Abstract

The low tax ratio and the massive underground economy prompted the Government of Indonesia to implement the Tax Amnesty policy (Law Number 11 of 2016) as a pragmatic solution to accelerate state revenue. However, this study finds that the policy triggers a serious antinomy of norms within the Indonesian legal system. There is a diametrical conflict between the Tax Amnesty Law and the anti-money laundering regime (AML Law) as well as corruption eradication efforts (Anti-Corruption Law). The absolute confidentiality clause in Article 20 of the Tax Amnesty Law potentially hinders the principles of follow the money and asset tracing, thereby creating a risk of legalized money laundering for assets derived from crimes. Philosophically, this policy also violates Distributive Justice (Justitia Distributiva) and the principle of Equality Before the Law, as the state grants privileges in the form of penalty waivers to lawbreakers, while compliant taxpayers continue to bear the normal tax burden without equivalent incentives. This research employs a normative juridical method with statutory and conceptual approaches. The results conclude that although Tax Amnesty succeeded in increasing short-term liquidity, it fundamentally undermines legal certainty and the authority of the criminal justice system. Therefore, a Volume III Tax Amnesty is not recommended as it would exacerbate the erosion of voluntary compliance and validate moral hazard behavior.

Abstract

Matakidi Bath Tourism is a natural tourism destination located in Barangka Village, Barangka District, West Muna Regency, known for its pristine natural beauty. This study uses SWOT analysis to design a development strategy for the area. The research was conducted through observation, interviews, and surveys distributed at the research location. The respondents included management, local residents, and visitors, selected through purposive sampling. The study results indicate that the tourism area has an attraction score of 95 with a total score of 570 out of a maximum of 720 resulting in a feasibility index of 79.16%. Amenities received a score of 90 with a total score of 270 out of 300 giving it a feasibility index of 90%. Accessibility scored 85, with a total score of 255 out of 360, resulting in a feasibility index of 70.83%. The overall feasibility index of the Matakidi Natural Hot Springs Tourism is 79.99%. Based on the analysis of attraction, amenities, and accessibility, all three criteria are deemed feasible for development. The SWOT analysis suggests developing the full potential of Barangka Village and leveraging local government support for successful growth.

Abstract

Abstract: Agroforestry is a strategy in community forest management that plays an important role in land conservation and food provision. The purpose of this study was to determine the characteristics of farmers, the classification of agroforestry systems, the application of agroforestry patterns, and the types of plants that make up the agroforestry land of farmer groups in Andalambe Village, North Tongauna District, Konawe Regency. This study used a descriptive qualitative and quantitative approach, interviews, and field observations. The descriptive method was used to describe the classification of agroforestry system implementation, agroforestry patterns, and types of plants in the study location. The results showed that the agroforestry classification applied by farmers was the agrisilviculture system, with 27% of farmers applying the alternate rows agroforestry pattern and 73% applying the random mixture agroforestry pattern. The types of plants used in agroforestry included forestry plants, plantation plants, and agricultural plants, with a total of fourteen types of plants recorded. The types of plants used were dominated by those for forest and land conservation (23%) and for sustainable local food supply (20%). This study is expected to contribute to the development of a community-based agroforestry forest management model to support forest and land conservation and sustainable food supply.

Abstract

Notaris merupakan pejabat publik yang menjalankan Profesinya berdasarkan Undang-Undang Nomor 02 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris ( selanjutnya disingkat UUJN ) dan diatur juga dalam Kode Etik Notaris. Notaris wajib mematuhi aturan perundang-undangan termasuk larangan rangkap jabatan sebagai Pegawai Negeri Sipil, Advokat, Legal Officer dan lain-lain. Salah satu profesi yang biasanya dirangkap oleh notaris adalah dosen namun pengembanan jabatan rangkap sebagai Notaris dan juga sebagai dosen atau tenaga pengajar tersebut terkadang menimbulkan keraguan mengenai boleh atau tidaknya rangkap jabatan sebagai dosen atau tenaga pengajar tersebut dilakukan. Keraguan ini berpotensi menimbulkan suatu perdebatan yang terkadang berujung pada kondisi ketidak-pastian hukum. Penelitian ini bertujuan untuk mengkaji apakah rangkap jabatan sebagai dosen/tenaga pengajar dapat dikategorikan sebagai Notaris yang telah melakukan pelanggaran terhadap peraturan perundang-undangan tentang Jabatan Notaris dan Kode Etik Ikatan Notaris Indonesia Ikatan Notaris Indonesia.Penelitian ini merupakan penelitian yuridis normatif, menggunakan data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Analisis dilakukan secara kualitatif.Hasil penelitian menunjukan bahwa Pengembanan jabatan rangkap baik sebagai Notaris maupun juga sebagai dosen atau tenaga pengajar di suatu perguruan tinggi atau fakultas hukum atau program pasca sarjana dapat dibenarkan atau tidak melanggar UUJN dan Kode Etik Ikatan Notaris Indonesia sepanjang perguruan tinggi tersebut berbentuk atau didirikan oleh badan hukum Yayasan (bukan didirikan atau berbentuk badan usaha milik negara, badan usaha milik daerah, atau badan usaha swasta) dan/atau Notaris tersebut tidak merangkap jabatan sebagai (dosen yang berstatus) pegawai negeri.

