situations of uncertainty, encapsulated by the Latin phrase “In Dubio Pro Natura” (In Doubt, For Nature). Focusing on the context of Indonesia, the discourse navigates the complex terrain of environmental justice. The study delves into the multifaceted challenges faced by Indonesia, considering economic development, social equity, and ecological sustainability. By examining cases of environmental degradation, resource exploitation, and their societal implications, the study aims to shed light on the ethical dimensions of decision-making in the face of environmental uncertainties. Drawing on diverse perspectives, including indigenous knowledge and international frameworks, the discourse advocates for a nuanced approach that balances economic growth with environmental stewardship and social justice. Ultimately, this study outlines the necessity of reevaluating priorities, fostering sustainable practices, and ensuring equitable environmental policies for the well-being of present and future generations in Indonesia.

Abstract

This study delves into the mainstreaming of the concept of legal protection for child labor in Indonesia, drawing insights from the International Labour Organization (ILO) Conventions. Child labor remains a global challenge, impacting the physical, psychological, and social development of children who engage in work during their school years. Beyond mere employment for wages, the issue involves elements of exploitation, hazardous working conditions, and restricted access to education. Certain forms of child labor even qualify as the most intolerable, necessitating urgent attention. The primary objective of this research is to analyze, identify, and compare the legal protection mechanisms for child labor in Indonesia based on the ILO Conventions. Employing a normative legal study methodology, the research employs a dual approach, combining comparative law study and statute analysis. By scrutinizing the legal protection practices within the context of Indonesian law and international law, the study aims to shed light on disparities, commonalities, and potential areas for improvement. Conducting an in-depth examination without relying on fieldwork, the study utilizes a literature review and document study, drawing on various sources from both online and printed materials. Through this comprehensive exploration, the research seeks to contribute to a nuanced understanding of the mainstreaming of legal protections for child labor in Indonesia. By highlighting key findings, this study aims to inform policy discussions, foster awareness, and facilitate the development of more effective measures to safeguard the rights and well-being of children involved in labor activities in the Indonesian context.

Abstract

Character becomes the identity of a nation, establishing Pancasila as an ideological foundation. Implicitly states that Indonesia is a nation that places customary values, cultural values, and religious values at the top of the legal hierarchy. Strengthening Character Education is the government's effort to pay attention that character education is important to highlight. Using a literature review research method and comparing it with people's behavior in welcoming the times. As well as focusing on implementing the practice of Pancasila using examples of problems from each subject. The influence of foreign cultures makes moral degradation and it seems that Indonesia has lost its identity. So the formation of national character through practice and implementation taught in elementary schools is the best solution in strengthening the foundation, using the educational concept of Thomas Lickona ideas can be a consideration for the government that the contribution of Pancasila education through a personal approach and involving parents in shaping the character of their children. It is hoped that the correlation between knowledge and technology combined with etchial human beings will be able to make Indonesia a developed nation, and have ethical human resources.

Abstract

Trademarks play a crucial role in protecting the intellectual property rights of businesses and individuals. However, in rural and remote areas, awareness of trademark infringement and the legal mechanisms to prevent it may be limited. This study explores the use of Participatory Rural Appraisal (PRA) as an innovative approach to legal education in preventing trademark infringement, focusing on the case of Bandungan in Central Java, Indonesia. The research utilizes a mixed-methods approach, combining qualitative and quantitative data collection techniques. Through a series of workshops, surveys, and participatory activities, the study engages with the local community in Bandungan to assess their understanding of trademarks, identify potential infringement issues, and deliver legal education on trademark protection. The findings reveal that the PRA approach effectively enhances the community's awareness of trademark rights and the legal remedies available to prevent infringement. Participants actively participate in discussions, share their experiences, and collaboratively generate strategies to protect local businesses' intellectual property. Moreover, the study identifies specific challenges faced by the community in safeguarding trademarks, such as limited access to legal resources and awareness of the legal system. The research contributes to the field of legal education and rural development by highlighting the potential of PRA as a practical and community-driven method for raising awareness about trademark infringement prevention. It underscores the importance of tailoring legal education programs to the specific needs and contexts of rural communities, ultimately empowering them to protect their intellectual property rights and foster economic development.

Abstract

This research aims to analyze the application of the "in dubio pro natura" principle in Indonesia. This principle translates as "in doubt, for nature" and emphasizes the importance of protecting nature and the environment in making legal decisions. This scientific research uses one of the parts of the grand method, namely Library Research which is based on literature or literature. The author uses several references as legal materials to analyze the object of writing. The results show that the application of the principle of "in dubio pro natura" is the foundation of the application of the concept of the precautionary principle that has entered the Indonesian legal order since the enactment of Law Number 32 of 2009, this principle is in line with the principles of environmental equity, bio diversity and polluter pays principle. In addition, this principle in Indonesia still faces challenges in its application. Several factors affecting the application of this principle in Indonesia include inconsistent government policies in environmental protection, lack of public understanding and awareness of the importance of nature conservation, and shortage of human and technical resources in environmental law enforcement.

This paper explores the revolutionary impact of integrating Pancasila-based legal education with the Street Law model on Indonesian society. Pancasila, Indonesia's foundational philosophy, serves as a guiding framework for legal education, while the Street Law model provides a practical, experiential learning approach. Through a meticulous case study focused on Indonesia, the research investigates the nuanced ways in which this innovative educational combination contributes to transformative societal changes. The study analyzes the influence of Pancasila-inspired legal education on shaping societal norms, values, and fostering legal awareness. By delving into specific instances and outcomes within the Indonesian context, the research illuminates how this integrated approach cultivates a deeper understanding of legal principles and ethical considerations among the populace. The findings not only highlight the success of this educational model in enhancing legal knowledge but also underscore its broader impact on social dynamics. This paper contributes valuable insights into the potential of Pancasila-based legal education with the Street Law model to revolutionize traditional legal teaching methods and, in turn, foster positive societal advancements within the unique cultural and legal landscape of Indonesia.

Abstract

Human trafficking grows and develops rapidly, with various motives and types of crimes. Various obstacles are faced in handling human trafficking cases, ranging from inadequate legal instruments to weak law enforcement. This study overviewed the international legal instrument on human trafficking cases, following the identification of the recent forms and issues in enquiring how international legal instruments deal with human trafficking. This study used legal research method by referring to international laws as the source of law in compiling this human trafficking research. This study found that various instruments and international cooperation have dealt with human trafficking cases. However, in various related studies, these different legal instruments did not have a clear and binding force when the issue occurs in the domestic state. In addition, human trafficking in various legal instruments also had many types, and all of them are interrelated. This study highlighted and concluded that in making various international legal instruments effective in this case, more intensive international cooperation was needed, both regionally and globally. Abstract

The emergence of various cases of radicalism in universities is the responsibility of all parties. Various cases that occur in universities show that campuses in Indonesia are very vulnerable to being compiled by radical ideas and terrorism movements, even considered to have no clear curriculum direction in preventing radicalism and terrorism. This study aims to analyze three important things in the issue of radicalism and terrorism in universities, especially at Semarang State University, namely, first how radicalism prevention policies in universities (study at UNNES); second, how to implement policies to prevent radicalism and terrorism at UNNES; and third, how UNNES campus efforts to overcome students or lecturers exposed to radicalism and terrorism. The method used in this study is a mixed method that combines normative juridical research with empirical data in the field. The projected results of this study are in the form of real data regarding the implementation of religious freedom regulations on the UNNES campus. The output of this research is in the form of articles published in accredited national journals.
