Abstract

Article 28 B of the 1945 Constitution of the Republic of Indonesia affirms that children have the right to be protected from discrimination, economic and sexual exploitation, neglect, cruelty, violence, persecution, injustice and other mistreatment. This study aims to 1) Describe child protection policies in the midst of the COVID-19 pandemic, 2) Describe the children's health protection policy during the covid-19 pandemic. This was a normative legal research conducted by examining library materials or secondary data. It used the statutory approach, with a descriptive method. The policy of protecting children in the midst of the Covid-19 pandemic is based on Law Number 35 of 2014 concerning Child Protection which includes not only protection of the child's body and soul, but also spiritually, physically and socially. However, at the level of implementation, the government is more focused on protecting children from Covid-19 cases and has not been optimal in helping children face the burden of mental health during the Covid-19 pandemic. Therefore, the government needs to deal with mental health issues for children and adolescents during the pandemic by making regulations that focus on the direction of each policy towards the realization of a society that cares about mental health.Keywords: policy; child mental health; covid-19

Abstract

The 1945 Constitution of the Republic of Indonesia Article 28 H states that every person has the right to live in physical and mental prosperity, to have a place to live, and to have a good and healthy living environment and the right to obtain health services. This study aims to 1). Describe the policy for handling and overcoming the pandemic - Covid-19; 2). Describe the village government-based policies for handling and overcoming the Covid-19 pandemic. This research was a normative legal research conducted by examining library materials or secondary data. The approach used was a statutory approach and a conceptual approach. The type of study in this research was more descriptive in nature, because it intends to clearly describe various things related to the object under study. The policy for handling and overcoming the Covid-19 pandemic is marked by the formation of a Task Force for the Acceleration of Handling Covid-19 through Presidential Decree Number 7 of 2020. However, until now the number of positive cases of Covid-19 continues to increase to 1,505,800 people positive for Covid-19 cases in Indonesia as of March 30, 2021. In fact, the government has issued a new policy namely the Enforcement of Community Activity Restrictions (PPKM) and intensified the Covid-19 vaccination program. Therefore, the government needs to optimize the village government-based Covid-19 handling policy that better understands the environment by empowering all stakeholders in an effort to reduce the growth rate of Covid-19. Abstract

Objective: This article aims to discuss the enforcement of customary law in North Maluku, the deliberation value in the BMA Sultanate of Ternate, and the implementation of customary criminal sanctions by the Badan Musyawarah Adat.Methodology: The methodology used in this study was legal research conducted in a non-doctrinal qualitative approach. In this study, the law is not only conceptualized as all the principles and rules that regulate human life in society but also includes institutions and processes that actualize the validity of these rules in society.Findings: Law enforcement of fisheries crimes is based on the provisions of Indonesian Law No. 45 of 2009 concerning Fisheries. Criminal provisions are regulated by Articles 84 to 104. One of them is about sinking the ship used to commit fishing crimes. Sanctions given to the fish theft (illegal fishing) perpetrators in territorial waters that have been determined by the local customary head are 1) warning; (2) monetary charges according to the agreement of the local customary community; and (3) boat (pajeko in Ternate) or motorboat seized by the sultanate to be used by the community through profit sharing.Utility: Customary Institute of Ternate Sultanate in 2018 has decided on three cases in the Kao bay area concerning fish catching. Besides the traditional law enforcement that is implemented by the Sultanate, North Maluku recognizes Sasi Customs (Adat Sasi), which is regulation of tradition that limits people for catching fish or taking other sources in a certain type and particular period. Thus, the ecological balance is still maintained.Novelty/Originality: The concept of transcendental law enforcement is substantially in line with the values in the Segulaha tradition that has been applied for a long time in North Maluku. In Segulaha customary law, there is a traditional element in a person who has the same soul with transcendental values by positioning revelation as the source of the law. Keywords: Law Enforcement, Fisheries Crimes, Transcendental Approach

Abstract

Para wali murid atau orang tua yang menyeret guru ke ranah hukum dengan dalih melanggar UU Perlindungan Anak dan beberapa diantaranya malah memenjarakan guru yang akibat tuduhan melakukan kekerasan pada anak. Pihak kepolisian juga menimbulkan polemik dibeberapa daerah dengan langsung menangkap dan menahan guru berdasar laporan sepihak dari orang tua atau wali murid yang tidak terima anaknya dihukum agar anaknya memperbaiki perilaku. Solusi jelas dibutuhkan yaitu aparat harus membedakan manakah tindakan yang bersifat kekerasan dan penganiayaan pada murid atau manakah tindakan yang bersifat membinaKata Kunci: Etik, Guru, Perlindungan, Hukum

Abstract

Today, some Indonesian still adhere to the customs that come from their respective regions. It also includes habits that are carried out repeatedly which becomes a rule or commonly referred to customary law. Based on the philosophical aspect of customary law that lives, grows and develops in the soul of the Indonesian people in accordance with the values of the Pancasila as stated in the opening of the 1945 Constitution, the existence of customary law is very influential on customary crimes that occur in certain regions. Customary violations are still commonly found in the community, especially adultery. The implementation of customary criminal sanctions is felt to provide satisfaction and a sense of justice for some people so that the people’s lifes can be balanced.

Abstract

The thought of law science today is getting stagnant and being doubtful because it tends to be mainstream positivistic. Positivism paradigm is a rigid paradigm, autonomous, and the law becomes merely a law that reduces the law itself to be simple, linear, mechanistic and deterministic then it raises the condition that positive justice is a procedural justice and not an essential justice. The positivist concept produces an incomplete legal study and then it is being dry, stiff and unable to explain the reality. Such of this condition causes an anxiety then the law science requires a shift paradigm so that there is no gap between Das Sein and Das Sollen. Therefore, the holistic paradigm has become the choice for legal science to be genuine science and signifies that the real science of law is not static but dynamic. This paradigm is an effort to formulate the science of law as a unity of science which is full of values and philosophy to reveal truth and justice to the level of meaning.

