Abstract

The determination of a marriage guardian is one of the requirements for a valid marriage in Islamic law, especially for women. In the case of children born out of wedlock, problems arise because there is no blood relationship with the biological father, so he cannot be the guardian. This study aims to analyse the urgency of determining the marriage guardian in Islamic marriage law, as well as to examine the appointment of a marriage guardian for children born out of wedlock according to the perspective of Islamic law and Indonesian positive law. The method used is library research, analysing fiqh literature, the Compilation of Islamic Law (KHI), and the Constitutional Court Decision No. 46/PUU-VIII/2010. The results of the study show that the majority of scholars state that the biological father is not valid as a guardian, so the authority of the guardian is transferred to the judicial guardian. In practice, this is accommodated by Indonesian positive law through the authority of the Head of the Religious Affairs Office (KUA). Although legal solutions are available, social challenges such as stigma and discrimination against children born out of wedlock remain obstacles. This research contributes to strengthening the legal basis for the appointment of a judicial guardian and promotes an approach that considers justice, child rights protection, and the principles of maqāṣid al-Syarī‘ah in the reform of Islamic family law.

Abstract

Pendidikan sangatlah penting dalam kehidupan, pendidikan Al Qur’an diajarkan dari usia dini guna untuk memahami Al-Qur’an. Proses pembelajaran Al Qur’an yang dilakukan pada anak usia dini dapat membentuk karakter dan moral yang kuat, serta meningkatkan pengetahuan dan kecintaan terhadap Al Qur’an. Anak usia dini yang dibekali pembelajaran Al Qur’an berharap akan mempunyai karakter yang mulia. Implementasi pembelajaran Metode Qiroati di TPQ Al-Mukhlashin pada anak usia dini dari umur 3 tahun. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian deskriptif-kualitatif dan memakai metode deskriptis. Hasil penelitian menunjukkan bahwa : Pembelajaran metode qiroati pada anak usia dini di TPQ Al-Mukhlashin itu dibagi dua TPQ Pagi dan TPQ Sore. Guna TPQ pagi adalah khusus untuk anak usia dini yang kegiatannya berisi dengan mengaji, menggambar, belajar menulis, belajar membaca, bermain, berkreasi, memasak dan olahraga. Sedangkan TPQ Sore lebih fokus belajar mengaji tapi untuk semua kalangan anak dari usia dini sampai anak SMP dan hal ini untuk kelas sesuai pencapain murid. Yang digunakan metode qiroati adalah metode klasikal dan individual. Sistem evaluasi dalam implementasi Metode Qiro’ati yaitu evaluasi pembelajaran setiap hari dan evaluasi pada kenaikan jilid. Keterkaitan penerapan Metode Qiro’ati dapat meningkatkan kemampuan membaca Al-Qur’an dengan baik, sesuai ilmu tajwid, pembelajaran ghorib yang tidak biasa atau asing, makhorijul khuruf, menghafal surat pendek dan do’a sehari-hari. Salah satu hal yang sering di diskusikan dalam pembelajaran metode qiroati kepada wali santri adalah bentuk kerja sama yaitu support orang tua. Dalam hal ini orang tua adalah support pertama bagi anak-anaknya, upaya orang tua memberikan dukungan emosional, motivasi, dan bimbingan yang dibutuhkan anak untuk berkembang. Jika dalam pendidikan hanya guru saja yang berperan maka kualitas pendidikan seorang anak dapat menurun.

Abstract

This research aims to optimize the role of supervision in the era of technology-based digital learning. The object of this research is Technology-Based Supervision: Optimizing the Role of Supervision in the Digital Learning Era at SMA Darussalam Blokagung Banyuwangi East Java. In this research, the method used is qualitative with a case study approach to examine the effectiveness of technology-based supervision at SMA Darussalam Blokagung, Banyuwangi, East Java. The source of informants in this study consisted of the Quality Control Team (TPM), the principal, and teachers at SMA Darussalam Blokagung Banyuwangi, East Java. Data collection techniques in this study include observation, interviews, and documentation, which aim to gain a comprehensive understanding of the effectiveness of technology-based supervision at SMA Darussalam Blokagung Banyuwangi, East Java. Data analysis in this study used the data analysis model proposed by Miles and Huberman, which consists of three main steps: data reduction, data presentation, and conclusion drawing. The results of this study are the increased effectiveness of supervision through digital tools, the ability of supervisors to monitor the development of learning innovations globally and the improvement of teacher competence in technology through digital supervision.

