Abstract

This study aims to investigate the practice of establishing dowry within the Bugis-Makassar community and to assess its alignment with the tenets of Islamic law and dominant local cultural norms. This study utilizes a qualitative methodology grounded in a normative-sociological framework. Data were gathered by literature review, analysis of Islamic legal sources, and scrutiny of customary behaviors within Bugis-Makassar marital traditions. The results show that setting the dowry is not only seen as a religious duty in the marriage contract, but also as a sign of respect, family honor, and cultural identity. In reality, the amount of dowry is frequently determined by social standing, education, ancestry, and familial consensus. From the standpoint of Islamic law, the establishment of dowry is permitted, provided it does not cause difficulty to the groom, does not include compulsion, and is consistent with the ideal of ease in marriage. Thus, it can be inferred that the practice of dowry determination within the Bugis-Makassar community exemplifies a reconciliation between Islamic legal principles and the maintenance of local cultural values, provided it does not contravene Islamic teachings.

Abstract

The authority of parents in arranging marriages for their children is a significant subject in family law studies, especially from the viewpoint of Islamic law. In Islamic tradition, marriage is regarded as a valid union provided it fulfills specific criteria, including the agreement of the guardian, which in this instance refers to the parents. However, the practice of parents arranging marriages without the child's consent sometimes incites discussions concerning the validity of such unions. This study seeks to examine the authority of parents in arranging marriages for their children in accordance with Islamic law, as well as the legal ramifications of such activities on the legitimacy of the marriage. The research methodology utilized is a normative approach, examining sources of Islamic law including the Qur’an, Hadith, and scholarly opinions to elucidate the essential principles regarding parental power in marriage. This study also looks at how these laws are used in society and how they affect the legitimacy of marriage. The anticipated outcome of this research is an enhanced comprehension of the constraints of parental authority in arranging marriages for their children and its ramifications on the legitimacy of marriage according to Islamic law. This study aims to enhance the evolution of Islamic family law that is equitable and aligned with Sharia principles.

Abstract

This study aims investigate the incorporation of Maqāṣid al-Sharī‘ah into the Islamic law education curriculum to reinforce the basis of justice and the applicability of Islamic law in contemporary society. This study employs a qualitative technique, including literature analysis and interviews with scholars and practitioners of Islamic law. The study's findings suggest that including Maqāṣid al-Sharī‘ah into the Islamic law curriculum may enhance students' comprehension of the overarching aims of Islamic law, namely the safeguarding of religion, life, intellect, lineage, and property. Maqāṣid principles in Islamic law education assist students learn theory and also make them think critically and be flexible when faced with new problems. In conclusion, including Maqāṣid al-Sharī‘ah into the curriculum of Islamic law education is essential for cultivating legal practitioners who comprehend social justice and can apply Islamic law more effectively in contemporary society.

Abstract

This study analyzes the evolution of indigenous knowledge within the context of Islamic da'wah in South Sulawesi, focusing on social and cultural dimensions. This research is predicated on the premise that Islamic da'wah in South Sulawesi evolves within a social framework influenced by persistent local cultural values and traditions. In this context, local wisdom serves as both a cultural identity and a strategic vehicle for disseminating Islamic doctrines. This research seeks to examine the transformation of local wisdom within Islamic da'wah methods and to discern its social and cultural ramifications. The study utilized a qualitative methodology using a descriptive-analytical framework. Data were gathered by library research, observation, and comprehensive interviews with religious leaders, traditional leaders, and community people engaged in culturally oriented da'wah activities. The results indicate that the evolution of local wisdom transpires through the adaptation, accommodation, and reinterpretation of indigenous cultural values within the context of Islamic teachings. This method makes da'wah more acceptable to society, enhances social integration, protects local cultural identity, and encourages a moderate, inclusive, and contextual type of religiosity.

Abstract

This study examines the dialectical relationship between fiqh and Bugis Makassar customary law in the formation of local Islamic norms. The research is grounded in the reality that Islamic normativity in Bugis Makassar society is not shaped solely by formal religious texts, but also by living customary values that continue to guide social life. This interaction reflects a dynamic process in which Islamic teachings and local traditions negotiate, adapt, and reinforce one another in everyday practice. The study aims to analyze the patterns of this dialectic and to explain how both normative systems contribute to the construction of local Islamic norms. This research employs a qualitative approach with a library research design. Data were collected from classical and contemporary fiqh literature, studies on customary law, and scholarly works related to Bugis Makassar culture. The data were analyzed using descriptive analytical techniques through data reduction, thematic classification, and interpretive reading. The findings indicate that fiqh and customary law are not merely oppositional frameworks, but mutually constitutive sources of social legitimacy. Their interaction produces contextual Islamic norms that are religiously authoritative, culturally acceptable, and socially functional, thereby enriching the development of Islamic legal studies in plural societies within contemporary sociolegal discourse today.