Abstract

Purpose of the study: The benefits of the internet during a pandemic bring opportunities for cybercrimes, such as online data theft and leakage of consumers’ personal data. For this reason, the objectives of this study are 1) to determine the phenomenon of misuse of consumer’s personal data amidst COVID-after19 in Indonesia and 2) to describe strategies in preparing consumer personal data protection as the key to the success of the new normal in Indonesia. Methodology: This study used non-doctrinal research. To describe the phenomenon of misuse of consumers’ personal data amidst COVID-19 in Indonesia, the data were collected by distributing questionnaires to internet users in Indonesia and applying qualitative methods employing survey data collection techniques with stratified multi-stage random sampling technique. Results: It was found that the consumers’ personal data in Indonesia is still unprotected, so the conception adopted by the European Union and the OECD can be used as a reference for Indonesia in making a Law on Personal Data Protection.Applications of this study: To raise the people's awareness in protecting online personal data and encourage the government to educate society on cyber security through the National Cyber and Crypto Agency Novelty/ Originality of this study: This paper analyzes the protection strategy of e-commerce consumers during the new normal situation in Indonesia. The originality is that it discusses amidst Covid 19 cyber security.

Abstract

Tujuan: Artikel ini bertujuan untuk merumuskan konsep perlindungan hukum lahan pertanian ditinjau dari teori utilitarianismeMetodologi: Penelitian ini merupakan jenis penelitian hukum sosiologic (non-doctrinal) denyang bersifat deskriptif kualitatif. Penelitian ini merupakan penelitian dengan tujuan mendeskripsikan perlindungan hukum bagi lahan pertanian produktif dari alih fungsi. Pendekatan penelitian ialah pendekatan interaksional atau pendekatan mikro dengan analisis kualitatif yang berikutnya dianalisa secara logis dan sistematis dengan menggunakan metode kualitatif.Temuan: Alih fungsi lahan terjadi karena kondisi pertumbuhan kebutuhan lahan untuk pembangunan pemukiman, jalan, maupun kebutuhan lain. Alih fungsi lahan yang sangat cepat dapat membawa bencana tersendiri bagi seluruh warga Indonesia.Kegunaan: Pemerintah melalui instrument hukum yaitu peraturan dengan menindak tegas pelaku alih fungsi lahan serta memberikan insentif yang cukup menguntungkan bagi petani sehingga akan tercipta keseimbangan baru yang lebih layak bagi petani.Kebaruan/Orisinalitas: Peraturan yang jelas dan tegas yang disertai dengan insentif yang cukup dapat mencegah alih fungsi lahan sehingga kemandirian pangan bangsa Indonesia dapat terjaga.

Abstract

Lembaga Keuangan Syariah (LKS) saat ini telah ada dan berkembang dengan cukup pesat. Telah banyak varian dari LKS diseluruh Indonesia dan termasuk pula adalah Bank Syariah. LKS merupakan lembaga keuangan yang beroperasional dan berjalan dengan prinsip syariah Islam. Prinsip syariah Islam ini berbeda dari perbankan atau lembaga keuangan konvensional. LKS sebagai lembaga keuangan dengan prinsip syariah awalnya hadir sebagai pilihan sekaligus solusi untuk muslim yang ingin terhindar dari praktek bank atau lembaga keuangan konvensional yang menggunakan system ribawi namun akhirnya juga dapat menjadi pilihan bagi selain umat muslim. Penyelenggaraan LKS berarti wajib bertanggung jawab secara syariah untuk menjaga tidak hanya agar praktek dalam LKS itu bebas riba saja tapi juga harus bebas dari unsur unsure maysir/ judi dan Ghoror/spekulasi/judi. Islam memerintahkan untuk menjauhi hal hal tersebut karena hal tersebut dianggap sebagai berbuat zhalim atau kerusakan Penyelenggara LKS dituntut memiliki tidak hanya visi bisnis an sich yang bertujuan mengeruk laba yang setinggi tingginya dengan mengesampingkan syariah namun juga harus memiliki visi syariah. Proses agar LKS tentap berada dalam prinsip prinsip syariah ketika beroperasional menjadi tanggung jawab bersama antara lain pengelola LKS dan institusi negara yang ditunjuk untuk melakukan proses dan prosedur agar LKS tetap dalam koridor yang seharusnya dan tidak melakukan hilah/trik hanya sekedar kamuflase berkedok syariah dalam parktek dan operasionalnya.

Abstract

Abstract: This descriptive research was aimed at finding out how the ability of the first year students of SMK Negeri 2 Pekanbaru in comprehending Recount texts. The design of the research was one class for try-out test and one class for real test. The population was the first year students of SMK Negeri 2 Pekanbaruin second semester of academic year 2016/2017. The sample was 27 students of class X.1 which were chosen by using cluster random sampling. The data were collected by giving 5 recount texts in form of multiple choices test. From the five texts, there were 30 items which focus on six components, they are finding main idea, factual information, references, meaning of difficult word, restatement, and social function. The results of the study revealed that the mean score of the students’ ability in comprehending recount texts is 57.51. It means that the ability of the first year students of SMK Negeri 2 Pekanbaru in comprehending recount texts was categorized into average level. The highest score obtained by the students was in comprehending main idea with the mean score of 76.29 which was categorized into good level, and the lowest score that the students got was in comprehending restatement, with the mean score of 40.00 which is categorized into poor level. Based on the result of this research, it is suggested that the students to learn more about comprehending recount text, particularly about comprehending restatement.Keywords: Students’Ability, Reading Comprehension, Recount text.
