Abstract

Sekitar tiga juta kendaraan di Jawa Barat dinyatakan sebagai Kendaraan Tidak Melakukan Daftar Ulang (KTMDU). Bagaimana Penerapan dan Pelaksanaan Pajak Progresif Terhadap Wajib Pajak Kendaraan Bermotor yang memiliki kendaraan lebih dari 1 (satu) Berdasarkan Peraturan Daerah Jawa Barat Nomor 13 Tahun 2011 Tentang Pajak Daerah, dan kendala-kendala dan faktor serta solusi yang mengakibatkan  pelaksanaan Pajak Progresif tidak dapat memaksimalkan penerimaan dari Wajib Pajak? Pelaksanaan pungutan biaya progresif terhadap kendaraan bermotor roda 4 (empat) maupun roda 2 (dua) berlaku perhitungan yaitu : terhadap kepemilikan Pertama 1,75%, Kedua 2,25%, Ketiga 3,75%, Keempat 3,25%,  Kelima 3,75% Kepemilikan kendaraan bermotor untuk penetapan pajak progresif kendaraan bermotor didasarkan atas nama dan/atau alamat yang sama. Hambatannya, terjadi perlawanan yaitu Perlawanan Pasif dan Perlawanan Aktif, serta sering terjadi wajib pajak pemilik pertama, apabila menjual kendaraan bermotor tidak melapor ke kantor Samsat bahwa kendaraan tersebut telah dijual, dan/atau kendaraan bermotor tersebut segera dilakukan proses balik nama oleh pemilik kedua atau seterusnya.

Abstract

Tanah merupakan sumber daya yang penting bagi masyarakat, baik sebagai media tumbuh tanaman, maupun sebagai ruang atau wadah tempat tinggal dan ruang guna melakukan berbagai kegiatan. Kondisi dan tersedianya tanah yang tidak seimbang terus berlanjut dan akan menimbulkan masalah dalam penggunaan tanah, antara lain: berkurangnya luas tanah pertanian subur menjadi tanah pemukiman, industri dan keperluan non pertanian lainnya. Salah satu cara yang dilakukan dalam melakukan pembatasan terhadap status kepemilikan tanah namun kenyataan masih dijumpai pemilik tanah yang melebihi batas maksimum. Tujuan penelitian adalah untuk mengetahui dan menganalisis kepemilikan hak milik atas tanah non pertanian di wilayah Kantor Pertanahan Kota Bandung dapat melebihi batas kepemilikan dan untuk mengetahui dan menganalisis upaya yang dilakukan oleh Kantor Pertanahan Kota Bandung dalam rangka penertiban terhadap kepemilikan tanah non pertanian yang melebihi batas.

Abstract

In principle, all wages in arrears must be paid after the assets of the bankrupt Debtor are sold and the distribution list has been determined by the Court based on the curator's proposal. Meanwhile, based on the Constitutional Court Decision No. 67/PUU-XI/2013, the Constitutional Court has explicitly provided protection for workers' rights by providing legal certainty to prioritize workers' rights so that they can obtain their own rights in the event the company concerned goes into bankruptcy. The position of other rights of workers or laborers with the Constitutional Court Decision Number 67/PUU-XI/2013 takes precedence over claims for state rights, auction offices, and public bodies established by the Government. But the status of other rights of workers or laborers is still under the bill of wage rights and separatist creditors. So in practice, if a company is declared bankrupt, then the other rights of workers or workers are in third position after the settlement of wage rights and claims of separatist creditors. The Bankruptcy Law is revised or amended again, so that the rights of each creditor that have been regulated in other laws do not overlap, so that its implementation is not too difficult in reality.Pada prinsipnya semua upah buruh yang tertunggak wajib dibayarkan setelah aset Debitur yang pailit dijual dan daftar Pembagian sudah ditetapkan oleh Pengadilan berdasarkan atas usulan kurator. Sedangkan berdasarkan Putusan MK No. 67/PUU-XI/2013, MK telah secara tegas memberikan perlindungan terhadap hak pekerja dengan memberikan kepastian hukum untuk memprioritaskan hak pekerja agar dapat memperoleh haknya sendiri dalam hal perusahaan yang bersangkutan mengalami kepailitan. Kedudukan hak-hak lain pekerja atau buruh dengan adanya Putusan Mahkamah Konstitusi Nomor 67/PUU-XI/2013 didahulukan atas tagihan hak negara, kantor lelang, dan badan umum yang dibentuk Pemerintah. Tetapi kedudukan hak-hak lain pekerja atau buruh masih berada di bawah tagihan hak upah dan kreditur separatis. Sehingga pada praktiknya apabila suatu perusahaan diputuskan pailit, maka hak-hak lain pekerja atau buruh berada di posisi ketiga setelah pelunasan hak upah dan tagihan kreditur separatis. Undang-Undang Kepailitan diperbaiki ataudiubah lagi, agar hak-hak setiap kreditor yang telah diatur dalam perundang-undangan lainnya tidak tumpang tindih, sehingga penerapan dalam kenyataannya tidak terlalu sulit.

Abstract

In today's digital era, cryptocurrency has emerged as a new form of asset that challenges traditional financial and tax law paradigms. This article aims to analyze how various countries around the world apply tax laws to cryptocurrency transactions, focusing on the comparison of regulatory approaches and their economic and social implications. Through a comparative analysis methodology and case studies, this research reveals the diversity in cryptocurrency tax regulations, highlighting significant policy differences between countries. The main findings indicate that despite efforts to harmonize cryptocurrency tax regulations globally, there is still significant non-uniformity, impacting economic policy and social justice. This article also explores the challenges faced by tax authorities in identifying, tracking, and taxing cryptocurrency transactions, and discusses the potential of cryptocurrencies in enhancing the efficiency and transparency of the tax system. The conclusions of this study offer policy recommendations for governments and tax authorities in addressing the unique challenges posed by cryptocurrencies, as well as suggesting directions for future research in this field.