Abstract

This article examines how minority students form and assert their identities in school's public spaces, particularly in interactions with majority groups. This qualitative research uses interviews and documentation studies, focusing on several minority students in schools in East Java. The research results show that the identity of minority students is formed through religious expressions, which include verbal expressions, attitudes of prayer, and greetings on holidays. These three expressions function as a means for minorities to assert their identity among the majority. This research concludes that identity formation depends on significant religious expressions and small actions carried out repeatedly. Therefore, schools must provide equitable social spaces for minority students, with policies supporting equality and respecting differences in school social life. The research results show that the understanding of inclusive education is still limited to involving children with special needs in regular school learning classes. Significant structural and cultural obstacles exist to its implementation, and inclusive education needs to be redefined to make it more holistic. This research produced recommendations, including improving infrastructure, training teaching staff, and developing policies that support inclusive education. The findings from this research illustrate the importance of a broader understanding of inclusive education and the need for strategic action to ensure equal access to education for all children.

Abstract

This research aims to explain and analyze the factors that influence Repurchase Intention in e-commerce in 5 big cities in Indonesia. This research is also intended to explain the Satisfaction variable that can mediate Utilitarian Shopping Value and Hedonic Shopping Value on repurchase intention. The subjects of this research are Indonesian consumers who shop online for fashion products in 5 cities, which are the cities with main source of ecommerce visitors. In this research, the Likert Scale was used as a research instrument measurement scale to determine the opinions of consumers in 5 city in Indonesia regarding the following three factors: (1) hedonic shopping value is necessary for e commerce in order to encourage users to make a repeat purchase/repurchase intent; (2) Utillitarian shopping value has a positive and significant effect on Repurchase intention; (3) Satisfactory shopping value perceived adventure journey in shopping, for example, to get value added in getting promos or discounts there can lead users to repeat purchases; and (4) Utilian shopping value can increase satisfaction; (5) satisfaction mediates the relationship between the two variables; (6) satisfaction is still able to have a significant influence on the motivation shopping value (Utiliarian and hedonitic) on epurchase intention, even though the nature of the satisfaction variable is partial mediation.

Abstract

This study aims to analyze the role of teacher traits in overcoming obstacles to educational supervision in order to improve the quality of education at SMA Alhikmah Muncar Banyuwangi. Using a qualitative approach with a descriptive type, this study involved in-depth interviews, participatory observation and document analysis as data collection techniques. Informants were purposively selected to gain in-depth insight into the experiences of teachers, supervisors and students. The results show that teacher traits such as openness, empathy, assertiveness and creativity significantly contribute to overcoming supervision obstacles, as well as creating a positive learning environment and supporting improved student learning outcomes. The implication of this study is the importance of developing positive traits in teachers through training and professional development, which can be an effective strategy in improving the quality of education. This study also contributes to the understanding of the dynamics of the relationship between teacher traits and the effectiveness of educational supervision in the context of secondary schools.

Abstract

The study entitled Collaborative Supervision in Islamic Boarding Schools: From Strict Hierarchy to Openness in Educational Communication explores the shift in supervision patterns in the Darul Qur'an Islamic Boarding School, North Kundur, from a fairly strict and closed hierarchical system to a more open collaborative approach in educational communication. The purpose of this study is to identify and analyze collaborative supervision models that can be applied in the Darul Qur'an Islamic Boarding School as an effort to increase the effectiveness of educational communication between the leaders of the Islamic boarding school and teachers/ustadz. This study uses a qualitative method by seeking sources from in-depth interviews and observations at the Darul Qur'an Islamic Boarding School, North Kundur to analyze the impact of collaborative supervision on the effectiveness of learning and relations between leaders and teachers/ustadz. The results of the study indicate that the implementation of collaborative supervision increases active participation and strengthens the relationship between the leaders of the Islamic boarding school and teachers/ustadz, as well as facilitating a more open exchange of ideas or opinions. The conclusion of this study is to emphasize the importance of renewal in the pattern of supervision of Islamic boarding schools with the aim of supporting a more inclusive, adaptive, and responsive learning environment to the needs of contemporary education.