Abstract

This study aimed to determine the effectiveness of the caterpillar game in improving forward roll learning outcomes among Grade 3 students at UPT SPF SDI Sambung Jawa 3, Makassar City. This research employed a Classroom Action Research (CAR) design with two cycles using the Kemmis and McTaggart model, consisting of planning, acting, observing, and reflecting stages. The research subjects were 28 Grade 3 students comprising 13 male and 15 female students. Assessment instruments covered three domains: cognitive (30%), affective (20%), and psychomotor (50%), with a minimum learning mastery criterion (KKTP) of 80. Results demonstrated significant improvement from the pre-cycle to Cycle II. In the pre-cycle condition, only 3 students (10.7%) achieved the KKTP; this increased to 15 students (53.6%) in Cycle I; and reached 27 students (96.4%) in Cycle II. The caterpillar game proved effective in improving forward roll learning outcomes as the playful approach successfully reduced fear, increased motivation, and developed the fundamental movement coordination required for the forward roll technique.

Abstract

The paper discusses the perspectives of Islamic jurisprudence on the marriage of pregnant women in terms of their legitimacy in Islamic law. The problem is still relevant, as it continues to generate divergent understandings in society, notably concerning the legality of the marriage contract, the status of marital relations, and legal implications following marriage. This study employs normative method with library research strategy. Data were analysed from primary sources such as the Qur'an, hadith, and opinions of Islamic jurists and secondary sources such as books, journal articles, and pertinent Islamic legal literature. The peculiarity of this study is that it discusses systematically the marriage of pregnant women by combining the validity of contract, the legal legitimacy and family welfare in one analytical frame. The data indicate that there are different opinions in Islamic jurisprudence on this issue. Some scholars allow marriage under specific conditions, others are more restrictive with legal rules. The divergences stem from varying readings of the textual evidence, the status of pregnancy and the purpose of lineage protection. The study indicates that the validity of such marriage should be carefully evaluated in light of the Islamic legal sources, scholarly perspectives, and the notion of public interest.

Abstract

The purpose of this study was to investigate how active learning strategies can enhance student engagement and facilitate the internalization of Islamic values. This study used a qualitative approach, data were collected through semi-structured interviews, classroom observations, and document analysis involving IRE teachers. The study findings revealed that active learning significantly increased student participation and moral reflection, offering a more dynamic and practical approach to character education. Teachers reported that activities such as role-playing, group discussions, and problem-solving not only made religious teachings more relevant but also encouraged students to apply Islamic principles in real-life situations. However, the study also identified challenges, including lack of training and resources, and the need to contextualize active learning within an Islamic framework. This study contributes to the broader discourse on educational strategies that nurture intellectual and moral development, offering insights and recommendations for improving character education in Islamic educational settings. Future research should focus on the long-term impact of these strategies and the development of specific training programs for IRE teachers.

Abstract

Polygamy is one of the concerns of Islamic family law that still stimulates discussion, especially on the notion of women’s protection from the standpoint of the Qur’an. The fundamental problem of this study analyzes how the Qur’an perceives polygamy and the application of the values of justice, respect and protection for women in its regulation. The aim of this study is to investigate the notion of polygamy through a thematic interpretation of the Quranic verses connected to polygamy and women’s rights. This research uses a qualitative library research method. The fundamental sources are the verses of the Qur'an concerning polygamy, including Surah An-Nisa verses 3 and 129. The secondary sources are the classical and modern tafsir volumes, books of Islamic law and relevant academic works. The data analysis was carried out utilizing the tafsir maudhu’i approach (thematic interpretation) to analyze the context, meaning, and purposes of the verses. The results reveal that the Qur’an does not give full approval for polygamy, but gives rigorous constraints based on justice, responsibility and fulfillment of women’s rights. A basic aspect for preventing injustice and prejudice is the notion of protecting women. The study indicates that polygamy, from the perspective of the Qur'an, is a restricted permission that should be performed within the bounds of justice, human dignity and societal good.

Abstract

Marriage in the perspective of Islamic law is based on a strong foundation as a sacred institution, aimed at achieving a harmonious, loving, and compassionate family life. However, with the dynamics of society and changes over time, the challenges in maintaining a lasting and happy marriage have become more complex. This study aims to explore the concept of marriage reconstruction in the perspective of Islamic law, focusing on renewal efforts that can ensure the sustainability and happiness of households. The research method used is a literature review with a qualitative approach, examining classical and contemporary texts on marriage in Islamic law, as well as interviews with religious and community figures. The findings reveal that marriage reconstruction in Islam not only emphasizes the re-understanding of the rights and obligations of spouses but also highlights the importance of spiritual approaches, effective communication, and wise conflict resolution. The conclusion of this study is that renewal in marriage practices is essential to address modern issues faced by couples, such as inequality, role differences, and a lack of understanding about marriage rights. With proper reconstruction, marriage can serve as a stronger foundation for achieving a sustainable and happy family life.