Abstract

This research aims to explore the role of the fiscal tax law perspective in realising justice and efficiency in the tax system by applying critical analysis of applicable tax regulations. The research method involves an in-depth review of applicable tax regulations and data collection through related literature. This research methodology consists of three main approaches: normative juridical, literature studies as a data collection method and case studies on implementing tax regulations. The research results show an imbalance in the implementation of current tax regulations, which can affect the achievement of justice and efficiency goals. This research also identifies several aspects that require deeper attention to improve tax effectiveness and fairness. Reforms in terms of transparency, accuracy of tax rates, and simplification of tax regulations are important steps to achieve these goals through critical analysis of applicable tax regulations.

Abstract

Konseling Dialectical Behavioral (DBC) merupakan pendekatan yang sangat penting bagi guru bimbingan dan konseling, terutama dalam konteks pendidikan di sekolah. Penelitian ini bertujuan untuk mengevaluasi efektivitas pelatihan Konseling Dialectical Behavioral (DBC) dalam meningkatkan keterampilan konseling guru Bimbingan dan Konseling. Metodologi yang digunakan adalah pendekatan kuantitatif dengan desain pra-test dan post-test pada kelompok eksperimen. Partisipan penelitian ini adalah 24 guru-guru Bimbingan dan Konseling di MTs Se-Kota Malang Raya. Hasil penelitian menunjukkan adanya peningkatan yang signifikan dalam keterampilan konseling guru BK setelah mengikuti pelatihan. Selain itu, berdasarkan hasil evaluasi kegiatan terdapat umpan balik positif dari guru-guru bimbingan dan konseling yang mengikuti pelatihan. Para peserta mengungkapkan bahwa mereka merasa lebih memahami tentang konsep DBC dan memiliki ketrampilan baru dalam melaksanakan layanan konseling. Peningkatan ketrampilan konseling guru Bimbingan dan Konseling dapat memberikan alternatif metode dalam menangani permasalahan siswa di sekolah. Sehingga siswa permasalahan-permasalahan siswa di sekolah dapat tertangani dengan baik.

Abstract

Permanent Magnet Synchronous Motor (PMSM) applications include electric vehicles, industrial pumps, wind turbines, aerospace technology, and many others. In this study, cogging torque is the central aspect of the discussion, which is the motor model, the thickness of the permanent magnet rotor, and the air gap in the electric motor influence. The Taguchi method uses parameter levels on the motor, which are divided into 16 types of orthogonal arrays, where the process is carried out twice in iterations. The first stage of simulation testing was to produce the primary model where number 4 (A1B4 series) was obtained as the most optimal motor model with a cogging torque of 1.56 Nm and an air gap flux density of 768 mTesla (mili tesla). Then the second test was to modify several parts of the motor with the following 16 orthogonal array types, which produced number 8 (A2B4 series) with a cogging torque of 1.08 Nm and an air gap flux density of 733 mTesla. One of the parameters apart from the cogging torque must be maintained is the air gap flux density. This variable affects the permeability of the motor so that later it will affect the amount of material used and the production costs of electric motors. The final result is a model that produces the lowest cogging torque while maintaining other parameters on the motor.

Abstract

In the realm of renewable energy, researchers worldwide have been paying close attention to developing the Oscillating Wave Surge Converter (OWSC) device. This device has the potential to harness the power of ocean waves and convert it into a reliable source of clean energy. Hydrodynamic characteristics are essential parameters in developing OWSC devices. Therefore, this research conducted a hydrodynamic study on the OWSC device with variations in ocean wave periods, including T= 1.5, 1.7, 1.9, 2.1, and 2.3. The Boundary Element Method (BEM) describes the interaction between sea waves and floating body structures. This method assumes incompressible, inviscid, and irrotational flow. A numerical approach is used as a calculation method followed by verification and validation to support the level of actualization. The research results showed that the incident wave caused the OWSC device to experience a deviation from its equilibrium position in the form of an oscillating flap inclination angle as a form of hydrodynamic characteristics. The sea wave period correlatedwith the rate of change in flap position over time, including the maximum deviation in the flap angle. As a power plant, the performance of the OWSC device can work at reasonably short-wave period intervals based on the device's ability to produce mechanical power. The highest average mechanical power was achieved in the T= 1.5 period of 34.49 Watts with an efficiency of up to 52.43%. The OWSC device requires a high intensity of wave energy in a short duration to generate optimal mechanical power. It is important to note that optimal mechanical power generation is crucial for the OWSC device to function effectively. Therefore, the device should be placed in a location where the wave energy intensity is consistently high.

Abstract

The phenomenon of flow separation plays a vital role in the industrial world. The backward-facing step (BFS) is a general form representing flow separation. This study investigates the influence of the slope angle of the step on BFS flow characteristics at various low Reynolds numbers. According to the CFD results, the flow separation phenomenon forms a circulation zone for each increase in Reynolds numbers. This phenomenon is a result of the sudden expansion of the channel geometry. The BFS with the slope angle of the step demonstrates that the increase in the recirculation zone can be minimized, thus appropriately delaying flow separation. The recirculation zone causes fluid flow to reverse direction, affecting fluid flow efficiency due to resulting pressure differences. Therefore, a BFS with the slope angle of the step exhibits a more efficient flow phenomenon by minimizing the recirculation zone.