Abstract

Digitalization in student management in madrasah is important for the development of Islamic identity, but it still requires the integration of religious values so as not to lose the spiritual essence of education. The purpose of this research is to mention the Digitalization of Student Management System in Madrasah as Islamic Identity Innovation. The object of research is the digitization of student management systems in madrasah as an innovation in Islamic identity at SMA Darussalam Blokagung. This research design uses qualitative research with a case study approach. Sources of informants in this study include the principal, teachers and students of SMA Darussalam Blokagung. Data collection techniques in this research are observation, interview, document. Data analysis in this study used Spradley's model by using four stages including domain analysis, taxonomy, compenential, and cultural themes. The results of this research Digitalization of Student Management System in Madrasah as an Innovation of Islamic Identity produced findings including the application of “Islamic Social Responsibility (ISR) tracker”, dynamic curriculum based on online platform with moral assessment & Islamic knowledge, and face recognition system with personal Islamic learning recommendations.

Abstract

Supervisi merupakan pelayanan kepada guru yang bertujuan menghasilkan perbaikan instruksional, belajar dan kurikulum, supervisi diartikan sebagai bantuan, pengarahan,bimbingan kepada guru dalam bidang instruksional, belajar dan kurikulum. Rumusan masalah dalam penelitian ini yaitu 1) Bagaimana perencanaan supervisi klinis kepala madrasah dalam meningkatkan kinerja guru di Madrasah Aliyah Nurul Yaqin Besuki Situbondo, 2) Bagaimana pelaksanaan supervisi klinis dalam meningkatkan kinerja di di Madrasah Aliyah Nurul Yaqin Besuki Situbondo, 3) Bagaimana kinerja guru setelah dilaksanaan supervisi klinis di di Madrasah Aliyah Nurul Yaqin Besuki Situbondo. Metode penelitian dalam tesis ini adalah pendekatan kualitatif deskriptif, pengumpulan data dapat menggunakan sumber data primer dan sumber data sekunder, teknik pengumpulan data menggunakan observasi, wawancara, dokumentasi. Hasil penelitian menunjukkan bahwa 1) Perencanaan Program supervisi klinis di Madrasah Aliyah Nurul Yaqin Besuki Situbondo sudah dilaksanakan dengan baik, kepala sekolah membuat rencana, menyusunan program dan menjalankan program supervisi klinis. Program yang direncanakan kepala sekolah dalam melakukan supervisi klinis itu ada perminggu, perbulan dan persemester. Supervisi klinis yang ditelah dilaksanakan oleh kepala sekolah di Madrasah Aliyah Nurul Yaqin Besuki Situbondo sangat memberikan keuntungan kepada guru-guru, sehingga guru mengetahui akan kelemahan dan kekurangannya dalam melaksanakan tugasnya sebagai pendidik. 2) Pelaksanaan supervisi klinis kepala sekolah terhadap kinerja guru di Madrasah Aliyah Nurul Yaqin Besuki Situbondo mencakup keterampilan guru dalam menyusun rencana pembelajaran, mengelola dan melaksanakan pembelajaran serta melakukan evaluasi pembelajaran. Pelaksanaan supervisi klinis sudah berjalan dengan baik dan sesuai dengan prosedur sebagaimana mestinya yaitu melalui persiapan awal, pertemuan awal, proses supervisi dan pertemuan balikan. 3) Kinerja guru setelah dilaksanakan supervisi klinis oleh kepala sekolah mengalami peningkatan yang signifikan dari kriteria kinerja kurang menjadi baik.

Abstract

This study aims to examine and comprehend the implementation of a data-driven approach in educational strategic planning by identifying the challenges encountered and the opportunities that can be leveraged in the digital era. Educational institutions often struggle to maximize the use of data due to infrastructure limitations, low digital literacy, and minimal integration of technology in decision-making processes. This research employs a Research and Development (RD) methodology to design a data-driven implementation model for educational planning. Data collection was conducted through in-depth interviews with various stakeholders, observations of daily data utilization practices, and document analysis of education policies and evaluation reports. The data analysis process utilized triangulation techniques to ensure accuracy and consistency in research findings. The results indicate that a data-driven approach enhances efficiency and precision in educational strategic planning; however, its implementation remains hindered by constraints such as limited human resources, technological infrastructure, and supporting policies. This study recommends capacity building for educators, investment in digital infrastructure, and the development of regulations to safeguard and optimize data utilization. While data-driven approaches hold significant potential to transform educational strategic planning, successful implementation requires comprehensive and well-integrated support.