Abstract

Abstrak Pada dasarnya peraturan perundang-undangan di Indonesia bersifat hierarkis, oleh sebab itu ketentuan dalam Peraturan Walikota Bandung No.543 Tahun 2018, khususnya yang mengatur tentang pengesahan Perhimpunan Pemilik dan Penghuni Satuan Rumah Susun (P3SRS) tidak boleh bertentangan dengan peraturan yang ada di atasnya. Penelitian ini bertujuan untuk mengetahui konsistensi antara Peraturan Walikota Bandung No.543 Tahun 2018 dengan peraturan di atasnya dan juga mengetahui bagaimana keberlakuannya bila terjadi inkonsistensi, serta mengetahui tindakan hukum bila terjadi inkonsistensi. Hasil penelitian ini menunjukan bahwa ketentuan mengenai pengesahan P3SRS dalam Peraturan Walikota Bandung No.543 tidak konsisten dengan peraturan perundang-undangan yang ada di atasnya, sehingga ketentuan tersebut tidak dapat diberlakukan berdasarkan asas lex superior derogate legi inferiori, dan oleh karena itu tindakan yang dapat dilakukan sebagai upaya penyelesaiannya guna mencapai kepastian hukum adalah dengan melakukan judicial review atau executive review. Abstract

Introduction: School-age children were children in the age range of 6 to 12 years and in this age range children have risk of contracting various diseases because children spend a lot of time at school. These diseases can be prevented by practicing proper hand washing. One of the predisposing factors of hand washing behavior was gender, but there are no results of research that agree on the relationship between gender and the correct practice of hand washing in school-age children. Objective: This study aims was to determine the relationship between gender and the correct practice of hand washing in school-age children Method: This study used a cross-sectional study design conducted at the Jawa 5 Elementary State School in Martapura. Respondents were elementary school students in grades II, III, IV and V, as many as 393 people were obtained using simple random sampling techniques. Data analysis used Pearson Product Moment test. The instruments of this study used a questionnaire. Result: The results showed that there was a significant relationship between gender and correct hand washing practices (p value <0.05). Conclusion: School-age children with female sex have more handwashing practice scores and there is a relationship between sex with correct hand-washing practices in school-age children

Abstract

The Indonesian government plans to move the capital city from Jakarta to Penajam Paser Utara (PPU) which is the upstream area of Balikpapan Bay, East Kalimantan. There are several activities in the planned new capital city that potentially affect the condition of land and marine ecosystems, including clearing new land for housing and agriculture as well as expanding mining and petroleum areas. Directly or indirectly, these activities could affect the oceanographic conditions of Balikpapan Bay. For this reason, in order to obtain an up-to-date picture of Balikpapan Bay, an oceanographic survey was conducted in early March 2020. In addition, to support the analysis of marine dynamics in these waters and their predictions in the future, numerical simulations of hydrodynamic modeling were also carried out. Oceanographic observations indicate significant water stratification in the area about 20 km from the mouth of the bay. This result is also well illustrated in the hydrodynamic model numerical simulation, where there is a water loop at the confluence between salt and fresh water masses from two rivers 18-20 km from the mouth of Balikpapan Bay. Abstract

This study aims to develop hypotheses regarding the factors influencing sustainable organizations with the mediating role of employee productivity, particularly in the airline sector. The method applied is a literature review with a descriptive qualitative approach. Data were collected through the review of various relevant academic articles and books, sourced from reputable databases such as Thomson Reuters, Springer, Taylor & Francis, Scopus Q2–Q4, Emerald, Elsevier, Sage, Web of Science, Sinta 2–5 Journals, DOAJ, EBSCO, Google Scholar, Copernicus, and other digital references. The analysis technique used is comparative analysis of previous research findings to identify similarities and differences. The findings indicate significant relationships between organizational factors, employee productivity, and sustainability. First, coaching, mentoring, and work engagement positively influence employee productivity. Second, these factors also have a direct impact on the establishment of sustainable organizations. Third, employee productivity serves as a crucial mediating variable linking coaching, mentoring, and work engagement to organizational sustainability. Thus, this study emphasizes that strengthening coaching and mentoring practices, along with enhancing work engagement, not only improves employee productivity but also contributes to long-term organizational sustainability. The implication is that airline companies should prioritize human resource development strategies as a key driver to achieve sustainable goals and maintain competitiveness in a dynamic industry.

Abstract

The technique used in this literature review is Comparative Analysis. The data used in this descriptive qualitative approach comes from previous studies relevant to this study and sourced from academic online media such as Thomson Reuters Journal, Springer, Taylor & Francis, Scopus Q2-Q4 Emerald, Elsevier, Sage, Web of Science, Sinta 2-5 Journal, DOAJ, EBSCO, Google Scholar, Copernicus, and digital reference books. The results of this literature review are: 1) Investment affects the business management of companies in the air transportation sector; 2) Services affect the business management of companies in the air transportation sector; 3) Marketing management affects the business management of companies in the air transportation sector; and 4) Promotion affects the business management of companies in the air transportation sector.

Abstract

This study evaluates the need for validated instruments to measure students' environmental literacy (EL) and creative thinking skills (CTS). It specifically aims to evaluate the content validity and inter-rater reliability of these instruments. Content validity was evaluated using Aiken's V, which quantified the level of agreement among three experts on the relevance and suitability of instrument items. The instrument includes 30 questions for EL, and 16 questions for CTS. Subsequently, inter-rater reliability was analyzed with Cohen's Kappa and Fleiss' Kappa to measure agreement between two or more raters. The findings demonstrate that both the EL and CTS instruments possess excellent content validity, with the majority of items rated as valid by the experts. Furthermore, the analysis indicated moderate to high agreement among the raters, confirming the instruments' reliability for continued research. Future research is encouraged to incorporate a greater number of experts for content validity testing to gain a more diverse perspective, as well as more raters in the reliability analysis to enhance the representation of agreement
